HomeMy WebLinkAbout1957 04-02 CCM Special Session Minutes of the proceeding of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota April 2, 1957 The Village Council met in special session.and was called to order by William N. Super, Mayor, at 8 :00 p.m. The following members were present: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones. Motion made by Wayne Gageby and seconded by Carl Carlson to approve the minutes of the special meeting of March 19, 1957 The minutes were approved as recorded.. Motion carried. Motion made by Clifford Wellman and seconded by Wayne Gageby that the'Village Council hire Clarence Canfield as Plumbing and Heating Inspector at $80 per week and mileage of 6¢ per mile. Motion carried. Motion made by Wayne Gageby and seconded by Clifford Wellman that the Village accept the following petitions for sanitary sewer. Halifax Drive from 63rd Avenue North to Grimes Avenue North and Grimes Avenue North from 63rd to Halifax Drive; June Avenue North from 58th Avenue North to the South line of Pearson's Northport 3rd Addition; 410 feet of Kyle Avenue North north of 61st Avenue North. Date of public hearings to be set later. Motion carried. Motion made by Clifford Wellman and seconded by Carl Carlson that the Village accept the quit claim deed of Claus H. Johnson and Sons, Inc. for aneasement for street purposes in and to the following described property: The' West Thirty (30) feet of the West one -half (WJ) of the Northwest Quarter of the Southwest Quarter of Section 34, Township 119, Range 21, as measured along the North and South lines of said Northwest Quarter of the Southwest Quarter being a part of,Lot Nine (9), Auditor's Subdivision Number 25, except the South 256'_ thereof,',Hennepin County, Minnesota. Motion carried. Mdion made by Carl Carlson and seconded by Wayne Gageby to accept the petition for oil stabilizing on East Twin Lake Blvd south of Oak Street. Date of public hearing to be set later. Motion carried. Motion made by Wayne Gageby and seconded by Russ Jones that the Village release the bond of Raleigh H. Lonnes and St. Paul Fire and amine Insurance Co., as surety as of April 2, 1957• Motion carried. Motion made by Russ Jones and seconded by Wayne Gageby that the Village Council approve the application of Frank P. Surma for plumber's license for 1957 and 1958. Motion carried. Motion made by Clifford Wellman and seconded by Wayne Gageby that the Village approve the application of Roy Bergstrom for garbage and rubbish hauling license; subject to receiving bond. Motion carried. Member Clifford Wellman introduced the following ordinance and moved its adoption AN ORDINANCE AMENDING TER ORDINANCE REGULATING COLLECTION AND DISPOSAL OF GARBAGE AND RUBBISH TO PROVIDE SEPARATi LICENSES TO COLLECT AND DISPOSE OF RUBBISH ONLY THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN: Section 1. Chapter 7 of the Village Ordinances is hereby amended by�adding thereto the following new section: -1- " Section 7- 108.1 SEPARATE LICENSE FOR RUBBISH HAULERS. Separate licenses may be issued authorizing the collection and disposal of rubbish only. Application for aid issuance of such licenses shall be in accordance with the trovisions of Section 7 -108 of this Ordinance." Section 2. This ordinance shall be effective from and after its passage and publication. The motion for the adoption of the foregoing ordinance was duly seconded by member Wayne Gageby, and upon vote being taken thereon, the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same; None; whereupon said ordinance was declared duly passed and adopted. Motion made by Wayne Gageby and seconded by Russ Jones that the Village abate the assessment taxes for water on Lot 5, Block 2, Westview Addition. Motion carried. Motion made by Wayne Gageby and seconded by Clifford Wellman that the Village Council approve the final plat of Bergstrom's Lynside Manor; subject to all restrictions of the platting ordinance and bond to be posted. Motion carried. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR THE ISSUANCE AND SALE OF $430,000 INPROV3+M BONDS WHEREAS, the village council has entered into contracts for the construction of Storm Sever Improvement Nos. 1956 -57, 1956 -58 and 1957 -9, Sanitary Sewer Improvement Nos. 1957 -4, 1957 -5, 1957 -6, 1957 -71 1957 -8 1957 -10, 1957 -12, 1957 -14 and 1957 -17, and Water Main Improvement Nos. 1957 -1, 1957 -2, 1957 -11 and 1957 -15, all under the provisions of Chapter 398, Laws of Minnesota 1953, as amended, NOW, THEREFORE BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The Clerk shall forthwith calculate th+e proper amount to be spgcially assessed for the improvements against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, based upon the benefits received. 3. It is hereby determined to finance the entire cost of said improvements by the issuance of improvement bondsr 4. There is hereby created a special fund to be designated as Improvement Tor 1$57 -A Fund out ct which shall be paid the cost of the said ,4*ovements and the principal` and interest on the Improvement Bonds authorized hereunder and into which shall be paid all of toe proceeds of the special assessments and taxes to be levied for said improvement and the moneys received from the sale of Improvement Bonds. 5. In anticipation of the collection of said special assessments and t4xes, the villageishall forthwith issue, and sell $430,000 Improvement Bonds. The full faith and credit of the villagd s` ll be pledged for the payment of the principal aid int rest on the bonds when theimoneys on hand in the Improveme No. 1957 -A Fund are insufficient for the purpose. 6. The Improvement Bonds shall be 430 in number and numbered 1 to 430, both inelusi *e, in the denominationiof $1000 each, shall bear date April 1, 19571 shall bear interest payable July 1, 1958, and semiannually thereafter on January I and July 1 in each year. Said bonds shall mature serially on January 1 in the years and amounts as follows: $30,000 January 1, 1959 $30,000 January 1, 1960 $30 January 1 1961 $30,000 January 1 1962 $30,000 January 1 1963 $30,000 January 1, 1964 $25,000 January 1 1965 $25,000 January 1, 1966 $25,000 January 1, 1967 $25,000 January 1, 1968 $15,000 January 1, 1969 $15 January 1, 1970 $15,000 January 1, 1971 $15,000 January 1, 1972 $15,000 January 1, 1973 $15,000 January 1, 197+ $15,000 January 1, 1975 $15,000 January 1, 1976 $15,000 January 1, 1977 $15,000 January 1, 1978 All bonds maturing on January 1,. 1969 and thereafter are subject to redemption in inverse numerical order on January 1, 1963 or any interest payment date thereafter upon payment as follows: (1) if redeemed prior to January 1, 1968, at par plus accrued interest plus a premium of $39.00 for each bond redeemed. (2) if redeemed on January 1, 1968 or thereafter, at par plus accrued interest only. The full faith and credit of the Village will be pledged to payment of the bonds. 7. The village council shall meet at the village hall in the village on Tuesday, the 30th day of April, 1957, at eight o'clock p.m., for the purpose of receiving sealed bids for the purchase of -3- r- said bonds and the village clerk is authorited and directed to cause notice of the sale of said bonds to be given by publication ten days in Commercial West, a financial paper published in Minneapolis, Minnesota. Said notice shall recite that the village will furnish printed bonds and approving legal opinion of Messrs. Faegre & Benson, Minneapolis, Minnesota, both without expense to the purchaser, shall require that all bins be unconditional and accompanied by a good tth check in the amount of at least $8,000.00 and shall specify one or more interest rates in multiples of one -tenth or one - quarter of one percent. Said notice shall further provide that delivery of the bonds will be made by the village within forty days after the date of sale at the office of the village clerk or, at the option of the purchaser, at Minneapolis or St. Paul without expense to the purchaser. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William Super, Carl Carlson, Wayne Gageby, Clifford Wellman, and H. R. Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion made by Clifford Wellman and seconded by Wayne Gageby to adjourn.
