Super, Mayor, at 8 :05 P.M. The following members Were present; William N. Super, Wayne Gageby, Clifford Wellman, and Russ Jones. Allen Lindman was absent. The Mayor announced that this was the time and place for receipt of bids for the purchase of two 24" wells. Affidavits were presented showing publication of advertisements for bids in accordance with law and ordered placed on file. The sealed bids which had been received then were presented. Pump House No. 1 $47,190.00 Pump House N 2 $47,190,00 Member Clifford Wellman introduced the following resolution and moved its adop- tion: RESOLUTION TABLING FURTHER ACTION ON BIDS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota that further action on the bids received for wells, be ta- bled for further examination and study by the Village Engineer, successful bid- der to be announced May 22, 1956, 8 o'clock P.M. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman and member Russ Jones, and upon vote being taken tbere- on the following voted in favor thereof; William N Super, Wayne Gageby, Clifford Wellman, and Russ Jones; and the following voted against the samet None; whereupon said resolution was declared duly passed and adopted. Philip Mittlestadt appeared before the Village Council to discuss the grading of the street boulevard in front of his property. The Village Engineer recommended that the elevation of the street to be changed to approximately tbre. feet West of the center line and that point to slope within eight feet of the property line. Motion by Clifford Wellman and seconded by Russ Jones to ac- cept the recommendation of the Village Engineer, Member Wayne Gageby moved the adoption of the following ordinaUces AN'ORDnMNCE AMENDIM SECTION 23 -201 THROUGH SECTION 23 -208 OF THE VILLAGE 01011 ANCES BY REMOVING THERE - PROM ALL REFERENCES TO 'FOWLING ALLE AND ENACTING.. A NEW PROVISION FOR THE LICE SIM OF BOWL ALLEYS The Village Council of the Village of Brooklyn Center do ordain as follows: 1. Section 23 -201 through Section 23 -208, both inclusive, are herel amended to omit from said sections all references to bowling alleys. 2. A new section shall be added to the ordinances of the village to read as follows; t Section 23.209 LICEM110 OF BOWLING ALLEYS. No persons shall own or operate any bowling alley which is to be used by the public until and unless he has been licensed by the Village Council. t An applicant for such license shall state in writing the names d and address of the owner or owners of the property in which the bowling alley is located, the names and addresses of the persons who operate the bowling alley, the location of said bowling alley and a general description thereof. Said application shall be accompanied by the required licensing fee. If the Village Council shall find that the owners and operators of the bowling alley are persons of good moral character and that the operation of the bowling alley will be carried on in conformity with all the laws and ordinances applicable thereto and that the operation of a bowling alley at the place indicated is consistent with the character of the community immediately surrounding, then it may grant a license which will expire on December 31 next following. The'annual fee for such license shall be $10.00 for the first alley and $7.00 for each additional alley located in one estab- lishment. If an owner or operator shall be convicted of any violation of any of the ordinances of the village or laws of the state in connection with the operation of said bowling alley, the village council may revoke said license or may cause the same to be suspended for a time to be determined by the village council. Any Person who shall own or operate any bowling alley without being licensed under the provisions of this ordinance shall, upon conviction therefor, be subject to a penalty not to exceed $100 fine or 90 days in jail. 3. This ordinance shall take effect from and after its publication. The foregoing motion having been seconded by member Clifford Wellmanp vote was taken thereon, and the following voted in favor thereof: William N. Super, Wayne Gageby, Clifford Wellman, and Russ Jones; and the following voted against the sane; None; whereupon said ordinance was declared duly passed and adopted. Member Wayne Gageby moved the adoption of the following ordinances AN ORDINANCE AMENDING THE EI OTRICAL CODE BY ELIMINATING THE R]QUIREMENT FOR A BOND The Village Council of the Village of Brooklyn Center do ordain as followss` 1. Section 3.809 of the Ordinance of the Village of Brooklyn Center is hereby amended to read as follows, Section 3 -+809. EXAMINATION FOR LICENSE,. Application for a license shall be made to the Village Council and shall be granted upon the vote of the Council upon proof of the applicant's qualifications therefor. 