Planning Commission Items (7:30 p.m.): a. Application No. 81016 submitted by Merila and Associates for preliminary RLS approval to combine into a single tract of land the property presently occupied by the Brooklyn Center library and two single family residences at 5601, 5607 and 5625 Brooklyn Boulevard. The Planning Commission recommended approval of Application No. 81016 at its February 26, 1981 meeting. CITY COUNCIL AGENDA -2- March 9, 1981 b. Application No. 81017 submitted by C & G Transcontinental Developers for site and building plan approval to construct two five -story office buildings and a one-story ffice building on the property at the north - ry east corner of County Road 10 and Brooklyn Boulevard. The Planning Commission recommended approval of Application No. 81017 at its February 26, 1981 meeting. 9. Public Hearings (8:OO p.m.): a. Discussion Items: a. Request by Creek Villas Association for sealcoating the streets in the Creek Villas development. This item was deferred at the last City Council meeting to the March 9,meeting at the request of Creek Villas Association. b. Legislative Report -The staff will be prepared to discuss recent meetings held with State representatives. C. Kaleidoscope 1981 -The staff will be prepared to discuss plans for Kaleidoscope to be held April 5, 1981. d. Local Board of Equalization The City Council should set a date, time and location for the local Board of Equalization meeting. The date of June 1, 1981 is recommended. e. Request for Engineering Study of Brooklyn Center Radio Communications System CITY COUNCIL AGENDA -3- March 9, 1981 • f. Tree Trimming Policy -The staff will be prepared to discuss the City policy regarding the trimming of boulevard trees. g. Ordinance Enforcement Complaints -The staff will be prepared to review and discuss complaints received on enforcement of various City ordinances. h. Review of Date and Subject for aoint Meeting with Brooklyn Center School Board. -The date of April 27, 1981 has been recommended for the joint meeting date. i i. FOR PROFESSIONAL SERVICES RELATING 'ID PRC=T 1980 -24 BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, that the Mayor and City Manager are hereby authorized to exeClate a supplemental agreement with the firm of Orr- Schelen- Mayeron for professional services relating to the rebidding of Project 1980 -24, Contract 1980 -P. Said Supplemental Agreement shall provide for a maximum fee of $17,100 in lieu of the $12,000 maximan previously authorized by Resolution No. 80 -234. The revised plans and specifications for Contract 1980 - P for the following improvemnts prepared by the firm of Orr- Schelen- Mayeron and Associates, Inc. are hereby approved and order filed with the City Clerk: ST01M SEWER IMPR V PROJECT NO. 1980 -24 2. The City Clerk shall advertise for bids for such improvements by publications at least of - ce in the official newspaper and in the Construction Bulletin, the date of first publication not less than 21 days prior to the date for receipt of bids. Said notice shawl state that no bids will be considered unless sealed and filed with the City Clerk and accompanied by a cash deposit, cashier's check, bid bowl, or certified check payable to the City Clerk in the amount of not less than five per cent (50) of the bid. 3. Bid date is set for April 14, 1981, at 11:00 o'clock, a.m., local time. 4. The City Manager and City Engineer are hereby authorized to open and tabulate the bids. RESOLUTION ACCEPTII3 PETITION, ESTABLISHII, PaTERIAIN DIPRaJEMEDIT' PRWBCT NO. 1981 -05, SANITARY SD TR IMPROVE^![EI`7T PROJECT NO. 1981 -06, STORM SM IMPRffJ=7T PROJECT M. 1981 -07, AND STREET IMPRUJn,0',I' PROJECT NO. 1981 -08, AMID ORDER= PREPARATION OF RFPORT Aim PLPNS AND SPECIFICATIONS WHEREAS, a petition has been sulmitted, requesting that watenrain, sanitary sewer, storm sewer, and street improvements be installed along Farle Brown Drive from its current terminus at the existing cul-de -sac westerly and southerly to its Westerly intersection with Suinnit Drive; and WHEREAS, the City D'igineer has determined that additional storm sewer installation is required on easements adjacent to Earle Brown Drive to complete the system so as to better serve the surrounding area; and he has recommended that concrete curb and gutter and street resurfacing be installed on the exist - ing portion of Earle Brown Drive from its Easterly intersection with Siznnit Drive to the existing cul-de -sac. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that. 1. The petition for improvements is hereby accepted. 2. The additional improvements recomend.ed by the City Engineer are hereby initiated. 3. The following projects are hereby established: 1981 -05: Installation of Prater Main Improvement on Farle Brown Drive from the T %bsterly intersection with Sunmlit Drive to the existing watermain adjacent to the South right- of-way line of Interstate Highway 94. 