Adjournment • 1 i CITY MANAGER'S COMMENTS Item 6a Confirm Appointment of Police Chief Consistent with -the provisions of •the City Charter the appointment , of James Lindsay as Police Chief, effective May 21, 1978, is hereby submitted for Council confirmation. Disposition Item 6b Confirm Planning Commission Appointment Mayor ;Nyquis•t <is prepared to appoint Richard C. Theis, 3006 Thurber Road, 'to the Planning Commission and requests Council confirmation. Mr. Theis would replace Mark Sazama who has recently resigned from the Planning Commission and - the appointment would be effective - the first Commission meeting in May - to expire December 31, 1979. Disposition • Item 7a Final Plat Approval - Babb Addition It is recommended that the City Council approve - the final plat for the Babb Addition comprehending property at the northwest quadrant of 69 Avenue North and T.H. 169. The preliminary plat was approved on December 19, 1977 Disposition Item 7b Final Plat Approval - Clinch Valley It is recommended that the City Council approve the final plat for the Clinch Valley Addition located at - the sou quadrant of T. H. 169 and 69 Avenue North. The preliminary plat was approved on March 20, 1978 as Planning Commission Application No. 78008 sub - mitted by Phillip Neese. Disposition Mai CITY MANAGER'S COMMENTS • Page 2 Item 7c Final Plat Approval The Ponds 2nd Addition Yt is recommended - that •the City Council approve - the final plat for the Ponds 2nd Addition comprehending property on Unity Avenue North between 69 Avenue North and 73rd Avenue North. The preliminary plat was approved on September 12, 1977. Disposition Item 8 Subdivision Bond Reduction It is recommended - that -the City Council authorize - the reduction of a financial performance guaranty for Linder's 1st Addition sub- division from $9,800 - to $8,100 on the basis that corresponding obligations have been satisfied. Disposition • Item 9a Expressing Appreciation for Services (2) The attached resolutions are recommended for - the purpose of expressing the .City's appreciation for the services rendered by Police Chief Thomas O'Hehir, whose resignation is effective May 20, 1978, and Planning Commission member Mark Sazama, whose resignation is effective follow- ing •the April 27, 1978 Planning Commission meeting. Disposition Item 9b Authorizing' Participation in - the joint Airport Zoning Board The attached resolution is recommended for - the 'purpose of authorizing participation in -the Joint Airport Zoning Board with the Metropolitan Airport's Commission and - the cities of Crystal, Brooklyn Park', and New Hope and - to appoint representatives to the board from the'City of Brooklyn Center. Disposition .r- CITY MANAGER'S COMMENTS • Page 3 Item 9c Authorizing the Purchase of Dump Box The attached resolution is recommended for - the purpose of accepting the quotation, through the Hennepin County joint purchasing arrange- ment, of Crystal Distributing, Inc. , Lake Crystal, Minnesota, for one 5 yard dump box with hydraulics in - the amount of $4,324.58. The dump box will be used by - the Street Division in conjunction with a dump 'truck cab and chassis, - the purchase of which was authorized recently by the, City Council. Disposition Item 9d Accepting Bid for Bituminous Oil The attached resolution is recommended for - the purpose of accepting the bid of L. N. Sickels for furnishing the annual supply of bituminous oil used by 'the S'tree't Division. Bids were opened at 11 :15 a.m. on April 18, 1978. • Disposition - Item 9e Accepting Bid for Plant -Mixed Bituminous Materials The attached resolution is recommended for - the purpose of accepting the bid of Midwest Asphalt for supplying plant -mixed bituminous material to be utilized by •the Street Division in 1978. These bids were also opened on April 18, 1978 Disposition Item 9f Accepting Bid for Stabilized Gravel and Fine Aggregate for Seal Coat The attached resolution is recommended for 'the purpose of accepting the bid of Barton Contracting for supplying stabilized gravel and seal coat a a•te to be used b the Street Division in 1978. Disposition • CITY MANAGER'S COMMENTS • Page 4 Item 9g Establishing Sidewalk Improvement Project Nos . 