Licenses 12 Adjournmerrt CITY MANAGER'S COMMENTS Item 6a Requesting Hennepin County - to Apply for MHFA,Home Improvement Grant Funds The attached resolution is recommended for - the purpose of requesting Hennepin County - to apply for Minnesota Housing Finance Agency Home Improvement Grant funds for implementation within 'the City of Brooklyn Center. Hennepin County will be submitting an application to become an administering entity for the Home Improvement Grant Program during Phase III, and the resolution conveys the City's intention to participate further in - the program. The Metropolitan HRA has served -this function for Hennepin County communities during Phase I and Phase II. A this- time, Brooklyn Center's allocation for Phase III is unknown, but once a contract has been furnished - the City and it has been reviewed, authorization will be sought to enter into an agreement for operating 'the program within 'the City. Disposition Item 6b Amending 1978 General Fund Budget The attached resolution is recommended for the purpose of - transferring $11,966 from - the Unallocated Labor appropriation Ito various departmental appropriations -to provide for wage and salary adjustments previously approved by the' City Council. Di spos i , tion Item 6c Establishing Public Hearing for Water Main Improvement Project No. 1978 -17, Sanitary Sewer Improvement Project No. 1978 -18, Storm Sewer Improvement Project No. 1578 -19, and S'tree't Grading, Base & Surfacing Improvement Project No. 1978 -20 The a - ttached resolution is recommended for the purpose of establishing June 19, 1978 at 8:00 p.m. as -the date and 'time for the public hearings on the above improvement projects. The improvements are to be installed along Irving Avenue North and Irving Lane within - the proposed Irving Es'ta subdivision which lies between 69th and 70th Avenues North on the west side of Irving Avenue. Disposition Item 6f Approving Plans and Directing Advertisement for Bids for Contract 1978 -D The attached resolution is recommended for the purpose of approving plans and specifications for Water Main Improvement Project Nos. 1978- 17 and 1978 -21; Sanitary Sewer Improvement Project Nos. 1978 -18, 1978 -22 and 1978 -25; Storm Sewer Improvement Project Nos. 1978 -19, 1978 -23 and 1978 -26; and Alley Paving Improvement Project No. 1 1978 -72. The resolution also directs advertisement for bids for U'tili'ty Contract fi78 -D. The bids are scheduled - to be opened at 11:00 a.m. on Monday, June 19, 1978. 1 Disposition f 3 CITY MANAGER'S COMMENTS Pa ge 3 Item 6g' Approving Plans and Directing Advertisement for Bids for Contract 1978 -E The attached resolution is recommended for - the purpose of approving plans and specifications for S'tree't Grading, Base and Surfacing Improvement Project Nos. 1978 -20, 1978 -24 and 1978 -27; Curb and Gutter Improvement Project No. 1978 -28; Street Grading, Base and Surfacing, and Curb and Gutter Project No. 1978 -2; Alley Paving Improvement Project Nos. 1977. -13; 1977 -22 and 1978 -7B. The resolution also directs advertisement for bids for Contract J478 -E. The bids are scheduled to be opened a 11:00 a.m. on Monday, June 19, 1978. Disposition Item 6h Ordering Construction of Alley Paving Improvement Project No. 1978 -7 This resolution is offered should - the public hearing on Alley Paving Improvement Project No. 1978 -7, scheduled for 8:00 p.m , be favorable. Disposition Item 7 Continued Public Hearing on Alley Paving Improvement Project No. 1978 -7 (8:00 p.m.) The public hearing for Alley Paving Improvement Project No. 1978 -7 which comprehends alley paving between Humboldt and Irving Avenues North from 53rd to 54 Avenue was continued by the City Council from - the May 22, 1978 meeting. Since that - time a petition has been received from 57% of - the property owners requesting - the installation of - the alley. Disposition Item 8a Application No. 77064 submitted by Gene Hamilton Appeal from administrative ruling regarding structural addition at 6230 Lee Avenue North. This item was considered by the Planning Commission at its November 10, December 8 and 15, 1977 and February 23 and May 11, 1978 meetings. Disposition 4 CITY MANAGER'S COMMENTS Page 4 Item 8b Application No. 78023 submitted by BLIP Special use permit for "game room" activities. This item was considered by the Planning Commission at its May 11, 1978 meeting and was tabled by - the City Council on May 22, 1978 because the applicant was not present. Disposition Item 8c Application No. 78029 submitted by Meadow Corporation Site