Adjournm C en• '�' S K 1' C i7�fiG�iC , I CITY MANAGER'S COMMENTS Item 6 Final Pla - t Approval - Northbrook Center Addition Final plat approval for Northbrook Center Addition for which the City 7 Council approved 'the preliminary plat on August 9, 1976 under Planning g Commission Application No. 76025. This item was deferred from the Council meeting of July 10, 1978. Disposition — Item 7 Release Subdivision Bond - Lynn Lee Addition It is recommended that - the City Council authorize final release of the remaining $500 of a $4,150 subdivision bond posted by Mr. William E. Bobendrier for grading, blacktopping, sodding and boulevard , tree improve- ments along Unity Avenue North between 62nd and 63rd Avenue North. All work has now been sa•tisfac torily completed Disposition Item 8 Release Subdivision Bond - Bobendrier's 4th Addition It is recommended that the City Council authorize final release of the remaining $500 of - the $7,200 subdivision bond posted by Mr._ William E. Bobendrier for certain subdivision improvements such as boulevard sod, *trees and street surfacing in the area of Halifax Avenue North from 70th 'to 71 at, Grime s Avenue North from 69th to 71 st and 71 s Avenue be -tween Halifax and Grimes. All work is now completed. Disposition Item 9 Declaring Surplus Property It is recommended that the City Council declare the old city hall, located at 7100 Brooklyn Boulevard, surplus property - to be disposed of according *to provisions of - the City Charter. t Disposition ositzon CITY MANAGER'S COMMENTS Page 2 Item 10a Approving MN /DOT Plans and Specifications for Traffic Noise Barriers and Landscaping Along the South Side of FI -94 groin T.H. 152 to Noble Avenue North The Minnesota Department of Transportation is proposing 'to take bids for.-the above noise abatement project. This is 'the area which involves the remnant property on the south side of 'the freeway, which 'the Minnesota Department of Transportation is purchasing for construction of a noise wall in response to the City of Brooklyn Center's request. Disposition Item 10b Ordering Addition of Alley Paving Improvement Project Nos. 1977 -13 1977 -22 and 1978 -7B, and Street Grading, Base and Surfacing Improvement Project Nos. 1978 -2, 1978 -20, 1978 -24 and 1978 -27 - to Contract 1978 -D The contractor for Utility Contract No. 1978 -D has agreed - to perform - the grading work necessary in the above street projects in accordance with the unit bid prices they have submitted in - the Utility Contract negotiated with 'the City Engineer. Disposition Item 10c Approving Plans and Specifications for Water Tower Maintenance Project No. 1978 -30 and Directing Advertisement for Bids (Utility Contract 1978 -F) The attached resolution comprehends the painting of the one million gallon water tower located at Dupont Avenue North and 69th Avenue North. The bids are scheduled to be opened on August 9, 1978 Disposition Item 10d Establish Water Main Improvement Project No. 1978 -4 and Sanitary Sewer Improvement Project No. 1978 -5 The project provides utility service to - the Real Estate Ten office building located on - the east side of Brooklyn Boulevard just southerly of -the Brooklyn Park city limits. The above utility service will be connected to the City of Brooklyn Park's utility system. The formal agreement will be entered into with 'the City of Brooklyn Park relative - to - the above u'tili'ties prior 'to construction, Disposition CITY MANAGER'S COMMENTS Pa ge 3 Item 10e Setting a Public Hearing Date for Amending - the Schedule of Rates Fees and Charges for - the Use of and Connection - to the Sanitary Sewer System of the City of Brooklyn Center The Metropolitan Waste Control Commission has imposed an industrial users` sewer strength charge upon the users of 'the Metropolitan Disposal System to recover operation and maintenance of the treatment and work attributable - to the strength of - the discharge of industrial wastes. Even .though - the City of Brooklyn Center does not have 'the industries of sewer users - that would fall under the strength charged, it is necessary for - the City to establish such a charge in - the event that existing or new industrial gsers sewer strength should fall under the new sewer strength_ charge. Disposition Item 10f Authorization to Hire a Consultant for a Pilot Program of Evaluating Ground Water Inflow Into Sanitary Sewer Lines It appears that underground water is infiltrating into the sanitary sewer either through cracks in the pipe or by way of basement subdrain systems which are illegally connected to the sanitary sewer system. It is our suspicion that illegally connected basement subdrain systems are causing - the