1978 -15 & 16 The attached resolution is recommended for - the purpose of establishing Sidewalk Improvement Project No. '1978 -15, located along - the north side of 57 Avenue North from 134 feet west of Logan 'to 268 feet west of Logan Avenue North; and Sidewalk Improvement Project No 1978 -16 located along - the north side of Emerson Lane from Dupont Avenue North to Emerson Avenue North. Disposition 4 Item 9h Directing Advertisement for Bids for Contract 1978 -B The attached resolution is recommended for - the purpose of approving plans and specifications for Sidewalk Improvement Project Nos. 1977 -12, 1978 -15, and 1978 -16, and directing advertisement for bids for Contract 1978 -B. The contract comprehends - the installation of sidewalk Pedestrian handicap- bicycle ramps along County Road 10 and Shingle Creek Parkway as well as the above established sidewalk projects 1978 -15 and 16. • Disposition Item 91 Establishing Bridge Improvement Project No. 1978 -6 The attached resolution is recommended for - the purpose of establishing Bridge Improvement Project No. 1978 -6 which comprehends - the con - struction of a bridge on Shingle Creek Parkway over Shingle Creek. Disposition Item 9j Authorizing , the Mayor and City Manager to Enter Into a Contract for Design of Bridge Improvement Project 1978 -6 The attached resolution is recommended for the purpose of authorizing 'the Mayor and City Manager to enter into a contract with Egil Wefald and Associates for design work involving Bridge Improvement Project No. 1978 -6. Disposition v CITY MANAGER'S COMMENTS • Page 5 Item 9k Authorizing the Mayor and City Manager - to Enter into MN /DOT Agreement No. 58929 The attached resolution is recommended for -the purpose of authorizing the Mayor and City Manager - to enter into an agreement with the Minnesota Department of Transportation for traffic signal improvements along T.H. 152 at 58th Avenue North, 63rd Avenue North, 'the FI -94 ramps, and 69th Avenue North Disposition Item 91 Approving Land Division for Hennepin County Library Site The attached resolution was deferred by - the City Council at - the April 10, 1978 meeting and the City Manager was directed - to obtain assurances from Hennepin County and BCIP 'that they would not seek occupancy permits until the matter of delinquent taxes and special assessments was resolved - through arbitration. Should the written assurances be received prior to Monday evening's meeting, ,the • resolution will be offered for the Council's consideration. Disposition Item 9m Accepting Quotations for Repair of Well Pump No. 2 A handout resolution will be presented - to - the City Council recommending 'the acceptance of quotations for repair of well pump No. 2 located at 6242 Brooklyn Boulevard. Disposition Item 10a Withdrawal of Planning Commission Application No. 77011 Submitted by Kenneth Bergstrom The City has received a letter from Kenneth L. Bergstrom requesting 'that Planning Commission Application No. 77011 be withdrawn. Disposition v► CITY MANAGER'S COMMENTS Page 6 Item 1 la Amending Various City Ordinances Regarding Planning and ,Building Fees (1 s•t Reading) The attached ordinance amendment is recommended for - the purpose of updating various planning and building fees as comprehended in the 1978 budget. Disposition Item 12a Parking at Twin Lake Beach A recommendation has been made by the Park and Recreation Commission regarding •the parking si'tua'tion at Twin Lake Beach. We will be prepared to discuss in more detail this recommendation, Disposition Item 12b Deferment of Special Assessments for Low Income Senior Citizens Information relating - to a policy for deferring special assessments for low income senior citizens is being prepared for discussion at Monday, evening's meeting. Discussion of such a policy is in conjunction with - the forthcoming public hearings on various alley paving projects scheduled for - the May 22, 1978 City Council meeting. Disposition Item 12c Revising Sanitary Sewer Rate Schedule We will be prepared - to discuss -the possibility of providing a reduced sewer rate for senior citizens in homes which have 3 persons in the household. RESOLUTION EXPRESSING RECOGNITION OF AND APPRECIATION FOR THE DEDICATED PUBLIC SERVICE OF CHIEF THOMAS G. O'HEHIR WHEREAS, Mr. Thomas G. O'Hehir served as Chief of Police from March 12,-- through May 20, 1978; and WHEREAS, his devotion to the tasks and responsibilities associated with this position contributed substantially to the sound progress and development of the City; and WHEREAS, his public service and civic effort for the betterment of the community merit the gratitude of the citizens of Brooklyn Center: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that: The dedicated public service of Mr. Thomas G. Date Mayor ATTEST Clerk The motion for the adoption of the foregoing .resolution was duly seconded by member , and upon vote, being taken thereon, the following voted in favor thereof: and the following voted against the same: whereupon said resolution was declared duly passed and adopted. • Member introduced the following