HomeMy WebLinkAbout1957 04-30 CCM Special Session rn Minutes of the proceeding of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota April 30, 1957 The Village Council met in special session and was called to order by William N.,'Super, Mayor, at 8 :05 P.M. 8 C all: William N. Super, Carl Carlson.. Wayne Gageby, and Russ 'ones were present and Clifford Wellman was absent. Motion made by Carl Carlson and seconded by Russ Jones to approve the minutes of the special meeting of April 16, 1957. The minutes were approved as recorded. Motion carried. Motion made by Carl Carlson and seconded by Russ Jones to approve the minutes of the regular meeting of April 23, 1957. The minutes were approved as read. Motion carried. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1957 -21. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on April 25, 1957, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER IMPROVEMENT NO. 1957 -21 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed: Sanitary Sewer on 73rd Avenue North from France Avenue North to West Palmer Lake Drive, 72nd Avenue North from France to West Palmer Lake Drive, a Violet Drive from Ewin g Avenue North to West s t P lmer Lake Drive, Urban Avenue North from Drew Avenue North to West Palmer Lake Drive, and West Palmer Lake Drive from 69th Avenue Forth to 73rd Avenue North. 2. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed: Water Mein on 73rd Avenue North from France Avenue North to West Palmer Lake Drive, 72nd Avenue North from France Avenue North to West Parr Lake Drive, Violet Drive from Ewing Avenue North to West Palmer Lake Drive, Urban Avenue North from Avenue North to West Palmer Lake Drive, and West Paper Lake Drive from 69th Avenue North to 73rd Avenue North. 2. The plain and specifications for said impr ovement shall be prepared by Minder Engineering Co., Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted is favor thereof: William N. Super, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ORDERIM CONSTRUCTION OF LIFT STATION & OUT FALL LINE IMPROVEMENT NO. 1957 -29 AND ORDE RING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: I. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed: _2_ Construction of Lift Station and Out Fall tine located in Palmer Lake Terrace 2nd Addition. 2. The plans and specifications for said improvement shall be prepared by Minder Engineering Co., Inc., Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof William N. Super, Carl Carlson, Wayne Gageby, and Russ Jones; and.the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. After consideration of the Lift Station and Out Fall Line Improvement No. 1957 -29, the Council was of the opinion that the benefit from this improvement was confined to that area ?hick was being serviced by Sanitary Sewer Improvement No. 1957-21 and 1957 -23 (such areas lying within the area set forth in the Notice of Hearing for said Improvement No. 1957-29) and recommended Engineer proceed accordingly when the d that the 957 y 9) Ens p g assessment rolls are made up. The Engineer was directed to notify the persons owning .property within the area benefited by Sanitary Sewer Improvement No. 1957 -21 and 1957 -23 of the Council's opinion with reference to the assessment of benefits for Lift Station and Out Fall Line Improvement No. 1957 -29. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1957 -23- The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on April 25, 1957, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. It is hereby determined that it is necessary and for the best interests of the village and the ewers of property.specially benefited thereby that the following Improvement stall be constructed: Sanitary Sewer on Beard Avenue North from 69th Avenue North to Thurber Avenue North, Abbott Avenue North from 68th Avenue North to 69th Avenue North; and 68th Avenue North from Beard Avenue North to Abbott Avenue Xortb. 2. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. It is hereby determined that It is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed: Water Mein on Beard Avenue North from 69th Avenue North to Thurber, Abbott Avenue ;North from 68th Avenue North to 69th Avenue North and on 68th Avennie North from Beard Avenue North to Abbott Avenue North. 2. The plans and specifications for said improvement shall be prepared by Minder Engineering Co., Inc., Engineer. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed: Sanitary Sewer 410 of Kyle Avenue North North of 61st Avenue North. 2. The plans and specifications for said improvement shall be prepared by A. J. Lee, Village Engineer., The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1957 -26. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on April 25, 1957, which affidavit was examined and found satisfactory and ordered placed on file. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER DWROVEI4EP1r' NO. 1957 - AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed: Construction of Sanitary Sewer on Halifax Drive from 63rd Avenue North to Grimes Avenue North and Grimes Avenue North from 63rd Avenue North to Halifax Drive. 2. The plans and specifications for said improvement shall prepared by Minder Sagineering Co., Inc., Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in William N. Super, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. After hearing and r J eonsidering all objeetions, and the property owners appearing in favor of said improvement, member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER IMPROVEMENT NO. 1957 -27 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed: Construction of Sanitary Sewer on June Avenue North from 58th Avenue North to 171' North of the South line of Pearson's Northport 3rd Addition. 2. The plans and specifications for said improvement shall be prepared by Minder Engineering Co., Inc., Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Elevated Water Tank Improvement No,. 1957 -28. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF ELEVATED WATER TANK IMPROVEMENT NO 1957-28 9 5 7 AND ORDERING PREPARATION OF FLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed: Construction of an elevated water tank located at 69th Avenue North and France Avenue North. 2. The plans and specifications for said improvement shall be prepared by A. J. Member Russ Jones introduced the following ordinance and moved its adoption: AN ORDINANCE REGULATING THE PRESENCE OF MINORS UNDER THE AGE OF EIGHTEEN YEARS ON PUBLIC STREETS AND OTHER PLACES BETWEEN CERTAIN HOURS, AND DEFINING, DUTIES OF PARENTS AND OTHERS IN CARE OF MINORS a copy of which is attached hereto, and moved its adoption. The motion for the adoption of the foregoing ordinance was duly seconded by member Carl g � Carlso -i, entO upon vote being taken thereon the foll.cwing voted in favor therect: William N. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED SANITARY SEWER DWROVEMENT NO. 1957 - WHEREAS, it is proposed that there be constructed an improvement consisting of the following: -8- 1 Construction of sanitary setter on France Avenue from 53rd Place to 53rd Avenue North, on 53rd Avenue North from France Avenue North to Ewing Avenue North, and on Ewing Avenue North from 53rd Avenue North to 50th Avenue. WHEREAS, the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $28,000.00, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Northport School in the village on Tuesday, the 21st day of May, 1957, at 8 :00 o'clock P.M., and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the village. 3• The area proposed to be assessed for said improvement is as follows: All lots and parcels of land abutting thereon. 4. This proposed improvement shall be designated Sanitary Sewer Improvement No. 1957 -30. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same : None; whereupon said resolution was declared duly passed and adopted. The council proposes to proceed under authority granted by Chapter 39$, Law of Minnesota, 1953, as amended. 2. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION Whereas, at application for a charter for Community Savings and Loan Association has been filed with the Securities ,Commission of the State of Minnesota by residents of Robbinsdale, Crystal and New Hope, and Whereas, the City of Robbinsdale and the Villages of Crystal, Golden Valley, Brooklyn Center, New Hope, Plymouth, Brooklyn Park, and Maple Grove do not have a Savings and Loan Association nor any other financial institution that invests its 'deposits primarily in home mortgages, nor is there any such lending insitution in North Minneapolis, and WHEREAS, there is a real need for a lending inditution of this nature in this area and to serve as a depository of funds, Now Therefore, be it resolved that this council acting in its capacity as the governing body of this municipality go on record as favoring the granting of a charter to the Community Savings and Loan Association and as an endorsement of the need for this service im, this area. fhe Motion for the adoption of the foregoing resolution was duly seconded by hember'Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Kaybr 07 -c� k •11- AN ORDINANCE REGULATING THE PRESENCE OF MINORS' N ` UNDER THE AGE OF EIGHTEEN YEARS ON PUBLIC STREETS AND OTHER PLACES BETWEEN CERTAIN FOURS, AND DEFINING DUTIES