I.r. • lib July lo, 1956 The Village Council met in regular session ad was ml2ed to order by William N. Super, Mayor, at 8 :10 p.m. Tho followi-g members were present: William K. Super.. Clifford We. , Wayne Gageby, and Russ Jones. Allen Lindmesn was absert, Motion made by Wayne Gageby and secondedby Clifford Wellman to approve the minutes of the special meeting of June 5, 1956, regular meting of June 12, 1 956, special meeting of June 19, 1956, continued s peci al meeting of June 20, 3.9 ., P.nd regular meeting of June 26, 1956. The minutes were approved as recorded. Motion carried. The Mayor announcerl that the Council was met to r eceive., open, and consider bids for water w.ters. i An affidavit was presented showing publication of advertisement for bids in accordance with law and ordered placed on Pile. That the public hearings on the following improvements be continued to July 17, 1956, due to the further study to be given by the V Engineer to the improvements: Construction of sanitary sewer lateral on France Avenue North from 653 Avenue North to 661 Avenue North. Construction of sanitary sewer lateral on Regent Avenue North from 67th Avenue North to 69th Avenue North. Construction of water main on Regent Avenue North from 67th Avenue North to 69th Avenue North. Construction of sanitary sewer lateral on Perry Avenue North from 67th Avenue North to 69th Avenue North. Construction of sanitary sewer lateral on Lee Avenue from 69th Avenue North to 70th Avenue North. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Doll to build a garage within four feet of his South property line. Motion carried. Motion made by Wayne C,ageby and seconded by Clifford Wellman to allow Allie Gerber to convey a part of her land by metes and bounds description as follows: The Forth 297.841 of that part of Lot 32, Auditor's Subdivision No. 310, lying East of the line 225' East from the West line of Lot 32 and West of the line 300' West from the East line of Lot 31. Notion carried. Member Clifford Wellman moved the adoption of the following ordinance: An Ordinance Amending the Platting Ordinance nE Ld ng Certain Reguiremen Thereto follows: The Village Council of the Village of Brooklyn Center do ordala.ss 1. Section 15 -103 of the platting o rdinance is amended to read as follows: S ection 15 -10, F:s1',AL APPROVAL. After approvrI is given by the Council the final plat shall be submitted for suture of the Village officials within one year after the Council's a;prooval. Otherwise such approval shall expire. Such siAnaatures will be p3aced upon the final plat only when :11 stree'-s'havp been gr*Aded, unless the applicant shall make and fil ri th the 'Village a sufficient bond to cover the cost o' such @r+ ftnv and grsve3.. g in the event the owner falls to comply therewith w. thin tha time set in the bond. If the applicant shall fail to grade and gm- el within the time set in the bond, the Village of Brooklyn Center may proceed to have such improvements made and shall be reimbursed from such bond. During the interval between the signing of the final plat by the Village officials and final acceptance of the streets after being brought to grade and surfaced, the applicant shall maintain the streets in a suitable and usable condition, and sha11 be responsible for any changes occurring in the condition of the streets during this time. If the road is not kept in a suitable and usable condition during this period and after one week *s notice the applicant has failed to remedy the detects, the Village Council may proceed t correct such detects and the appUcaat shall. 3 d ately u a demft%c1 i -3 - reimburse the Village for such work. Any bod or deposit filed with the Village Council may be proceeded against to enforce payme of this liability. 2. This ordinance shall be in effect from and after its date of publication. The foregoing motion having been seconded by member Wayne Gageby, and vote being taken thereon, the following voted in favor thereof; William N. Motion made by Wayne Gageby and seconded by Russ Jones to increase the check cashing fund from $4,O0o.00 to $6,000.00. Wayne Gageby and Russ Jones -oced yes, and Clifford Wellman and William Super voted no. Motion not carried.
