Adjournment I • • 1 CITY MANAGER'S COMMENTS Item 6 Final Plat Approval It is recommended - that the City Council approve the final plat for 'the Realty Terrace Addition comprehending property at -the northeast quadrant of Brooklyn Boulevard and 70th Avenue North. The preliminary plat was approved on August 11, 1977 - through Planning Commission Application No. 77033. Disposition Item 7 Authorize Execution of an Agreement It is recommended that the City Council authorize the Mayor and -the City Manager to enter into an agreement with Bather, Ringrose, Wolsfeld, Jarvis and Gardner, Inc, for planning and consulting services related to - the comprehensive planning process mandated by State law, Disposition Item 8a Commending Brooklyn Center High School Office Education Association Chapter The attached resolution is recommended for -the purpose of commending Mr. Dick Lawrence and - the Brooklyn Center High School Office Education Associa- tion Chapter for being named Chapter of the Year in national competition. Disposition Item 8b Recommending Home Improvement Grants The attached resolution is recommended for -the purpose of recommending home improvement grants to eligible Brooklyn Center homeowners. The proposal has been reviewed and recommended by the Brooklyn Center Housing Commission. Disposition •i CITY MANAGER'S COMMENTS Page 2 • Item 8c Authorizing - the Purchase of Sign Posts The attached resolution is recommended for -the purpose of authorizing, through - the Hennepin County joint purchasing agreement, the purchase of 300 - 7 foot sign posts from the M & R Sign Company of Fergus Falls, Minnesota for $1,272. Disposition Item 8d Accepting Bid for Tiling Community Center Pool The attached resolution is recommended for the purpose of accepting -the bid of Land -O- Lakes Tile Company for - tiling - the community center - swimming pool. Bids for `this project were opened on May 16, 1978 and this bid is deemed `to be - the best bid submitted by a responsible bidder. Disposition Item 8e Approving Amendments - to - the Fire Relief Association Bylaws • The attached resolution is recommended for -the purpose of amending the bylaws of - the Brooklyn Center Fire Department Relief Association 'to authorize increased monthly pension benefits for members Disposition Item 8f Approving MN /DOT Plans for Portion of 1 -94 West of T.H. 152 The attached. resolution is recommended for - the purpose of approving MN /DOT plans for traffic noise attenuators and landscaping on portions of 1-94 west of T. H. 152. The subdivision lies between 69th and 70th Avenue North on 'the west side of Irving Avenue. '1977 -22, 1978 -7, 1978 -8, 1978 -9, 1978 -10, 1978 -11, 1978 -12, 1978 -13, and 1978 -14 should the public hearings on these projects be favorable. Disposition Item 9 Public Hearing on Alley Paving Improvement Project Nos. 1977 -22, 1978 -7, ` 1978 -8, 1978 -9, 1978 -10, 1978 -11, 1978 -12, 1978 -13 and 1978 -14 (8 :00 p.m.) A public hearing has been scheduled for 8:00 p.m. on - the above- stated alley paving improvement projects. This item was considered by the Planning Commission at its May 11, 1978 meeting. Disposition Item 10c Application No. 78026 submitted by Harvey Stevens Variance from Chapter 35 - to permit house addition to noncomplying structure in R -2 district at 5334 Fremont Avenue North. This item was considered by - the Planning Commission at its May 11, 1978 meeting. Disposition Item 10d Application No. 78028 submitted by Robert Grosshans Variance from Section 35 -400 - to permit house addition with approximate 8 foot encroachment into rear yard at 6920 Lee Avenue North. (See M & C No. 1978 -15) Disposition Item 12b Status of Police Officer, Arbitration We will be prepared to review the status of the arbitration ' ca s e between MAMA and Local #320. (See M & C No: 1978 -14) Disposition • Member introduced the following resolution and moved its adoption: RESOLUTION NO. RESOLUTION COMMENDING BROOKLYN CENTER HIGH SCHOOL OFFICE EDUCATION ASSOCIATION CHAPTER WHEREAS', the Brooklyn Center High School Office Education Association has been named Chapter of the Year in national competition among some 4,000 students from twenty -one states; and WHEREAS, this award has brought recognition to the City; and WHEREAS, the success of the Chapter contributes substantially to the pride and cohesiveness of the community; and WHEREAS, the accomplishments of this group merits the gratitude and recognition of the citizens of Brooklyn Center. RESOLUTION ENDO RSING HOME IMP ROVEMENT - GRANT REQUES WHEREAS, Council Resolution No. 77 -138, adopted July 11, 1977, requested the Metropolitan Council Housing and Redevelopment Authority to apply for Reha- bilitiative Grant funds for the City of Brooklyn Center; and WHEREAS, the City.was