and building plan approval for phase addition of "The Ponds" planned residential development at the northerly portion near 73rd Avenue North and Unity Avenue North. This item was considered by 'the Planning Commission at its May 11 and May 25, 1978 meetings, Disposition Item 9a Amending Chapter 35 Relative - to Carports and Canopies (ls•t reading) The attached ordinance amendment is recommended for - the purpose of clarifying - the definition of carports and canopies in - the City's Zoning Ordinance. The ordinance has been reviewed and is recommended by the Planning Commission. Disposition Item 10a CEAP We will be prepared to discuss and make various recommendations regarding -the City's future relationship to CEAP. Disposition Ttem 10b Explosives License for Howe Inc. It is recommended - that an explosives license for Howe, Inc. be authorized by the City Council (see M & C No. 78 -19) . We will be prepared - to discuss in more detail - the activities involved in - the licensing at Monday evening's meeting. Disposition Member introduced the following resolution and moved its adoption: RESOLUTION NO. RESOLUTION REQUESTING HENNEPIN COUNTY TO APPLY FOR MINNESOTA HOUSING FINANCE AGENCY HOME IMPROVEMENT GRANT FUNDS FOR IMPLEMENTATION WITHIN THE CITY OF BROOKLYN CENTER WHEREAS, the City of Brooklyn Center desires to assist low income homeowners in making repairs to their homes for the purpose of correcting defects affecting directly the safety, habitability, or energy usage of the property; and WHEREAS, the Minnesota Housing Finance Agency has funds to be used for such purposes, and will accept application from counties desiring to administer these Home Improvement Grant Program funds;' NOW, THEREFORE, BE IT RESOLVED, that Hennepin County is hereby requested to include the City of Brooklyn Center in an application for Minnesota Housing Finance Agency Home Improvement Grant Program funds, and that upon approval of such application, the City will consider entering into an agreement with the County for operating the program within the City. RESOLUTION AMENDING THE 1978 GENERAL FUND BUDGET TO PROVIDE FOR WAGE AND SALARY ADJUSTMENTS WHEREAS; Section 7.08 of the City Charter of the City of Brooklyn Center does provide that the City Council may, by majority vote of its members, transfer unencumbered appropriation balances from one office, department or agency to another within the same fund; and WHEREAS, on October 3, 1977, the City Council of the City of Brooklyn Center adopted a budget for the calendar year 1978; and WHEREAS, when said budget was adopted, 1978 salaries and wages for most City employees had not been set; and WHEREAS, the City Council did appropriate funds for departmental labor in the amount of $115,000 to Unallocated Departmental Labor to provide funds for final 1978 salary and wage settlements; and WHEREAS, on December 12, 1977, the City Council did adopt Resolution No. 77 -243 which set salaries and wages for the year 1978 for all nonorganized City employees; and WHEREAS, on December 12 1977, the City Council did adopt Resolution No. 77 -244 which increased the maximum City contribution for the cost of group health plans for each of its nonorganized permanent full -time employees by $10 per month; and WHEREAS, on February 27, 1978, the City Council did adopt Resolution No. 78 -36 which amended the 1978 General Fund Budget to provide for said wage and salary adjustments; and WHEREAS, on March 20, 1978, the City Council did authorize the Mayor and City_ Manager to sign a memorandum of understanding between the International Union of Operating Engineers, Local #49 and the City of Brooklyn Center regarding an increase in wages and insurance contributions for 1978; and WHEREAS, on March 20, 1978, the City Council did also authorize the City Manager to increase the salaries of the City's nonorganized permanent full -time employees by .8% effective April 2, 1978: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center to transfer $11,966 from the Unallocated Labor appro- priation (Account No. 01 -4100- 000 -81) to the following departmental appropr- ations to provide for said wage and salary adjustments: RESOLUTION NO. RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED WATER MAIN IMPROVEMENT PROJECT NO. 1978 -17, SANITARY SEWER IMPROVEMENT PROJECT NO. 1978 -18, STORM SEWER IMPROVEMENT PROJECT NO. 1978 -19, AND STREET GRADING, BASE & SURFACING IMPROVEMENT PROJECT NO. 1978 -20 WHEREAS, it is proposed that there be constructed improvements consisting of the following: Estimat