HomeMy WebLinkAbout1957 04-09 CCM Regular Session Minutes of the proceeding of the Village - Council of the Village of Brooklyn Center 1 in the County of Hennepin and State of Minnesota, including all accounts audited t by said Council April 9, 1957 The Village Council met in regular session and was called to order by William N. Super, Mayor, at $:00 o'clock p.m. Roll Call.; William N. Super, Carl Carlson, Clifford Wellman, Wayne Gageby, and Russ Jones were present. Motion made by Wayne Gageby and seconded by Clifford Wellman to approve the minutes of the regular meeting of tUrah 4 1957, as recorded and corrected. Motion carried. Motion made by Wayne Gageby and seconded by Clifford Wellman to uphold the recommendation of the Planning Commission and approve the proposed plat of J. R. Murphey with a minimum set back of 301; subject to all restrictions of the platting ordinance. Motion carried. Motion made by Russ Jones and seconded by Wayne Gageby to uphold the recommendation of the Planning Commission and deny a special permit to Harlan Kemper to construct and operate a garage on Lot 6, Block 2, Lane's Brooklyn Center Addition, for lack of information. Motion carried. Motion made by Carl Carlson and seconded by Wayne Gageby to uphold the recommendation of the Planning Commission and approve the proposed plat of Frank Burch's Grandview Manor 2nd Addition , subject ect to all restrictions of the platting ordinance. Motion caried. a Gageby Motion made by Clifford Wellman and seconded by Wa yn Gag y that the Village Council accept the metes and bounds division of Lot 6, Auditor's Subdivision #216 into a 75' lot and a 96.4' lot facing on June Avenue North, being understood that the division be as indicated by Cartwright- Olson's survey of May 13, 1953. Motion carried. Motion made by Clifford Wellman and seconded by Russ Jones that the Village Council authorize the Village Attorney to check to see what funds are available from the County or State for the purpose of weed control of Twin Lake and to determine the authority of the Village Council to make appropriations for weed control. Mr. Qualey indicated that if the County is asked for appropriations for weed control, the Twin Lake Improvement Association did not want the weed control appropriations to interfere with any portion of aid they might get for lake level control. Motion carried. Member Wayne Gageby introduced the following resolution, based upon the recommendations of the Village Engineer, and moved its adoption: RESOLUTION ACCEPTING BID BE IT RESOLVED by the Village Council of the Village of Wooklyn_ Center, Minnesota, that the bid of Ruffridge- Johnson Equipment Co.,, Inc., as to the furnishing of distributor, as to specifications plus cab air controls and air compressor, for $5223.00, is deemed to be the lowest and best bid submitted by a responsible bidder, and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Russ Jones and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Clifford Wellman, Wayne Gageby, and Ri:iss Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Clifford Wellman introduced the following resolution, based upon the recommendation of the Village Engineer, and moved its adoption: RESOLUTION ACCEPTI14 BID BE IT RESOLVED by the Village Council of *the Village of Brooklyn Center, Minnesota, that the bid of Pioneer G.M.C. Trucks, Inc., as to the furnishing of a truck with snow plow,as to specifications with a Dunn body with Wausau Plow, for $6,051.02, is deemed to be the best bid submitted by a responsible bidder, and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby and upon vote being taken thereon, the following voted in favor thereof: William N. Super, Carl Carlson, Clifford Wellman, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion made by Russ Jones and seconded by Wayne Gageby to designate as Chapter 10 of the village ordinances the ordinance adopted by the Village of Brooklyn Center on January 22, 1957 entitled "AN ORDINANCE AUTHORIZING INVEST - MENT OF CERTAIN MONEYS IN UNITED STATES SECURITIES" and to identify the five sec;,ions of that ordinance as follows: Section 10 -101, Section 10 -102, Section 0- - 1 l0 Section 3, S on 10 104, and Section 10 -105. This ordinance had previously been incorrectly identified as Chapter 36. Motion carried. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR SANITARY SEWER IMPROVEMENT NO. 1957 -17 BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The plans and specifications for Sanitary Sewer Improvement No. 1957 -17 prepared by A. J. Lee, Engineer, are hereby approved and ordered filed with the Clerk. 