Pertaining to State Bikeway Grant for Pedestrian /Bicycle Bridge No. 27615 Over Trunk Highway 100 at Summit Drive (S.A.P. 109- 115 -01, T M5402(10)) L_ ` -This resolution formalizes the agreement that NON /DOT provide $25,928.71 in the form of a State Bikeway Grant for construction of the pedestrian/ bicycle bridge over T.H. 100 at Summit Drive. e. Establishing Parks Improvement Project No. 1980 -16 144 F _ S -The resolution comprehends the work involved in constructing the parking lot, trails, basketball and volleyball courts,- and tennis ball walls under the recently approved park bond issue. f. Establishing Brooklane Park Shelter Building Project No. 1980-17/ �_ L The resolution provides for replacement of the shelter building in Brooklane Park. CITY COUNCIL. AGENDA. -2 - Jun 23 , 1980 g. Approving Plans and Specifications and Directing Advertisement for Bids for Brooklane Park Shelter Building Project No. 19'80 -17- (Shelter Building Contract 1980 -I) - Purchase of building materials for.this structure was approved at the I , May 19, 1980 City Council meeting. This resolution provides for the erection of the building materials as well as construction of miscellaneous items associated with the shelter building. h. Establishing Garden City Park Shelter Building Project No. 1980 -18 r't' -This resolution provides for construction of a new shelter building as a replacement for the recently destroyed Garden City Park structure. i. Establishing Central Park Shelter Project No. 1980 -19 -The resolution provides for construction of a Picnic shelter building under the terms of the LAWCON grant for improvements in.Central Park. j. Establishing Arboretum Improvement Project No. 1980 -20 �$ -The resolution comprehends the work to be performed at the arboretum in conjunction with the recently approved park bond issue. 8. Ordinances: a. An Ordinance Vacating that Portion of Irving Avenue North Bounded on the South by the Westerly Extension of the Northerly Line of Lot 1, Block 1,�-� Horbal Addition and on the North by the Easterly Extension of the South Right -of -Way Line of Irving Lane 1980 published on May 29 1980 n M 19 A Y ordinance was first read o a _. -This Y and is presented this evening for a second reading. The vacation of this one -half block of street is consistent with the earlier vacation of the southerly half of this block. Notices have been sent to adjoin- ing property owners and have been published in the official newspaper. b. An Ordinance Amending Chapter 34 of the City Ordinances Regarding Reap Estate Signs I 9"-Whe Council authorized the staff to prepare this amendment at its few May 19, 1980 City Council meeting. The ordinance is recommended for a first reading. �c. An Ordinance Amending Chapter 35 of the City Ordinances Regarding Accessory Off -Site Parking and Joint Parking Facilities- _l -This ordinance amendment is recommended in conjunction with Plannifig Commission Applications No. 80012 and 80013. The ordinance is recommended for a first reading. 9. Planning Commission Items (8:00 p.m.): a. Application No. 80012 submitted by Meridian Construction Company for site and building plan and special use permit approval to rehabilitate the horse barn and hippodrome on the Earle Brown Farm for use as a restaurant / nightclub facility. The Earle Brown Farm is listed on the Minnesota n has preliminarily Register of .Historic Places and p Y been determined eligible for the National Register. The Planning Commission recommended approval of Application No. 80012 at its June 12, 1980 meeting. CITY COUNCIL AGENDA -3- June 23, 1980 b. Application No. 80013 submitted by Meridian Construction Company for special use permit approval to offer live entertainment at the Trades & Trapper Restaurant on the Earle Brown Farm. The Planning Commission recommended approval of Application No. 80013 at its June 12, 1980 meeting. C. Application No. 80018 submitted by Northern States'Power for site and building plan approval to construct a 12,430 square foot addition to the existing NSP north service facility at 4501 68th Avenue North to be used for vehicle storage. The Planning Commission recommended approval of Application No. 80018 at its June 12,.1980 meeting. d. Application No. 80017 submitted by Swenson's Carriage - House -for site and building plan approval and special use permit approval to construct a 17,075 square foot furniture sales store and warehouse on Freeway Boulevard, immediately east of Schmitt Music. The Planning Commission recommended approval of Application No. 80017 at its June 12, 1980 meeting. 10. Charter Commission (8:30 p.m.) 11. Declaration of Surplus Property -It is recommended that a motion be made by the City Council declaring certain handguns in the Police Department as - surplus. Quotes for the purchase of the handguns have been received from two gun, distributors: Officers also have the option of purchasing their handguns from the City and ten of the officers have indicated they wish to buy their guns back. The remaining 26 handguns are recommended to be sold as surplus. 