Establishing Project: Concrete Curb and Gutter Repair Project No. 1981 -21 1 -This project consists of repair and replacement of defective, settled, or raised concrete curb and gutter segments throughout the City. This item was included in the approved 1981 Public Works Department Budget. f. Approving Plans and Specifications and Directing Advertisement for Bids for Contract 1981 -E r 1 -11& -This contract includes the following improvement projects: Improvement Project No. 1978 -42: Completion of Shingle Creek Trailway System from County Road 10 to County Road 130 by con- f struction of pedestrian and bicycle trails along Shingle Creek from I -94 to County Road 130. Improvement Project No. 1980 -10: Construction of Shingle Creek Trailway System from County Road 130 to the north corporate limits from County Road 10 to south corporate limits. This includes pedestrian/bicycle trails in Lions Park and Palmer Lake Basin. Also included is the furnishing and installation of the pedestrian/bicycle bridge at Shingle Creek north of County Road 130. Improvement Project No. 1981 -12: Construction of pedestrian trail along 69th Avenue North from Shingle Creek to Oliver Avenue North. Improvement Project No. 1981 -14: Construction of concrete curb and bituminous surfacing in neighborhood parks. Improvement Project No. 1981 -15: Construction of pedestrian trail in Central Park and Garden City Park. Improvement Project No. 1981 -16: Extension of storm sewer in Lions Park from 54th Avenue - Russell Avenue intersection west to Shingle Creek. g. Application No. 81016 -A submitted by Brooklyn Center Industrial Park for amended preliminary RLS approval to create.two lots rather than one on the property presently occupied by the old Brooklyn Center library and two vacant single family residences. This item was recommended for approval by the'Planning Commission at its May 21, 1980 meeting. °b. Application No. 81022 submitted by the Brooklyn Development Company for rezoning of a 5.6 acre tract of land at the corner of Shingle Creek Parkway and Xerxes Avenue North. This item was recommended for approval by the Planning Commission at its May 7, 1981 meeting. C. Application No. 81030 submitted by Pontillo's Pizza for site and building plan approval for a 100 -seat restaurant at the southerly quadrant at the intersection of Earle Brown Drive and Summit Drive. This item was recommended for approval by the Planning Commission at its May 21, 1981 meeting. d. Application No. 81031 submitted by Pontillo's Pizza for a special use permit to operate a recreation room with seven electronic games in the ose ro 100 -seat restaurant at 5937 Summit Drive. Application No. 81032 submitted by Lynbrook Bowl for site and building plan approval to construct a 6,446 square foot addition for a 230 -seat restaurant at 6357 North Lilac Drive. This item was recommended for approval by the Planning Commission at its May 21, 1981 meeting. 12. Ordinances: a. An Ordinance Amending the Brooklyn Center City Charter K -The public hearing on the proposed Charter amendment amending Section 12.05, Sales of Real Property, was held at the April 6, 1981 City Council meeting. The ordinance amendment was offered for a first reading at the April 20, 1981 meeting, published on April 30, 1981 and is recommended for a second reading this evening. Amending b. Adjournment Member introduced the following resolution and moved its adoption: RESOLUTION NO. RESOLUTION AUTHORIZING THE BROOKLYN CENTER VOLUNTEER FIRE DEPARTMENT TO USE A CERTAIN HOUSE IN THE CITY OF BROOKLYN CENTER FOR TRAINING PURPOSES WHEREAS, the Brooklyn Center Volunteer Fire Department has requested the Brooklyn Center City Council to authorize the use of a house within the City of Brooklyn Center for the purpose of burning for Fire Department train- ing; and WHEREAS, training drills are essential to maintain the effectiveness of the Brooklyn Center Volunteer Fire Department; and WHEREAS, the Brooklyn Center Volunteer Fire Department has obtained permission from Mr. Don R. Benson (Owner) for the use of the house for training contingent on authorization for such use by the Brooklyn Center City Council; and WHEREAS, the Brooklyn Center Volunteer Fire Department has requested the Brooklyn Center City Council to authorize the use of the house for training purposes through July 1, 1981; and WHEREAS, the subject house is located at 5611 Lyndale Avenue North within the City of Brooklyn Center. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brooklyn Center hereby authorizes the use of the house by the Brooklyn Center Volunteer Fire Department, for training purposes through July 1, 1981. BE IT FURTHER RESOLVED that except for negligent acts of the State, its agents and employees, the City of Brooklyn Center assumes all liability for, and will save the State, its agents and employees harmless from, all claims for damages, actions or causes of action arising out of the use of the subject building by the City for Faire Department training. RESOLUTION TO AMEND CAPITAL PROJECTS FUND APPROPRIATIONS WHEREAS, the Capital Projects Fund was created to provide funds, and to account for the expenditure of such funds, for major capital outlays, and /or to reduce debt incurred for capital outlays; and WHEREAS, certain park improvement projects.are being constructed through the Fund and appropriations have been made to those projects; and 6 _ WHEREAS, inflation and unforseen design problems have caused expend - itures to exceed appropriations in certain of these projects; and WHEREAS, certain projects have been completed and the final costs were less than the funds appropriated; and WHEREAS, there exists in the Capital Projects Fund a fund balance which is available to be appropriated to those projects which have exceeded their original appropriations; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that the following park improvement project appropriations be increased by the amount indicated: Shingle Creek Trailways, Grant I $159,000 Central Park, Grant I 40,000 Central Park, Grant II 90,000 Brooklane Shelter Building 18,000 _ $307,000 BE IT FURTHER RESOLVED that the increased appropriations shall be financed by transferring appropriations from completed projects.in which costs were less than the funds