Authorizing the Mayor and City Manager to Enter into a Sound Level Meter Custody .Agreement with the League of Minnesota Cities The sound level meter equipment would allow the Police Department A to establish a program of motor vehicle noise level enforcement. i } The equipment is provided at no charge to the City for the length of the agreement period, which is December 31, 1981. 8. Planning Commission Items (7:30 p.m.): a. Application No. 81020 submitted by Brooklyn Development Company for preliminary plat approval to subdivide the land at Xerxes Avenue North and Shingle Creek Parkway into two blocks, one for townhouse development and one for commercial office development. The Planning Commission recommended approval of Application 81020 at its April 23, 1981 meeting. b. Application No. 81021 submitted by Brooklyn Development Company for site and building plan approval to construct 100 townhouse units on the westerly and southerly portions of the property at Xerxes and Shingle Creek Parkway. The Planning Commission recommended approval of Application 81021 at its April 23, 1981 meeting. CITY COUNCIL AGENDA -2- May 4, 1981 9. Public Hearing on 63rd Avenue North Improvements Between Beard Avenue and Brooklyn Drive (8:00 p.m.) a. Consideration of Street Improvement Project No. 1981 -10 and Water Main Improvement Project No. 1981 -11 b. Resolution Ordering Improvement 10. Ordinances: a. An Ordinance Vacating a Portion of Noble Avenue Between 66th Avenue and I -94 -This vacation was requested by the adjoining property owner in conjunction with the platting of the property behind the noise wall. The ordinance is recommended for first reading. i b. An Ordinance Amending Chapter 7 of the City Ordinances Relative to Establishing Rules and Regulations and Licensing Provisions Relating to Public Swimming Pools The ordinance is recommended for a first reading. 11. Discussion Items: a. Request for License for Storage and Detonation of Explosives at Howe Fertilizer b. Improvements to Brooklyn Boulevard Municipal Liquor Store • C. Stop Signs at the 73rd Avenue /Newton Avenue Intersection d. MN /DOT /FHWA Approval of Project Development Report for Pedestrian/ Bicycle Bridge Across T.H. 100 at Shingle Creek Y g e. Citizen Attitude /Preference Survey -A rough draft of the survey has been prepared for Council review. f. Jimmy's Lemon Tree -This item involves a correction in the Company identified on the liquor license for the restaurant. The change would transfer the license from WGM Restaurants to JWA Company. g. Contract with Dr. David Braslau to Test Ammonia Gas Monitoring Equipment 12. Gambling License: a. St. Alphonsus Catholic Church - Application for a Class B gambling license (requires a majority vote of the City Council to pass) - Waiver of the $10,000 fidelity bond (requires a unanimous vote of the City Council to pass) 13. Licenses 14. Adjournment Member introduced the following resolution and moved its adoption: RESOLUTION NO. RESOLUTION ESTABLISHING AN INTEREST RATE ON LOANS FROM THE INVESTMENT TRUST FUND TO OTHER FUNDS OF THE CITY OF BROOKLYN CENTER WHEREAS, the City Council of the City of Brooklyn Center did on January 28, 1980, adopt Resolution No. 80 -41 which established an annual interest rate of 7% to be charged on loans made by the Investment Trust Fund to other City funds; and WHEREAS, because of current economic conditions the interest rate of 7% is insufficient; and WHEREAS, the City Council has determined that an annual interest rate of 10% is sufficient and equitable; and I WHEREAS, Minnesota law allows a maximum of 13% annual interest which can be paid on temporary improvement obligations: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota that the annual rate of interest to be charged by the Investment Trust Fund on loans to other City funds be set at 10% retroactive to January 1, 1981. • Date Mayor ATTEST: Clerk The motion for the adoption of the foregoing resolution was duly seconded by member , and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: whereupon said resolution was declared duly passed and adopted. Member introduced the following resolution and moved its adoption: RESOLUTION NO. RESOLUTION AUTHORIZING THE ISSUANCE OF TEMPORARY IMPROVE - MENT NOTES WHEREAS, there is a need for interim financing prior to the selling of bonds to finance certain improvement project costs which are to be assessed against benefitted properties: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, to authorize the issuance and sale by Special Assessment