Minutes of the proceeding of the Village Council
of the Village of Brooklyn Center in the County
of Hennepin and State of Minnesota, including all
accounts audited by said Council
September 28, 1555
The Village Council met in regular session and was called to order
by Arthur Paulson, Mayor, at 8 :00 P.M.
The following members were present Arthur Paulson, Allen Lindman,
Wayne Gageby and H. R. Jones. Glen Sonnenberg came later in the meeting.
The minutes of the regular meeting of September 14 and the special
meeting of September 20 were read and approved.
Motion made by Allen Lindman and seconded by H. R. Jones to accept
petition for Sanitary Sewer in Area 3 E, date of public hearing to be set on
receipt of survey. Motion carried.
Motion made by Wayne Gageby and seconded by H. R. Jones to return
to petitioners for more complete representation of property owners the petition
for grading and oil stabilizing Oliver Avenue North from 69th to 70th. Motion
carried
Motion made by Wayne Gageby and seconded by H. R. Jones to release
bond of Douglas Uzzell for grading, graveling and oil stabilizing of streets in
Twin Lake Woods 2nd Addition, with provision that cost of condemnation of
Drew Avenue be paid before we release the aforementioned bond. Motion carried._
Motion made by Wayne Gageby and seconded by Glen Sonnenberg to
instruct Village Attorney to start condemnation proceedings toacquire the East
ten (10) feet of the West thirty (30) feet of that part of Government Lot 3
corresponding to Lot 7, Mendenhall's Outlots and of the North l 3/4 acres of
that part of said Lot 3 lying West of River Road and South of the South line
of said Lot 7, Section 36, Township 115, Range 21, all expenses involved to
be paid by Henry Shanedling Sons Corporation. This action has no bearing on
rezoning of any abutting property. A letter to the above effect shall be
furnished by Shanedling agreeing to bearing the cost. Motion carried.
Motion made by Wayne Gageby and seconded by -Glen Sonnenberg to table
for further study the recommendation of the Planning ommission that Section
3.41 of the Zoning Ordinance be amended to include thg processing of metal
weather stripping and metal windows from prefabricated materials. Motion
carried.
Motion made by H. R. Jones and seconded by Glen Sonnenberg to release
storm sewer bond on Balfany!s Northport lst Addition upon recommendation of
Minder Engineering Co. Motion carried.
Motion made by H. R. Jones and seconded by Allen Lindman to accept
Justice Report of Aldor Johnson for August, 1555. Motion carried.
Member Wayne Gageby introduced the following resolution and moved
its adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING AND ADVERTISEMENT
FOR BIDS ON A PROPOSED IMPROVEMENT
WHEREAS, a petition of property owners has been filed in the office
of the village clerk for the construction of a proposed improvement
consisting of the following:
Construction of a storm sewer on 56th Avenue North from
Camden Avenue North to the Mississippi River
WHEREAS, the village engineer has made a preliminary report advising
that said proposed improvement is feasible and that it can be
constructed at an estimated cost of $6565.00,

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center, Minnesota, as follows:

1. The council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953•
2. A public hearing on the proposed improvement shall be held at
the Village Hall in the village on Wednesday, the 26th day of October,
1955, at 8 :00 o'clock P.M., and the clerk shall publish notice of the
.time and place of hearing by two weeks publication in the official
newspaper of the village.
3. The area proposed to be assessed for said improvement is as
follows:
That area lying within the following described boundaries:
On the south by 53rd Avenue North;
On the west by Morgan Avenue North and Highway 100;
On the north by 62nd Avenue North;
On the east by the Mississippi River.
4. The Clerk shall advertise for bids for such improvement by
publication at least once in the official newspaper and in the Construction
Bulletin, the date of first publication not less than 10 days prior to the
date for receipt of bids. Said notice shall state that no bids will be
considered unless sealed and filed and accompanied by a cash deposit,
bid bond, cashier's check or certified check payable to the Clerk in the
amount of not less than 5 percent of the bid.
The motion for the adoption of the foregoing resolution was duly seconded by member
H. R. Jones, and upon vote being taken thereon the following voted in favor thereof:'
Arthur Paulson, Allen Lindman, Wayne Gageby, H. R. Jones and Glen Sonnenberg; and
the following voted against the same: None; whereupon said resolution was declared
duly passed and adopted.
Motion made by Glen Sonnenberg and seconded by H. R. Jones to pay
Paul H. Weekly for nine months at $150.00 per month through September 30, 1955•
Motion carried.
Motion made by Allen Lindman to commit the Village of Brooklyn Center
to make the following improvements in accordance with the resolution heretofore
identified as Improvement Commitments for VA Loan Purposes. Said resolution shall
have inserted in it the following:
Property to be improved: Hipp's 4th Addition
Estimated cost: $ 12,600.00
Date of completion: 12 months
Improvements to be made:
Grading, graveling and oil stabilizing of all streets
within the boundaries of this plat; planting of one
boulevard tree per -lot; sodding of boulevards; and
installation of street signs
Builder: Hipp Construction Company
The foregoing motion was duly seconded by H. R. Jones, and all members present
voting in favor thereof, the motion was carried.
Member H. R. Jones introduced the following resolution and moved its
adoption:
RESOLUTION AUTHORIZING EXECUTION OF CONTRACT TO
USE ALLEY FOR SANITARY SEWER #
WHEREAS, the village council has heretofore passed a resolution in
which the village council agrees to indemnify the City of Minneapolis
for any damages which may be caused by the use of that certain alley
traversing the block bounded by 52nd and 53rd Avenues North and Upton
and Vincent Avenues North which is located within the corporate limits
of the City of Minneapolis, and
WHEREAS, the City Council of the City of Minneapolis has proposed a contract
to be signed between the Village of Brooklyn Center and the City of
Minneapolis incorporating the provisions of said resolution, and

WHEREAS, said contract appears to be suitable and proper in form,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center that the Mayor and the Clerk are herewith
authorized and directed to execute said contract on behalf of the
Village of Brooklyn Center and to cause a copy of this resolution
to be certified and attached to said contract.
The motion for the adoption of the foregoing resolution was duly seconded by
member Wayne Gageby, and upon vote being taken thereon, the following voted
in favor thereof: Arthur Paulson, H. R. Jones, Wayne Gageby, Allen Lindman and
Glen Sonnenberg, and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