12. Discussion Items: a. Renewal of Employee Assistance Program -It is recommended that a motion be made by the City Council to renew the Employee Assistance Program for another year. b. Continued Board of Equalization Meeting -The staff has completed the reappraisals requested at the June 2, 1980 Board of Equalization meeting and is prepared to discuss these re- appraisals with the Council. C. Northwest Suburbs Cable Communication Commission Joint Powers Agreement The Northwest Suburbs Cable Communications Commission has proposed certain revisions in the joint powers agreement which establish the Commission. The staff is prepared to discuss and make recommendations regarding these proposed revisions. 13. Gambling Licenses: The Rosary Altar Socit Y P of St. AZ honsus Catholic Church -The City Council must act on the following: Application for a Class A gambling license ( requires a majority vote of the City Council). Waiver of $10,000 fidelity bond (requires a unanimous vote of the City Council). 14. Licenses 15. Adjournment Member introduced the following resolution and r p moved its adoption: RESOLUTION N0. RESOLUTION APPROVING SPECIFICATIONS FOR FURNISHING AND DELIVERY OF PLAYGROUND EQUIPMENT AND DIRECTING ADVERTISE- MENT FOR BIDS BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota as follows: 1. The specifications for furnishing and delivery of playground equipment as prepared by the City's Parks and Recreation Director are hereby approved and ordered filed with the City Clerk. 2, The Clerk shall advertise for bids for such equipment by publication at least once in the official newspaper, the date of first_ publication not less than 'ten days prior to the date of receipt of bids. Said notice shall state that no bids will be considered unless sealed and filed and accompanied by a cash deposit, bid bond, cashier's check or certified check payable to the City Clerk in an amount of not less than five per cent of the accompanying bid. 3. Bid date is set for Tuesday, July 15, 1980, at 11 :00 -a.m. 4 The City Manager shall be authorized to open and tabulate the bids. RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED STREET GRADING, BASE '& SURFACING IMPROVE= PROJECT NO. 1978 -45 AND CURB AND GUT'T'ER AND SIDE 1AIX IMPROVEMENT PROJECT NO. 1978 -46 WHEREAS, it is proposed that there be constructed improvements consisting of the following: Project Estimated No. ?mprovement Costs 1978-45 Street grading, base & surfacing on the $ (MSAP 109- westerly and southerly half of Shingle 109 -16, 17) Creek Parkway from Freeway Boulevard to the east property line of Tract A, R.L.S. No. 1274; Shingle Creek Parkway fran the east property line of Tract A, R.L.S. No. 1274 to Xerxes Avenue North; and the northerly and easterly of Shingle Creek Parkway from Xerxes Avenue North to County Road No. 130. 1978 -46 Curb & gutter & sidewalk on the westerly (MSAP 109- and southerly half of Shingle Creek Park- 109-17) way from Freeway Boulevard to the east property line of Tract A, R.L.S. The Council proposes to proceed under authority granted by Chapter 429, Minnesota Statutes. 2. A public hearing on the proposed improvements shall be held at the City Hall, 6301 Shingle Creek Parkway, on Monday, July 7, 1980, at 8 :00 o'clock P.M., central daylight time, and the Clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the City. 3. These proposed improvements shall be designated as Street Grading, Base & Surfacing Improvement Project No. 1978 -45 and Curb & Gutter Improvement Project No. 1978 -46. Date Mayor ATTEST: Clerk The motion for the adoption of the foregoing egoing resolution was duly seconded by member , and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: whereupon said resolution was declared duly passed and adopted.* i E Member ,introduced the following resolution and moved its adoption: RESOLUTION NO. f RESOLUTION AMENDING UTILITIES AGR' BETWEEN BROOKLYN CENTER AND BROOKLYN PARK (73rd Avenue North between Humboldt and Lyndale Avenues North) WHEREAS, the cities of Brooklyn Park and Brooklyn Center entered into an agreement June 16, 1969, whereby sanitary sewer service was provided for certain property along 73rd Avenue North between Humboldt Avenue North and Lyndale Avenue North (West River Road, U.S. Hwy. #169/252) in Brooklyn Park through the Brooklyn Center municipal sewer system; and WHEREAS, this agreement recognized the possibility of future exten- sions of service beyond the limits set therein, contingent upon the approval of both municipalities; and WHEREAS, the owners of an additional 349 feet total frontage (the east 174.5 feet of the Lone Pine Addition and the west 174.5 feet of Lot 2, Watts Brooklyn Acres) have requested permission to connect to the Brooklyn Center sewer system; and WHEREAS, the City Engineer of Brooklyn Center and the City Engineer of Brooklyn Park concur that said extension of the sewer system is feasible; and WHEREAS, the Metropolitan Waste Control Commission and the Minnesota Pollution Control Agency have indicated their approval of said sanitary sewer service extension. =' NOW, FORE, BE IT RESOLVED that upon adoption of this resolution by the City Councils of Brooklyn Center and Brooklyn Park, the agreement of June 16, 1969, between the municipalities shall be amended to include an area 135 feet in extending 349 feet in frontage along 73rd Avenue North easterly from Camden Avenue North. BE IT FURTHER RESOLVED that: 1. The City of Brooklyn Park shall pay to the City of Brooklyn Center the sum of $753.84 (349 feet at $2.16 per front :foot) as assessment, for the sanitary sewer interceptor mains. 