RESOLUTION NO. 2011 -116
RESOLUTION APPROVING FINAL PLAT FOR BRI MAR SECOND ADDITION
WHEREAS, the Planning Commission has recommended approval for the final plat
for BRI MAR SECOND ADDITION based on certain conditions as set forth in the City Council
Resolution No. 2011 -92; and
WHEREAS, the applicant has applied for approval of the final plat for BRI MAR
SECOND ADDITION as required by City Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota that the final plat for BRI MAR SECOND ADDITION is hereby
approved, subject to the following conditions:
1. Conditions as previously recommended by the Planning Commission
Resolution Nos. 2011 -10, and /or as revised and amended by City Council
actions taken on said development's Preliminary Plan approval in accordance
with City Council Resolution No. 2011 -92.
2. The final plan must incorporate the conditions of approval as indicated in the
Preliminary Plan Review Memorandum dated May 20, 2011, or as required
and approved by the City Engineer.
3. Property owner must provide an executed and certified recorded copy of a
cross access and cross parking agreement between Lot 1 and Lot 2, Block 1
of Bri Mar Second Addition.
4. Property owner must provide an executed and certified recorded copy of a
shared access agreement between Lot 1 and Lot 2, Block 1 of Bri Mar Second
Addition.
5. Property owner must provide an executed and certified recorded copy of an
overall utility facilities easement agreement for all private utility facilities that
will connect into the City's utility system.
6. Property owner must provide executed and certified recorded copies of all
easements required for drainage, utility, streetscape, trail, roadway and signal
system purposes.

7. Existing public easements that are being granted on the final plat must be
released and terminated.
8. Evidence of title satisfactory to the City Attorney and City Engineer.
9. Any other conditions as established by Hennepin County for recording of said
Final Plat.
10. Prior to release by the City of the final, approved plat, the owner must
reimburse the City the full amount of legal fees incurred by the City in
obtaining a review or opinion of title.

The motion for the adoption of the foregoing resolution was duly seconded by member
Kay Lasman
and upon vote being taken thereon, the following voted in favor thereof:
Tim Willson, Carol Kleven, Kay Lasman, and Dan Ryan;
and the following voted against the same: none;
whereupon said resolution was declared duly passed and adopted.
