Super, Mayor, at 8:30 P.M. Roll Call: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ .tones were present. Member Wayne dageby introduced the ordinance entitled AN ORDINANCX AMENDING THE ZONM ORDINANCE OF THE VILLAGE OF BROOKLYN CENTER BY REPEALING` SECTIONS 35 -218, 35 -29 AND 35 -220, AND INSERTING A NEW SECTION TO BE KOM AS SECTION 35 - 21 8 a copy of which is attached hereto, and moved its adoption: The motion for the adoption of the foregoing ordinance was duly seconded by member Carl Carlson and upon vote being taken thereon the following voted in favor thereof William N. Motion by Russ Joaea and seconded by Wayne Qapb y that the Village Cbua uPhOld the recommendation of the Planning Commission and deny a special permit to Ralph Mesker to keep a pony on his property at 651$ Bryant Avenue North, becase Mr. Mesker was not present at the Planning Commission meat, Notion carried. Motion by Russ Jones and seconded by Wayne Gageby that the VillaV Council uphold the - recommendation of the Planning Commission and allow James R. Fischbach to stable a riding horse at 5700 Russell Avenue Norrth for the summer months. Motion carried. No. Motion canted• a r i I Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED WATER MAIN IMPROVEMENT NO. 1957-31 I WHEREAS, it is proposed that there be constructed an Improve - ment consisting of the following: Construction of water main on Halifax and Indiana Avenue North from 69th Avenue North to 72nd Avenue North, And on 716t Avenue North and 72nd Avenue North from Halifax Avenue North to June Avenue North. WHEREAS,. the Allage engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $31,000.00, NOW, THRRMRE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hail in the village on Tuesday, the 4th day of June, 1957, at 8:00 o'clock P.M., and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the village. \ 3. The area proposed to be assessed for said improvement is as follows All lots and parcels of land abutting thereon. 4. This proposed improvement shall be designated Water Main Improvement No. 1957 -31• The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Wayne Gageby, Clifford Wellman, and Russ Jones; and the following voted against the sari: None; whereupon said resolution was declared duly passed and adopted. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED SANITARY 31WER NO. 1957 -32 WHEREAS, it is proposed that there be constructed an improvement consisting of the following: Construction of sanitary sewer an Halifax and Indana Avenue North from 69th Avenue North to 72nd Avenue 'North., and on 71st Avenue North and -72nd Avenue North frft Halifax Avenue North to Avenue North. WAS, the village engineer has made a, preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of-$54,15O.00, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed underauthority granted by Chapter 398, Laws of Minnesota, 1953, as amended. .2r 2. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED STORM SEWER IWROVMW NO. 1957 -34 WHEREAS, it is proposed that there be constructed an improvement consisting of the following: Construction of storm sewer within the following boundaries: Commencing on the north Village line at its intersection with the westerly high 'water line of Palmer Lake; thence southerly along the western shore line of Palmer Lake to 69th Avenue North; thence easterly along 69th Avenue North to Zenith Avenue; thence south along Zenith to 68th Avenue extended; thence westerly along 68th Avenue to a point midway between Ewi ng and France Avenues; thence southerly parallel France to 67th Avenue, thence westerly along 67th Avenue to Osseo Road; thence northwesterly along Osseo Road to 69th Avenue; thence westerly along 69th Avenue to a point 450 feet west of the east line of Section 28, Township 119, Range 21; thence northerly parallel said section line to Osseo Road; thence southeasterly along Osseo Road to County Road No. 46; thence northerly along County Road No. 46 to the north Village line; thence easterly along said Village line to the point of beginning. Motion carried. -4- Member Russ Jones introduced the ordinance entitled AN ORDINANCE AKCRDING THE BUILDING CODE TAO ESTABLISH SPACE REQUIREKINTS FOR DWELLINGS a copy of which is attached hereto, and moved its adoption. The motion for the adoption of the foregoing ordinance was duly seconded by member Wayne Gageby and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Clifford Wellman, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said ordinance was duly passed and adopted. Motion by Wayne Gageby and seconded by Russ Jones that the Village enter into a contract with The Service Bureau Corporation in preparing assessment reports. Work is to be performed at standard rates. Motion carried. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR SANITARY BMW IMPROVR -EW NO. 1957 -25 BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: I. The plans and specifications for Sanitary Sewer Improvement No. 1957 -25 prepared by A. J. Lee, Village Engineer are hereby approved and ordered filed with the Clerk, based upon the recommendations of the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION FOR SANITARY SEWER IMPROVEMERT NO. 1957 -25 CIE IT AHOQLVAD by the Village Council of the Vij.1W of Bra Center Minnesota, as follows: I. The construction for said improvement is to be added to the existing contract with Lyon's Construction Co. for construction of Sanitary Sewer 1957 -6, 7 $, lo, 17, and 2 0. The plans and specifications for Sealtary Sewer Improvement loo. 1957 -26 prepared by Minder Engineering Co., Eegineer, are hereby approved and ordered filed with the Clerk, based upon the recommendation of the Village Engineer. -7- 2. The plans and specifications for Sanitary Sewer Improvement No. 1957 -27 prepared by Minder Engineering Co., Inc. Engineer, are hereby approved and ordered filed with the Clerk, based upon the recommendation of the Village Engineer. 