Super, i� %T °os, at 8 .-10 o'clock P.M. The following m niuers were present: William N. Super, Clifford Wellman, Wayne Gageby, and Russ ,gin =:s. Allen Lindmar_ was absent. Motion made by Clifford Wellman and seconded by Wayne Gageby to approve the minutes of the regular meet::ng of October 9, 1976. The minutes were approved as recorded. Motion carried. The Mayor announced that the Council was met to receive, open, and consider bids for an electric calculator. An affidavit was presented showing publtation of advertisement for bids in accordance with law and ordered placed on file. The sealed bid, which had been received was then presented. The bid was opened, examined, and found to be as follows No. Name of Bidder Amount 1. Friden Calculating Machine Co.,Inc. $640.00 Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID BE IT RESOLVED by the Village Council of,-the Village of Brooklyn Center, Minnesota, that the bid of Friden Calculating Machine Co., Inc., 2392 University Avenue, St. Paul 14, Minnesota, for one electric calculator, for $640.00, is hereby found, determined, and declared to be the most favorable bid and is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman and upon vote being taken thereon the following voted in favor thereof: William N. Super, Wayne Gageby, Clifford Wellman, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Clifford Wellman introduced the following resolution and moved it-, adoption; RESOLUTION APPROVING STORM SEWER BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The construction of the storm seer improvement in Garden City Addition is hereby approved, 4pon recommendation of the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member -Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. -1- Member Clifford Wellman introduced the following resolution and moved its adoption: RESOLUTION APPROVING DETAILED PLANS AND SPECIFICATIONS AND DIRECTING ADVERTISIIWT FM BID BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The playas and specifications for Storm Sewer No. 1956 -57, prepared by the Minder Engineering Company, are hereby approved and shall be filed with the Clerk. 2. The bid opehing date set for November 13, 1956) at 8;00 o'clock P.M. 3. The Clerk shall advertise for such improvement in the North Hennepin Post and the Construction Bulletin, the date of first publication not less than ten days prior to the date for receipt of bids. Said notice shall state that no bids will be considered unless sealed and f4ed and accompanied by a cash deposit, bid bond, cashier's check yr certified check payable to the Clerk in the amount of not less than five per cent (5 %) of the bid. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gegeby, and upon vote being taken thereon, the following voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, and Russ 'ones; and the following voted against the same; None; whereupon said resolution was declared duly passed and adopted. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION APPROVING DETAILED PLANS AND SPECIFICATIONS AND DIRECTING ADVEMSENUT FOR BID BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The bid opening date set for November 13, 1956, at 8 :00 o'clock P.M. 3. Motion made by Russ Jones and seconded by Wayne Gageby to authorize an audit and physical inventory for the Village Municipal Liguore Store. This is to be done by Hanley, Zimmerman, and Moen, as of 'Becember 31, 1956• Motion carried Motion made by Russ Jones and seconded by Wayne "Ieby to authorise Hanley, Zimmerman, and Moen to prepare an annual financial statement of the Village of Brooklyn Center, as of December 31, 1956. Motion carried. Motion made by Russ Jones and seconded by Wayne Gageby to release the certified check of Homedale Builders on June Avenue North from 63rd -2 Avenue to 64th Avenue improvements, upon the recommendation of the Village Engineer, in the amoxit of $1280.00. Motion carried. Motion made by Russ Tones and seconded by Clifford Wellman to release the bonds and certified checks in the anouat of $1435.00 on Burch's 4th Addition improvements, based upon the recommendation of the Village Engineer. Motion carried. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION ESTABLISHING WORKING CONDITIONS, WAGES, AiIAD HOURS FOR PUBLIC WORKS DEPARTMENT EMPLOYEES WHEREAS, the Village Council feels that it is for the best interest of the. Village of Brooklyn Center, the Public Works Department Employees, axed their designated bargaining representative, Local 49, International onion of Operating Employees, A.F.L. - C.I.O.., for the purpose of establishing conditions of employment of the employees of the public Works Department, and to insure a friendly spirit of cooperation between the Village, its employees, and their designated bargaining representative, and to avoid disruption in the service and operation of the Public Works Department and to secure the benefits intended to be derived by the Village, its employees, and their designated bargaining representative to adopt the hereinafter set out rules and regulations governing the employment and working conditions of the employees of the Public Works Department. NOW, THEREFORE, be it hereby resolved, by the Village Council,, that the following rules and regulations