The Planning Commission recommenddd approval of Application No. 82040 at its October 28, 1982 meeting. 11. Ordinances:' a. An Ordinance Amending Chapter 4 of the City Ordinances Relating to Delinquent Water and Sewer Accounts -This ordinance amendment would increase the interest rate charged on delinquent public utility accounts from 8% to 12 The ordinance is offered for a first reading. It is recommended that a public hearing on the ordinance amendment be scheduled for 8:00 p.m. on December 6, 1982. *12. Licenses 13. Adjournment I f . 4 f� MINUTES OF THE PROCEEDINGS OF THE CITY COUNCIL \ I OF THE CITY OF.BROOKLYN CENTER IN THE COUNTY OF HENNEPIN AND THE STATE OF MINNESOTA SPECIAL SESSION AUGUST 30, 1982 CITY HALL CALL TO ORDER The Brooklyn Center City Council met in special session and was called to order by Mayor Dean Nyquist at 7:04 P.M. ROLL CALL Mayor Dean Nyquist, Councilmembers Gene Lhotka,, Celia Scott, Bill Hawes, and Rich Theis. Also present were City Manager Gerald Splinter, Director of Finance Paul Holmlund, Director of Planning and Inspection Ron.Warren, City Attorney Richard Schieffer, Chief of Police James Lindsay, and Administrative Assistants Brad Hoff- man and Tom Bublitz. PUBLIC HEARING ON A PROPOSAL TO UNDERTAKE AND FINANCE A SINGLE FAMILY HOUSING PROGRAM UNDER MINNESOTA STATUTES CHAPTER 462C, AS AMENDED The City Manager noted that the public hearing is intended to allow public input on the $8.5 million mortgage revenue bonds proposed for the City of Brooklyn Center under Minnesota Statutes 462C. He explained the bonds are tax - exempt bonds and are not full faith and credit bonds. He stated the program will allow the City to fund first -time 'home buyer's mortgages through the Minnesota Housing Finance. Agency Program. He explained the program will involve no hiring of new staff and that it will be accomplished on a contract basis with local lenders admin -- istering the program. He explained this mortgage revenue bond program is a con - tinuing program and is available to municipalities annually. Administrative Assistant Hoffman pointed out that the application will be reviewed on September 23, 1982, and that it will comprehend $7 million in mortgage money for approximately 100. -120 mortgages in the City of Brooklyn Center for first -time home buyers who qualify. He stated his recommendation was to make application for the program and return to the-Council before September 23 with, a more in -depth review. He noted that Mr. Dan Nelson from the law firm of Holmes and Graven is here this evening to answer any questions that the Council - might: have on the project. Mayor Nyquist inquired whether the program would be entirely limited to the first -, time home buyer. Mr. Nelson explained that this restriction is imposed by federal law but noted that 10% of the bond proceeds can go to other than first - time home buyers. Discussion continued regarding the mortgage bond,prggram, and Mayor Nyquist recog- nized Ms. Andrea Lubdov of Miller and Schroeder who reviewed.the income limits established for persons qualifying for the program. She explained the funds are held for a certain period for persons with incomes under $25,000 per year. -_She explained that few senior citizens moving into the project would be first -time home buyers, and that the funds would be intended for the purchase of single family homes. Councilmember Theis inquired whether there was any time period for the issuance of- the.loans. Ms. tubdov replied that the time period was two and one - half.years -to issue the loans. 8-30-82 -1 4 w Mr. Nelson pointed out that each year $200 million in housing bonds are issued by the state, and that the bonds must be issued by December 31 of each year. He explained the resolution this evening, if passed by the Council, would be the first step in issuing the mortgage revenue bonds. Councilmember Hawes inquired whether there.was any legal liability to the City with regard to the issuance of the bonds. Mr. Nelson replied the City has no 0 liability with regard to payment.of the bonds, and the City cannot be held liable for these obligations. Ile added that the City would incur costs only in attorney fees and staff time. He explained the mortgages are assigned as security to the bondholders via a trustee, and that the City would have a con- tractual agreement between the program administrator which would be a major lender. Councilmember Scott noted that in the memorandum received by the Council,_ it was stated that there would be a 3�%� contribution by the City. She inquired what this contribution concerned. The City Manager stated that negotiations have been taking place with the developer regarding this issue, and with the use of tax increment financing proceeds. He stated that we hope to respond to this in more detail on September 23. Councilmember Lhotka inquired what the purpose of the local dollars would be. Ms.