allocated a total grant amount of $19,£02.00; and WHEREAS, following a 7% deduction for'administr•ative costs, the balance of grant funds is $18,229.86; and WHEREAS, grant applications for eligible work have been submitted by eligible homeowners and said applications have been reviewed and evaluated according to State criteria; and WHEREAS, said applications were reviewed and evaluated by the Housing Advisory Commission on April 26 and May 16, 1978 and ranked according to the Selection Criteria adopted by the Council on January 23, 1973; and WHEREAS, said applications are to be now referred to the MHRA and the Minnesota Housing Finance Agency for final approval: . RESOLUTION AUTHORIZING THE PURCHASE OF 300 - 7' SIGN POSTS WHEREAS, -the City of Brooklyn Center is authorized -to participate in the Hennepin County Purchasing Agreement; and WHEREAS, on Tuesday, April 18, 1978 at 2:00 p.m. bids were received for the furnishing and delivery of 300 - 7 foot sign posts 4 NOW, THEREFORE, BE IT RESOLVED - that - the bid of M & R Sign Company of Fergus Falls, Minnesota in - the amount of $4.24 each totaling $1,272 in accordance with -the specifications is deemed ;to be the best bid submitted by responsible bidders and said bid is hereby accepted. RESOLUTION ACCEPTING BID FOR TILING THE SWIMMING POOL IN THE COMMUNITY CENTER WHEREAS, the Director of Public Works and the City Clerk have reported that on May 16, 1978, at 3 :00 p.m., they opened and tabulated bids received for the tiling of the swimming pool and that said bids were as follows Bidder Base Bid Unit Price/S.F. RESOLUTION APPROVING AMENDMENTS TO T11E BYLAWS OF THE BROOKLYN CENTER FIRE DEPARTMENT RELIEF ASSOCIATION WHEREAS, on May 24., 1967 "an act relating to the Firemen's Relief Association of the City of Brooklyn Center; providing certain benefits for volunteer firemen and their survivors; authorizing tax levies, providing for the administration of the fund" was signed into law; and WHEREAS, on June 12, 1967 the City Council enacted Resolution No. 67 -189 approving the provisions of the act; and WHEREAS, the act provides among other things that the bylaws of the Fire Relief Association and any amendments thereto shall not be effective unless approved by the City Council of Brooklyn Center; and WHEREAS, on January 22, 1969 the City Council enacted Resolution No. 69 -38 approving the bylaws of the City of Brooklyn Center Fire Department Relief Association as set forth in a draft dated December 19, 1968 which established benefits within the framework provided by the pension act and specifically increased from $40 to $100 the monthly pension earned after twenty year's service; and WHEREAS, on March 30, 1970 the City Council first amended the bylaws to • revise the definition of early retired member; and WHEREAS, on February 25, 1974 the City Council enacted Resolution No. 74 -36 which amended the provisions pertaining to elections of officers and specifically increased from $100 to $120 (the maximum allowable under the Act) the monthly .pension earned after twenty year's service; and WHEREAS, the membership of the Brooklyn Center Fire Department Relief Association initiated action to amend the Act to increase the maximum benefit allowable; and WHEREAS, the City supported legislation which would increase the maximum _ benefits allowable; and WHEREAS, on March 31, 1978 "an act relating to the City of Brooklyn Center; j Firefighter's Relief Association; amending Laws, 1967, Chapter 815, Section l; 2 3; 4; 5; 7; and 8, Subdivision I" was signed into law; and WHEREAS, on March 27_, 1978 the City Council enacted Resolution No. 78 - -59 approving the provisions of the act; and WHEREAS, the act provides, among other things, authorization to increase . from $120 to $150 the maximum monthly pension earned after twenty year's service; and RESOLUTION NO. RESOLUTION APPROVING MINNESOTA DEPARTMENT OF TRANSPORTATION PLANS AND SPECIFICATIONS FOR TRAFFIC NOISE ATTENUATOR5 AND LANDSCAPING ON PORTIONS OF T.H. 94 WESTERLY OF T.H. 152. WHEREAS, the Commissioner of Transportation for the State of Minnesota has caused to be prepared: plans, special provisions, and specifications for the improvement of Trunk Highway No. 393, renumbered as Trunk Highway No. 94, ,within the corporate limits of the City,of Brooklyn Center, from the west corporate limits to T.H. 152 in Brooklyn , Center; and - WHEREAS, said plans on file in the 'office of the Department of Transportation, St. Paul, Minnesota; being marked, labeled, and identified as: S.P. 2786 -61 (94 =393); and WHEREAS, said special provisions are on file in the office of the Department of Transportation, St. Paul, Minnesota; being marked, labeled, and identified as: S.P. 2786 -61 (94 =393); and which, together with the "Minnesota