resolution; and moved its adoption: • RESOLUTION NO, RESOLUTION AUTHORIZING PARTICIPATION IN A JOINT AIRPORT ZONING BOARD WHEREAS, the Metropolitan Airports Commission, hereinafter called the municipality, owns and controls Crystal Airport, a public airport Located in Hennepin County; and WHEREAS, portions of the airport hazard area to such airport are located within the territorial limits of this City; and WHEREAS, the above municipality has requested in writing that the City of Brooklyn Center join with them and with the Cities of New Hope, Brooklyn Park and Crystal, all in Hennepin County, Minnesota in the creation of a Joint Airport Zoning Board; and WHEREAS, this City deems it necessary and expedient to participate in such a Joint Airport Zoning Board in cooperation with the Airports Commission and the Cities of New Hope, Brooklyn Park and Crystal pursuant to Minnesota Statutes 360.063,` Subdivision 3, and other applicable laws, for the purpose of establishing, administering and enforcing zoning laws for the areas surrounding the airport and for the protection of the airport and the public; and WHEREAS, the above statute provides that the City of Brooklyn Center has the right to appoint two persons to said Board (said persons need not be members of this Board); and WHEREAS, Subdivision 8 of Section 32 of the Appropriations Bill passed by the Minnesota Legislature effective July 1, 1973, provides that no moneys shall be expended by the Commissioner of Aeronautics of the State of Minnesota to improve and maintain an airport unless the governmental unit owning the airport has or is establishing a zoning authority for the airport. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center• 1. RESOLUTION AUTHORIZING THE PURCHASE OF ONE 5 YARD DUMP BOX WITH HYDRAULICS WHEREAS, Chapter 471 .345 of the Minnesota Statutes provides for the purchase of merchandise, materials or equipment, or any kind of construction work by informal quotations when the amount of such contract is less than ten thousand dollars ($10,000); and WHEREAS, the City Manager has obtained quotations on the purchasa of pne -(1) 5 yard dump box and has determined that the quota - EFZ tion of Gp Distributing, Inca, Lake Crystal, MN 56055, in the amount of $4,324,58 for one 5 yard dump box with hydraulic pump and controls installed is the best quotation submitted. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that the City Manager be authorized to contract for the purchase of one 5 yard dump box with hydraulics in the amount of $4,324.58 from Crystal Distributing, Inc. RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR SIDEWALK IMPROVEMENT PROJECTS NO. 1977 --12, 1978 -15, AND 1978 -16 AND DIRECTING ADVERTISEMENT FOR BIDS (CONTRACT 1978 -B) BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, as follows: 1. The plans and specifications for-the following improvements: prepared by the City Engineer are hereby `approved ' and ordered filed with the Clerk Sidewalk Improvement Projects No. 1977 -12, 1978 -15 and 1978 -16 2 The Clerk shall advertise for ;bids for such improvement by publication at least once in the official newspaper and in the Construction Bulletin, the date of first publication not less than ten (10) days prior to the date for receipt of bids. Said notice shall state that no bids will be considered unless sealed and filed and accompanied by a cash deposit, bid bond, cashier's check or certified check payable to the City Clerk in the amount of not less than five per cent (5%) of the bids. 3. Bid date is set for Monday, May 8, 1978, at 11 :00 o'clock A.M., central daylight time. 4. The City Manager and the City Engineer shall be authorized to open and tabulate the bids. WHEREAS, the City Council deems it necessary to initiate the above mentioned improvement project; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center to direct the City Engineer; to prepare plans and specifications for said Bridge Improvement Project No. 1978 -6, described as follows: 1978 --6 - Bridge On Shingle Creek Parkway crossing over Shingle Creek. RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO EXECUTE AN AGREEMENT WITH EGIL WEFALD & ASSOCIATES, INC., FOR PREPARING PLANS AND SPECIFICATIONS FOR BRIDGE PROJECT NO. 1978 -6 WHEREAS, the City Council of the City of Brooklyn Center has established Bridge Project No. 1978 -6 on Shingle Creek Parkway crossing Shingle Creek and ordered preparation of plans and specifications; and WHEREAS, an agreement for preparation of said plans and specifications has been satisfactorily negotiated by the City Engineer and the City Manager with Egil Wefald & Associates, Inc., of