Construction Fund No. 58, Temporary Improvement Notes in the amount of $775,000. These notes shall be dated January 2, 1981, and shall be payable out of proceeds of the final bond issue for the projects. These notes shall bear an interest rate of 10% per annum. BE IT FURTHER RESOLVED that the City of Brooklyn Center Investment Trust Fund be authorized to purchase these notes. BE IT FURTHER RESOLVED that the Mayor and City Manager be authorized to execute the aforementioned notes. RESOLUTION AUTHORIZING EXECUTION OF A SOUND LEVEL METER CUSTODY AGREEMENT WHEREAS, the League of Minnesota Cities and the Minnesota Depart - ment of Transportation has granted to the City of Brooklyn Center a one year renewable contract for a motor vehicle noise enforcement kit; and WHEREAS, the motor vehicle noise enforcement kit will enable the Brooklyn Center Police Department to establish a program of motor vehicle noise level enforcement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that the Mayor and City Manager are hereby authorized to enter into a sound level meter custody agreement with the League of Minnesota Cities. • Date Mayor ATTEST: Clerk The motion for the adoption of the foregoing resolution was duly seconded by member , and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: whereupon said resolution was declared duly passed and adopted. RESOLUTION CPDERIlW3 CONSTRUCTION CF 63RD AVENUE IMPRCVFMnT1',c: STREET ]MPR9vrZA T' PRO= NO. 1981 -10 M'D [,1TER MAIN IMPROVF- MENr PR=T NO. 1981 -11 W]ERFAS, Resolution rb. 81 -77 adopted by the City Council of the City of Brooklyn Center, Minnesota, on April 6, 1981, fixed a date for a public hear ing on the proposed improvement of 63rd Avenue North between Beard Avenue North and Brooklyn Drive by installation of Watermain Improvement Project No. 1981 -10 and Street Improvement Project No. 1981 -11; and WHERFAS, ten days' published notice on the hearing through twn weekly r publications of the required notice was given and the hearing was held thereon on May 4, 1981, at which time all persons desiring to be heard were given an opportunity to be heard thereon; NOW, THEREE'ORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, that such improvements are hereby ordered as pro - posed in the resolution adopted April 6, 1981. DOES ORDAIN AS FOLLOWS: Section 1: That portion of Noble Avenue North below described is hereby vacated as a public street "That part of Noble Avenue North lying north of the north right -of -way line of 66th Avenue Tbrth extended and south of tY:e northerly boundary of Block 3, extended, Northgate Addition, files of e County Recorder, Hennepin County Minnesota . Section 2: The City excepts from the vacation of Noble Avenue North as described above, and reserves to itself and its assigns an easement for all public utility purposes, including without limiting the general nature of said reservation, an easement for electric, gas, sanitary sewer, storm sewer, water and g telephone equipment on over, and under the property above P _ Pm P Pox' Y described as vacated Section 3: This ordinance shall be effective after adoption and thirty (30) days following its legal publication. AN ORDINANCE AMENDING THE BROOKLYN CENTER ORDINANCES BY ADDING NEW PROVISIONS TO CHAPTER 7.202 THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES HEREBY ORDAIN AS FOLLOWS: Section 1. The following Chapter 7.202 of the Brooklyn Center City Ordinances is hereby adopted to read as follows: Section 7- 202.01. LICENSE REQUIRED. It shall be unlawful for any person to operate or permit swimming in a public swimming pool, regardless of whether a fee is charged for such use, unless the City of Brooklyn Center has issued a valid license therefor which is in full force and effect. Such license shall be on display in the vicinity of the subject swimming pool or con- veniently accessible upon demand. Section 7- 202.02. PERSON. The term "person" as it occurs in Section 7- 202.01 shall refer to any person, firm, partnershi association, corporation, company, governmental agency, club, cooperative, or organization of any kind. Section 7- 202.03. PRIVATE SWIMMING POOL. Section 7- 202.01 shall not apply to any swimming _pool located on property which is zoned or used for single family dwellings, or two - family dwellings. Section 7- 202.04. PUBLIC SWIMMING POOL. For the purposes of this licensing requirement, "public swimming pool" shall refer to-all swimming pools within Brooklyn Center, except those defined by Section 7- 202.03. Section 2.
