HomeMy WebLinkAbout1956 06-19 CCM Special Session Minutes of the proceeding of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota June 19, 1956 The Village Council met in special session and was called to order - by William N. gape -, Mayor, at 8:00 P.M. The follow ng members were present: William N. Super, Wayne Gageby, Allen Lindman, Clifford Wellman and Russ Jones. Motion made by Wayne Gageby and seconde�l by Russ Tcnes to abate taxes on sa itary sewer on Vic Anderson's property: 1 3"t a p�.r c of Lot 11 Block 2, Bellvue Acres, lying east of the West 99..32 feet thereof, Hennepin County, Minnesota. Motion carried. Member Wayne Gageby introduced the - following resolution and moved its adoption: RESOLUTION APPROVING DETAILED PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota as follows: 1. The plans and specifications for improvements designated as Sanitary Sewer No. 1956 -32, prepared by the Minder Engineering Company, subject to review by the Village Engineer, are hereby approved and shall be filed with the Clerk. The motion for adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof :. William N. Super, Wayne Gageby, Allen Lindman, Clifford Wellman, and Russ Jones; the following voted against the same: None; whereupop said resolution was declared duly passed and adopted. Motion made by Clifford Wellman and seconded by Allen Lindman to deny abatement on special assessment taxes on Dahinden's property: Lot 1 Block 1, Brook Park Addition, Hennepin County „Minnesota. r- ---Motion made by Clifford Wellman and seconded by Allen Lindman that the Village of Brooklyn Center join as a party _plaintiff with the Northport Lake Adsociation, at the request of James Johnsvon, representative of the Northport Lake Association, to determine the legal issues involved in'matters pertaining to their petition dated May 21, 1956. Motion carried. Motion made by Russ Jones, seconded by "Wayne Gageby, that the Village obtain the proper technical person to make an inspection of the Howe Fertilizer Plant and-ma ' ke recommendations.to the Village relative to changes in operation to correct the situation now existing in regard to the Air Pollution Ordinance. This approved mentioned party to be hired immediately. Motion carried. klember Wayne Gageby introduced the following resolution and moved its a.doptior. COUNCIL RESOLUTION DIRECTING CONDEMNATION WHEREAS, It is necessary, advisable and in the public interest that the Village of Brooklyn Center acquire certain easements for Purposes of laying and maintaining water distribution lines and for 'the purpose of laying and maintaining sanitary sewer lines, and WHEREAS, It is necessary, advisable, and in the public interest that said easements be located as hereinafter described, NOW, THEREFORE, The Village Council of the Village of Brooklyn Center does hereby resolve as follows: 1. The Village of Brooklyn Centelr,shall proceed to procure an easement in the land hereinafter described for the purpose set forth opposite said description under is right of eminent domain and the Village attorney is instructed,,and directed to file the necessary petition therefor and to prosecute such action to a successful conclusion or until it is d=doned, dismissed or terminated by the Village or by the Court; and the Village attorney, the Payor and the Clerk shall do all things necessary to be done in the coivsncement, prosecution and successful termination of such acticn. 2. The easements to be acquired are as follows: For the purpose of laying and maintaining a sanitary sewer line: The north 15 feet of the West 3/4,0f the North 1/2 of the SE 1/4, of Section 33 , Township 119, R ange 21, Hennepin County, together with a construction easement over the 15 foot strip lying to the south of said description to expire November 1, 1956. The south 15 feet of that part of Ithe South 1/2 of the Northeast 1/4 of Section 33, Township 119, Range 21, Hennepin County lying west of the easterly,360 feet thereof, together with a construction easement overlthe 15 foot strip lying to the north of said description to expire November 1, 19560 The north 15 feet of Lot 1, BlockIl, Grizme'a Addition, Hennepin County. For the purpose of laying and maintaining a water distribution line The west 15 feet of that part of the North 230.7 feet of the SW 1/4 of the NE 1 /4, Section 34,!o wnship 119, Range 21, Hennepin County, lying west of the east 1225 feet thereof and East of the West 24 feet thereof, plus a construction easement over the 10 foot strip lying to this east of said description to expire September 1, 1956. For the purpose of laying and maintaining storm and sanitary sewer lines - The south 30 feet of the easterly 360 feet of t South 1/2 Of the NE 1/4 of Section 33, Township 119, Range 21, Hennepin County. The motion for adoption of the foregoing resolution was duly seconded by member Allen Lindman, and upon vote being_taken',thereon the following voted in favor thereof: William N. Super, Allen Lindman, Clifford Wellman, Wayne Gageby and Russ Jones; the following voted against the same: Prone; whereupon said resolution was declared duly passed and adopted. Notion made by Fuss Jones and seconded by Allen Lindman that the Village isaB a permit to rarerr, Pettman, for rubbish hauling, specifically excluding garbage.