Minneapolis, Minnesota; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that the Mayor and City Manager be and they are hereby authorized to execute an agreement with Egil Wefald & Associates, Inc„ for preparing plans and specifications for Bridge Project No. 1978 -6. • BE IT FURTHER RESOLVED to authorize the appropriation of $34,000.00 for engineering consulting fees for said Bridge Improvement Project No. 1978 -6. RESOLUTION APPROVING LAND DIVISION FOR HENNEPIN COUNTY REGIONAL LIBRARY SITE WHEREAS, Hennepin County has acquired from the Brooklyn Center Industrial Park a tract of land lying within Tract A of Registered Land Survey No. 1440 and Tract B of Registered Land Survey No. 1359 for construction of a regional library; and WHEREAS, delinquent taxes and special assessments are due from y said tracts of land; and WHEREAS, the said County and Brooklyn Center Industrial Park,' Ind., have agreed to submit to arbitration a dispute relative to payment I of certain real estate taxes, special assessments including interest, and other costs involving the land sale between the two parties and WHEREAS, the City of Brooklyn Center City Ordinances require land divisions and combinations by formal plat or registered land survey; and • WHEREAS, on November 28, 1977, the Brooklyn Center City Council approved a preliminary registered land survey for said land division; and WHEREAS, the Hennepin County Finance Division requires all delinquent taxes and special assessments to be` paid `up on all parcels within a formal plat or registered land survey prior to filing such a document; and WHEREAS, Hennepin County may be in a position to start constructio of said library prior to a final decision of said arbitration; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that the land division for the Hennepin County Regional Library site to be built on Tract B, Registered Land Survey No. 1359 and a portion of Tract A, Registered Land Survey No. 1440 is approved with the following conditions: 1) The preliminary registered land survey approved by the City Council on November 28, 1977, shall be submitted' for final approval and be filed at the Hennepin County Registrar of Titles prior to the issuance of an occupancy permit by the City building official for any • building,, within said land division. AN ORDINANCE AMENDING CHAPTER 3 OF THE CITY ORDINANCES REGARDING CODE REFERENCES, PERMITS, AND PERMIT FEES THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 1. Section 3 -101 of the City Ordinances is hereby amended as follows: Section 3 -101. Adoption of the Minnesota [State] Building Code. The `City of Brooklyn Center hereby adopts by reference those [ S.B.C.] State Regulations S.B.C. 101 through S.B.C 8901 collectively known as the Minnesota [State] Building "Code, filed with the Secretary of State and the Commissioner of Administration on January 6, 1972, and subsequent amendments to those regulation duly adopted and filed by the State Department of Administration three copies of which Code shall be on file and available for inspection in the Office of the City Clerk. Those regulations, combined with the provisions of this Chapter of the City Ordinances shall hereinafter be known as the "Building Code." Section 2. Section 3-103 (D) of the City Ordinances is hereby amended as follows: (D) Submission of Plans and Specificiations. [With each application for a building permit, and when otherwise required by the Building Official, two sets of plans and specifications bearing appropriate engineering or architectural certifications shall be submitted • to the Building Official.] Each application for a Building Permit shall include at least two sets of plans and specifications in the case of one and two family dwellings and residenti accessory buildings; and at least three sets of plans and specifications in the case of all multiple family dwellings and accessor buildings commercial build ings, industrial buildings, and other non- residential buildings. No building or structure e xcept those in Groups [A to H inclusive] R -3 and M shall be used or occupied, and no change in the existing occupancy classification of a building or structure or portion thereof shall be made, unless the Building Official has issued a Certificate of Occupancy therefor. Changes in the character or use of a building shall not be authorized if a new or proposed use is more hazardous in terms of life and fire risk than in the existing use. Upon a determination that a building complies with the provisions of the Building Code, the Building Official shall issue a Certificate of Occupancy in a form of his determination.
