HomeMy WebLinkAbout1955 10-19 CCM Special Session - - E Minutes of the proceeding of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota, including all accounts audited by said Council October 19, 1955 The Village Council met in special session and was called to order by Arthur Paulson, Mayor, at 8:15 P.M. The following members were present: Arthur Paulson, Allen Lindman and H. R. Jones. Wayne Gageby came at 9 :00 P.M., and Glen Sonnenberg came at 10:30 P.M. Member H. R. Jones introduced the following resolution and moved its adoption: RESOLUTION ADOPTING LEVY FOR PART PAYMENT OF SANITARY SEWER IMPROVEMENT NO. 1955 -1 IN LIEU OF ASSESSMENTS FOR CERTAIN LAND BENEFITTED i THEREBY 'f WHEREAS, Sanitary Sewer Improvement No.,1955 -1 consists of a main trunk serving the westerly half of the Village'of Brooklyn Center, and WHEREAS, at the time of making preliminary plans it appeared that said trunk line could not serve that area of the village . lying south of 53rd Avenue North and west of Highway 100, and WHEREAS, said area was therefore not included in the area pro - posed to be assessed for said improvement, and WHEREAS, it now appears that said main trunk line will serve the area of the village lying south of 53rd Avenue North, and WHEREAS, the cost cf the trunk line attributable to said area is in the sum of $14,757.07, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that the following described property is benefitted by the construction of Sanitary Sewer Improvement No. 1955 -1: The area which is bounded by the following described line: Starting at a point where 53rd Avenue North intersects the West shore of Twin Lake; thence South along the West shore of Twin Lake to the Southwesterly corner of said lake; thence Southeasterly along the Southwest boundary of Lot 12, Block 4, Twin Lake Woods, to the intersection of Lake Drive and 51st Avenue North; thence Southerly to the point where 50th Avenue North extended intersects the North boundary of Minneapolis, St. Paul & Sault Ste Marie Railway right of way; thence Easterly along the center line of 50th Avenue North extended ` to the center line of France Avenue North; thence Northerly 183 feet along the center line of France Avenue North; thence Easterly and parallel to 50th Avenue North to a point where' this line intersects the Northwest boundary of the State Highway #100 right of way; thence Northeasterly along the Northwest boundary of State Highway #100 right of way to the center line of S3rd Avenue North extended; thence Westerly along the center line of 53rd Avenue North extended and 53rd Avenue North to the point of beginning. 2. In lieu of the assessments against said property, the Village Council shall levy a tax in the sum of $1619.74 to be paid in the year 1956, and the Village Clerk is authorized and directed to certify said levy to the County Auditor. 3. The Village Clerk each year hereafter shall certify to the County Auditor the sum of $737.85 representing.1/20th of the principal amount together with interest on the unpaid balance at 5% until such time as an area interceptor shall have been constructed to serve the area set forth in paragraph 1 above, at which time the principal amount 30 of $1+,757.07 shall be added to the cost of said area interceptor and assessed against the property owners benefitted thereby within said area at the ''same time as the assessments are spread against said property owners for said area interceptor. 4. The Village shall be reimbursed from said special assessments for such amounts as it may thertofore have levied as a general tax pursuant to this resolution. The motion for the adoption of the foregoing resolution was duly seconded by member Allen Lindman, and upon vote being taken thereon the following voted in favor thereof: All members present; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion made by H. R. Jones and seconded by Allen Lindman to accept petition for Sanitary Sewer presented by independent School District No. 24, Robbinsdale Public.Schools. Motion carried. Motion made by Wayne Gageby and seconded by H. R. Jones to instruct Village A ttorney to draft an ordinance relating to two family dwellings in residential zoning._ Motion carried. Member Allen Lindman introduced the following resolution and moved its adoption: WHEREAS, if this "country is attacked, the primary objective of the enemy will include centers of industrial production, and concentrated on our civilian population; and WHEREAS, the capabilities of nuclear and other weapons are so great that an attack, if successful, will result in damage and casualties far beyond the resources of any community; and WHEREAS, the St.Paul- Minneapolis Metropolitan area is officially listed by the Federal Government as one of 70 critical target areas in the N ation; and WHEREAS, the Federal Civll Defense Administration has invited the State of Minnesota to participate in the National Survival Plan project, NOW, THEREFORE, be it resolved that: the political subdivision of Village of Brooklyn Center, State of Minnesota, will cooperate to the full extent of our capabilities with the State of Minnesota and the Federal Government in the study and development of civil defense measures designed to afford maximum protection of life and property through participation in the Survival Plan project financed entirely by the Federal Civil De6nse Administra- tion. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: All members present; and the following voted against the same None; whereupon said resolution was declared duly passed and adopted. Motion made by H. R. Jones and seconded by Wayne Gageby to adopt the budget figures as worked out by the Village Council and to certify them to the Auditor. The specific figures in the budget shall be inserted in the minutes of the next regular meeting of the Council. This budget includes the General Fund, Poor Fund, Firemen's Relief Association, Park Fund. Motion carried. The following bills were audited and ordered paid: General #3804 Robert L.