covering the employment of the employees of the public Works Department be adopted and placed in effect as follows; to wit: ARTICLE I Recognition The Village agrees to recognize Local 49, International Union of Oper- ating Engineers, AFL. - CIO., as the bargaining representatives of all employees employed in the Public Works Department_. ARTICLE II Wages CLA SSIFICATIONS : January 1,1957 .ul1, Foreman $2.60 per hr. $2.75 per hr. Heavy Equipment Operator 2.40 2.55 Light Equipment Operator 2.15 2.25 ' Oublic Works Maintenance Man(Laborer) 2.00 2.05 Supervisor of Utilities 2.40 2.55 Personnel operating the following equipment shall be classified as heavy equipment operators: Patrol, rubber tired loader (over 30 horsepower), sweeper, crawler tractor, self - propelled seamen mixer. '1er3onnel. operating the following equipment shall be classified as Tight equipment operators: Trucks, tractor mowers, self - propelled rollers (under 5 ton), compressor and attachments, rubber tired loader (under 30 horsepower), distributor, broom. Personnel employed as Public Works Maintenance Man shall not operate any trucks or power driven equipment other than a pick up truck or sewer cleaning equipment, ARTICLE III Seniority A policy of seniority shall be formulated that will give employees with loxigZz perioe.s of service an opportunity for promotion and also -3- give all employees a feeling of security. In the event of a lay off due to lack of work in either of the above departments, employees with the least seniority shall be the Pi.rst to be laid off, and in the event of rehire the last employee laid off shall be the first to be rehired. In the event of a job opening within a department, the job should be announced by bulletin and the oldest employee in that department should be given opportunity to gtrp up for promotion. Employees in both departments shall not be reduced in pay scale when assigned work of a lower classification. FZployees performing work of a higher pay classification shall receive the wage scale prevailing for the higher classification. No employee shall be laid off out of turn on the seniority list. In the event of discharge the employee or his representative shall be entitled to a hearing before the Village Council. Tf it is determined that the employee has been unjustly discharged he shall be reinstated at once and all wages and other benefits lost during his time off shall be credited to him. ARTICLE IV Hours 1. The regular work day for employees shall be eight hours. P. The minimum work week, for employees shall be forty hours. 3. The average work month for employees for purposes of computing vacations, sick leave, and fractions of a month's work shall be 173 hours.. ARTICLE V Overtime I. Overtime shall be allowed and paid to any employee on the basis of one and one -half times the regular rate of pay computed on an hourly basis when overtime employment is directed by a responsible supervisor. <` 2. Overtime for an employee is defined as work beyond eight hours in any one day, forty hours in any one week and for work performed on Saturdays, Sundays, and legal holidays or days observed as legal holidays. 3. Overtime for all employees shall be paid as it is earned. 4. An employee called back to work after he has completed his regular work day or called out on his day off shall receive a minimum of two hours' pay at the overtimes rate. ARTICLE VII Ef ective Date This resolution shall be effective as of January 1, 1957• The foregoing resolution was seconded by member Russ Jones and upon vote thereon, all members voted in favor thereof. Motion made by Russ Jones and seconded by Wayne Gageby to permanently tremsfer funds frara the Liquor Store Fund to the General Fund for payment of the Village master plan to Thorshov and Cerny, and payment of the Municinal Village Hall addition. Motion carried. Motion made by Russ Jones and seconded by Clifford Wellman that the money collected from water permits to be credited to the General Fund. Motion carried. Motion made by Clifford Wellman and seconded by Russ Jones that the municipal water rates for the Yi4age of Brooklyn Center will be $7.50 minimum per one quarter or 35¢ per gallon, whichever is higher. Motion carried. Member Russ Jones moved the adoption of an ordinance entitled CHAPTER 32 - AN ORDINANCE ESTABLISHING A WATER DXPARTMEET AND MAKING PROVISION FOR THE ADMIN- ISTRATION OF THE WATER SUPPLY SYST34 IN THE V ILI AGE OF BROOKLYN CF The foregoing motion having been seconded by member Wayne Gageby, vote being taken thereon, the following voted in favor thereof: William N. Super, Wayne Gageby, Clifford Wellman, and Russ Jones, and the following voted against the same: None; whereupon said ordinance was declared duly passed and adopted. Motion made by Clifford Wellman and seconded by Russ Jones to authorize a temporary loan from the Storm Sewer #1 Fund to the Public Utilities Fund in the amount of $5000.00. This loan is to be paid back when sufficient funds provide. Motion carried. The bills set forth on the schedule attached to these minutes and made a part hereof entitled "The Bills Audited and Ordered Paid at the Meeting of October 23, 1956" were audited and ordered paid. Motion made by Wayne Gageby and seconded by Russ Jones to adjourn. Motion carried.