2. The construction for said improvement is to be added to the existing eontract with Lyon's Construction Co. for construction of Sanitary Sewer 1957 -6, 7, 8, and 10. Said work to be performed at the same unit prices as now in force in said contract. The amount of the addition being $3312.00. The motion for the adoption of the foregoing resolution was duly seconded by member Russ Jones, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Clifford Wellman introduced the following resolution and moved its adoption: RESOLUTION APPROVING PLANS AND SPECIFICATIONS l i FOR SANITARY SEWER Il PROVEMENT NO. 1957-20 BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The plans and specifications for Sanitary Sewer Improvement-No. 1957 -20 prepared by A. J. Lee, Engineer, are hereby approved and ordered filed with the Clerk. 2. The Construction for said improvement is to be added to the existing contract with Lyon's Construction Co. for construction of Sanitary Sewer 1957 -6, 7, 8, and 10. Said work to be performed at the same unit prices as now in force in said contract. The amount of the addition being $3,450.00 The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Member Russ Jones introduced the following resolution and moved its adoption: Y RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED SANITARY SEWER IMPROVEMENT NO. 1957 -21 WHEREAS, it is proposed that there be constructed an improvement consisting of the following: Construction of sanitary sewer on 73rd Avenue North from France Avenue North to West Palmer Lak( Drive., 72nd Avenue North from France Avenue North to West Palmer Lake Drive, Violet Drive from Ewing Avenue North to Whst Palmer Lake Drive, Urban Avenue from Drew Avenue North to West Palmer Lake Drive, and West Palmer Lake Drive fx:�rn 59th Avenue North to 73rd Avenue North. WHMEAS, the village engineer has made a prellrinary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $80,000.00, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed unt'er authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Tuesday, the 30th day of April, 1957, at 8:00 o'clock P.M., and the clerk shall publisr notice of the time and place of hearing by two weeks' p::bl in the official newspaper of the village. 3. The area proposed to be assessed for said improvement is as follows: All lots and parcels of land abutting thereon. This proposed improvement shall be designated Sanitary Sewer Improvement No. 1957-21. The motion for the adoption of the foregoing resolution was duly seconded by mcmbar Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED WATER MAIN IMPROVEMENT NO. 1957 -22 WHEREAS, it is proposed that there be constructed an improvement consisting of the following: Construction of water main on 73rd Avenue North from France Avenue North to West Palmer Lake Drive, 72nd Avenue North from France Avenue North to West Palmer Lake Drive, Violet Drive from Ewing Avenue North to West Palmer Lake Drive, Urban Avenue North from Drew Avenue North to West Palmer Lake Drive, and West Palmer Lake Drive from 69th Avenue North to 73rd Avenue North. WHEREAS, the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $63,700.00, -3- NOW, THERWORE, BE' -IT RESOLVN by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Tuesday, the 30th day of April, 1957, at 8:00 o'clock P.M., and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the village. 3. The area proposed to be assessed for said improvement is as follows: All lots and parcels of land abutting thereon. This proposed improvement shall be designated Water Main Improvement No. 1957 -22. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED SANITARY SEWER IMPROVEMENT NO. 1957 -23 WHEREAS, it is proposed that there be constructed an improvement consisting of the following: Construction of Sanitary Sewer on Beard Avenue North from 69th Avenue North to Thurber, Abbott Avenue North from 68th Avenue North to 69th Avenue North, and on 68th Avenue North from Beard Avenue North to Abbott Avenue North. WHEREAS, the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of 21 300.00 , , NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Tuesday, the 30th day'of April, 1957, at 8 :00 o'clock P.M., and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the village. Super, Carl Carlson, Clifford Wellman, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. _k_ Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED WATER MAIN IMPROVEMENT NO. 1957 -24 WHEREAS, it is proposed that there be constructed an improvement consisting of the following: Construction of Water Main on Beard Avenue North from 69th Avenue North to Thurber, Abbott Avenue North from 68th Avenue North to 69th Avenue North, and on 68th Avenue North from Beard Avenue North to Abbott Avenue North. WHEREAS, the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $20,830.00, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: I. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Tuesday, the 30th day of April, 1957, at 8 :00 o'clock P.M., and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the village. 3• The area proposed to be assessed for said improvement is as follows: All lots and parcels of land abutting thereon. 