October 9, 1956
The Village Council met in regular session and was called to
order by William N. Super, Mayor, at 8:15 o'clock p.m.
The following members were present: William N. Super, Allen
Lindman, Clifford Wellman, and Russ Jones. Wayne Gageby was absent.
Motion made by Allen Lindman and seconded by Russ Jones to
approve the minutes of the special session of October 2 1 1956. The
minutes were approved as read and recorded. Motion carried.
The Mayor announced that the meeting was open for further *on-
sideration of objections to arty of the assessments for the following
improvements:
Sanitary Sewer Interceptor No. 1956 -17, Sanitary Sewer Improve-
ment Nos. 1956 -6, 1956 -7, 1956 -18, 1956 -2o, 1956 -21, 1956 -22
1956 -23, 1956 -31, 1956 -32, 1956 -4o, 1956 -41, 1956 -43 1956 -4,
1956 -45, 1956 -46, 1956 -48, 1956 -52, and Storm Sewer Improve-
ment Nos. 1956 -13 and 34, 1956 -35, 1955 -9, 1956 -47, and street
Improvement Nos.- 1956 -1, 1956 -2, and 1956 -49. Water Improve-
ment No. 1956 -19 -1 and 1956 -19 -2.
The Clerk produced an affidavit of publication of notice of
hearing on the assessments showing one week's publication thereof in the
official newspaper, the publication being on Septemtter 13, 1956, which
affidavit was exas►ined and found satisfactory and ordered placed on
file.
The then called upon all property owners present to
proem their objections to the above assessments. After hearing end
considering the arguments, member Allen Lindman introduced the following
resolution and moved its adoption:

BE IT 'RESOLVED by the Village Council of the Village of Brooklyn Center,
Minnesota., as follows:
1. The Village Clerk has, with the assistance of the engineer
heretofore selected by this Council for such purpose, calculated the
proper amounts to be specially assessed for the improvements known as
the improvements listed above of said Village against every assessable
lot, piece or parcel of land in accordance with the provisions of law,
and bas prepared and filed with the Village Clerk tabulated statements
in 4Wlicate sboving tie proper description of each and every lot, piece
cW parcel of land, be specially assessed and the amount calculated
aealast the same.
2. Notice has been duly published as require4 by law that this
Council would meet in special sessiqu.on Tuesday, Ogtober 2, 1956,.to
pass on the proposed asoestments. T s bearing was'held and continued
to the regular meeting of October 9, 1956.
3. Said proposed assessments have at all times titn open to
inspection and copying by all persons interested, and an opportunity
has been given to all interested persons to present their objections,
if any, to such proposed assessments, or to any item thereof.
4. No changes in the proposed assessments are necessary.,
5. This Council finds that each of the lots, pieces or parcels of
land enumerated in said proposed assessments was and is specially ben! -
fited by said improvements in the amount of said proposed assessment set
opposite the description of each such lot, piece or parcel of land, and
that amount so set out is hereby levied against each of the respective
lots, pieces or parcels of land therein described.
6. Such proposed assessments are affirmed, adopted and confirmed,
and the sums fixed and named in said proposed assessments are affirmed,
adopted and vonfirmed as the proper special assessments for each of said
lots, pieces or parcels of land respectively.
7. Said assessments so affirmed, adopted and confirmed shall be
certified to by the Village Clerk and filed in his office and shall there-
upon be and constitute the special assessments for the payment of the
above listed Improvements.
8. The amounts assessed against each lot, piece or parcel of land
shall bear interest from the date hereof until, the same have been paid
at the rate of 5% per annum.
9. Such assessments shall be payable in equal installments begin-
ning in the year 1957, payable on the 1st day of January in each year,
and continuing until all of said installments shall have been paid, each
installment to be collected with taxes collectible during said year by
the County Auditor, as follows:

10. The Villages Clerk is hereby directed to make up and file in �
the office of the County Auditor of Hennepin County a certified stmte-
ment of the amount of all of such unpaid assessments and the amount which
will be due thereon the let day of Janua_lt in each year.
The motion for the adoption of the foregoing resolution was duly seconded
by member Russ Jones, and upon vote being taken thereon, the following
voted in favor thereof: William N. Super, Allen Lindman, Clifford
Wellman, and Russ Jones; and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
The Mayor announced that the meeting was open for consideration of
a proposed improvement in the Village consisting of the following:
Construction of a storm sewer in the area bounded by the follow-
ing described lines:
Commencing on the north Village line at its intersection with
the westerly high water line of Palmer Lake; thence southerly
along the western shore line of Palmer Lake to 69th Avenue
North; thence easterly along 69th Avenue to Zenith Avenue;
thence south along Zenith to 68th Avenue extended; thence
westerly along 68th Avenue to a point midway between Ewing
and France Avenues; thence southerly parallel France to
67th Avenue; thence westerly along 67th Avenue to Osseo Road;
thence northwesterly along Osseo Road to 69th Avenue; thence
westerly along 69th Avenge to a point 450 feet west of the
east line of Section 28, Township 119, Range 21; thence northerly
Parallel said section line to Osseo Road; thence southeasterly
along Osseo Road to County Road No. 46; thence northerly along
County Road No. 46 to the north Village line; thence easterly
along said Village line to the point of beginning.
The Clerk produced an affidavit of publication of notice of hearing
on the proposed improvement showing two weeks' publication thereof in
the official newspaper, the last publication being on September 27, 1956,
which affidavit was examined and found satisfactory and ordered placed
on f ile .
The Mayor then called upon all property owners present to present
arguments either for or against the proposed improvement. After hearing
and considering all objections, and the property owners appearing in
favor of said improvement, member Clifford Wellman introduced the follow -
ing resolution and moved its adoption:
RESOLUTION 0R1== IMPROVEMENTS AND
DETAILED PLANS AND SPECIFICATIONS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. It is determined hereby that it is necessary and for
the best interest of the Village and the owners of property
specially benefited thereby that the following improvement shall
be constructed:
Storm sewer mains on a line which is approximately the
extension of 70th Avenue North from Palmer Lake to
France Avenue and on Drew Avenue North or its extension
from 70th Avenue North to approximately 250 feet south
of 69th p.venue North.
Said improvement shall be designated hereafter Storm Sewer Improve -
ment N 1 956 -57.
2. The plans and specifications for said improvement shall
be prepared by YAnder Engineering Company, and be submitted to
the Village Council for approval.

3. That area completely served by this improvement shall 409,
be assessed approximately $483.00 per acre and that area which
will be served by an extension of this improvement shall be
assessed for the balance of the cost'which assessment is ex-
tended at $85.00 an acre.
The motion for the adoption of the foregoing resolution was duly
seconded by member Allen Lindman, and upon vote being taken thereon, the
following voted in favor thereof: William N. Super, Clifford Wellman,
Allen Lindman, and Russ Jones; and the following voted against the same:
None; whereupon said resolution was declared duly passed and adopted.
The Mayor announced that the meeting was open for consideration of
a proposed improvement in the Village consisting of the following:
Construction of a storm sewer in the area bounded by the
following described line:
Commencing at the intersection of 64th Avenue North and Major
Avenue North; thence Easterly approximately 490 feet to the
extension of the back lot line of Block 2, Millers Northview
Heights, thence Northerly approximately 100 feet to the North
lot line of Lot 8, Block 2, Millers Northview Heights, thence
Easterly approximately 330 feet along Jet lines to the back
lot line of Block 1, Millers Northvieew Height thence
Northerly 75 feet to the North lot line of Loi 7, Block 1,
Miller's Northview Heights, thence Easterly approximately 330
feet along lot lines to the rear lot line of Block 8, Worth-
gate, thence Northerly and Easterly along the West and North
line of Lot 5, Block 8, Northgate; thence Easterly along the
North line of Lot 14, Block 9, Northgate, thence Northerly

Member Allen Lindman introduced the following resolution and moved
its adoption:
RESOLUTION AUTHORIZING AND CONFIRMING CONTRACT
FOR SANITARY SEWER WROVEMENT ND. 1956 -2
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center as follows:
1. It is hereby recited that the negotiations for the
construction of Sanitary Sewer Improvement No. 1956 -23 were
completed with Lametti and Sons, Inc. on the basis that said
Improvement be added to the existing contract for Sanitary
Sewer Improvement No. 1956 -6, 7 and 20 at the same unit
prices, and pursuant thereto said work was undertaken by
them. 7be Village Council proceedings are amended to show
that the letting of Sanitary Sever improvement 1956 -23 on
such basis is hereby ratified and approved in all respeects
said letting having been known to the Village Council but
having been inadvertently omitted from the minutes.
The motion for the adoption of the foregoing resolution was duly seconded
by member Clifford Wei lzan and upon vote being taken thereon the follow-
ing voted in fa"r tuerecf : William N. Super, Allen Linftan, H. R. Joan
and Cliffor Wellinan; and the follow:.nag voted against the same: bane;

Member F. R. Jones introduced the following resolution and moved

1. The graveling and blacktopping of the West one -half of
Halifax Avenue lying between 57 and 58 Avenues North i designated
Street Improvement No 1956 -2.
2. The village records are hereby amended to show that the
actual work thereon was carried out by day labor, the equipment
for said construction having been rented from J. W. Craig C ompany
and no construction contract having been let therefor, and the
construction of said work by day labor is hereby ratified and
approved.
The motion for the adoption of the foregoing resolution was duly seconded
by member Allen Lindman and upon vote being taken thereon the following
voted in favor thereof: William N. Super, H. R. Jones and Allen Lindman;
and the following voted against the same: None; (Clifford Wellman did
not vote and Wayne Gageby was absent:) whereupon said resolution was
declared duly passed and adopted.
Member Clifford Wellman introduced the following resolution and
moved its adoption.:
RESOLUTION ON VACATION OF DRAINAGE
EASEMENT
WZWTJS, a petition has been duly filed with the Village Council
of the Village of Brooklyn Center for the vacation of drainage
easement centered on the line dividing Lots 12 and 13, Block 1,
Pearson's Northport First Addition, and it appearing that said
petition carried the of owners of not less than 519 in
frontage of real property abutting on property, and
WHEREAS, a notice of public hearing on said proposed vacation to
be held on October 9 1956 was duly published on Se ptember 20,
1956 in the North Hennepin Post, and three copies of said notices
were posted in P
conspicuous laces within the Village, and

