HomeMy WebLinkAbout1955 10-12 CCM Regular Session r 25 Minutes of the proceeding of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota, including all accounts audited by said Council October -12, 1955 The Village Council met in regular session and was called to order by Arthur Paulson, Mayor, at 8:15 P.M. The following members were present: Arthur Paulson, Wayne Gageby, Allen Lindman and H. R. Jones. Glen Sonnenberg came at 10: -30. The minutes of the regular meeting of September 28 were read and approved. The Mayor announced that the Council was met to receive, open and consider bids for a snow plow. The Clerk presented an affidavit showing publication of advertisement for bids in the official newspaper, which affidavit was examined and found to be in accordance with law and ordered placed on file. The Clerk then presented the sealed bids which had been received. These were opened and examined and found to be as follows: No. Name of Bidder Type of Plow Amount of Bid I. W m. H. Ziegler Co., Inc. Wausau Model TB35W (Mounted) 736.00 Member Wayne Gageby introduced the follows resolution and moved its adoption: Yn Y P RESOLUTION TABLING FURTHER ACTION ON BIDS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that further action on the bids received for one new one -way tripping snow plow for use on F -800 Ford Truck be tabled for further examination, successful bidder to be notifed by mail. The motion for the adoption of the foregoing resolution Ims duly seconded by member Allen Lindman, and upon vote being taken thereon, the fcpaowing voted in favor thereof: All members present; and the following voted ainst same: None;whereupon said resolution was declared duly passed and adopted. Motion made by H.�R.Jones and seconded by Wayne Gageby to transfer funds from Liquor Fund to General Fund in the amount of the cost of 1955 Chevrolet 2 Ton Pickup Truck. Motion carried. Motion made by H. R. Jones and seconded by Allen Lindman to transfer back to Storm Sewer #1 Fund $,20,000.00 from 1955 -A fund to reimburse Storm Sewer #1 Fund. Motion carried. Motion made by Wayne Gageby and seconded by Allen Lindman to uphold the recommendation of the Planning Commission relative to original motion zoning land on Northwest corner of intersection gf Highways 100 and 169; Lindman, Gageby and Jones voting aye, Paulson nay, Glen onnenberg absent. Our Village Attorney advised we hdd to have a four- fifths vote of the entire Council. Motion Wayne Gageby, seconded H. R. Jones, to reconsider and lay on table. Motion carried. Motion made by Wayne Gageby and seconded by H. R. Jones to uphold the recommendation of the Planning Commission and grant special permit to Howard Bjork to build a 26 foot house on 40 foot lot, viz., Lot 4, Bloak 2, Fairhaven Park, with a seven root side yard on each side. Motion carried. Motion made by Allen Lindman and seconded by Wayne Gageby to give special permit to Ione Slonski to operate a beauty shop in the basement of her home at 1605 - 57th Avenue North, any sign in connection therewith to comply with Section 3.21 of Zoning Ordinance. Motion carried. j 26 Motion made by H. R. Jones and seconded by Allen Lindman to uphold the recommendation of the Planning commission and grant special permit to M. C. Balfany to build a new home with the wall of the attached garage to be within five feet of the West line of Lot 12, Block. 2, Balfany's Northport lst Addition, and that it be established that he is at least five feet from the line. Motion carried. Motion made by Mayne Gageby and seconded by H. R. Jones to uphold the recommendation of the Planning commission and accept the proposed plat submitted by William Bobendrier, subject to the Platting Ordinance. Motion carried. f Motion made by H. R. Jones and seconded by Wayne Gageby to rescind the action of the Council releasing Pearson Brothers' street bond for Pearson's Northport Ist and 2nd Additions. Motion carried. (See Minutes Sept. 14, 1955•) Fraser to contact Pearson Brothers. Motion made by H. R. Jonesand seconded by Allen Landman to take off the table motion relative to Zoning. Motion carried. Motion made by Wayne Gageby and seconded by Allen Lindman to adopt the following ordinance: AN ORDINANCE .AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF BROOKLYN CENTER BY DESIGNATING CERTAIN LAND AS COMMERCIAL THE VILLAGE COUNCL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN AS FOLLOWS, O Brooklyn enter is hereby. I. The Zoning Ordinance of the Village of B o klyn . C y amended by zoning the following described land to commercial aid adding said description to Section 3.40 of said ordinance: All that part of the following described parcel of land located in Section 36, Township 119 North, Range 21 West, as follows: Commencing at a point 905.0 feet north and 112.5 feet hest of the center line intersection of Trunk Highway 100 and Trunk Highway 169; thence Westerly 635.95 feet Parallel with the north line of the NE of the SWu of said Section; thence Southerly at a deflection angle to the left 94 55' a distance of 701.5 feet; thence Northeasterly at a deflection angle to the left 122 48' a distance of 612.65 feet; thence Northeasterly at a deflection angle to the left of 35 8 20" a distance of 307.69 feet; thence northerly to the point of beginning except the northerly 229.15 feet of the said described parcel of land. 2. This ordinance shalltake effect from and after its publication. Upon vote being taken on the adoption of the foregoing ordinance, the following voted in favor thereof: Allen Lindman, Glen Sonnenberg, Wayne Gageby and H. R. Jones; and the following voted against the same: Arthur Paulson; whereupon said ordinance was declared duly passed and adopted. Motion made by Glen Sonnenberg and seconded by Wayne Gageby to uphold the recommendation of the Planning commission relative to Spanjers' property, and that no buildings other than Spanjers original building be allowed in this area until a plan for development of the entire area is presented to the Planning C ommission. Motion carried. Motion made by Wayne Gageby and seconded by Glen Sonnenberg to adopt the following ordinance: AN ORDINANCE AMENDING SECTION 3.42 OF THE ZONING ORDINANCE OF THE VILLAGE OF BROOKLYN CENTER BY ADDING A CERTAIN USE THERETO THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN AS FOLLOWS: II 1. Section 3.42 of the Zoning Ordinance of the Village of Brooklyn Center is amended to read as follows: COMMERCIAL USES REQUIRING SPECIAL APPROVAL. Gasoline filling stations, bulk fuel oil storage, parking lots, public garages, processing metal weather - stripping and metal combination windows from prefabricated material., taverns, moving picture theatres, trailer camps, bungalow courts, motels, hospitals, sanatariums, rest hones, nurses homes, convalescent homes, clinics for the care, cure or restraining of the mentally unbalanced or for victims of drink or drugs, detention homes, reform schools, asylums or institutions of kindred natures, or cemeteries, columbarians and crematories, may be permitted by special permit. 2. This ordinance shall take effect from and after its publication.` Motion carried. Motion made by Allen Lindman and seconded by Wayne Gageby to grant a special permit to A. J. Span C9. to process metal weather stripping and: metal combination windows from prefabricated material, on the Southwest one acre of the South three acres of that part of GovernYnent Lot 3, Section 36, Township 119, Range 21, lying west of River Road and south of the south line of the north 1 3/4 acres of that part of said Lot 3 lying west of River Road and south of Lot 7, Mendenhal.l's Outlots. Motion carried. Motion made by H. R. Jones and seconded by Wayne Gageby to accept Justice report of Aldor Johnson for Seliember, 1955. Motion carried.
