HomeMy WebLinkAbout1955 12-28 CCM Regular Session r 59 Minutes of the proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota, including all accounts audited by said Council December 28, 1955 The Village Council met in regular session and was called to order by Acting Mayor, Glen Sonnenberg, at 8:15 p.m.' The following members were present: Glen Sonnenberg, Allen Lindman, Wayne Gageby and H. R. Jones. Arthur Paulson came at 10:00 p.m. The minutes of the meeting of December 14th were read and approved. Motion made by Wayne Gageby and seconded by Allen Lindman to uphold the recommendation of the Planning Commission and approve the proposed plat submitted by Dean Maeser and Olaf Hjelvik, with 66 foot width lots and with the stipulation that sanitary sewer be installed, subject to the Platting Ordinance. Motion carried. Motion made by Allen Lindman and seconded by Wayne Gageby to uphold the recommendation of thePlanning Commission and approve special permit to J. I. Larson for a 30 foot setback on Lot 11, Block 4, Twin Lake Woods Ad- dition. Motion carried. Member Wayne Gageby moved the adoption of an ordinance as follows: AN ORDINANCE REZONING CERTAIN PROPERTY TO INDUSTRIAL THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN AS FOLLOWS: 1. The South 50 feet of the North 150 feet of Lots 2, 3 and 4:of Block 4, Brooklyn Manor Addition, are hereby zoned industrial and shall be included in Section 35-221 of the ordinances of the Village. 2. This ordinance shall take effect from and after its publiea- tion. The foregoing motion having been seconded by member H. R. Jones, vote was taken thereon and the following voted'in favor thereof: Allen Lind- man, Arthur Paulson, Wayne Gageby, Glen Sonnenberg and H. R. Jones, and the following voted against the same: None; whereupon said ordinance was de- clared duly passed and adopted. Motion made by Allen Lindman and seconded by Wayne Gageby that Howe, Inc. be granted a special permit to construct on the industrial portion of Lots 2, 3 and 4, Block 4, Brooklyn Manor, a building approximately 60 feet by 165 feet, for warehouse purposes in connection with existing operation, and that suitable fencing be installed on the 100 foot line between the residential and industrial property of said Lots 2, 3 and 4, Block 4, Brook - lyn Manor, said buffer strip fence to be completed within one year. Motion carried. Member Allen Lindman moved the adoption of an ordinance as follows AN ORDINANCE TO REGULATE AND CONTROL ATMOSPHERIC POLLUTION THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDAINS: Section 7 -701. Air Pollution Prohibited. No person shall cause, suffer or allow to be emitted into the open air any foreign materials such as dusts, gases, fumes, mists, vapors, smokes, and odors in quanti- ties which, by reason of their objectionable properties, shall consti- tdo a nuisance because they: a) Injure, or are sufficient to injure, the health or safety of any person or the public; _ 60 b) Create an obnoxious odor in the atmosphere; c) Cause damage to property or incobvenience to the general public; E d) Create a nuisance or hazard by obscuring vision; or e) Have a deleterious effect upon trees, plants, or other farms of vegetation. Section 7 -702. Standards for Industrial Plants. Any industrial or manufacturing plant taus ng ust, vapor, mist, odors or fumes to be emitted so as to cause a concentration thereof in excess of the maximum allowable standards set forth in "Industrial Safety Standard, Laws and codes" adopted by the Industrial Commission of Minnesota, copies of which are on file in the Village Office, shall be required to collect said dust, vapor, mist, odors or fumes in a manner which eliminates the objectional properties in such emission. These standards shall be supplementary to and shall not limit the standards set out in Section 7 -701. Section 7 -703. Enforcement. The Building Inspector and his duly appointed su o inate s ve t primary responsibility for the enforce- ment of this Ordinance and shall investigate all complaints regarding at- mospheric pollution. Upon recommendation of the Building Inspector, the Council shall have the power to engage in Industrial Engineer qualified in the field of atmospheric pollution to assist the Building Inspector in the enforcement of this Ordinance. Section 7 -70 4. Violations and Penalties. Any and all persons who shall violate any of the provisions of t s ordinance or fail to com- ply therewith, or who shall violate or fail to comply with any order or regulation made thereunder, shall severally for each and every such vio- lation and non - compliance respectively be guilty of a misdemeanor, and up- on conviction thereof, be fined not to exceed One Hundred ($100.00) Dollars or imprisoned not to exceed ninety (90) days. The imposition of one pen- alty for any violation of this ordinance shall not excuse the violation, or permit it to continue; and all such persons shall be required to cor- rect or remedy such violations or defects within a reasonable time. Each day during which a violation exists shall be deemed a separate offense. The application of the penalty above shall not be held to prevent the en- forced removal or correction of prohibited conditions. Section 7 -705. Effect This Ordinance shall be effective upon its passage ann p — ub ccation. The foregoing motion having been seconded by member Arthur Paulson, vote was taken thereon and the following voted in favor thereof: Allen Lind- man, Arthur Paulson, Wayne Gageby, Glen Sonnenberg and H. R. Jones, and the following voted against the same: None; whereupon said ordinance was declared duly passed and adopted. Motion made by H. R. Jones and seconded by Wayne Gageby to accept applications for licenses as fo" ows: Ernie & Ray's Direct Service, 6501 L,yndale Ave. N., . Cigarette License; Service Station License McGrath Grocery, 5845 Lyndale Ave. N., Cigarette License and Non - Intoxicating Malt Liquor License Albert Schumacher, Maple Plain, Minn., Garbage