appropriated and from the Capital Projects Fund fund balance in the amount indicated: Park Bonding Costs $ 34,000 Arboretum 41,000 Shingle Creek Trailway, Grant II 5,000 Shingle Creek Relocation 39,000 Fund Balance _188,000 $307,000 • Date Mayor ATTEST: Clerk The motion for the adoption of the foregoing resolution was duly seconded by member , and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same; whereupon said resolution was declared duly passed and adopted. RESOLUTION ESTABLISHIlN33 S7R IMPROVEMENT PRQJ CT NO. 1981 -18, SIDEWALK IMPROVEMENT PROJECT NO. 1981 -19, AND STOIT4 SE19M IMPROVE - MENT PPCJBCT NO. 1981 -20 (FREENTAY BOULEVARD), ACCEPTING EMINEER'S REPORT, AND PROVIDING FOR PUBLIC HEARING ON PROPOSFD 1MPRON124ENI' PROJECTS NOS. 1981 -18, 19, AND 20 W]ERE1S, the City Council• has received a report from the City Engineer regarding the feasibility of the improvement of Freeway Boulevard from Xerxes Avenue North to Shingle Creek Parkway by construction of storm sewer, concrete sidewalk, and street improvements according to the following schedule of esti- mated construction costs: Street Improvement Project No. 1981 -18: $131,209.00 Sidewalk Improvement Project No. 1981 -19: 7,861.00 Storm Sewer Improvement Project No. 1981 -20: 29,183.00 and, V+IEiiEREA.S, the City Council deems it necessary and in the best interests of the City of Brooklyn Center to ccxnplete said improvements: NOW, M EREFCRE, BE IT RESOLVED BY THE CITY COUNCIL of the City of Brooklyn Center, Minnesota, that the City Engineer's report is hereby accepted. BE IT FURTHER RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, that: 1. Said improvements are hereby established as follows: Street Improvement Project No. 1981 -18 Sidewalk Improvement Project No. 1981 -19 Storm Sewer Improvement Project No. 1981 -20 2. The accounting for these projects will be done in the Special Assessment Fund. 3. There is appropriated the sum of $800.00 from the Special Assess - ment Fund to provide consulting services. 4. The City Council authorizes the issuance of Master Note #1981 -01 . too provide construction financing for this improvement. BE IT FURTHER RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, as follows: 1. The Council proposes to proceed under authority granted by Chapter 429, Minnesota Statutes. 2. A public hearing on the proposed improvement shall be held at the City Hall in the city on Monday, the 13th day of July, 1981, at 8:00 o'clock P.M., and the Clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the city. RESOLUTION NO. 3. The City Clerk shall advertise for bids for such improvements by publications at least once in the official newspaper and in the Construction Bulletin, the date of first publication not less than ten (10) days prior to the date for receipt of bids. Said notice - shall state that no bids will be considered unless sealed and filed with the City Clerk and accompanied by a cash deposit, cashier's check, bid bond, or certified check payable to the City Clerk in the amount of not less than five per cent (5%) of the bid. 3. RESOLUTION ACCEPTING WORK PERFO= UNDER CONTRACT 1980-F (TRAFFIC SIGNAL-HUMBOLDT AVENUE NORTH AND FREUW BOULEVARD) WHEREAS, pursuant to written Contract No. 1980-F signed with the City of Brooklyn Center, Minnesota, Collins Electric Company has satisfactorily com- pleted the following improvement in accordance with said contract: TRAFFIC SIGNAL IMPROVEMENT PROJECT M. 1979 -10 Signalization of the intersection of Humboldt Avenue North and Freeway Boulevard /65th Avenue. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of the City of Brooklyn Center that: 1. The work completed under said contract and Change Order No. 1 is accepted and approved. Original Award $80,590.00 Change Order No. 1 1,951.00 TOTAL $82,541.00 2. The value of the work performed is equal to the original contract and Change Order No. 1. 3. It is directed that final payment be made on said contract, taking the Contractor's receipt in full. The total amount to be paid for said contract shall be $82,541.00. RESOLUTION A0=ING WORK PERFORNM UNDER CONTRACT NO. 1980 -1 (REFORESTATION) WHEREAS, pursuant to written Contract No. 1980 -J signed with the City of Brooklyn Center, Minnesota, Midwest Landscaping, Inc. has satisfactorily ompleted the following inprovement in accordance with said contract: REE'ORESTATION PROJECT NO. 1980 -21 Furnishing and planting shade trees on public lands and street boulevards within the'corporate limits of the City of Brooklyn Center. NCW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of the City of Brooklyn Center that: 1. The work oompleted under said contract is accepted and approved. Original Award $5,250.00 2. If the true owner does not claim property or money during the two 2) month period, the City Manager may release such unclaimed property or order such un- ' laimed money to be paid to the person who found same, if at the � time of delivery to the City of Brooklyn Center such finder indicated in writing that he wished to assert a claim to the property or money as a finder. Section 2 -104 TRANSFER OF UNCLAIMED MONEYS TO GENERAL FUND. If any such money is not claimed by the true owner or by the finder within the two (21 month period, the City Manager shall cause such money to be transferred to the General Fund of the City. Section 2 -105. PUBLIC SALE OF UNCLAIMED PROPERTY. Upon expiration of the two 2 month period, unclaimed property remaining in the possession of the City of Brooklyn Center shall be appropriated for City use upon approval by the City Manager if such item of property is valued less than $100 and upon approval by the City Council if such item of property is valued greater than $100 or, shall be sold at public sale by the City Manager. The City Manager shall cause one week published notice of public sale in the official newspaper, describing therein the article to be sold and the date, time and place of the sale. Any unclaimed property offered for public sale but not sold, and not suitable for appropriation for City use, shall be deemed to be of no value and shall be disposed of in such manner as the City Manager directs. This ordinance shall be effective after adoption and thirty (30) days following its legal publication. Adopted this day of 1981.