ed Project No Improvement Cost 1978 -17 Water main on Irving Avenue North from approx- imately 165 feet south of 70th Avenue North to 69th Avenue North; proposed Irving Lane from approximately 723 feet east of jogan Avenue North to Irving Avenue North; and water serv- ices on the north side of 69th Avenue North from Irving Avenue North westerly approximately 245 feet. $22,150.00 1978 -18 Sanitary sewer on proposed Irving Lane from an existing manhole 718 feet east of Logan Avenue North easterly 118 feet. $ 3,200.00 1978 -19 Storm sewer on Irving Avenue North from 70th Avenue North to proposed Irving Lane $10,000.00 1978 --20 Street grading, base and surfacing on Irving Avenue North from approximately 155 feet south of 70th Avenue North to proposed Irving Lane; and proposed Irving Vane from approx - imately 738 feet east of Logan Avenue North to Irving Avenue North. $15,750.00 WHEREAS, the City Engineer has made a preliminary report advising that said proposed improvements are feasible and that they can be constructed at estimated costs as indicated above. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, as follows: 1. `The Council proposes to proceed under authority granted by Chapter 429, Minnesota Statutes. RESOLUTION NO. 2.. A public hearing on the proposed improvements shall be held at the City Hall in the City on Monday, June 19, 1978, at 8:00 o'clock P.M., central daylight time, and the Clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the City. 3. The areas proposed to be assessed for said improvements are described as follows: a. Water Main Improvement Project No. 1978 -17, Sanitary Sewer Improvement Project No. 1978 -18, and Street Grading, Base & Surfacing Improvement Project No. 1978 -20: ALT, LOTS AND PARCELS ABUTTING THE ABOVE DESCRIBED STREETS AND /OR TO BE BENEFITED BY THE IMPROVEMENTS. b. Storm Sewer Improvement Project No, 1978 -19: That portion of the South 1/2 of Section 26, T. 119N, R.21W bounded on the south by the north right --of -way line of 69th Avenue North;. and bounded on the west by the west line of Gregor's Addition extended northerly and southerly, and bounded on the north by a line 50 feet southerly of and parallel with the south right -of -way line of 70th Avenue North; and bounded on the east by the east right -of -way line of Irving Avenue North; and that portion of the west one -half of Lot 3, Block 1, Horbal Addition lying southerly of a line 155 feet southerly and parallel with the north line of said lot and lying northerly of a line 75 feet northerly of and parallel with the south line of said lot; and Lot 1, Block 1, Horbal Addition. 4. These proposed improvements shall be designated as Water Main Improvement Project No. 1978 -17, Sanitary Sewer Improvement Project No. 1978 -18, Storm Sewer Improvement Project No. 1978 -19 and Street Grading, Base & Surfacing Improvement Project No. 1978 -20. The Council proposes to proceed under authority granted by Chapter 429, Minnesota Statutes. 2. All that part of Section 36, T. 119, R. 21, Hennepin County, Minnesota, bounded on the east by the east line of Swanco Terrace Addition; bounded on the south by a line 80 feet northerly and parallel. with the centerline of 68th Avenue North; and bounded on the west by the west line of Gunderson's Addition; and bounded on the north by a line 168 feet southerly and parallel with the centerline of 69th Avenue North. 4. These proposed improvements shall be designated as Water Main Improvement Project No. 1978 -21, Sanitary Sewer Improvement Project No. 1978 -22, Storm Sewer Improvement Project No. 1978 -23, and Street Grading, Base & Surfacing Improvement Project No. 1978 -24. WHEREAS, it is proposed that there be constructed,improvements consisting of the following: Estimated Project No Improvement Cost 1978 -25 Sanitary sewer on proposed James Circle from Freeway Boulevard southerly approx- imately 545 feet. $ 11,550.00 1978 -26 Storm sewer on the south side of Freeway Boulevard from proposed James Circle easterly approximately 200 feet to an existing inlet on Freeway Boulevard. $ 4,400.00 1978 -27 Street grading, base & surfacing on proposed James Circle from Freeway Boulevard southerly approximately 570 feet to cul-de- sac. $ 22,300.00 1978 -28 Curb & gutter on proposed James Circle from Freeway Boulevard southerly approx- imately 570 feet to cul -de -sac. $ 7,350.00 WHEREAS, the City Engineer has made a preliminary report advising that said proposed improvements are feasible and that they can be constructed at estimated costs as indicated above. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, as follows: 1. The area proposed to be assessed for Sanitary Sewer Improvement Project No. 1978 -25 and Storm Sewer Improvement Project No. 1978 -26 is described as follows: All those parts of Tract B, Registered Land Survey No. 1477 and Lot 1, Block 1, Brooklyn Center Industrial Park Plat 2, except streets, lying westerly of the following described line: Beginning at a point on the northerly line of Tract B, Registered Land Survey No. 1477, 260.12 feet westerly of the northeast corner thereof, thence S.3 26' 45 "E. 492.43 feet, thence S.86 33' 15 "W. 259.10 feet, thence S.17 07' 48 "W. "259.30 feet to a point on the southerly line of Lot 1, Block 3, Brooklyn Center :industrial Park Plat 2 and there terminating, b. The area proposed to be assessed for Street Grading, Base & Surfacing Improvement Project No. 1978 -27 and Curb & Gutter Improve - ment Project No. 1978 -28 is described as follows: All property lying north of F.A.I. 94 bounded on the - north by County Road No. 130, on the west by the west line of Section 35, T. 119,, R. 21, and or the east,by the following described line: Commencing at the northeast corner of Outlot A, Twin Cities Interchange Park, thence southerly on the easterly line of said Outlot A to the southeast corner of said Outlot A, thence southerly to the northwest corner of Lot 1, Block 1, Twin Cities Inter- change Park, thence southerly on the westerly line of said Lot 1, to the northerly right -of -way line of 65th Avenue North, thence easterly on the north right -of- way line of 65th Avenue North to Humboldt Avenue North, thence southerly along the westerly right -of -way line of Humboldt Avenue North to F.A.I. 94 and there terminating; and except for Tracts B, C, & D of R.L.S. RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR WATER MAIN IMPROVEMENT PROJECTS NO. 1978 -17 AND 1978 -21; SANITARY SEWER IMPROVEMENT PROJECTS NO. 1978 -18, 1978 -22, AND 1978 -25; STORM SEWER IMPROVEMENT PROJECTS NO. 1978 -19, 1978 -23, AND 1978 -26; AND ALLEY PAVING IMPROVEMENT PROJECT NO. 1978 -7A, AND DIRECTING ADVERTISEMENT FOR BIDS (UTILITY CONTRACT 1978 -D) BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, as follows: 1. The plans and specifications for the following improvements prepared by the City Engineer are hereby approved and ordered filed with the Clerk: Water Main Improvement Projects No. 1978 -17 and 1978 -21 Sanitary Sewer Improvement Projects No. 1978 -18, 1978 -22 and 1978 -25 Storm Sewer Improvement Projects No. 1978 -19, 1978 -23 and 1978 -26 Alley Paving Improvement Project No. 1978 -7A 2. The Clerk shall advertise for bids for such improvements by publication at least once in the official newspaper and in the Construction Bulletin, the date of first publication not less than ten (10) days prior to the date for receipt of bids. Said notice shall state that no bids will be considered unless sealed and filed and accompanied by a cash deposit, bid bond, cashier's check or certified check payable to the City Clerk in the amount of not less than five per cent (S/) of the bids. 3. The Mayor announced that the meeting was open for the con - • sideration of proposed Alley Paving Improvement Project No. 1978 -7. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on May 18, 1978, which affidavit was examined and found satis- factory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvements member introduced the following resolution and moved its adoption: RESOLUTIO14 NO. AN ORDINANCE AMENDING CHAPTER 35 OF THE CITY ORDINANCES R ELATIVE TO CANOPIES AND CARPORTS THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 1. Section 35 -310 (1) (b) (3) and Section 35 -311 (1) (b) (3) are hereby amended to read as follows: (3) One accessory building or carport (either detached or attached 'to 'the dwelling building) where the dwelling building ground coverage area does not exceed 880 square feet; in the event - the ground coverage area of - the dwelling building exceeds 880 square feet, - two accessory buildings or carports (either detached or attached 'to - the dwelling building) will be permitted provided that no one accessory building or carport shall exceed 75% of - the ground coverage area of the dwelling building or 1000 square feet, which- ever is lesser; and provided that 'the - total area of both accessory buildings or carports (either detached or attached to the dwelling building) shall not exceed 100% of the ground coverage area of the dwelling building, or 1100 square feet, whichever is lesser.