License and that said licenses be approved and issued to the above parties. lotion car- ried. Jones introduced the following resolution and moved its adoption: A RESOLUTION ESTABLISHING A PAYROLL ACCOUNT WITH THE CAMDEN NORTHWESTERN STATE BANK AND AUTHORIZING THE USE OF FACSIMM SIGNATURES BE IT RESOLVED By the Village Council of the Village of Brook- lyn Center as follows: 1. RESOLVED, that Camden Northwestern State Bank of Minne- apolis be and it hereby is designated as a depository for the funds of the Village of Brooklyn Center and the officers are hereby authorized to open or cause to be opened an account or accounts with said Bank on such terms, con- ditions and agreements as shall be required by said Bank, to endorse or cause to be endorsed, in the name of this municipal corporation and to cash, to negotiate or to deposit or cause to be deposited in such account or accounts any money, checks, drafts, orders, notes and other instruments for the pay- ment of money and to make any other agreements deemed advisable in regard thereto. 2. RESOLVED FURTHER, that checks, drafts or other withdrawal orders issued against the funds of this municipal corporation on deposit with said Bank shall be : signed by all three of the following: Will N. Super, Mayor H. R. Jones, Clerk Victor A. Ehrenberg, Treasurer and said Bank is hereby fully authorized to pay and charge to the account of this municipal corporation any checks, drafts or other withdrawal orders, so signed, including those payable to the individual order of the person signing the same and including also checks or other withdrawal orders pay - able to the said.Bank or to any other person or corporation, which are ap- plied in payment,of any indebtedness owing to said Bank from the person or persons who signed such checks or other withdrawal orders. 3,. RESOLVED FURTHER, That said Bank be and it is hereby requested, authorized and directed to honor checks, drafts or other orders for the payment of money drawn in the name of the Village of Brooklyn Center, when bearing or purporting to bear the facsimile signatures of any two of said authorized signers, provided that the third signature shall be also affixed and shall not be a facsimile signature, and the Bank shall be en- titled to honor and to charge this corporation for such checks, drafts, or other orders, regardless of by whom or by what means the actual or pur- ported facsimile signature or signatures thereon may have been affixed there- to, if such signature or signatures resemble the facsimile specimens duly certified to or filed with the Camden Northwestern State Bank of Minneapolis by the Clerk of the Village. 4. BE IT FURTHER RESOLVED, That this resolution shall per- tain only to an account known as the "Payroll Account" and the facsimile signatures herein authorized for this account are expressly not authorized for any other account of the Village of Brooklyn Center. The motion for the adoption of the foregoing resolution wes duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: Arthur Paulson, Glen Soxuaenberg, Allen Lindman, Wayne Gageby and H. R. Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted.. Motion made by H. R. Jones and seconded by Wayne Gageby that the initial deposit to the Payroll Account shall be the sum of $5,000.00 from the General Fund. Motion carried. Motion made by Wayne Gageby and seconded by Allen Lindman to cancel the oil assessments on Lots 1, 2 and 3, Block 4, Bobendrier's Addition, as the Village has on deposit a certified check covering the cost thereof. Jones and seconded by Wayne Gageby to accept the Justice reports presented by John Wingard for the months of November and December, 1955, and the Justice report presented by Aldor Johnson for the month of December, 1955• Motion carried. Motion made by Allen Lindman and seconded by W e eby that the final plat of Bergstrom's Delphian Gardens 2nd Addition;`s ec to all the restrictions of the Platting Ordinance, bond in the amount of $1125.00 to be posted, and the Mayor and Clerk authorized to sign said plat. Motion carried. Member Wayne Gageby moved the adoption of an ordinance entitled AN ORDINANCE ADOPTING THE CODIFICATION OF VILLAGE ORDINANCES AND GIVING NOTICE OF THE AVAILABILITY THEREOF The foregoing motion having been seconded by member Allen Lindman, vote was taken thereon and the following voted in favor thereof: Arthur Paulson, Wayne Gageby, Allen Lindman, Glen Sonnenberg and H. R. Jones; and the following voted against the same: None; whereupon said ordinance was declared duly passed and adopted. Motion made by H. R. Jones and seconded by Wayne Gageby that the Village be authorized to distribute the new compilation of the Ordinances for the following charges: $5.00 for a complete copy, or five cents per page. Member Allen Lindman introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON A PROPOSED IMPROVEMENT WHEREAS, a petition of property owners has been filed in the office of the village clerk for the construction of a. proposed improvement consisting of the following: Construction of sanitary sewer lateral on proposed Perry Avenue and Quail Avenue from 69th Avenue North to 1300 feet North of 69th Avenue WHEREAS, the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $23,000.00, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953• r 63 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Wednesday, the 11th day of January, 1956, at 8 :00 o'clock P. M., and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the village. 3. The area proposed to be assessed for said improve- ment is as follows: All lots and parcels of land abutting the proposed streets which are a part of the following described tract: Lots 14, 15 and 17 of Auditor's Subdivision 57 The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: Arthur Paulson, Wayne Gageby, Allen Lindman, Glen Sonnenberg and H. R. Jones; and the following voted against the sate: None; whereupon said resolution was declared duly passed and adopted.
