HomeMy WebLinkAbout1956 11-13 CCM Regular Session Minutes of the proceeding of the Village w k- Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota, including all accounts audited by said Council _ November 13, 1956 The Village Council met in regular session and was called to order by William N. Super, Mayor, at 8:00 o'clock P.M. The following members were present; William N. Super, Clifford Wellman, Allen Lindman, Wayne Gageby, and Russ Jones. Motion made by Wayne Gageby and seconded by Allen l�indman to approve the minutes of the regular meeting of October 23, 1956 and continued meeting of October 29, 1956. The minutes were approved as recorded. Motion carried. The Mayor announced that the Council was met to receive, open, and consider bids for a cash register for the Municipal Liquor Store. An Affidavits was presented showing publication of advertisement for bids in accordance with law and ordered placed on file. The sealed bids, which had been received were then presented The bids were opened, examined, and found to be as follows: NO. Name of Bidder Amount 1 The National Cash Register Co. $2,140.00 2 Cash Register Sales, Inca 1,844.00 Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION TABLING FURTHER DICTION ON BIDS BE'IT RESOLVED by the Village Council of the Village of Brooklyn canter., Minnesota, that furtheAction on the bids received for cash register be tabled for examination by a coameittee Consisting of A. J. Lee, Dale F. Curry, James Fischbach, and William N. Super. This oommi is to check into the difference between the two machines and try to determine which machine would be best suited for the Liquor Stor* The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon, the following voted in favor thereof: William N. Super, Wayne Gagety, Allen Lindman, Clifford Wellman, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Ashbach Construction Co. 130,445.60 -1- Hatber Wayne dageby introduced the following resolution and move4 its adoption: RESOLUTION ACCEPTING BID AND APPROVING CONTRACT FM BE IT RESOLVED by the Village Council of the Tillage of Brooklyn Center, Minnesota, that the bid of Lametti & Sons, as to furnisbing all work, labor, and material in connection Wtth Storm Sewer Improvement No. 1956•57, according to the plabs and specifications therefor now on file in the office of the Visage Clerk is deeme4 y to be the lowest and best bid submitted for Mid work by a responsible bidder, and said bid is hereby accepted subject to a complete check by the Village Engineer. BE IT FURTHER RESOLVED that the form of contr . prepose4 for *"c. to , between the Village and Lametti & Sons, Inc,, Is approved, and the Mayor and Clerk are authorized hereby and directed to execute the on behalf of the Village upon the filing with the Village Clerk of a bond in the amount of $58,917.20 with an approv*4 corporate surety, conditioned for the faithful performance of said contract. The motion for the adoption of the foregoing resolution was duly seconded by member Russ Jones, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Wayne Gageby, Allen Lindman, Clifford Wellman, and Russ Jones; and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted. Motion made by Allen Lindman and seconded by Clifford Wellman to grant a license to John Burlingame to operzte a Standard Oil Station at 2119 57th Avenue ,North, subject to all restrictions of the Village ordinance regarding filling stations and all restrictions that were set up when the building permit was issued. A $300. certified check 4s to be deposited with the Village in lieu of said fence required* This check is pay for the cost of the fence and its erection, if in six aonths construc- tion is not started on the adjoining property on the West. Motion carp d. Motion made by Russ Jones and seconded by Allen Lin#man to accept the Justice of Peace reports for the months of August, Septe aber, and October, 1956. Motion carried. Motion made by Allen Lindman and seconded by Wayne Gageby that the Village accept the streets in Balfany's Northport 4th Addition, providing that the Village receive a certified check in the amount of $2,000.00 to guarantee the streets surfacing is brought up to standards. Motion carried Motion made by Wayne Gageby and seconded by Allen Lindman to uphold the recommendation of the Planning commission to grant a special permit to Chris R. Andersen for the construction of a house on a sixty -four foot lot and further recommends the approval of special permits for 3 lots immediately South of 662 Avenue North from seventy to seventy -five feet in width on the west side of Prance Avenue North. Motion made by Allen Lindman