2. The Clerk shall advertise for bids for such improvement by publication at least once in the official newspaper and in the Construction Bulletin, the date of first publication not less than 3 weeks prior to the date for receipt of bids. Said notice shall state that no bids will be considered unless sealed and filed and accompanied by a cash deposit, bid bond, cashier's check or certified check payable to the Clerk in the amount of not less than five percent of the bid. 3. The plans and specifications for Lift Station and Out Fell Line Improvement No. 1957 -29 prepared by Minder Engineering Co., Engineer, are hereby approved and ordered filed with the Clerk, based upon the recommendation of the Village Engineer. -8- 2. The Clerk shall advertise for bids for such Improvement by publication at least once in the official newspaper and in the Construction Bulletin, the date of first publication not less than 3 weeks prior to the date for receipt of bids. Said notice shall state that no bids will be considered unless sealed and filed and accompanied f by a cash deposit, bid bond, cashier's check or certified check payable to the Clerk in the amount of not less than five percent of the bid. 3. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ORDERING ADVERTISEMCHT FOR BIDS FOR BITUMINOUS MATERIAL I. The Village Clerk shall advertise for bids for bituminous material under the specifications prepared by the Village Engineer. 2. Bid date set for June 25, 1957 at 8 o'clock pm. The motion for the adoption for the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, Carl Carlson and Russ Jones; and the following voted against the same: gone; whereupon said resolution was duly passed and adopted. Motion by C lifford Wellman and seconded by Russ Jones that the 'V'illatge Council hire Donald Stark as Building Inspector, at the salary of $115.40 per week. Motion carried. The bills set forth on the schedule attached to these minutes and made a part hereof entitled "The Bills Audited and Ordered Paid at the Meeting of May 14, 1957" were audited std ordered paid. Motion carried'. rk AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF BROOKLYN CENTER BY REPEALING 1 SECTIONS 35 -218, 35 -219 AM 35 -220, AND INSERTING A NEW SECTION TO BE KNOWN AS SECTION 35 - 218 THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CErim ORDAINS: Sect i o_ n 1. The following amendment to the zoning ordinance of Brooklyn Center is to be considered an interim measure pending completion of the Village's comprehensive plan and revised zoning ordinance. To withhold any action on the Village's zoning until the revised ordinance is presented and acted upon tends to make for hardships to both developers and home owners. Therefore, Section 35 -218 of the zoning ordinance of the Village.' of Brooklyn Center is hereby amended to read as follows: Section 35 -218. USES MMORIZED IN COMMERCIAL ZONING. Future development of land zoned commercial must meet the requirements or Table 1. Such development 2 furthermore will be limited to the uses listed in Table 2, unless authorized by a Special Permit. The uses that may be authorized by a Special Use Permit are listed in Table 3. TABLE 1 ter.. a. The property shall be located within a general area designated for local shopping according to the Guide Plan of the Planning ommission a co � s PY of which is attached hereto and made a part hereof. b. The area shall be platted as a single parcel of land or replatted, if necessary, to gain a single parcel, the parcel shall be under unified control. C. The off- street parking ratio shall be not less than three square feet of off- street parking to one square foot of floor area. d. The minimum development to qualify as a shopping center shall contain not less than one retail grocery store and one drug store. There shall be aat less than 25,000 square feet of gross floor area, and not more than 100,000 square feet. e. Where such development abuts a residential district, a buffer zom shstl be established. There shall be a protective strip of not less than 25 feet in width. This protective strip shall r4ntaia no str'unturos not be Used fOr puftng, off- street loading, or storage, and shall be land- scaped. The landscape treatment shall contain a compact evergreen hedge or fence. The planting or fence design must be approved by the Building Department asbeing in harmony with a residential neighborhood and providing succifient screening of the commercial area. The hedge or fence shall be no less than four feet and no more than six feet in heights. f. There shall be no off- street parking within 15 feet of any street right -of- way. g. The parking area shall be surfaced with an all- weather type treatment, and the handling of surface water drainage shall be according to a plan approved by the Village Engineer. h. Cross lane traffic access on major thoroughfares, as designated on the Planning commission's Guide Plan, shall be channeled across thoroughfare intersections. Other cross -lane traffic must be eliminated through design of the development. i. If a second shopping center is to be considered within any of the areas designated for local shopping, a market analysis shall be submitted. This market analysis shall be based upon the Planning Commission's Guide Plan and not merely upon existing development and shall demonstrate a need for an additional shopping center. j. The building set -back along the Osseo Road and other major thoroughfares, as designated on the Planning Commissions Guide Plan, shall be 65 feet. T om? a. Barber r r Sho ps b. Beauty Parlors c. Laundries, automatic self- service type or hand, employing not more than two persons in addition to the owner or manager provided, that laundrey machines shall not exceed twelve pound capacity each. 1. Restaurants, when no entertainment or dancing is provided. d. Public Utility facilities. e._ Clubs or lodges — private, non - profit. f. Other retail businesses. g. Automobile Service Stations. Section 2. The existing provisions of Sections 35- 218s35 -219 and 35 -220 of the zoning ordinance are hereby repealed. Sect 3 . This ordinance shall take effect from and after its legal publication.