- Lubdov of Miller and Schroeder stated that the local dollars would make the program financially feasible and explained that in order to get the bonds rated, the rating agencies must be convinced that the bonds can . be paid off. She explained the WiFA regulations and criteria include a local contribution for acceptance of the application. She explained that if the city contributes 3-�%, -the process for the return of this to the City would be 'that, . after the project begins to pay off in five years, the City may use these funds in other housing areas. Councilmember Hawes inquired whether there was a limitation on the sale of homes purchased under the program. Mr. Nelson replied that those who assume.the loan and anyone selling the home must also meet the income qualifications. Mayor Nyquist opened the meeting for the purpose of the public hearing on the proposal to undertake and finance a single family housing program under Minne- sota Statutes Chapter 462C as amended. He inquired if there was anyone present who would like to speak at the public hearing. No one appeared to speak, and he enter - tained'a motion to close the public` hearing. - There was a- motion by Councilmember Scott and seconded by Councilmember Hawes 'to - close the public hearing on the proposal to undertake and finance - a single family housing program under Minnesota Statutes Chapter 462C,as amended. Unanimous. RESOLUTION NO. 82 -168 Member Hawes introduced the following resolution and moved its adoption: RESOLUTION APPROVING THE 1982 SINGLE FAMILY HOUSING BOND PROGRAM The motion for the adoption of the foregoing resoaution,was duly. seconded by.. =' member Gene Lhotka, and upon vote being taken thereon, the following voted in favor ,thereof: Dean Nyqust, Gene Lhotka, Celia Scott, Bill Hawes,'and Rich Theis; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. Councilmember Lhotka left the table at 7 :40 P.M. PLANNING COMMISSION ITEMS PLANNING COMMISSION APPLICATION NO. 82020 SU BMITT ED BY HUSSMAN INVESTMENT COMPANY 1 _- AS A REQUEST TO REZONE FROM R -1 TO R -3 TWO PARCELS OF LAND ON THE SOUTH SIDE IN THE 800 BLOCK OF 70TH AVENUE NORTH 8 -30 -82 -2 PLANNING COMMISSION APPLICATION NOS. 82031 and 82032 SUBMITTED BY HUSSMAN INVESTMENT COMPANY FOR SITE AND BUILDING PLAN AND PRELIMINARY PLAT APPROVAL FOR A 8 UNIT TOWNHOUSE PROJECT ON THE SOUTH SIDE OF 70TH AVENUE NORTH. The Director of Planning and Inspection stated that the Planning Commission applications were tabled at the August 23, 1982, City Council meeting to allow time for the applicant to submit.a certified copy of the landscape plan for the project. Councilmember Lhotka returned to the table at 7:42 P.M. The City Manager noted that the public hearing on the applications had been held at the last City Council meeting. The Director of Planning and Inspection reviewed the site and building plan and parking plan for the applications and stated that the main consideration of the Planning Commission regarding the applications was the required screening. He proceeded to review the screening proposed by the applicant, and reviewed the Planning Commission's recommended conditions of approval for Application 82031. He pointed out that.condition #7 in conjunction with,Application 82031 can be strikers since it has been met by the applicant. He also noted that the second sentence in condition #8 can be striken since it has been met also. He proceeded to review the Planning Commission's recommended conditions for approval for application 82032 and noted that the applicant had submitted the required homeowner's association documents. There was a motion by Councilmembe'r Scott and seconded by Councilmember Hawes to approve Application 82020 in consideration of the following: 1. The R -3 zoning classification is an appropriate land use classification for the location in question in that it is consistent and compatible with all surrounding land uses. 2. Development of the property for townhouses is in the interest of the City, and the surrounding land uses, as well -as the property owner by adding 8 dwelling units to the northeast neighborhood. 3. Development of the property for townhouses is more consistent with a traf- fic level of up to 7,000 cars per day anticipated on 69th/70th Avenues North than single family residences in that internal driveways allow better visibility for residents to enter public streets. 