- Tract N of RLS 1325 located on the southerly side ,of'John Martin
Drive between Perkins and State Farm.. Final plat approval is
requested for the subdivision of Tract N of RLS 1325 into two lots
with one of the lots being developed by Burger Brothers.
7. Subdivision Bond Reduction:
-RLS 1409 located on 73rd Avenue North between Logan Avenue and east
of Knox. The bond reduction request is to reduce the financial per
formance guarantee from $3,000 to $1,000.

the Minnesota Department of Transportation have both approved
the project plans and specifications.

recommended that the bid of Clark Landscaping in the amount

9. Acceptance of Fire Department Relief Association Financial Statement
-It is recommended that a motion be made by the City. Council accepting
the Fire Department Relief Association Financial Statement as of
December 31, 1979 in accordance with the State Statutes establishing
the Firemen's Relief Association Pension Fund.
10. Approval of the Purchase of Washing Machine for the West Fire Station
it is recommended that a motion be made by the City _Council approving
the purchase or a washing machine for the West Fire Station to oe paid
from existing 1980 Fire Department capital outlay budget appropriations.
11. Approval of Purchase of a Belt Sander for the Park and Recreation Department
-It is recommended that a motion be made by the City Council approving the
purchase of a belt sander for the Park and Recreation Department to be
paid from the Park and Recreation Department capital outlay budget
appropriations. It is recommended that the quotation of Crystal Electric
An the amount of $225 be accepted.

At the invitation of the Brooklyn Center City Council Senator William
Luther, Representative Robert Ellingson and Representative Lyndon Carlson
will be appearing at this evening's meeting.
14. Discussion Items:
a. Review of State Laws Regulating Gambling
-The staff is prepared to comment on recommended changes in the
State -law governing the licensing of gambling.
b. Municipal Contracts for Refuse Collection
C. Neighborhood Policy Recommendations in the Comprehensive Plan
The Planning Commission has reviewed the neighborhood recommendations
contained in the current Comprehensive Plan and is recommending that
a chapter containing,' neighborhood recommendations be included in
":the new Comprehensive Plan.
d. Consulting Engineer for City Hall Solar Heating System

W MMAS, the City Clerk and the City Engineer have reported that
on March 4 1980, at 11:00 A.M., Central Standard Tires, they opened and tabu-
lated bids received for 53rd Avenue North Reconstruction Project Nos. 1978 -38,
39, and 44 and Project Nos. 1979 -1 and 2, and that said bids were as follows:

WHEWAS, it has been determined by the City Engineer to the satisfaction
of the City Council that the bid of Thomas and Sons Construction is the best bid
submitted.
NOW, , M=ORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota, that the bid of Thomas and Sons Construction, in the
amount of $843,436.00, as to furnishing of all labor, materials, tools, and equip -
ment in connection with the above mentioned irrprovement projects, according to the
} plans and specifications therefore now on file in the office of the City Clerk, is
deemed to be the best bid submitted for said work by a responsible bidder, and
said bid is hereby accepted.
BE IT FURTHER RESOLVED that the Mayor and City Manager are hereby
authorized to execute a contract with said bidder.

March 4, 1980, at 11:00 A.M., Central Standard Time, they opened and tabulated

RESOLUTION AUTHORIZING THE PURCHASE OF A MAINTENANCE
CONTRACT FOR SIX CASH REGISTERS
WHEREAS, the City of Brooklyn Center is authorized to participate
in the Hennepin County Purchasing Agreement;. and
WHEREAS, on Wednesday, July 11, 1979 at 2 :00 p.m. bids were
received for the maintenance of electronic cash registers.
NOW, THEREFORE, BE IT RESOLVED that the bid of Minnesota Cash
Register in the amount of $434.80 each for three DTS 550 Master cash
registers and $406.80 each for three DTS 550 Slave cash., registers
totaling $2,524.80 for the six registers in accordance with specifications
is deemed, to be the best bid submitted by responsible bidders and said
bid is hereby accepted.