OF PARENTS AND OTHERS IN CARE OF MINORS THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN: " Curfew " Section 19 -301 UNLAWFUL ACTIVITY OF MINORS UNDER THE AGE OF 14 YEARS. It shall be unlawful for any person under the age of 14 years to be on or present upon any public street, avenue, park, playground, or place open to the public, or place of amusement and entertainment, vacant lot, or other unsupervised place in the Village of Brooklyn Center between the hours of 9 :30 p.m. of any day and 5 o'clock a.m. of the following day; provided, however, that the provisions of this section shall not apply to any such minor person who is accompanied by his or her parent, guardian or other adult person having the authorized care and custody of such minor person, or when such minor person is upon an emergency errand or legitimate business directed by his or her parent, guardian or adult person having authorized care and custody of such minor person. The .fact that such minor person, unaccompanied by parent or other adult person having authorized care and custody of such minor person is found upon or in any such place within the Village after said 9:30 p.m. and before said 5 a.m. shall be prima facie evidence that said minor person is there unlawfully. Section 19 -302 UNLAWFUL ACTIVITY OF MINORS UNDER THE AGE OF 18 . YEARS AND OF THE AGE OF 14 YEARS AND OVER. It shall be unlawful for any person under the age of 18 years and any person who has a ttained the age of lk years and over to loiter, idle, wander, stroll or play in or upon any public street, avenue, alley, park, playground, or place open to the public, or place of amusement and entertainment, vacant lot, or other unsupervised place in the Village of Brooklyn Center, between the hours of 10 p.m. of any day and 5 o'clock a.m. of the following day; provided, however, that the provisions of this section shall not apply to any such minor person who is accompanied by his or her parent, guardian or other adult person having the authorized care and custody of such minor person, or when such minor person is upon an emergency errand or legitimate business directed by his or her parent, guardian or adult person having authorized care and custody of such minor person. Section 1 -304 UNLAWFUL FOR PARENTO GUARDIAN OR OTHMS TO ALLOW VIOLATION. It shall be unlawful for any parent, guardian or other adult person having authorized care, custody or control of any person under 18 years, to allow or to permit such person to violate the provisions of Sections 19 -301 or 19 -302. Section 19 -305. UNLAWFUL FOR BUS??�TESS PFRSON TO ALLOW VIOLATION. It shall be. uula -�iul. for any person operating or in charge of any place of amusement, entertainment or refreshment, or other place of business, to permit any minor under the age of 18 years to loiter or idle in such place contrary to the provisions of Section 19 - ;,Ol or 19 - 302 and he shall immediately order such minor person to leave and if such person refuses to leave such place he shw11 immediately notify the police department of the violation. Section 19 -306. OTHER ORDINANCES U10r" REPEALED. This ordinance shall not be construed as permitting the presence at Any time of any person under the age of 18 years in any place where, his presence is now prohibited by any existing law or ordinance. Section 1 -307 PENALTIES. Any minor violating the provisions of Section 19 - 0 19 -302 shall be dealt with in accordance with juvenile court law and procedure. Any person, guardian or other adult person or persons having authorized care and custody o° such minor, violating Section 19 -304 and 19 -305 shall be fined, on conviction 'whereof, not more than $100 or imprisoned not more than 90 days. Section 19 -308. SEPARABILITY. It is the intention of the Village Council that each separate provision of this ordinance shall be deemed independent of all other provisions herein, and it is further the intention of the Village Council that if any provision of this ordinance be declared invalid, all other provisions thereof shall remain in force and valid. Section 1.9 -309. REPEAL OF PRIOR ORDINANCE. The ordinance regulating the presence of minors under the age of 16 years on or in streets or public places between certain hours and defining duties of parents and others in the care of minors and providing for arrest and penalties for violation thereof now codified as Section 19 -301 through Section 19 -307, inclusive, is hereby repealed and the foregoing Sections shall be inserted in accordance with the section numbers as designated herein. Section 19 - EFFECTIVE DATE. This ordinance shall take effect from and after its publication." •