majority of - the problem. It is recommended we retain a consultant to conduct a pilot program in some portions of - the City where we suspect this 'to be occurring. Disposition Item 10g Regarding MN /DOT Noise Variance Request for Construction of FI -94 The attached resolution recommends approval of the Minnesota Department of Transportation's application for a noise variance from the PCA. Disposition Item 10h Accepting Bid Quotations for Fire Department Uniforms The attached resolution is recommended for the purpose of accepting the bid of Cy's Men's Wear for Fire Department unforms. Disposition t CITY MANAGER'S COMMENTS Page 4 Item 10i Expressing Recognition and Gratitude for Dedicated Public Service (3) Attached are three resolutions expressing the City's gratitude for the public service of Blair Tremere as Planning and Inspection Director, Leo Beikler for service on the Housing Commission, and for Gary Livingston ' for his service on - the Conservation Commission. Disposition Item 10j Accepting Bid Quotations for Printing Fall Park and Recreation Program and City Manager's Newsletter The attached resolution is recommended for the purpose of accepting the bid of Brooklyn Printing, Inc. for - the printing of the fall Park and Recreation Program and City Manager's Newsletter. Disposition CITY MANAGER'S COMMENTS Pa ge 6 Item 12a Amending Chapter 35 Regarding Carports and Canopies The attached ordinance is a first reading and is recommended for the purpose of defining carports and canopies. Disposition Item 13 Liquor Licenses - jEM Bowl, Inc. - Earle Brown Bowl' jEM Bowl, Inc. has requested an on -sale liquor license and a Sunday on -sale liquor license for the Earle Brown Bowl to be located at 6440 James Circle. The police department has completed its investigation of the principals involved in - the application and the various other requisites in - the issuance of a liquor license have been met. On the basis of - the police report and liquor license requisites being met, it is recommended that - the City Council authorize - the issuance of a liquor license to jEM Bowl, Inc. for - the subject premises. Disposition Item 14a CEAP Con'trac't, i Mr. Ed Theisen has requested to address the Council relative to the attached CEAP contract. Disposition Item 14b Contract for the Adminis'tra'tion of the Housing Rehabilitation Program with - the Metropolitan Council We will be prepared - to discuss 'the Metropolitan Council's administration of - the Housing Rehabilitation Program Monday evening. I Disposition Item 14c Land Dedication to the City by Dayton Development, Inc. We have received a letter of inquiry from Dayton Hudson Properties inquiring if the City would accept dedication of a 1 .5 acre parcel owned by - their company. The location of - the property parallels Highway 100 on - the east side across from Brookdale. Disposition Member introduced the following resolution and moved its adoption: RESOLUTION N0. RESOLUTION APPROVING MINNESOTA DEPARTMENT OF TRANSPORTATION PLANS AND SPECIFICATIONS FOR TRAFFIC NOISE BARRIERS AND LANDSCAPING ALONG THE SOUTH SIDE OF T.H. 94 FROM T.H. _152 TO NOBLE AVENUE NORTH. WHEREAS, the Commissioner of Transportation for the State of Minnesota has caused to be prepared: plans, special provisions, and specifications for the improvement of Trunk Highway No. 393, renumbered as Trunk Highway No. 94, within the corporate limits of the City of Brooklyn Center, from Noble Avenue to T.H. 152 in Brooklyn Center; and WHEREAS, said plans are on file in the office of the Department of Transportation, St. Paul, Minnesota; being marked, labeled, and identified as: S.P. 2786 -64 (94 =393); and WHEREAS, said special provisions are on file in the office of the Department of Transportation, St. Paul, Minnesota; being marked, labeled, and identified as: S.P. 2786 -64 (94 =393); and which together with the "Minnesota Department of Transportation Standard Specifications for Highway Construction," dated 1978, will govern, and which are on • file in the office of the Commissioner of Transportation, constitute the specifications for said improvement of Trunk Highway No. 393, renumbered as Trunk Highway No. 94; and, WHEREAS, copies of said plans and special provisions as so marked, labeled, and identified are also on file in the Office of the City Clerk; and WHEREAS, the term, "said plans and special provisions," as hereinafter used in the body of this Resolution will be deemed and intended to mean, refer to, and incorporate the plans and 'special pro- visions in the foregoing recitals particularly identified and described; and WHEREAS, the Commissioner of Transportation desires in the interest of public safety