Department of Transportation Standard Specifications • for Highway Construction," dated 1978, will govern, and which are on file in the office of the Commissioner of Transportation, constitute the specifications for said improvement of Trunk Highway No. 393, renumbered as Trunk Highway No. 94; and WHEREAS, copies of said plans and special provisions as so marked, labeled, and identified are also on file in the Office of the City Clerk; and WHEREAS, the term, "said plans and special provisions," as hereinafter used in the body of this resolution will be deemed and intended to mean, refer to, and incorporate the plans and special provisions in the foregoing recitals particularly identified and described; and WHEREAS, the Commissioner of Transportation desires in the in- terest of public safety that any and all parking of vehicles, if such parking is permitted within the corporate limits of the City of Brooklyn Center, on said Trunk Highway No. 393, renumbered as Trunk Highway No. 94, will be parallel with the curb adjacent to the highway and will be at least 20 feet from any crosswalk. • NOW, THEN, BE IT RESOLVED that said plans and special provisions for the improvement of Trunk Highway No. 393, renumbered as Trunk Highway No. 94, within the corporate limits of the City of Brooklyn Center, be and hereby are approved. RESOLUTION NO. • BE IT FURTHER RESOLVED that the City of Brooklyn Center does hereby agree to require the parking of all vehicles, if such parking is permitted within the corporate limits of said City, on said Trunk Highway No. 393, renumbered Trunk Highway No. 94, will be parallel with the curb adjacent to the highway, and at least 20 feet from any crosswalks on all public streets intersecting said trunk highway. BE IT FURTHER RESOLVED that the elevations and _grades as shown in said plans and special provisions are hereby approved and consent is hereby given to any and all changes in grade occasioned by the construction of Trunk Highway No. 393, renumbered Trunk Highway No 94, in accordance with said plans and special provisions. RESOLUTION ESTABLISHING STREET PAVING AND CURB AND GUTTER IMPROVEMENT PROJECT NO. 1978 -2 AND WATER MAIN IMPROVEMENT PROJECT NO. 1978 -3 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS WHEREAS, petitions have been presented to the City Council requesting Street Paving and Curb & Gutter Improvement Project No. 1978 -2 and Water Main Improvement Project No. 1978 -3; and T WHEREAS, the City Council deems it necessary to initiate the above mentioned improvement projects; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center to direct the City Engineer to prepare plans and specifications for said improvement projects, described as follows: 1978 -2 Street Paving and Curb -& Gutter On the north one -half of 70th Avenue North from Brooklyn Boulevard to future Kyle Avenue North. 1978 -3 - Water Main On 70th Avenue North from June Avenue to future Kyle Avenue North. RESOLUTION ORDERING CONSTRUCTION OF STREET PAVING AND CURB & GUTTER IMPROVEMENT PROJECT NO. 1978 -2 AND WATER MAIN IMPROVEMENT PROJECT NO. 1978 -3 WHEREAS, the City Council received a petition from all of the affected property owners requesting the construction of Street Paving and Curb & Gutter Improvement Project No. _1978 -2 and Water Main Improvement Project No. 1978 -3; and WHEREAS, Chapter 429.031, Subdivision 3, Laws of Minnesota, provides that "Whenever all owners of real property abutting upon any street named as the location; of any improvement shall petition the Council to construct the improvement and to assess the entire cost against their property, the Council may, without a public hearing, adopt a resolution determining such fact and orde- ring-the improvement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, that it has been determined that a petition signed by all owners of real property to be benefited by the installation of said Improvement Project No's. 1978 -2 and 1978 -3 has been received. • BE IT FURTHER. ORDINANCE NO.' Section 4. Section 3 -103 (I) of the City Ordinances is hereby amended as follows: (I) Certificate of Occupancy. No building or structure except those in Groups [A to H inclusive) R -3 and M . shall be used or occupied, and no change in the existing occupancy classification of a building or structure or portion thereof shall be made, unless the Building Official has issued a Certificate of Occupancy therefor. Changes in the character or use of a building shall not be authorized if a new or proposed use is more hazardous in terms of 'life and fire risk than in the existing use. Upon a` "determination that a` building complies with the provisions of the Building Code, the Building Official shall issue. a Certificate of Occupancy in a form of his - determination.