2. Sanitary sewer extensions shall be constructed according to the plans approved by the City Engineer of Brooklyn Center. 3. All service availability charges are to be paid through Brooklyn Park. Plumbing permits are to be obtained from Brooklyn Center. 4. The Comprehensive Sanitary Sewer Plan of both cities, shall be amended accordingly. Date Mayor ATTEST: __ ........... . RESOLUTION PERTAINING TO STATE BIKEVRY GRANT FOR PEDESTRIAN/ BICYCLE BRIDGE NO. 27615 OVER T.H. 100 AT SLMIT DRIVE (S.P. 109 - 115 -01, M5402(10)) WHEREAS, the City of Brooklyn Center has applied to the C mnissioner of Transportation for a grant from the Minnesota. Outdoor Recreation Act, Chapter 421 for the develoFmnt of a bikeway from Summit Drive to 59th Avenue North and located within MN T.H. 100 (bike -ped bridge) Road Right -Of -Way. WHEREAS, the amount of the grant has been determined to be $25,928.71 • by reason of the lowest responsible bid. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of • Brooklyn Center, Minnesota does hereby affirm that any cost of the Bikeway in excess of the grant will be the responsibility of the City of Brooklyn Center, and that any grant monies appropriated for the bikeway but not required, based on the final estimate, shall be returned to the Minnesota Outdoor Recreation Fund, Minnesota Department of Transportation. 'BE IT FURTHER RESOLVED that the Mayor and City Manager are hereby authorized to sign and execute on behalf of the City of Brooklyn Center, (county of Hennepin), Grant Agreement Number 27- 0460 -01, with the State of Minnesota, a copy of which was before the City Council. Member introduced the following resolution and moved its adoption: f RESOLUTION NO. .J RESOLUTION ESTABLISHING PARKS IlY1PROVEMII4T PROJECT NO. 1980 -16 AND ORDERING PREPARATION CF PLANS AND SPECIFICATIONS WHEREAS, on May 19, 1980, the City Council declared that the referendum questions addressed in the Special Election of May 6 1980, had been resolved in the affirmative; and WHEREAS, 'a portion of said referendum questions dealt with improve- vents to neighborhood parks in the form of parking lots, pedestrian/bicycle trails, basketball and volleyball courts, tennis ball walls and park lighting and WHEREAS, the City Council deems it necessary to initiate Parks Improvement Project No. 1980 -16 in order to implement the issues addressed in the referendum questions. NOW, THMEFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, to direct the City Engineer to prepare plans and specifications for said improvement project described as follows: 1980 -16 Park Improvements Construction of parking lots, pedestrian/bicycle trails, basketball and volleyball courts, tennis ball walls, and park lighting in the following neighborhood parks within the City of Brooklyn Center: Bellvue, Lion's, Riverdale, Firehouse, East Palmer Lake, Freeway, Orchard Lane, Brooklane, Happy Hallow, Twin Beach, Grandview, Ever- green, West Palmer Lake, Willow Lane, Kylawn, and Northport. BE IT FURTHER RESOLVED that the City Treasurer is hereby directed to encumber the amount of $573,320.00 fran the Capital Projects Fund (Fund No. 25) for construction of this work. RESOLUTION ESTABLISHING BROOKLANE PARK SHELTER BUILDING PROJECT NO. 1980 -17 AND ORDERING, PREPARATION OF PI AND SPECIFICATIONS WHEREAS, the City Council on October 15, 1979, did, in Resolution No. 79 -240, acknowledge the condemnation of the existing shelter building in Brooklane Park and order its demolition; and WHEREAS, the City Council did, in the aforementioned resolution, appropriate $25,000.00 from the Capital Projects Fund to serve as funds for the construction of a replacement structure for the former shelter building; and W[I REAS, the City Council deems it necessary to initiate Brooklane Park Shelter Building Project No. 1980 -17 in order to provide for a replacement structure for the condemned and demolished former shelter building in Brooklane Park. The plans and specifications for the following improvement prepared by the City Engineer are hereby approved and order filed with the City Clerk: Brooklane Park Shelter Building Project No. 1980 -17 2 The City Clerk shall advertise for bids for such improvements by publications at least once in the official newspaper and in the Construction Bulletin, the date of first publication not less than ten (10) days prior to the date for receipt of bids. Said notice shall state that no bids will be considered unless sealed and filed with the City Clerk and accompanied by a cash deposit, bid bond, cashier's check, or certified check payable to the City Clerk in the amount of not less than five per cent (5%) of the bid. 3. RESOLUTION ESTABLISHING GARDEN CITY SHELTER BUILDING PRaJECT NO. 1980 -18 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS ' WHEREAS, on May 19, 1980, the City Council declared that the referendum questions addressed in the Special Election of May 6, 1980, had been resolved in the affirmative; and WHMUAS, a portion of said referendum questions dealt with pro- viding utility services to the Garden City Park Shelter building; and W PEAS, the shelter building in Garden City Park was totally destroyed by fire on May 18, 1980; and WHEREAS, the City expects to receive fire insurance proceeds of approximately $35,000 for replacement of said structure; and WHEREAS, the City 'Council deems it necessary to initiate Garden City Park Shelter Building Project No. 1980 -18 -in order to provide for a replacement structure for the destroyed shelter building and to implement the issues addressed in the referendum questions. