Super, at 8:10 F.M., at the Earle Brown School. The following members were present: William N. Super, Wayne fteby.. Clifford Wellman, Allen Landman, and Russ Jones. The Mayor announced that the meeting was open for consideration of e proposed improvement in the Village consisting of the following: Construction of a sanitary sewer main manholes, meter stations and all other interceptor line including lift stations, usual sanitary sewer appurtenances along a route described generally as follows Commencing at the intersection of 53rd and Lynditle Avenue North; thence North along Lyadale Avenue to ?3rd Avenue. The Clerk produced an affidavit of publication of Notice'of Hearing on the proposed improvement showing two weeks' publication thereof in the officia: gewspaper, the last publication being on May 31, 1956, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After several hours of discussion by the interested pproperty owners and hearing and considering all ob,ections, and a ma,ority of the property owners appearing opposed to said improvement,, member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUMON DLUPFROVING PROJECT BE IT RESOi.VED by the Village Council of the Village of Brooklyn Center as follows: 1. That the Village Council disapprove said proposed imporo t The motion for the adoption of the foregoing resolution was duly seconftd by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof William N. Super, Wayne Gageby, Clifford Wellman, Russ .mss. and Allen Lindman; and the following voted against the same: Alone; whereupon said resolution was declared duly passed and adapted. The Mayor announced that the meeting was open for further consider*UM of a proposed improvement, which was extended from the public hearing of Dray 8, 1 95 6 , in the Village consisting of the followings A Storm Sewer Interceptor main to serve the area bounded as follows: Beginning at the Mississipp River and 62nd Avenue, extended, thence West to Highway No. 100, thence Southwesterly along Highway No. 100 to 57th Avenue; thence West to Shingle Creek, thence North along Shingle Creek as it meanders to a point 650' South of the North line of Section 35, thence East along a line ' parallel and $50 from. the North line of Section 35 to Knox Avenue, extended, thence North to a point 660' South of the North line of Section 35, thence East along a line parallel and 660' South of the North lines of Section 35 and 36 to the Mississippi River. it `.� The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After discussion by the interested property owners and hearing and considering all objections, motion was made by Clifford Wellman and seconded by Wayne Gageby to have a showing of hand who was for or against the proposed improvement. Motion carried. A majority of the property owners appearing opposed to said improve- ment, member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION DISAPPROVING PROJECT BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows: 1. That the Village Council disapprove said proposed improvement. The motion for the adoption of the foregoing resolution was duly seconded by member Allen Lindman, and upon vote being taken thereon the following voted in favor .thereof: William N. Super, Wayne Gageby, Clifford Wellman, Russ Jones, Allen Lindman; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for consideration of a proposed improvement in the Village consisting of the following: Construction of a storm sewer in Miller's Willow Lane First Addition as follows: Alta bounded on the south by 69th Avenue, On the West by the West Village limits, on the North by Shingle Creek and the Village limits, on the East by Highway 152 to its intersection with west line of Section 27 and the West line of Section 27 to 69th Avenue North. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION ORDERING IMPROVEMENT AND DETAILED PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is determined hereby that it is necessary and for the best interests of the Village and the owners of property specially benefited thereby that the following improvements shall be constructed: Construction of storm sewer in Miller's Willow Lane First Addition Mich is bounded generally as follows: -2- _r e { On the South by 69th Avenue, on the West by the West Village limits, on the North by Mingle Creek and the Villssge limits, on the East by Highway 152 to its intersection with West line of Section 27, and `the West line of Section 27 to 69th Avenue North. Said improvement shall be designated hereafter Storm Sewer Improvement No 1956 -35. 2. The plans and specifications for said improvement s be prepared by the Village Engineer. 3. The Clerk shall advertise for such improvements in the forth Hennepin Post and the Construction Bulletin, the date of first publication not less than 10 days prior to the date for receipt of bids. Said notice shall state that no bids wi11 be considered unless sealed and filed and accompanied by a cash deposit, bid bond, cashier's check or certified check payable to the Clerk in the amount of not le s than five per cent �) of the bid. eat 0 The motion for the adoption o the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the vollowing voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, Allen Lindman, and Russ Jones; and the following voted against: the same: None; whereupon Said resolution was declared duly passed and adopted.