that any and all parking of vehicles, if such parking is permitted within the corporate limits of the City of Brooklyn Center, on said Trunk Highway No. 393, renumbered as Trunk Highway No. 94, will be parallel with the curb adjacent to the highway and will be at least 20 feet from any crosswalk. NOW, THEN, BE IT RESOLVED that said plans and special provisions for the improvement of Trunk Highway No. 393, renumbered as Trunk Highway No. 94, within the corporate limits of the City of Brooklyn Center, be and hereby are approved. RESOLUTION NO. BE IT FURTHER RESOLVED that the City of Brooklyn Center does hereby agree to require the parking of all vehicles, if such parking is permitted within the corporate limits of said City, on said Trunk Highway No. 393, renumbered Trunk Highway No. 94, will be parallel with the curb adjacent to the highway, and at least 20 feet from any crosswalks on all public streets intersecting said trunk highway. BE IT FURTHER RESOLVED that the elevations and grades as shown in said plans and special provisions are hereby approved and consent is hereby given to any and all changes in grade occasioned by the construction of Trunk Highway No. 393, renumbered Trunk Highway No. 94, in accordance with said plans and special provisions. RESOLUTION ORDERING ADDITION OF THE GRADING PORTION OF ALLEY PAVING IMPROVEMENT PROJECT NOS. 1977 -13, 1977 -22, AND 1978 -7B AND STREET GRADING, BASE & SURFACING IMPROVEMENT PROJECT NOS. 1978 - 2,`1978 -20, 1978 -24 AND 1978 -27 TO CONTRACT 1978 -D WHEREAS, on June 19, 1978, the Brooklyn Center City Council awarded Contract No. 1978 -D in the amount of $70,335.58 to Walhunt Construction, Inc., on the basis of their bid being the lowest bid received; and WHEREAS, said Contract 1978 -D consists of Water Main, Sanitary Sewer, and Storm Sewer Improvement Nos. 1978 -7A, 17, 18, 19, 21, 22, 23, 25, and 26; and r WHEREAS, the Brooklyn Center City Council has twice rejected bids for Grading & Paving Contract 1978 -E consisting of Alley Paving Project Nos. 1977 -13, 1977 -22 and 1978 -7B, and Street Grading, Base & Surfacing Improvement Project Nos. 1978 -2, 1978 -20, 1978 -24, and 1978 -27, and other related projects because said bids were substantially above the engineer's estimate; and WHEREAS, the majority of the said alley and street surfacing' improvement projects are in the same locations as the utility improvement projects under Contract 1978 -D; and WHEREAS, Walhunt Construction, Inc., has agreed to perform the grading work for the said alley and street improvement projects based upon the unit prices bid under Contract 1978 -D for select granular back- fill, and unit price quotations for common excavation and truck haul, deemed acceptable by the City Engineer; and WHEREAS, the total cost of said grading work amounts to $15,992.50 as computed on the basis of the aforementioned unit prices with said cost representing an increase of 22.7% to the total contract amount of $70,335.58 for Contract 1978 -D. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, that the City Engineer is hereby directed to add the grading portions of Alley Paving Improvement Project Nos. - 1977 -13, 1977 -22, and 1978 -7B, and Street Grading, Base & Surfacing Improvement Projects No. 1978 -2, 20, 24, and 27 to Contract 1978 -D, with payment to be made in accordance with the unit prices received for a total estimated amount of $15,992.50. RESOLUTION NO. RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR WATER TOWER MAINTENANCE PROJECT NO. 1978 -30, AND DIRECTING ADVERTISEMENT FOR BIDS (UTILITY CONTRACT 1978 -F) BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, as follows: 1. The plans and specifications for the following improvements prepared by the City Engineer are hereby approved and ordered filed with the Clerk: Water Tower Maintenance Project No. 1978 -30 2. The Clerk shall advertise for bids for such improvements by publication at least once in the official newspaper and in the Construction Bulletin, the date of first publication not less than ten (10) days prior to the date for receipt of bids. Said notice shall state that no bids will be considered unless sealed, and filed, and accompanied by a cash deposit, bid bond, cashier's check, or certified check payable to the City Clerk in the amount of not less than five per cent (5/) of the bids. 3. Bid date is set for Wednesday, August 9, 1978, at 11 :00 a.m. o'clock, central daylight time, 4. The City Manager and City Engineer shall be authorized to open and tabulate the bids. RESOLUTION ESTABLISHING WATER MAIN IMPROVEMENT PROJECT NO. 1978 -4 AND SANITARY SEWER IMPROVEMENT PROJECT NO. 1978 -5 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS WHEREAS, petitions have been presented to the City Council requesting Water Main Improvement Project No. 1978 -4 and Sanitary Sewer Improvement Project No. 1978 -5; and WHEREAS, the City Council deems it necessary to initiate the above mentioned projects; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center to direct the City Engineer to prepare plans and specifications for said improvement projects, described as follows: 1978 -4 Water Main Beginning 5 feet north of the City limits of Brooklyn Center at an existing water main in Brooklyn Park approx- imately 210 feet west of the Brooklyn Boulevard (T.H. 152) h • right -of -way; thence east along the City limits to Brooklyn Boulevard; thence southeasterly approximately 165 feet along the southeast edge of said right -of -way; thence across Brooklyn Boulevard to a point approximately 55 feet south of the City limits on the northeast right- of-way line of Brooklyn Boulevard. 1978 -5 - Sanitary Sewer Beginning 15 feet north of the City limits of Brooklyn Center at an existing sanitary sewer manhole approximately 204 feet west of the Brooklyn Boulevard (T.H. 152) right -of -way; thence east along the City limits to Brooklyn Boulevard; thence southeasterly approximately 160 feet along the southeast edge of said right -of -way; thence across Brooklyn Boulevard to a point approximately 44 feet south of the City limits on the northeast right -of -way line of Brooklyn Boulevard. RESOLUTION REGARDING THE MINNESOTA DEPARTMENT OF TRANSPORTATION'S REQUEST FOR VARIANCE FROM THE MINNESOTA POLLUTION CONTROL AGENCY NIGHT TIME NOISE STANDARDS WHEREAS, the Minnesota Department of Transportation in conjunction with the construction of T.H. 94, has requested a variance from the Minnesota Pollution Control Agency to exceed the night time noise standard of 55 dBA; and WHEREAS, the Minnesota Department of Transportation, formerly known as the Minnesota State Highway Department, has been in the process of building said T.H. 94 through the City of Brooklyn Center for the past twenty years; and WHEREAS, numerous delays in construction of said T.H. 94 caused by governmental jurisdictions and agencies have disrupted the development of the City of Brooklyn Center; and WHEREAS, the City Council of the City of Brooklyn Center objects' to the delay in construction of the freeway noise abatement project on T.H. 94 between Xerxes Avenue North and T.H. 152 earlier proposed to be ` constructed in 1978, and to any further delays in the construction of said T.H. 94; and 'WHEREAS, the City of Brooklyn Center commends the Minnesota . Pollution Control Agency for their concern in protecting the residents abutting the said freeway but does not feel that granting the Minnesota Department of Transportation a variance of 6 decibels from the night time noise standards of 55 decibels between 6 :00 and 7:00 a.m, to be damaging to the health, safety, and general welfare of the residents of the City of Brooklyn Center; and WHEREAS, the City of Brooklyn Center has conducted a survey of residents abutting the proposed freeway and the results of said survey indicate that the majority of responding abutting residents do not want the proposed noise walls raised any higher, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that the City of Brooklyn Center opposes the raising of the proposed noise abatement walls along T.H. 94 in order to meet Minnesota Pollution Control Agency night time noise standards, BE IT FURTHER RESOLVED that the City urges the Minnesota Pollution Control Agency not to further delay construction of F.I. 94 and to grant a variance to the Minnesota Department of Transportation of six decibels from the night time standards of 55 decibels for the period from 6:00 a.m. to 7 :00 a.m. RESOLUTION NO. , Date Mayor ATTEST: Clerk The motion for the adoption of the foregoing resolution was duly seconded by member , and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: whereupon said resolution was declared duly passed and adopted. RESOLUTION AUTHORIZING THE PURCHASE OF FIRE DEPARTMENT UNIFORMS WHEREAS, Chapter 471.345 of - the Minnesota Statutes provides for - the purchase of merchandise, materials or equipment, or any kind of construction work by informal quotations when - the amount of such contract is less than - ten - thousand dollars ($10,000); and WHEREAS, - the City Manager has obtained quotations on the purchase of Fire Department uniforms and has determined -that the quotation of Cy's Men's Wear in the amount of $2,418.95 is - the best quotation submitted. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that the City Manager be authorized 'to contract for the purchase of Fire Department uniforms in the amount of $2 from Cy's Men's Wear, 507 West Broadway, Minneapolis, Minnesota. RESOLUTION EXPRESSING RECOGNITION OF AND APPRECIATION FOR THE DEDICATED PUBLIC SERVICE OF DIRECTOR OF PLANNING AND INSPECTIONS BLAIR TREMERE WHEREAS, Mr. Blair Tremere served as Administrative Assistant from March, 1971 through April, 1973 and Director of Planning and Inspections from April, 1973 through June, 1978; and WHEREAS, his devotion to the tasks and responsibilities associated with this position contributed substantially to the sound progress and development of the City; and WHEREAS, his public service and civic effort for the betterment of the community merit the gratitude of the citizens of Brooklyn Center: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City_ of Brooklyn Center that: The dedicated public service of Mr. Blair Tremere as Director of Planning and Inspections is recognized and appreciated by the City of Brooklyn Center. 'RESOLUTION AUTHORIZING THE PURCHASE OF PRINTING OF THE FALL RECREATION PROGRAM AND CITY MANAGER'S NEWSLETTER WHEREAS, Chapter 471.345 of the Minnesota Statutes provides for the purchase of merchandise, materials or equipment, or any kind of construction work by informal quotations when the amount of such contract is less than ten thousand dollars ($10,000); and WHEREAS, the City Manager has obtained quotations on the purchase of printing of the Recreation Program and City Manager's Newsletter and has determined that the quotation of Brooklyn Printing, Inc. in the amount of $2, 048.00 is the best quotation submitted. AN ORDINANCE AMENDING CHAPTER 35 OF THE CITY ORDINANCES RELATIVE TO CANOPIES AND CARPORTS THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 1. Section 35 -310 (1) (b) (3) and Section 35 -311 (1) (b) (3) are hereby amended - to read as follows: (3) One accessory building or carport (either detached or attached to - the dwelling building) where - the dwelling building ground coverage area does not exceed 880 square feet; in the event •the ground coverage area of - the dwelling building exceeds 880 square feet, two accessory buildings or carports (either detached or attached to the dwelling building) will be permitted provided that no one accessory building or carport shall exceed 75% of - the ground coverage area of - the dwelling building or 1000 square feet, which- ever is lesser; and provided that - the total area of both accessory buildings or carports (either detached or attached - to - the dwelling building) shall not exceed 100% of - the ground coverage area of - the dwelling building, or 1100 square feet, whichever is lesser. Section 2. Section 35 -900 of - the City Ordinances is hereby amended, in part, by - the addition of -the following: Canopy - an accessory roof -like s'truc'ture, either attached - to or d etacFiEd from a permitted building, open on all sides, other - than where attached; which is located over and designed to provide temporary cover for entrances, exits walkways, and approved off- street vehicle service areas (such as gasoline stations, drive -in establishments, and loading berths) . Carport - an accessory roof -like structure, either attached - to or _ etac�hR from a permitted building, enclosed on not more - than - two sides, which is designed - to provide cover for approved off - street vehicle parking or vehicle storage space. RESOLUTION REQUESTING THE METROPOLITAN COUNCIL HRA TO APPLY FOR REHABILITATION GRANT FUNDS FOR THE CITY OF BROOKLYN CENTER WHEREAS, the City of Brooklyn Center desires to assist low income homeowners in making repairs to their homes for the purpose of correcting defects affecting directly the safety, habitability, energy usage, or accessibility of the property; and WHEREAS, the Minnesota Housing Finance Agency has funds to be used for such purposes, and will accept applications from housing and redevelopment authorities desiring to administer these Home Improvement Grant Program funds; and WHEREAS, the Metropolitan Council has been duly organized pursuant to Minnesota Statutes 1976, Section 473.123 and has all of the powers and duties of a housing and redevelopment authority pursuant to Minnesota Statutes 1976, 473.193 under the provisions of the Municipal Housing and Redevelopment Act, Minnesota Statutes 1976, Sections 462.411 to 462.711; and NOW, THEREFORE, BE IT RESOLVED that the Metropolitan Council is hereby requested to include the City of Brooklyn Center in an application for State Home Improvement Grant Program funds and that upon approval of such application, the City and the Metropolitan Council will enter into an agreement for operating the program within the City.
