-A public hearing has been scheduled for this ordinance amendment 0
at 8:00 p.m. The ordinance was first read on November 9, 1981,
published on November 19, 1981 and is recommended this evening for
a second reading:

10., Planning Commission Items (8:05 p.m.)
a. Application No. 81070 submitted by Summit Mortgage Corporation for
site and building plan approval to add an enclosed porch to the main
house on the Earle Brown Farm at 6150 Summit Drive. The Planning
Commission recommended approval of Application No. 81070 at its
November 19, 1981 meeting.
b. Application No. 81071 submitted by Volp Construction Company /Dale
Tile Company for site and building plan approval to remodel space
inside the warehouse and office buildings at 4815 France Avenue North.
The changes will alter the mix of uses in the complex, resulting in a
different parking requirement. The Planning Commission recommended
approval of Application No. 81071 at its November 19,- 1951 meeting.
c. Application No. 81072 submitted by Mr. Russell Viska for a variance
from the Sign Ordinance to allow the erection of a 34' high, 152 sq.
ft. freestanding sign at the Smoke Pit Restaurant at 5001 Drew Avenue
North. The Planning Commission recommended denial of Application
No. 81072 at its November 19, 1981 meeting.
*11. It is recommended a motion be made by the City Council acknowledging termina-
tion. of the Joint Parking Agreement between Northwestern Bell and School
District #286 (Planning Commission Application No. '75043).

JANUARY 1, 1982
Wes, Resolution Nos. 74 -45 and 77 - 113 provided for the annual
adjustment of water assessment rates for non- single family residential and
single- family residential properties, respectively; and
%MZEAS, said adjustment in water assessment rates is specified in
said resolutions to be effective January 1 of each year; and y
WHEREAS, said adjustment is also specified in said resolutions to
be
in accordance with the annual change in the Train Cities Consumer Price

Index for the preceding month of October; and
WHEREAS, the City Engineer has reported to the City Council that
the change in the Twin Cities Consumer Price Index from October, 1980, to
October, 1981, was an increase of 14.1 %.

Brooklyn Center, Minnesota, that the water assessment rates effective January
1, 1982, shall be as follows:

RESOIUTION AMENDIII MUNICIPAL STATE AID SWEET
CONSTRUCTION POLICY
WHEREAS, the City's Municipal State Aid Street policy comprehends
the establishment of maximum assessment rates to benefiting residential �
properties for street improvements to Municipal State Aid streets, and
WHEREAS, said policy provides that the maximum rates will be
adjusted annually based on current day costs; and
MERFAS, the Director of Public Wbrks has reported that the.
Engineering News Record Construction Cost Index for the Minneapolis area
has increased 11.5 percent between October, 1980, and October, 1981.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center:
(1) that the maximum assessment rate to residential properties
for a street paving improvement on a Municipal State Aid
street shall be increased from $9.35 per assessable foot
to $10.40 per assessable foot.
(2) that the maximum assessment rate to residential properties
for concrete curb and gutter installation on Municipal
State Aid streets shall be increased from $9.90 per assessa-
ble foot to $11.00 per assessable foot.

FOR LOCAL IMPROVEMENTS 1982
BE IT RESOLVED BY THE COUNCIL OF THE C ITY OF BROOKLYN CENTER
that all petitions requesting the installation of local improvements during
calendar year 1982 shall be submitted to the City Engineer's office no later
than January 31, 1982. Petitions submitted later than said date will be
considered only by the special consent of a 4 /5ths majority of the City
Council. Improvements referred to herein include street grading, curb and
gutter, street surfacing, stone drainage, water mains, sanitary sewers, and
any other improvements to be installed under M.S.A. Chapter 429 proceedings.

ment to the Zoning Ordinance by reducing the setbacks between the principal building
and accessory building.

AN ORDINANCE AMENDING CHAPTER 35 OF THE CITY ORDINANCES REGARDING
SEPARATION BETWEEN BUILDINGS'.IN THE Rl. ".AND. R2 DISTR1CT8

THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS:
Section 1. Chapter 35 of the City Ordinances of the City of Brooklyn
Center is hereby amended in the following manner
Section 35 --530. Buildings in Rl and R2 Districts.
In Rl and R2 districts, every building hereafter erected or structurally
altered shall be located on a lot, and in no case shall there be more
than one principal building on one lot. The term "principal building"
shall be given its common, ordinary meaning; in case of doubt, or any
question of interpretation, the decision shall rest with the Zoning Official.
1. No accessory building, unless an integral part of the
principal building, shall be erected, altered, or moved
within [eight] six feet of the principal building, as
measured from exterior wall to exterior wall. No
accessory building shall be erected, altered, or moved
within six feet of another accessory building, as
measured from exterior wall to exterior wall.

Section 2. This ordinance shall become effective after adoption and upon
thirty (30) days following its legal publication.