4. The proposed townhouse use of the land is not considered to be inconsistent with the comprehensive plan goal that the northeast neighborhood be pre - dominantly single family detached residential in character. 54 The proposed townhouse use is consistent with the recommendations of comprehensive plan, specifically with the land use revisions map which calls for mid- density residential development south of ; 70th Avenue North, east of the City Maintenance Annex, and west of the Columbus Village Apartments. 6. The property in question will bear fully the ordinance development restric- tions for the proposed.zoning district, whereas the R -1 zoning classification presented development problems which would have led to .a less efficient use of land. Voting in favor Mayor Nyquist, Councilmembers Lhotka, Scott, Hawes, and Theis. Voting against: none. The motion passed unanimously. 8 -30 -82 -3- There was a motion by Councilmember Lhotka and seconded by Councilmember Theis to approve Application No. 82031•subject to the following conditions: 1. Building plans are subject to review and approval by the Building Official with respect to applicable codes prior to the issuance of permits 2. Grading, drainage, utility, and berming plans are subject to review and approval by the City Engineer ,prior to the issuance of permits. 3. A site performance agreement and supporting financial guarantee (in an amount to be determined by the City Manager) shall be submitted prior to the issuance of permits to ensure completion of approved site improvements. 4. An outside trash - disposal facility will be appropriately screened from view. 5. Plan approval is exclusive of all signery which is subject to Chapter 34 of the City Ordinances. j p 6. -.B -612 curb and gutter shall be provided around all common parking and driving areas. . 9 7. Plan approval acknowledges some vegetative screening along the opaque_ fencing along the southerly and easterly boundary of the site. 8. "Building permits for the project will not be issued until the plat has been given final approval by the-City Council and filed with the County. Voting in favor: Mayor Nyquist, Councilmembers Lhotka, Scott, Hawes, and Theis. Voting against: none. The motion passed unanimously. There was a motion by Councilmember Theis and seconded by Councilmember Scott to approve Application No. 82032 subject to the following conditions: 1. The final plat is subject to review and approval by the City Engineer. 2. The final plat is subject to the provisions of Chapter 15 of the City Ordinances. 3. Homeowner's association documents shall be subject to review and approval by the City Attorney prior to final plat approval. Voting in favor: Mayor Nyquist, Councilmembers Lhotka, Scott, Hawes, and Theis. Voting against: none. The motion passed unanimously. The City Manager noted that the executive session would be held in the Manager's Conference Room. Those present at the special executive session were Mayor Nyquist, Councilmembers Gene Lhotka, Celia Scott, Bill Hawes, and Rich Theis along with City Manager Gerald Splinter, Chief of Police James Lindsay, Director of Finance Paul Ho]mlund, City Attorney Richard Schieffer, the City's Labor Relations Consultant Cy Smythe, and Administrative Assistant Tom Bublitz. Mayor Nyquist adjourned the City Council meeting and convened the Special Execu- tive Session of the Council. RESOLUTION APPROVING CHANGE ORDER NO. 1 TO PALMER LAKE BASIN SITE IMPROVEMENT CONTRACT 1982 -M WHEREAS, the City Council of the City of Brooklyn Center, Minnesota entered into Contract 1982 -M with Park Construction Company, for the construction of Palmer Lake Basin Site Improvement Project No. 1982 -25; and WHEREAS, the City Council deems it in the best interests of the City of Brooklyn Center, Minnesota, to delete the construction of the woodchip trail along the southeasterly perimeter of Palmer Lake Basin from said Improvement Project No. 1982 -25, resulting in a reduction of $1,165.50 in the Contract cost. Some rearrangement of landscape treatment around restaurant site. However, overall quantity and quality of plantings are consistent with plan. One hydrant valve is still buried beneath pavement in front of store. Recommend total release subject to raising of valve. 4. Church of the Nazarene 501 73rd Avenue North Planning Commission Application No. 81018 Amount of Guarantee $500.00 passbook Obligor -,Church of the Nazarene All plantings are in. The motion passed unanimously.