1981 -06: Installation of Sanitary Sewer Improvement on Earle Brown Drive from its v7esterly intersection with Summit Drive to the existing cul -de -sac approximately 1,800 feet Northerly of the Easterly intersection of Earle Frown Drive with Summit Drive. 1981 -07: Installation of Storm Sewer improvements on Earle Brown Drive required to c lete stem and. serve the s on easements as Y . and ea �P the unserved areas adjacent to Earle Brown Drive from its Westerly intersection with Summit Drive to its Easterly in- tersection with Summit Drive. - 1981 08. Construction of Street rovements consisting of concrete Imp curb and gutter, bituminous paving storm sewer , and minor t system adjustments on Earle Brown Drive from its Westerly intersection with Summit Drive to its Easterly intersection with Sum Drive. 4. It is proposed to assess the benefited properties for all or a portion of the costs of said s pur suant to Minnesota Statutes, rovement ur �P P Chapter 429. 5. The proposed improvements are hereby referred to the City Engineer } I` RESOLUTION NO. for study, and he is instructed to report to the Council, advi_sinr the Council as to whether the proposed improvements are feasible and as to whether they should best be made as proposed or in con - nection with some other improvE5ent, and the estimated costs of the improvements as recnded. 6. The City Engineer_ is hereby designated as the Ehaineer for this im-- provement. He s'zall prepare plans and specifications for the making of such improvements. RESOLUTION ESTABLISHING A POLICY FOR THE PUBLICATION OF CITY .n ORDINANCES AND ORDINANCE AMENDMENTS WHEREAS, the City Council and Charter Commission of the City of Brooklyn Center have reviewed the City Charter and in particular examined those sections of the Charter relating to publication of ordinances; and WHEREAS, there is a need to clarify the interpretation of these provisions. NOW, THEREFORE, BE IT RESOLVED that the City Council's direction and policy for publishing ordinances in accordance with the Charter provisions will be as follows: 1. The City Council shall. be provided with copies of proposed ordinances or ordinance amendments when it establishes and approves amendment at roves the proposed ordinance or ordinance pp prop a "first reading ". 2. Upon approval of the first reading text, a full and com- plete copy of the proposed ordinance or ordinance amendment shall be published in the City's official newspaper at least seven (7) days prior to the City Council's considera- tion for final passage (second reading). Y e 3. If the ordinance or ordinance amendment is approved by the City Council with no changes to the published text, the City Clerk shall then cause to be published in the official newspaper a "notice of ordinance passage" which contains a brief description of the ordinance or ordinance amendment and the date on which it was published as a first reading. This notice shall further state that the full text of the ordinance or ordinance amendment is available for inspection at the City Clerk's office. Should the Council modify the ordinance or ordinance amendment as originally published, then the City Clerk shall publish the full text of the modified ordinance or ordinance amendment as amended by the City Council in its final approval (second reading) in the official newspaper. RESOLUTION EXPRESSING RECOGNITION OF AND APPRECIATION FOR THE DEDICATED PUBLIC SERVICE OF CHRIS WHITE WHEREAS, Chris White served the City of Brooklyn Center for sixteen years as an,ernployee in the Park Department since March 8, 1965; and WHEREAS, he retired from Public Service on February 27, 1981; and WHEREAS, his devotion to the tasks and responsibilities associated with his position contributed substantially to the sound progress and develop- ment of the City; and WHEREAS, his public service and civic effort for the betterment of the community merit the gratitude of the citizens of Brooklyn Center. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that the dedicated public service of Chris White is recognized and appreciated by the City of Brooklyn Center and.that the City wishes him a long and happy retirement. RESOIJJ'TION ORDERING CONSTRUCTION OF STREET 1MP1OVL"= PROUECT NO. 1981 -02 (SHIIGLE CREEK PPJNIAY STREET IMPROVEMENT) E ' 'N S, a resolution of the City Council of the City of Prooklyn Center, Minnesota, adopted February 9, 1981, fixed a date for a public hearing on the proposed improvements of Shingle Creek Parkway from County Road 10 to F.A.I. 94 by construction of right and left turn lanes; and SEAS, ten days' published notice on the hearing through two weekly publications of the required notice was given and the hearing � held thereon on March 9, 1981, at which time all persons desiring t:o be heard were given an opportunity to be heard thereon: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ili Brooklyn Center, Minnesota, that such improvement is hereby ordered as proposed in the resolution adopted February 9, 1981.