2. This ordinance shall be in force from and after its publication. The foregoing motion having been seconded by Wayne Gageby, vote was taken there- on, and the following voted in favor thereof; William N. Super, Wayne Gageby, Clifford Wellman, and Russ Jones; and the following voted against the same. None; whereupon said ordinance was declared duly passed and adopted. Member Clifford Wellman moved the adoption of the following ordinance. AN ORDINANCE TO PROVIDE FOR THE LICENSING AND REGISTRATION OF BICYCLES AND TO REGULATE THE OPERATION THEREOF r The Village Council of the Village of Brooklyn Center do ordain as follows. Section U-501. LICENSES REQUIRED. No person shall ride or use a bicycle upon any public street, highway, boulevard or alley in the Village of Brooklyn Center unless the bicycle shall be registered and licensed in the name of the actual owner as herein provided. j 1 Section 23 -502. IlMMATION MUM, Every owner of a bicycle shall register with the Village Clerk his name and address, the name of the manufacturer of his bicycle, its number, style and general des - cription. The Village Council can deputize other persons to issue licenses in receipt for payment of the license fees on behalf of the Clerk. Section 2303. FORM OF LICENSE. (a) The Village Clerk shall main tain at the Village Hall suitable records of registrations under this ordinance, On receipt of the license fee herein provided for, he Nhall provide a suitable metallic identification plate upon which shall be stamped suitable distinguishing letters or number. The owner shall affix and keep affixed to the rear of the seat of the bicycle for which the plate is issued, the original metallic plate, and shall keep such plate clean and visible at all times. (b) No bicycle shall be registered which is in unsafe mechanical condition. The Village Clerk shall have authority, upon the recom- mendation of the Juvenile Court of Hennepin County, to suspend the registration of, and remove the identification tag from, any bicycle operated contrary to any state law or village ordinance or operated while in unsafe mechanical condition, such suspension and removal to continue for a period not to exceed ten (10) days, provided that such registration shall not be reinstated or such identification tag be re- placed while such bicycle is in unsafe condition.. Such suspension and removal shall be in addition to other penalties provided hereunder. Section 23 -504, FEE. The biennial license fee is seventy -five (750) cents, and shall be paid on or before the 1st day of July in each even numbered year. Upon change of ownership, the license plate shall be registered in the name of the new owner upon payment by the new owner of a fee of twenty -five (250) cents. All receipts from license and transfer application shall be remitted by the Village Clerk to the Village Treasurer. ferred Section 23 -505, LOSS OF LICENSE PLATES. Plates shall not be trans -, from one bicycle to another and no person shall attach to any bicycle a plate which was not issued for such bicycle. Upon the loss of a license plate, the Village Clark upon satisfactory evidence of such loss and payment of a fee of twenty -five (250) cents shall issue an appropriate new plate, It shall be unlawful for any un- authorized person to remove or destroy a license plate on a bicycle. Section 23-506. OPERATION OF BICYCLES. (a) No person shall ride or propel a bicycle upon any public street, highway, boulevard, sidewalk or alley except in a careful and prudent manner. A person Propelling a bicycle shall not ride other than astride a permanent or regular seat attached thereto. No bicycle shall be used to carry more at one time than the number for which it is designed or equipped. No person riding upon any bicycle shall attach the same or himself to any vehicle upon a roadway. (b) No bicycle shall be ridden upon any public street, highway, boulevard, sidewalk or alley at a speed faster than is reasonable and proper under traffic conditions at the time, and every bicycle shall be operated with due regard to the safety of the operator and other person upon the streets, highways, boulevards, sidewalks, and alleys of the village. (c) No bicycle shall be operated on any street, highway, boulevard, sidewalk or alley during any period of time from one -half hour after sunset to one -half before sunrise without a headlight in good working condition. Such headlight shall display a white light of sufficient illumlWting power under normal atmospheric conditions to reveal any persons, vehicles or substantial objects fifty (50) i -3_ r feet ahead of headlight, which headlight shall be firmly attached to