Center in the County of Hennepin and State of Minnesota, including all accounts audited by said Council .r June 11, 1957 The Village Council met in regular session and was called to order by William N. Super, Mayor, at 8:25 P.M. Roll Call: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby and Russ Jones were present. Motion by Wayne Gageby and seconded by Carl Carlson to approve the minutes of the re -Ulax meeting of May 28, 1957. Minutes were approved as recorded. Motion carr�.ed. The Mayor announced that the meeting was open for the consideration of proposed Water Matn Improvement No. 1957-31 The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering'all Jbjections, and the property owners appearing in favor of said improvement, member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF WATER MAIN 10ROVOM NO. 1957 -31 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the village and the owners of property - specially benefited thereby that the following improvement shall be constructed: Water Main from .Halj;fax Avenue forth - from 71s t .Ave 14, to '73rd A ve. The plans and specifications for said improvement shall be prepared by Minder Engineering Co., Inc., Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; (William N. Super was absent during the voting); whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1957 -32• I The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Carl Carlson introduced the following resolttion and' moved its adoption: -1- Q RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER IMPROVEMENT NO. 1957 -32 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed: Sanitary serer from 72nd Avg North from Qrim , Avenue North to Hallfa;x Artnue Worth mid on:. The motion for the adoption of the foregoing resolution was duly seconded by member Russ Jones, and upon vote being taken thereon the following voted in favor thereof: Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; (William Super absent during voting); whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Storm Sewer Improvement No. 1957-34• The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After heartmg and considering all objections, and the property owners appearing in favor of said improvement, member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF STORM SEWER IMPROVE40T No. 1957 -34 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed: Construction of storm sewer within the following boundaries: Commencing on the north Village line at its intersectionwith the westerly high water line of Palmer Lake; thence southerly along the western shore line of Palmer Lake to 69th Avenue North; thence easterly along 69th Avenue North to Zenith Avenue; thence south along Zenith to 68th Avenue extended; thence westerly along 68th Avenue to a point midway between Ewing and France Avenues; thence southerly parallel France to 67th Avenue; thence westerly along 67th Avenue to Osseo Road; thence Northwesterly along Osseo Road to 69th Avenue; thence westerly along 69th Avenue to a point 450 feet west of the east line of Section 28, Township 119, Range 21; thence northerly parallel said section line to Osseo Road; thence southeasterly along Osseo Road to County Road No. 46; thence northerly along County Road No. 46 to the north Village line; thence easterly along said Village line to the point of beginning. 2. The plans and specifications for said improvement shall be prepared by Minder Engineering Co., Engineer. -2- The motion for the adoption of the foregoing was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones, and William Super; and the following voted against the same; None; whereupon said resolution was declared duly passed and adopted. Motion by Russ Jones and seconded by Clifford Wellman to uphold the recommendation of the Planning omission and approve the proposed plat of Pearson's Northport 5th Addition; subject to all restrictions of the platting ordinance. Motion carried. Motion by Wayne Gageby and seconded by Clifford Wellman to uphold the recommendation of the Planning Commission and allow Matt Kohler to sell a lot at the intersection of 73rd Avenue North and Girard Avenue North by metes and bounds description. The 90' x 133.5' lot lies adjacent to proposed Girard Avenue North at 73rd Avenue North. Motion carried. On May 8, 1957, the Planning Commission acted as follows; Motion by Sacre and seconded by Bullen that the petition of J. P. Melberg for a special permit to construct a shopping center on Lots 37 and 38, Auditor's Eubeliv Sion #216, be denied because it dues not comply to Sections "A'` zid "H of Table 1 of the proposed amendment to the zoning ordinance. SacL , Bullen, Warhol and Poate voting aye, and Edling voting no. motion carried. After due consideration to said petition, member Wayne Gageby made a motion to uphold the foregoing recommendation. The motion was seconded by Russ Jones; and upon vote being taken thereon the following voted in favor thereof: William N. Super, Wayne Gageby, and Russ Jones; and the following voted against the same: None; Carl Carlson and Clifford Wellman abstained from ,voting; whereupon said motion was duly passed. Motion by Russ Jones and seconded by Wayne Gageby to accept the justice report of John Wingard for the month of May. Motion carried. Motion by Russ Jones and seconded by Clifford Wellman to approve the following applications for well drillers licenses: Ernie Perron Well Co. 639 9th Avenue N.W. - New Brighton,Minn, Lloyd A. Buelow 4832 Louisiana Ave,N., Mpls., Minn. Motion carried. Motion by Carl Carlson and seconded by Wayne Gageby to approve the following applications for plumber's licenses: Matheson Bros. Plumbing Wyoming, Minnesota Weinmann Plumbing Co. 4129 West Broadway - Mpls., Minn. Motion carried. Motion by Russ Jones and seconded by Wayne Gageby to approve the following applications for electrician's licenses: Annis Electric Co. 2548 Central Ave. N.E. - Mpls., Minn, Bond Electric Co. 1650 Carroll Ave. - St. Paul,Minn. Lambie Electric Co. 6324 56th Ave. No. - MPIS., Minn. Mergen's Electric Inc. Wayzata, Minn. Motion carried. Motion made by Russ Jones and seconded by Wayne Gageby to approve the Surveyor's Certificate of Correction to the Plat of Northga", correcting the North line of Lot 1, Block 9. The original plat has the dimension of 75.49 feet which is wrong and should have the dimension of 70.49 feet. The Village Clerk was authorized to certify such correction. Motion carried. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION CONFIRMING LIABILITY OF THE VILLAGE FOR WORK PERFORMED FOR IMPROVEMENTS NO 1956 - and No. 1957 -11 2 4, 5, 9, 11,;� 1 15 BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota., as follows: 1. It is hereby found and determined that the contracts let for Improvemants No. 1956 - and No. 1957-1, 2, 4, 5, 9, 11, 12,'14 and 15 on the 26th day of March, 1957, are valid and binding contracts upon the Village of Brooklyn Center, it appearing that said contracts were let after substantial compliance with the statutes as to notice to bidders and the Village having received a large number of bids therefor, which it finds were competitive with the lowest thereof being substantially below the estimates made by the engineers for the Village. 2. The Village further finds and declares that the work performed by the ffielps -Drake Co., Inc., and Lametti & Sons, Inc., in the construction of the above enumerated projects is acceptable and satisfactory to the Village Council, and the Council further finds and declares that the reasonable value of the benefits to the Village of Brooklyn Center arising out of the work performed on each of said improvements by said companies is in the amounts set forth in the bids received from each of said companies by the Village on March l9, 1957, as they appear in the minutes of the proceedings of the Village Council for said date. 3. Pursuant to the foregoing, the Village Council hereby detdrmines that payment for the work performed by said companies on said improvements shall be made in the manner authorized by Section 429.041 Subdivision 6 of the Minnesota Statutes, with the Total payment therefor to be for the work completed at the unit prices set forth in the bid, which is the reasonable value thereof. The motion for the adoption of the foregoing resolution was duly seconded by member Carl 'Carlson, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Wayne Gageby, Clifford Wellman, Carl Carlson, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The bills set forth'on the schedule attached to these minutes and made a part hereof entitled "The Bills Audited and Ordered Paid at the meeting of June 11, 1957 "'were audited and ordered paid.