4. This proposed improvement shall be designated Water Main Improvement No. 1957 -24. -The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Ga.geby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC BARING ON PROPOSED SED - Q SANITARY SEWER IMPROVEMENT N0. 1957 2 5 WHEREAS, it is proposed that there be constructed an improvement consisting of the following: Construction of sanitary sewer 410' North of 61st Avenue North on Foyle Avenue North. WHEREAS, the village engineer has made a preliminary report advising that said ro osed improvement i p. p s feasible d an that it can be constructed at an estimated cost of 6 00.00 $7 , NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Tuesday, the 30th day of April, 1957, at 8 :00 o'clock P.M., and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the village. -5- 3. The area proposed to be assessed for said improvement is as follows: All lots and parcels of land abutting thereon. 4. This proposed improvement shall be designated Sanitary Sewer Improvement No. 1957 -25• The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted is favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passedand adopted. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED SANITARY SBWSR IMPROVOWT NO. 1957 -26 WHEREAS, it is proposed that there be constructed an improvement consisting of the following: Construction of Sanitary sewer on Halifax Drive from 63rd Avenue North to Grimes Avenue North and Grimes Avenue North from 63rd Avenue North to Halifax Drive. WHEREAS, the village engineer has made a preliminary report 'advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $12,220.00, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Tuesday, the 30th day of April, 1957, at 8:00 o'clock P.M., and the clerk shall publish notice Of the time and place of hearing by two weeks' publication in the official newspaper of the village. 3. The area proposed to be assessed for said improvement is as follows: All lots and parcels of land abutting thereon. 4. This proposed improvement shall be designated Sanitary Sewer Improvement No. 1957 -26. WHEREAS, the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $140,000.00, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village -of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. Soper, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED LIFT STATION AND OUT FALL LINE IMPROVEMENT NO. 1957 -29 WHEREAS, it is proposed that there be constructed an improvement consisting of the following: Construction of Lift Station and Out Fall Line located in Palmer Lake Terrace 2nd Addition. WHEREAS, the village engineer has made a preliminary report advising tht said proposed improvement is feasible and that it can be constructed at an estimated cost of $24,250.00, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the 'Village Hall in the village on Tuesday, the 30th day of April, 1957, at 8 :00 o'clock P.M., and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the village. 3• The area proposed to be assessed for said improvement is as follows: The area included within the following boundaries: On the West and North by the Village Limits On the East by the west edge of Palmer Lake and Shingle Creek; On the South by Highway 100, 50th Avenue as extended and the- Soo Line tracks. 4. This proposed improvement shall be designated Lift Station and Out Fall Line Improvement No. 1957 -29• The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon Said resolution was declared duly passed and adopted. Motion made by Wayne Gageby and seconded by Russ Jones that the Village Accept the petition for oil stabilizing on Lee Avenue North from 63rd to 65th Avenue North. Date of hearing to be set later. Motion carried. Motion made by Russ Jones and seconded by Carl Carlson that the Village accept the petition for the East Main Sanitary Sewer Interceptor. Date of public hearing to be set later. Motion carried. Motion made by Clifford Wellman and seconded by Russ Jones that the Village accept the deeds from T. b S. Realty, Hipp's Construction, and A. J. Spander's Co., for street purposes on Camden Avenue from 65th Avenue North to Lilac Drive; subject to approval by the Village attorney. Motion carried. /and Lilac Drive east of Camden Avenue. Motion made by Clifford Wellman and seconded by Russ Jonas that the Village accept the petition for oil stabilizing on Camden Avenue from 65th Avenue North to Lilac Drive Date of public hearing to be set later. Motion carried. and Lilac Drive East of Camden Ave. -8- Motion made by Clifford Wellman and seconded by Carl Carlson that the Village Council hire William Klatte and Derry Wood as police patrolman at a salary of $75.00 per week; subject to a physical examination. The new patrolman are to start as soon as they have passed a satisfactory examination. Motion carried. The bills set forth on the schedule attached to these minutes and made a part hereof entitled "The Bills Audited and Ordered Paid at the Meeting of April 9, 1957" were audited aM ordered paid.