RESOLUTION AUTHORIZING THE PURCHASE OF 1,400 FEET
OF 5" FIRE SUPPLY HOSE
WHEREAS, Chapter 471.345 of the Minnesota Statutes provides for
the purchase of merchandise,_ materials or equipment, or any kind of
construction work by informal quotations when the amount of such contract
is less than ten thousand dollars ($10,000); and
WHEREAS, the City Manager has obtained quotations on the purchase
of 1,400 feet of 5 inch supply hose and has determined that the quotation
of Mid Central Fire & Safety, Inc. in the amount of $9,450 ($6.75 /foot) is
the best quotation submitted.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center that the City Manager be authorized to contract for the
purchase of 1,400 feet of 5 inch supply hose in the amount of $9,450 from
Mid Central Fire & Safety, Inc.

RESOLUTION NO.
RESOLUTION AUTHORIZING THE CITY OF BROOKLYN KL N CENTER
TO PARTICIPATE IN THE JUSTICE SYSTEM IMPROVEMENT
ACT OF 1979
WHEREAS, the Justice System Improvement Act of 1979 (JSIA)
reauthorizes and restructures the LEAA Federal Grant -In -Aid Program to
state and local units of government; and
WHEREAS, certain units of local general government are eligible
individually or in combination to function under the JSIA as entitlement
jurisdictions and in that status enjoy significant autonomy with respect
to the utilization of a predetermined allocation of federal funding; and
WHEREAS, units of government within the State of Minnesota must
formally advise the Minnesota Crime Control Planning Board of their inten-
tions regarding participation in the -JSIA.
NOW, THEREFORE, BE IT RESOLVED that the City of Brooklyn Center
formally declares its intention to participate in the JSIA as a member of
the'Hennepin County.Cri.minal Justice Coordinating Council (HCCJCC) under a
joint Hennepin County, City of Minneapolis and suburban unit of government
combination entitlement jurisdiction.

BE IT FURTHER RESOLVED that in the event the Minnesota Crime
Control Planning Board proposes an alternative to entitlement jurisdiction
status which mom: r.taii s t h e integrity of predetermined funding allocations
and provides for the maintenance of cooperative intergovernmental planning
and coordination as embodied in the HCCJCC, such a proposal will be 'considered
by the City of Brooklyn Center at that time.

RESOLUTION NO.
RESOLUTION REGARDING DISPOSITION OF PLANNING COMMISSION
APPLICATION NO. 80004 SUBMITTED BY MR. WILLIAM NORENBERG
WHEREAS, Planning Commission Application No. 80004 was submitted by
Mr. William Norenberg on December 27, 1979 requesting a- special use permit
for a home occupation to build kitchen cabinets in the garage of his home
at 5338 Emerson Avenue North; and
WHEREAS, the Planning Advisory Commission considered the request
at a duly called public hearing on January 10, 1980 at which time testimony
both for and against the petition was taken; and
WHEREAS, the City Council considered the request at a duly called
public hearing on January 28, 1980 at which time testimony both for and
against was taken and
WHEREAS, the application was tabled by the City Council for one
month to allow the applicant and neighboring property owners to meet and
resolve differences relating to the request; and
WHEREAS, the City Council again considered the application at a
duly called City Council meeting on February 25, 1980 at which time it was
reported that the applicant and the neighboring property owners had not
resolved their differences.

! NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
E Brooklyn Center to deny Planning Commission Application No. 80004 submitted

by Mr. William Norenberg for a special use permit for a home occupation to
build kitchen cabinets in the garage of his home at 5338 Emerson Avenue North
on the basis that the Standards for Special Use Permits are not met particu-
larly with respect to the following:
1. The operation as proposed would result in noise and /or
vibrations perceptible beyond the boundaries of the
premises which, in this instance, are considered to be
detrimental to the health and comfort of neighboring
property owners.
2. The proposed hours of operation are considered excessive
and the full utilization of the hours for proposed
home occupation are deemed to be injurious to the use
and enjoyment of other property in the immediate vicinity.