` APPLICATION NO. 82040 (Lynbrook Bowl) Following the Chairman's explanati.an the Secretary introduced the first item of business, a request by'Steve Nelson of Lynbrook Bowl for a special use permit to authorize live entertainment in the restaurant adjacent to the bowling alley at 6357 North Lilac Drive. The Secretary reviewed the contents of .the :staff report (see Planning Commission Information Sheet for Application No. 82040 attached). The Secretary also explained that a previous special use permit for -live entertainment (Application No-. 79013) had comprehended larger bands and show groups, but that the permit had expired because the previous restaurant expansion was never built. Chairman Lucht asked the applicant whether he had anything to add. Mr. Nelson thanked the Planning Commission for its consideration and explained that there is no room to dance in the restaurant. He stated that as many as a trio of musicians might perform listening music for,patrons in the restaurant. PUBLIC HEARING Chairman Luc Ht then opened the meeting for a public hearing and noted that there was no one else present to speak on the application. He called for a motion to close the public hearing. CLOSE PUBLIC HEARING Motion by Commissioner Sandstrom seconded by Commissioner Ainas to close the public hearing. The motion passed unanimously. 10 -28 -82 -1- In response to a question from Chairman Lucht regarding the pos- sible need for a condition regarding noise, the Secretary stated that such a condition would probably not be necessary. He explained. that other ordinances would 'cover any actual disturbance resulting r .from noise at the establishment. ACTION RECOMMENDING APPROVAL OF APPLICATION NO.''82040 (Lynbrook Bowl) _Motion by Commissioner Manson seconded by Commissioner Malecki to ,recommend approval..of Application No. 82040, a- request for a special k ' use permit for light live entertainment at the restaurant and lounge at-Lynbrook Bowl-, to the following conditions: 1. The permit`i:s issued to the applicant as operator of the facility and is nontransferable. 2. The permit is subject to all applicable codes, ordinances, and regulations and any violation thereof shall be grounds for revocation. 3. The hours of'operation for live entertainment shall coincide with on -sale liquor license regulations, Voting in favor Chairman Lucht, Commissioners Malecki, Simmons, - Manson, Ainas, Sandstrom and Versteeg. Voting against: none. The motion passed unanimously. DISCUSSION ITEM - Billboards The Planning Commission then discussed a request, submitted in writing by the Chamber of Commerce, that'it consider favorably adopting Sign Ordinance regulations which would allow and control billboards. Chairman Lucht acknowledged a letter from Mr. Quenroe of the. Chamber of Commerce dated October 14, 1982. He asked the Planning Commission what its feeling were on billboards. Commissioner Sandstrom asked whether the Chamber wanted more bill- boards to be allowed and he asked what is presently allowed. Chair- man Lucht explained that billboards are presently prohibited under the Sign Ordinance. He explained that the Chamber endorsing billboards as' a means of promoting business generally. Commissioner Ainas clarified that the Planning Commission was not endorsing billboards. Commissioner Simmons asked whether there was any specific recommendation ` regarding proposed regulations from the Chamber. Chairman Lucht ex- plained that no such specific regulations have been offered. He sug- gested that the Planning Commission could forward a recommendation to the City Council acknowledging the concerns of the Chamber of Commerce, but recommending no change in the ordinance. Commissioner Simmons stated that the only difficulty would be in trying to figure out what the Chamber position actually was since they had not offered any specific recommendations. The Secretary explained that when the initial letter from the Chamber was received, he did not see a demand for billboards coming from the Planning Commission and, therefore, asked for a specific recommendation from the Chamber. The Chamber responded that they simply wanted to be on record as favoring billboards _ and to leave to the Planning Commission ordinance suggestions as to how this could be accomplished. The Secretary stated that the staff does not recommend a change in the ordinance or even a study of billboards unless the Planning Commission, would like such a study. The Secretary stated that he did 10 -28 -82 -2- w a not feel that billboards should be introduced into'the community as long as they have been kept out up to now.