said bicycle and properly lighted, nor shall any bicycle be so operated or parked without an adequate lighted red tail Light or in lieu thereof an adequate reflector attached to and visible from F the rear of such bicycle from a distance of not less than two hundred i (200) feet. (d) No person shall operate a bicycle unless it is equipped with a bell or other device capable of giving a.signal audible for a dis- tance of least one hundred (100) feet, except that a bicycle zhall not be equipped with nor shall any persons use upon a bicycle any siren or whistle, (e) No person shall operate a bicycle upon any public street, hg'ada boulevard, sidewalk or alley unless the bicycle is in good mechanic- condition and equipped with adequate brakes. Section 2J -5074 BICYCLE RENTALS. A rental agency shall not rent or offer any bicycle for rent unless the bicycle is licensed and a licen prate is attached thereto as provided herein and such bicycle is equipped with the lamps and other equipment required in this ordi- nance, Section 23 -5 PENALTY. Any persons who shall violate the provision of this ordinance shall, upon conviction thereof, be punished by a fi not a Dollars or ninety days to exceed On Hundred ($100.00) y (90) in the County Jail of Hennepin County. The Court may also after conviction remove and detain the license plate from the bicycle owned by the person convicted for a period not to exceed thirty (30) days or may both remove and detain said plate for a period not to exceed thirty (30) days and impound said bicycle for a period not to exceed thirty (3G) days. Section 23-509, all DATE. This ordinance shall take effect and be force from and after its publication. The foregoing motion having been seconded by Wayne Gageby, vote was taken there- on, and the following voted in favor thereof; William N. Super, Wayne Gageby, Clifford Wellman, and Russ Jones; and the following voted against the same; None; whereupon said ordinance was declared duly passed and adopted. Motion made by Wayne Gageby and seconded by Clifford Wellman to accept petition for oil stabilization, Ewing Avenue North, 67th to 69th Avenue, date of public hearing to be set later, Motion carried, Motion made by Wayne Gageby and seconded by Clifford Wellman to ac- cept the final plat of Pearson's Northport 4th Addition, subject to all the restrictions of the Platting ordinance, and the Mayor and Clerk authorized to sign the same, bond to be posted. Motion carried. Member Wayne Gageby introduced the following resolution and moved its adoption: BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, the bid of Motorola Communications and Electronics, Inc., 817 Kilpatrick Building, Omaha, Nebraska, for one two way radio com- munications system, for the Fire Department, as to specifications, for $3,4+1.37, is hereby found, de- termined and declared to be the most favorable bid and is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Russ Jones, and upon vote being taken thereon the following voted in favor thereof; William N. Super, Clifford Wellman, Russ Jones, and Wayne Gageby; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. u e 1- k k M� d Motion made by Russ Jas and seconded by Wayne Gageby *0 accept Adrian Knutson as Assistant Village Engineer, starting May 21, 1956, at the hourly rate of $2.40 per hour, which is $416 per month, subject to all the restrictions under the Employee's ordinance of Brooklyn Center, Minnesota. Member Clifford Wellman introduced the following resolution and waved its adoption: BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that the bid of Roto- Rooter Sewer Service Company, 1819 Nicollet Avenue, Minneapolis, Minnesota., for Sewer Cleaning Equipment, as to specifications, for $3, 72+.00, is hereby found, determined and declared to be the most favorable bid and is hereby accepted. The Clerk is directed to retain the check of said bidder and return check forthwith to the unsuccessful bidder. The motion for the adoption of the foregoing resolution was duly seconded by member Russ Jones, and upon vote being taken thereon the following voted in favor thereof; William N. Super, Clifford Wellman, Russ Jones, and Wayne Gageby; and the following voted against the same; None; whereupon said resolution was declared duly passed and adopted. Motion made by Wayne Gageby and seconded by Russ Jones, to inform Kenneth Nordquist, accountant for the Village of Brooklyn Center Liquor Store books, that his services will terminate July 1, 1956, for the reason that from that date on, the Liquor Store books will be kept in the Village Offices. This is in no way any reflextion on his services, only that the books are to be kept by our own employees and in our own offices. Motion carried.
