The Village Council met in special session and was called to order by
William N. Super, Mayor, at 8:00 P.M. -
The following members were present: William N. Super, Wayne Gageby..
Allen Lindman, s Rucs Jon,os. Clifford We llman wa3 absent.
The Majror announced that the meeting was open for consideration of a
proposed improrelr�nt in the Village consisting of the following:
Constriction of Storm Sever Addition and Smp ovements in the
area bounded as f-olldws: Lyndale Avenue North on the East,
53rd Avenue on the South, Morgan Avenue on the West and 62nd
Avenue North and Highway #100 on the North.
The Clerk produced ah affidavit of publication of notice of hearing on
the proposed improvement showing two weeks' publication thereof in the official
newspaper, the Last publication being on July 12, 1956, which affidavit was
examined and found satisfactory end ordered placed on file.
The Mayor then called upon all property owners present to present
arguments either for or against the proposed improvement. After hearing and
considering all objections, and the property owners appearing in favor of said
improvement, member Allen Lindman introduced the following resolution and moved
its adoption:

1. It is determined hereby that it is necessary and for the
best interests of the Village and the owners of property specially
benefited thereby that the following improvement shall be constructed:
Construction of Storm Sewer Addition and Improvements
in the area bounded as follows: Lyudale Avenue North
on the Easto 53rd Avenue North on the South, Morgan
Avenue North on the West, and 62nd Aveh ae North and
Highway #100 on the North.
Said improvement shall be designated hereafter Storm Sever
Improvement No. 1956 -47.

The Clerk produced an affidavit of publication of notice of hearing on
the proposed improvement showing two weeks' publication thereof in the official
newspaper,, the last publication being on July 12, 1956, which affidavit was
examined and found satisfactory and ordered placed on file.
The Mayor then called upon all property owners present to present
arguments either for or apst the proposed improvement. After hearing and
considering all objections and the property owners appearing in favor of sad
improvement, member Wayne Gsgeby introduced the foLuwing resolution and moored its

The motion for the adoption of the foregoing resolution was duly seconded by
member Allen Lindman, and upon vote being takAw thereon the Following voted in
favor thereof: William N. Super, Allen Undman, Wayne Gegeby, and Russ Jones; oats
the following voted against the same: None; whereupon said resolution was declared
duly passed and adopted.

Village Council for approval.
3. The construction for said Improvement be added to the
existing contract with Lametti and Sons.. Inc., covering the
construction of Water Alain Improvement No. 1956 -19 -1. Said
work to be performed at the same unit prices as now in force
in said contract.
The motion for the adoption of the foregoing resolution was duly seconded by
member Wayne Gageby, and upon vote being taken thereon the following voted in
favor thereof: William N. Super, Allen Lindman, Wayne Gageby, and Russ Jones;
and the following voted against the same: None; whereupon said resolution was
declared duly passed and adopted.
The Mayor announced that the meeting was open for consideration of a
proposed improvement in the Village consisting of the followings

The foregoing motion was duly seconded by Allen Lima, and all members present
voted in favor thereof. Motion carried.
Motion made by Russ Jones and seconded by Wayne Gageby to appoint Art
Lee! as Special Health Officer for the period of Ed Peterson's absence. Motion
carried.
Motion made by Allen Lindman and seconded by Russ Jones to appoint Walter
Johnson as temporary Village Electrical Inspector, retroactive as of May 1, 1956.
50% of all permit fees to be the Electrical Inspector's compensation, Motion
carried.
Motion made by Allen Lindman and seconded by Wayne Qageby to authorize
the purchase of the following safety equipment for the sewer Department: One
explosimeter, one M.S.A. Wolf safety ]amp, two harnesses, two safety caps, one
fresh air blower, and one first aid kit. Motion carried.
Member Allen Lindman moved the adoption of the following ordinances:

follows:
1. Section -244 of t �. 3 the Village Code is hereby amended by
adding a second paragraph thereto to read as follows:
It shall be unlawful for any person, firm or corporation
to sell or convey the premises upon which a new builAi.ng
or structure has been erected until the Building Inspector
shall have made a final inspection and shall have certified
that the building is in compliance with all of the ordinances
of the Village, The Building Inspector shall be notified
upon the completion of construction of Rny new building or
structure and in any event prior to the sale thereof to any
other persontD provide the Building Inspector an opportunity
to make a final inspection of the premises. At the time of
such final inspection the person, firm or corporation
responsible for the construction of the building or structure
shall have in place survey monuments indicating the boundaries
of the tract or lot upon which such structure is built.
These monuments shall consist of Iron stakes together with a
2" x 2 guard stake, the top of which shall be at least two
feet above the established grade. These survey monuments shall
correspond to the tract or plot of land whIch is proposed to be
conveyed to a third party.
2. This ordinance shall be in effect free and after its data of
publication.
The foregoing ordinance having been seconded by member Russ Jones, and qM vote
being taken thereon, the following voted in favor thereof: William N. SqW.,

same: None; whereupon said resolution was declared duly passed and adapted.
Member Allen Lindman moved the adoption of the foil Ing resolution:
RESOLUTION
WARM, the Soo Line Railroad has reeently increased its
switching operations to around- the - clock schedule, bringing dyer,
Y noise, and almost continuous blockading of traffic to residents of
the city and rural areas adjacent, and

WHEREAS, users of the Osseo Recd, Lyndale, Dupont, and
Rumboldt Avenue are compelled to suffer unnecessary delays in
the conduct of business and personal matters, and
WHEREAS, 1,320 residents, both rural and urban, have
petitioned the Minnesota Railroad and 'Warehouse Commission
for the abatement of this condition, and
WHEREAS, the Minneapolis City Council and the Sennepin
County Board of Commissioners have supported the plea of
petitioners,
NOW, =REF=P BE IT RESOLVED that the Village Council
of Brooklyn Center join the Minneapolis City Council and the
Hennepin County Board of Commissioners in asking the Railroad
and Warehouse Commission to take immediate steps to remedy the
situation which is rapidly becoming unbearable.

member Russ Jones, and upon vote being taken thereon the following voted in favor

Member Wayne Gageby introduced the following resolution and moved its

AND SPECIFICATIONS AND DIRECTING ADVERTISEMENT FCC BI1
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Ydnnesota, as follows:
1. The plans and specifications for pump house, prepared by
the Minder Engineering Company, are hereby approved, at the
recommendation of the Vi llage Engineer, and shall be filed with
the Clerk.
2. Bid opening date set for August 7, 1956, at 8 o'clock p.m,
3. The Clerk shall advertise for such improvements in the North
Hennepin Post and the Construction Bulletin, the date of first
publication not less than two weeks prior to the date for receipt
of bids. Said notice shall state that no bids will be considered
unless sealed and filed and accompanied by a cash deposit, bid
bond, cashier's check or certified check payable to the Clerk in
the amount of not less than five per cent (;5%) of the -bid.

Office of the village clerk for the construction of a proposed

WSRREAS, the village engineer has made a prel ul,mry re Mt
adylsing that said proposed im wovement is feasible and that it 40
be constructed at an estimated cost of $15680.00,

Was declared duly passed and adopted.