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, to direct the City Engineer to prepare plans and specifications for said improvement project described as follows; 1980 -18 Garden City Park Shelter Building Construction of a new shelter building in Brooklane Park. BE IT FURTHER RESOLVED that the City Treasurer is hereby directed to apply the insurance proceeds from the fire to, and encumber the amount of $24,000.00 from the Capital Projects Fund (Fund No: 25) fox construction of this work (Total Estimated Cost = $59,000.00). RESOLUTION ESTABLISHING CENTRAL PARK SHELTER BUILDING PROJECT NO. 1980 -19 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS i WHEREAS, the City of Brooklyn Center has received a LAWCON grant for the purpose of effecting certain improvements in Central Park; and WHEREAS, included in said grant are funds for the construction of a picnic shelter building in the southeast area of Central Park; and WHEREAS, the City Council deems it necessary to initiate Central Park ,Shelter Building Project No. 1980 -19. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, to direct the City Engineer to prepare plans and specifications for said improvement project described as follows: 1980 -19: Central Park Shelter Building o`nstruction of a picnic shelter building in Central Park. BE IT FURTHER RESOLVED that the City Treasurer is hereby directed to encLmber the amount of $33,220 from the LAWCON Fund. (Fund No. 28) for con- struction of this work. NGW, TBEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, to direct the City Engineer to prepare plans and specifications for said improvement project described as follows: 1980 -20 Arboretum Improvements Construction of grading, fencing, landscaping, pedestrian/bicycle trails, pedestrian/bicycle bridge, service road, parking lot, light- ing, benches and miscellaneous items in the Arboretum. BE IT FURTHER RESOLVED that the City Treasurer is hereby directed to encumber the amount of $210,000.00 from the Capital Projects Fund (Fund No. 25) for construction of this work. Section 35 -701 Subdivisipn 3 of the City Ordinances is hereby amended as follows: Section 35 -701 LOCATION OF OFF- STREET PARKING. 3. (b) Accessory off -site parking shall be permitted only on properties located in districts zoned commercial (Cl. C1A, C2) and in- dustrial (I -1 and I -2), and on properties which are institutional uses in residential zones, and having the same or less restrict- ive zoning classification as the principal use. For the purpose of this section of the ordinance, institutional_ uses in resi- d ential zones shall have the same status as Cl -zoned property. (c) Accessory off -site parking shall be limited to one site per each business or industr;al use issued a special use permit. (d) The distance from the furthest point of the accessory off -site parking property to the site of the principal use shall not exceed [300] 800 feet. (e) A minimum of 20 parking spaces must be provided on the off -site parking property. With respect to [nondevelopment complexes] separate individual establish- ments, the City Council may approve the joint use of common parking facilities under the following conditions: 1. The building or use for which application is made to utilize the off- street parking facilities provided by another building or use shall be located within 800 feet of [and contiguous toy such parking facilities [.1 ; and shall not be separated- by a building or use with which it does not share parking facilities in the manner prescribed by this ordinance. In no case will point parking facilities be located across those streets listed in Section 35-701, Su ivision 3 f . 2. The applicant shall show and the City Council must determine that there is no substantial conflict in the principal operating hours and parking demands of the two buildings or uses contem- plating joint use of off - street parking facilities. 3. A properly drawn legal instrument providing for joint use of off- street parking facilities, duly approved by the City Council :as to form and manner of execution'shall be filed as an easement encumbrance upon the title of the property. Section 3. Section 35 -900 of the City Ordinances is hereby amended as follows: 35 -900. DEFINITIONS Parking, Accessory Off -Site - A legal arrangement in which parking spaces, located on property other than that of the principal use, are encumbered solely fo use by the off -site principal use.