and seconded by Russ Jones to uphold the recommendation of the Planning ommission to allow Paul Cyr to sell a lot by Metea and bounds description wAh a minimum area of 9500 square feet. Motion carried. Motion made by Russ Jones to uphold the recommendation of the Planning Commission to adopt the following resolution: RESOLUTION a WHEREAS, the Village of Brooklyn Center is in the process of preparing a comprehensive plan to guide the future growth of the community; and WHEREAS, the comprehensive plan cannot be constructed until a tentative route is established for the proposed freeway passing through Brooklyn Center; and •2- i WHEREAS, the Planning Coxamission and the Planning Consultants have analyzed alternative freeway routes; BE IT THEREFORE RESOLVED that the following actions be recommended to the Village Council: 1. Village officials should meet with representatives of the State Highway Department as sal: as possible in order to reach an agreement on a tentative routing of the proposed freeway through Brooklyn Center. 2. The Village should recommend to the State Highway Department that the freeway be routed next to the river up to Highways #100; then as it extends North and West, be routed to the North of Palmer Lake, in the vicinity of the border between Brooklyn Center and Brooklyn Park. Such a route would be less costly, would displace fewer families, and would be least disruptive to existing neighborhoods 8nd the community as a whole. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon, the following voted in favor thereof: William N. Super, Allen Lindman, Clifford Wellman, Wayne Gageby, and Russ Jones; and the following members voted against the san*: Nome; whereupon said resolution was declared duly passed and adopted. Member Wayne Gageby made a notion which was seconded by Allen Lindman approving the appointment heretofore made of the following as judges and clerks of the Village Election being held December 4, 1956. Motion made by Russ Jones and seconded by Allen Lindman that the Village allow a refund of $52.85 to Northwestern Federal Savings and Loan Association of Minneapolis for special a.ssewments, providing this amount goes on the tax roll. Motion carried. Motion made by Wayne Gageby ead seconded by Allen Lindman that the Village allow the Brooklyn Center Baptist Church to connect their sump up to the Village storm sewer. The Village will assume no responsibility in case of damage or water back up. The Village is to receive a letter from the Church to this effect before permission is granted. Motion carried. Motion made by Wayne Gageby and seconded by Russ Jones to accept the resignation of Aldor Johnson as Justice of Peace as of December 31,1956. Motion carried. Motion made by Allen Lindman and seconded by Wayne Gageby that the Village reduce the street bond of Homedale Builders from $5416.40 to $3,000.00. Retroactive to November 6, 1956, all polling places, other than public buildings, are to receive $25.00 rental for presidential elections and $15.00 for all other elections. Motion carried. Motion made by Russ Jones and seconded by Allen Lindman that the Village pay roll system be changed to a peg board system as of January 1, 1957• Motion carried. Motion made by Russ Jones and seconded by Wayne Gageby that the Village combine 1956 -A and 1956 -C Sinking Fund, as of Ogtober 1, 1956• All principal and interest payments for 1956 -A and 1956 -C bonds will be made from this one Sinking Fund. Motion carried. Motion made by Wayne Gageby and seconded by Russ Jones to allow Civil Defense $100. for training purposes. Motion carried. Motion made by Russ Jones and seconded by Allen Lindban that the Village accept the streets and release street bond on Wangstad's Brooklyn Terrace 1st Addition, based upon the recommendation of the Village Engineer. Motion carried. Motion made by Allen Lindman and seconded by Wayne Gageby that the Village accept Sanitary Sewer Improvement No. 1956 -21. Motion carried. Motion made by Russ Jones and seconded by Allen Lindman that the Village accept Storm Sewer Improvement Not 1956 -13. Motion carried. Motion made by Wayne Gageby and seconded by Allen Lindman that the Village accept Sanitary Sewer Improvement 1956 -53 and Water Main Improvement 1956 -54. Motion carried. Moton made by Russ Jones and seconded by Wayne Gageby that the Village distribute interest from Investment Trust Fund to various funds participating on the weighted average basis. Motion carrie4. Motion made by Allen Lindman and seconded by Russ Jones that the weight limit on 57th Avenue North be set at five ton per axle weight. Signs to be posted to this effect, Motion carried.