WHEREAS, a hearing was held on October 9, 1956 pursuant to said
notice, and no one appearing in opposition thereto,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center as follows:
1. It is deemed to be in the best interest to and the
Village Council does hereby vacate the drainage easement
described as follows:
The east 5 feet of Lot 12, Block 1 Pearson's
Northport First Addition, Hennepin County, and
the westerly 5 feet of Lot 13 Block l of said
addition excepting the most northerly 5 feet
of said easement.
2. The Village Clerk is herewith authorized to certify a
copy of this resolution and cause said resolution to be recorded
with the Register of Reds in and for Hennepin County, Minnesota..
The motion for the adoption of the foregoing resolution was duly seconded
by Russ Jones, and all present voting in favor thereof, motion carried.
Motion made by Clifford Wellman and seconded by Allen Lindman to
uphold the recommendation of the Planning Commission to accept Art
Wingard's petition to sell a tract of land by metes and bounds, the
tract of land being in Lot 21, Auditor's Subdivision No. 57. Motion
carried.

Motion made by Clifford Wellman and seconded by Allen'Lindman
to refuse the claim of Mrs. Helen Karbo, 3828 - 661 Avenue North, in
the amount of $15.00. Motion carried.
Member Allen Liindm n introduced the following resolution:

The motion for the adoption:of the foregoing resolution was duly seco d.,

against the same None; whereupon said resolution was declared duly
passed and adopted.
Member Allen Landman introduced the following, resolution and
moved its adoption:
RESOLUTION ORIXMG ADVERT` ' FOR BIDS
HE ST RESOLVED by the Village of Brooklyn Center, Khmesots as
follows:
1. The specifications for a cash register, for the Liquor Store,
are to be prepared by the Village officers and shall be filed with the
Clerk.
2. The. Clerk shall advertise for bids on a cash register in the
North Hennepin Post, the date of first publication not less than ten
(10) days prior the date for receipt of bids. Said notice shall state
that no bids will be considered unless sealed and filed and acconpoied
by a cash deposit, bid bond, cashier's check or certified check pay4ble
to the Clerk in the amount of not less than five per cent (5 %).of the
bid.

3. Bid date to be set for Novemberl3, 1956.
The motion for the adoption of the foregoing resolution was duly seconded
by Clifford Wellman, and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Allen I3ndman, Clifford WeUman, and
Russ Jones; and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.

Mr. Clifford Wellman introduced the following resolution and
moved its adoption:
RESOLUTION ACCEPTING ALTERATIVE AWARDS AND CONDITIONS THSSROF
24 CONDEMNATION PROCEEDING
BE IT RESOLVED by the Village Council of the Village of
Brooklyn Center as follows:
1. T'he alternative award made and filed in the condemn&
tion proceedings co=enced by the Village of Brooklyn Center in
District Court, File No. 521432, insofar as it relates to the
Making of an easement over property owned by John A. Hokanson
and Adeline Hokanson, is hereby accepted, the alternative
award which the Village herewith accepts reading as follows:
An easement for the laying and maintaining of water and
sanitary sewer lines which is 30 feet in width, the
westerly boundary thereof being parallel to and distant
:RO feet west of the line hereinafter described, and the
easterly boundary thereof being parallel to and distant
10 feet east of the line hereinafter described, the
aforesaid line being described as follows: Commencing
at a point in the South line of Lot 14, Auditor's Sub-
division No. 57, a distance of 162 feet East of the
Southwest Corner of said Lot 14, said South line being
the center line of 69th Avenue North; thence Northerly
330 feet parallel to the West line of said Lob 14;
thence Northeasterly in a straight line to a point on
the North line of said Lot 14 which is distant 220 feet
East of the Northwest corner of Lot 14, Hennepin County,
Minnesota. The Village shall restore the surface of
the land over said easement to the condition it was in
Prior to any opening thereof for the purpose of laying
or maintaining each water and sewer lines, and the
Village shall construct no street or roadway or public
paths upon said easement. The property owners shall
not construct any improvement over said easement.
2. In accordance with the conditions of such alternative
award, the assessments for water and sanitary sewer lines against
the property of the Hokansons, insofar as the same are attributable
to the laying of sewer and water mains over the above described
easement, are hereby abated until sudh time as the owners desire
to make connection to said sanitary sewer and water mains.
The foregoing resolution was dully seconded by member Russ jams
and upon vote being taken thereon all members voted in favor thereof.
The bills set forth on t1w schedule attached to these minutes

Motion made by Allen Lindman and seconded by Clifford Wellman