- The Secretary also explained that,the Naegle Sign Company have made a presentation to the Economic Development Committee of the Chamber seeking support for a change in favor of billboards. Commissioner Simmons observed that the idea of allowing billboards had really been promoted by Naegle Sign Company and had simply been accepted by the Economic Development Committee of the Chamber. Chairman Lucht noted that the vote of the Chamber Council was only 6 to 4 in favor of recom- mending positively for billboards. =There followed a brief discussion as to how the Planning Commission should react to I the Chamber's endorsement of billboards. Commissioner Ainas observed that local businesses would probably not benefit from billboards, except possibly auto dealers. He suggested that the Chamber of Commerce is probably fairly neutral on the question of billboards and simply endorses billboards as an indication of support- ing business generally. Chairman Lucht stated that the billboards would probably have liquor and cigarette ads which are not major businesses in the community. ACTION ACKNOWLEDGING ENDORSEMENT OF BILLBOARDS BY THE BROOKLYN CENTER CHAMBER OF COMMERCE AND RECOMMENDING To THE CITY COUNCIL THAT NO CHANGE BE MADE IN THE SIGN.ORDINANCE Motion by Commissioner Malecki seconded by commissioner Simmons that the Planning Commission acknowledge the endorsement of bill- boards by the Brooklyn Center Chamber of Commerce and recommend to the City Council that there be no change in the Brooklyn Center Sign Ordinance regarding billboards. The Planning Commission adjourned at 8:13 p.m. Chairman 10 -28 -82 -3 { Planning Commission Information Sheet Application No. 82040 Applicant: Steve Nelson /Lynbrook Bowl Location: 6357 North Lilac Drive Request: Special Use Permit The applicant requests approval of a special use permit to offer live entertainment in the bar and _lounge in the new restaurant addition of Lynbrook Bowl at 6357 North Lilac Drive. The property in question is located at the northwest quadrant of the intersection of Interstate 94 and Minnesota Highway 252. It is bounded on the west by Schwellenberg Interiors and Camden Avenue North on the west, by vacant C2 zoned land on the north, and by North Lilac Drive on the south and east. The property in question is zoned C2 and live entertainment is allowed by special use permit in the C2, provided it does not abut R1, R2 or R3 zoned property at a property line or a street line. No such abutment exists in this situation. The applicant wishes to have one singer and an accompanist to perform in the bar and lounge area. At this time, he does not foresee having show groups, bands, or dancing. The Commission may wish to explore this possibility with the applicant so that a recommendation regarding the special use permit may , comprehend all likely possibilities. It should be noted that a special use permit for live entertainment was approved in 1979 when the Lynbrook proposed a larger expansion: That project was never accomplished and the special use permit, therefore, expired. Staff see no clear reasons for denying the special use permit based on the ordinance standards (attached). The proposed entertainment is in keeping with the nature of the existing establishment and should not cause detriment to surrounding property. The Commission may wish to seta condition limiting noise to the property itself. A public hearing has been scheduled and notices have been sent.' Advance Carter Company is currently doing business throughout the State of Minnesota. Investigator Monteen checked with the Hennepin County Sheriff's Office, Warrants and Records Division, and could find no record in the name of Amos Heilicher, Daniel Heilicher or Norman Pink, all equal partners in the- owner- ship of the Advance Carter Company. Monteen further checked the records of the local police departments in their cities of residence, St. Louis Park, Golden Valley and Minneapolis respectively, and found no record'of criminal activity. Investigator Monteen checked the card file of the Brooklyn Center Police Department as.well and found no record in the name of the Advance Curter Company or Daniel Heilicher, however,_ under the name of Amos Heilicher, Investigator Monteen found a miscellaneous officer incident dated 03- 13 -78, Case #78- 03074. Likewise, in the name of Norman Pink, Investigator Monteen found an incident of forgery at Shopper's City on 09- 22 -71, Case #71- 63690. It should be noted that in both cases these cards are indicative of informational purposes such as complainants or witnesses and are not booking information. Investigator Monteen did not review copies of the reports as they have been put on microfilm, as well, an incident classification "miscellaneous officer" would not indicate probable criminal activity and the forgery incident is over ten (10) years old. ry est fee rec.
