Super, Mayor, at 8 :10 P.M. The following membev were present: William N. Super, Clifford Wellne►n, Allen Lindman, Wayne Gageby, and Russ Jones. Motion made by Wayne Gageby and seconded by Clifford Wellman to approve the minutes of the regular session of November 27, 1956, the 9ittut*6 of the Canvassing Board of December 5, 1956, and the special meeting of December 5, 1956. The minutes were approved as recorded. Motion carried. Motion made by Wayne Gageby and seconded by Allen Lindman that the Council uphold the recommendation of the Planning Commission and approve the proposed plat of Joe Miller's and others. Motion carried. MAtion made by Allen Lindman and seconded by Clifford Wellman that the Council upho'b the recommendation of the Planning Commission and approve tb* special permit to the Ericon Corporation for the construction of a Reed Owl Stare on Lot 1, Rydeen's lot Addition, with the stipulation that a four foot chain link fence be erected on the South line of the property. Motion carried. Motion made by Wayne Gageby and seconded by Clifford Wellman that the Village Council and the Village Planning Commission go on record as not being in accord with the proposed route of the freeway as shown tonight by Mr. McCubrey, as we feel that it threatens our economic stability. Motion made by Clifford Wellman and seconded by Russ Jones that Mr, McCubrey convey the reflection of the Village Council, Planning Comtmisdon and Mr. Sherman Hasbrouck.. who is associated with Thorshov & Cerny, Inc., our feelings relative to the proposed route of the freeway and matters we feel are important in the solution of the problem. Motion carried. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Hennepin County, )Innesota, that the Village Council hereby petitions the Board of County Commissioners for Hennepin County, pursuant to Chapter 806, Laws of Minnesota 1955, to activate a park district consisting of all the County of Hennepin except that portion lying within the boundaries'of the City of Minneapolis. The 40t Um for the adoption of the foregoing resolution was duly seconded by member Russ Jones and upon vote being taken thereon the following voted in f%vor thereof: William N. Super, Allen Lindman, Wayne Gageby, Clifford Wollmon, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION BE IT R M LVED that the Village Council of the Village of Brooklyn Center support in principle the changes in Chapter 806 Laws of Minnesota, 1955 as set forth in the proposed bill as follows: I A BILL " FOR AN ACT REDUCING THE REGULATORY POWERS OF COUNTY AND MULTI- �C00NTY PARK BOARDS OVER LAKES; AMENDING CHAPTER 806, LAWS OF MINNESOTA 1955• BE IT ENACTED BY THE LEGISLATUR£' THE STATE OF MIiEL90TA Section 1, Section 9a, Chapter 806, Laws of Minnesota 1955, is hereby amended as follows: (a) The power to regulate by ordinance (1) the use of the waters of any lake lying wholly within a park established under this act and acts amendatory thereof by all persons, including persons boating, swimming, fishing, skating or otherwise in, upon or about said lake; and (2) the use of any lake shore which is within a park established under this act and acts amendatory thereof and the waterfront abutting such lake- shore by all persons including persons boating, swimming, fishing, skating or otherwise in, upon or about said Lakeshore and abutting waterfront, subject to the regulation of regulatory bodies the State of Minnesota. The motion for the adoption of the foregoing resolution was duly seconded by member Russ Jones and upon vote being taken thereon the following voted in favor thereof: William N. Super, Allen Lindman, Wayne Gegeby, Clifford Wellman, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion made by Wayne Gageby and seconded by Allen Lindman to accept the petitions of Frank Waite for sanitary sewer and water o on Quail Avenue North from 63rd Avenue then East to Perry Avenue then North on Perry to 63rd Avenue. Estimates to be drawn up and date of public hearing to be set later.. Motion carried. Member Russ Jones introduced the following resolution and moved its adoption; e RESOLUTION BE IT RESOLVED, that all that part of State Aid Road No. 10 within the limits of Brooklyn Center from Trunk Highway No. 152 in the East 1/2 of Section 3, Townshi� 118 North, Range 21 West to Trunk Highway No. 169 in the East 1J2 of Section 1, Township 118 North, Range 21 West, be rescinded as a State Aid or County Road. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman and upon being vote being taken thereon the following voted in favor thereof: William N. Super, Allen Lindman, Clifford Wellman, Wayne Gageby, and Russ Jones; and the following voted against the sans': None; whereupon said resolution was declared duly passed and adopted. Motion made by Russ Jones and seconded by Wayne Gageby that the Village accept the Justice of Peace report of John Wingard for November. Motion carried. Motion made by Wayne Gageby and seconded by Allen Lindman that we set April 15, 1957 as deadline to accept improvement petitions and that a concerned to be notified. Motion carried. Motion made by Allen Lindman and seconded by Russ Jones that the Council authorize the transfering of the following funds: Storm Sewer #1 - $5500.00 to the following accounts: 1953 -A $24O0.0o 1953 -B $2900.00 1954 -A 200.00 Fund #1956 -B - $600. to the following accounts. 1954 -A $ 200.00 195 -C 400.00 to sake priecipal aad iaterest payments due and psyablo jea ary 1. 57 yb This is due to the taet lAtt current ea,sh balances are invested in U S. 6ov�ernaent securities through the Investment Trust Fund except for 1954 -C, which has no invested monies. Motion carried. The bills set forth on the schedule attached to these minutes and made a part hereof entitled "Tbe Bills Audited and Ordered Paid at the Meeting of December 1#, 1956 were audited and ordored paid. Motion made by Clifford Wellman and seconded by Wayns Gsgeby to adjourn.
