HomeMy WebLinkAbout1956 06-12 CCM Regular Session cox -r- Minutes of the proceeding of the Ville Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota, including all accounts audited. by said Council - June le, 1956 The Village Council met in regular session and was called to order by William N. Super, Mayor at 8 :05 P.M. The following matters were present: William N. Super, Allen Lindman, Clifford Wellman, and Wayne Gageby. Russ Jones was absent. In the absence of Clerk Jones, Dale F. Curry, Accountant, took notes of the meeting. Motion by Wayne Gageby and seconded by Allen Linftan to aprove the minutes of the special meeting of May 15, 1956 and the regular meeting of May 22, 1956, as they were recorded. Notion carried. The Mayor announced that the meeting was open for the consideration of a proposed improvement in the village consisting of the following: Construction of storm sewer in the following described area: Ccaneing at the point of the intersection of the West Village limits and 69th Avenue North; theme easterly along 69th Avenue North to the intersection with Highway 152; thence southeasterly along Highway 152 to 67th Avenue; thence easterly along 67th Avenue to a point half way between France and Grimes Avenues North; thence northerly to 68th Avenue; thence easterly 4ong 68th Avenue extended to Zenith Avenue extended; thence northerly to 69th Avenue; thence easterly along 69th Avenue to Shingle Creek; thence southerly as Shingle Creek meanders to the south line of Section 35; thence westerly along the south line of Sections 35, 34, and 33 to the West Village limits; thence north along the west village limits to the point of beginning. An affidavit of publication was produced of notice of public bearing ' on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on May 34 2956, which affidavit was exsz0xed and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present argume s e f or against the proposed improvement. The plans and specifications for said improvements shall be completed by Minder Engineering Engineer, and be submitted to the Village Couneil.prior to the bid Opening date. Bid opening shall be July 24, 1956, at 10 :00 o' clock a.m. 3 . The Clerk shall advertise for such improv in the North Hennepin Post and the Construction Bulletin, the date of first publication not less than three weeks prior to the date for receipt of bids. Said notice shall state that no bids will be considered unless sealed and filed and accompanied by a cash deposit, bid bond, cashier's checi or certified check payable to the Clerk in the amount of not less than five per ciant {5%) of the bid, The motion for adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof William N. Super, Clifford Wellman Allen Lindman and Wayne by; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. A writtext report will be made by the Consulting Engineers in c0:bJunction with the Village Engineer on the Storm Sewer IWovement No. 1956 -13 installation. Member Allen Lindman introduced the following resolution and moved its adoption; RESOLUTION AUTHCRIMMG SANITARY SEWER IMOVENW NO. 1956 -22 AS "MCHENT To CONTRACT FM SANITARY SEWER IMPROVE* O. S 5, 6, and 20 BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that the construction of Sanitary Sewer Improvement No. 1956 -22 be added to the existing contract with Lametti and Sons Inc. covering the construction of Sanitary Sewer Improvement No.s 1956- 6 sand. , ? 20. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne GaSeby, and on vote being taken n thereon the following .voted in favor thereof: William N. The bonds issued hereunder shall be payable from Improvement No. 1956 -B Fund heretofore created, provided that if any payment of Principal or interest shall become due when there is notsufficient money in said fund to pay the saw, the treasurer shall pay such principal or interest from the general fund of the village and such fund shall be reimbursed for su0b advances out of proceeds of assessments for said improvement when collected. All proceeds of said bonds and assessments shall be credited to said rove - Imp went No. 1956 8 Fund;. 12. The estimated collection of special assessments and other revenues pledged for the payment of said bonds will produce at least five percent in excess of the amount needed to meet, when due the principal and interest payments on the bonds and no ad valorem tax levy shall be made. The Clerk shall deliver a certified copy or this resolution to the County Auditor of Hennepin County and obtain his certificate as required by Section 475.63, Minnesota, statutes. 13• The said bonds when fully executed shall be delivered by the Weasurer to the pwrchaser thereof upon receipt of the purchase price, and the said purchaser shall not be obligated to see to the proper application thereof. 14.
