of Hennepin and State of Minnesota, including all,
accounts audited by said Council
November 23, 1955
The Village Council met in regular session and was called to order
by Arthur Paulson, Mayor,,at 8:10 P.M.
The following members were present: Arthur Paulson, Wayne Gageby,
Allen �,indman and Glen Sonnenberg. H. R. Jones was absent.
In the absence of Clerk Jones the Village - Engineer, A. J. Lee, read
the minutes of the meeting of November 9, which were approved.
The Mayor announced that the Council was met to receive, open and
consider bids for a motor grader and snow plow.
An affidavit was presented showing publication of advertisement for
bids in the official newspaper, which affidavit was examined and found to be
in accordance with law and ordered placed on file.
The sealed bids which had been received were then presented. These
were opened and examined and found to be as follows:
1. A -W Company, Inc. of Minn., base bid
$20,835.00 for Model Super 99 add
for torque converter $1,050.00; alternate
bid, $18,000.00 for Model Super 88.
2. Wm. H. Ziegler Co., Inc., Model 12
'r Caterpillar, base bid $20,040.00; alter-
nate: Snow plow add $695.00; Power
Slide -shift Mold -board add $385 .00.
Deduction of $1,000.00 in consideration
of rental paid on used motor grader
during 1955•
3. Borchert - Ingersoll, Inc., Allis- Chalmers
Model 45 motor grader, base bid $20,200.00;
Power Slide -shift Mold -Board add $600.00.
4. Phillippi Equipment Co., Model 118 Galion
motor grader, base bid $19,345.00; hydrau-
lic shiftable mold -board add $540.00.
5. The George T. Ryan Co., Model 550 Adams
motor grader, base bid 20,040.00; Power
shift mold -board add $724.00.
Member Wayne Gageby introduced the following resolution and moved its adoption:
RESOLUTION TABLING FURTHER ACTION O� BIDS
HE IT RESOLVED by the Village Council of the Village
of Brooklyn Center, Minnesota, that further action
on the bids received for motor grader and snow plow
be talked for further e ination and study by the
Village Engineer and Coil.
The motion for the adoption of the foregoing resolution was duly seconded by
member Glen Sonnenberg, and upon vote being taken thereon, the following voted
in favor thereof: Arthur Paulson, Wayne Gageby, Glen Sonnenberg and Allen
Lindman; and the following voted against the same None; whereupon said
resolution was declared duly passed and adopted.
The Council discussed the advisability of enacting an air pollution
ordinance. Motion made by Wayne Gageby and seconded by Glen Sonnenberg to
instruct Vilbge Attorney to draft a proposed ordinance covering air pollution
control, the following parties to be notified when action is to be taken re
proposed air pollution ordinance: Mrs. V. L. Anderson, 4912 Zenith; L.H. Butler,
3201 - 49th Ave.; Leo W. Hanson, 4903 Osseo Road; Howe, Inc Motion carried.

j Motion made by Allen Lindman and seconded by Glen Sonnenberg to
authorize purchase of a used Ford tractor, the cost thereof not to exceed $500.00.
Motion carried
Motion made by Glen Sonnenberg and seconded by Wayne Gageby to authorize
purchase of a used broom for use on Ford tractor, the cost thereof not to exceed
$500.00. Motion carried.

Motion made by Glen Sonnenberg and seconded by Allen Lindman to purchase a
snow bucket for the Hough payloader at a cost of $275.00. Motion carried.
Mr. James Pearson and Attorney Olson appeared re Northport Lake, particularly
with respect to release of street bonds for Pearson's Northport 1st and 2nd
Additions. Motion made by Glen Sonnenberg and seconded by Wayne Gageby to release
street bond on Pearson's Northport 1st Addition. Motion carried. It was agreed
7 ' to call in the Northport Lake Association and Pearson Brothers to discuss further
the problem of Northport Lake at the special meeting on December 7.
Motion made by Wayne Gageby and seconded by Glen Sonnenberg to transfer
the following funds:

All members voting in favor of-this motion, nays none, motion carried.
Mr. Curry presented a form.for Sewer Billing to be used beginning
with the January 1, 1956 billing. Said form was approved by the Council.
Motion made by Glen Sonnenberg and seconded by Allen Lindman to adopt
the following ordinance: '
AN ORDINANCE AMENDING "AN ORDINANCE REGULATING
THE USE OF SANITARY SEWER SYSTEM AND ESTABLISHING
AN OPERATING FUND THEREFOR" REGARDING THR.BILLING
AND COLLECTION OF CHARGES
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDAINS:
Section 1. Section 7 -304 of "An Ordinance Regulating The Use of
Sanitary Sewer System and - Establishing An Opeating Fund Therefor" is hereby
amended to read as follows:
" Section 7 -304 Manner of Payment — Liens.
The Village shall bill each property owner connected to the
t' sewer system quarterly. The amounts shall be immediately due
at the time of such billing. A penalty of One ($1.00) Dollar
shall be added to the next quarterly billing for any account
unpaid thirty (30) days after the date of billing.
An additional penalty of One ($1.00) Dollar shall be added for
each subsequent quarter in which such account is unpaid.
All charges which are delinquent one year or more on
September 30 of each year and which have been properly billed
to the occupant of the premises served may be certified by the
Village Clerk to the County Auditor between the 1st and 14th day
of October each year. In certifying such charges, the Village
Clerk shall specify the amount thereof, the description of the
premises served, and the name of the owner thereof. The amounts
so certified shall be extended by the County Auditor on the tax
rolls against such premises in the same manner as other taxes
and shall be paid to the Village Treasurer along with other
r taxes."
j Section 2. This ordinance shall be effective upon its passage and
.publication.
Upon vote being taken on the adoption of the foregoing ordinance, the following
voted in favor thereof: Arthur Paulson, Glen Sonnenberg, Allen Lindman and
Wayne Gageby; and the following voted against the same: None; whereupon said
ordinance was declared duly passed and adopted.

street bond of Hii Cons Company on rri ' Addition. Motion carried.
Motion made by Wayne eby and seconded Allen Lindman to release
street bond of J. ahinden on Krut ig's Addition. Motion carried.
Motion made by Allen Li dman d seconded b Wayne Gageby to release
bond of J. R. Murphey on J. R. Murphey's Addition, subject to t►e posting of a
new bond to cover street wor on pon Avenue. Mot carried.
Motion made by G1 Sonne berg nd seconded Allen Lindman to
instruct the Village Attorney and Village Engineer write a letter to the
Minneapolis City Council urging the completion of work on Shingle Creek. Motion
carried.
Motion made by Glen Sonnenberg and seconded by Wayne Gageby to accept
the application for Cigarette License from Brooklyn Center Pharmacy, 691:4 Osseo
Road, and that Cigarette License be approved and issued to said Brooklyn Center
Pharmacy. Motion carried.
It was agreed by the Council to meet Tuesday, November 29, at 8 :00
o'clock P.M. to consider negotiations with Operating Engineers 49.
Motion made by Glen Sonnenberg and seconded by Wayne Gageby to
authorize the purchase of a Roll -dex file and cards for Special Assessments
records. Motion carried.
Motion made by Wayne Gageby and seconded by Allen Lindman to advertise
for the purchase of a calculator for use in the Village office. Motion carried.
