Item 6 Appointments,
Mayor Nyquist will be prepared Monday evening - to announce an
appointment Ito - the Human Rights Commission and possibly an
appointment Ito - the Park and Recreation Commission.

Item 7 Establish Board of Review Date
Section 7.04 of the City Charter provides 'that -the City Council
shall constitute a Board of Equalization for`taxation purposes.
This is an annual responsibility prior to submission of - the Assessor's
valuations each year. I•t is recommended *that the Council establish

the Board of Review meeting for Wednesday, May 31 1978 at 7:30 p.m.

It is recommended the City Council approve - the final plat for - the Babb
Addition located at the northwest quadrant of 69th Avenue North and
T.H. 169. Preliminary plat approval was granted by the Council on
December 19, 1977 - through Planning Commission Application No. 77063
submitted by Herbert Beighey. .

Item 10 Authorize Execution of Encroachment Agreement
It is recommended that the City Council authorize - the Mayor and the
City Manager to enter into an encroachment agreement with Robert G
Wilbur, 6857 Dallas Road. This agreement acknowledges the encroach
ment of a garage by -two feet onto a utility easement on 'the south side
of -the owner's property and holds the _City harmless from any damage
that might occur in -the future because of - the encroachment. It also
provides for •the owner - to pay the City for any extra cost that might be
incurred in an effort 'to protect - the garage from damages during installa-
tion of future utilities or for maintenance of existing utilities

Item 11 Authorize 5ettlemen•t of josyln Manufacturing Case
It is recommended that -the City Council authorize that three separate
checks be issued - to Joslyn Manufacturing and Supply Company for
$6, 620 in appraisal fees, $11,500 for attorney fees and $214.95 for
costs and disbursements. This would represent a final settlement
. for a condemnation case for open space land acquisition which was
abandoned by the City when federal funds ran out.,

RESOLUTION AMENDING THE 1978 GENERAL FUND BUDGET
WHEREAS, - the City Council appropriated $9,815 in the 1977 General
Fund.-Budget for - the purpose of purchasing microfilming equipment necessary
to implement , the City government records microfilming program; and
WHEREAS, because of the recent availability of LOGIS Computer Output
Microfilm (COM), which added a new dimension `to the microfilming planning,
- the planning phase of -the program was not completed during 1977; and
WHEREAS, since the planning phase was not completed it was not
possible to purchase relevant equipment prior - to the expiration of the 1977
Budget, and
WHEREAS, a balance of $9,353 remains unexpended from - the appropriation;
and
WHEREAS, Section 7.08 of the City Charter authorizes - the City Council to .
appropriate funds from unappropriated surplus in an amount equal - to a previous ,
•
appropriation if not, in fact,' expended -or encumbered for that purpose in - the
previous fiscal year.
NOW, THEREFORE, BE IT RESOLVED by the City Council of - the City of
Brooklyn Center -to amend `the 1978 General Fund Budget to increase the City
Manager's Office (Dept. No. 13) Office Furnishings and Equipment Appropriation
(Object No. 4551) by $:9,353 to provide for - the balance of microfilm equipment to
be purchased; and
BE IT FURTHER RESOLVED - tha•t said appropriation be funded from unappro-
priated surplus.

BE IT RESOLVED by the City Council. of the City of Brooklyn
Center, Minnesota,' as follows:
1. The specifications for Diseased Shade Tree Removal
Improvement Project No. 1978 -1 are hereby approved and ordered
filed with the Clerk.
2. The Clerk shall advertise for bids for such improvement
by publication at least once in the official newspaper and in the
Construction Bulletin, the date of first publication not less than
ten (10) days prior to the date of receipt of bids. Said notice
shall state that no bids will be considered unless sealed and filed
and accompanied by a cash deposit, bid bond, cashier's check or
certified check payable to the City Clerk in the amount of not less
than one thousand dollars ($1,000.00)
• 3. Bid date is set for Tuesday , February 28, 3978,- at
11x00 a.m., central , standard time.
4. The City Manager and the Director of Parks and Recreation

(STREET SURFACING AND CURB & GUTTER CONTRACT 1977 -K)
WHEREAS, the City Clerk and the City Engineer have reported
that on December 6, 1977, at 11:00 a.m., central standard time, '.they
opened and tabulated bids received for Contract 1977 -K, including
Street Surfacing Project No. 1977 -19 and Curb & Gutter Project No.
1977 -20 and that said bids were as follows:
1) Hardrives, Inc. $65,454.50;
2) Forest Lake Contracting, Inc. 70,879.00
3) Alexander Construction Co. Inc. 74,483.50
4) C. S. McCrossan, Inc. 77,272.50
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City`'of Brooklyn Center-that the bid of Hardrives, Inc., in the amount
of $65,454.50, as to furnishing of all work, labor, and material in
conjunction with the above mentioned improvement projects, according
to the plans and specifications therefor now on file in the office of
the City Clerk, is deemed` to be the lowest and best bid submitted
for said work by a responsible` bidder, and °said ' bid is hereby accepted.
BE IT FURTHER RESOLVED to authorize the Mayor and City Manager

AS MRS MYCEE WEEK
WHEREAS, the Brooklyn Center Mrs. Jaycees have promoted community .-
service in }Brooklyn Center for over 21 years; and
WHEREAS, the Brooklyn Center Mrs. Jaycees have set aside the week
of February 17 through February 25 to educate the community in the areas of
on going projects in Aid to Retarded Citizens, Accent on Youth, Alcohol Abuse,
Medical Health, Sudden Infant Death Syndrome, Today's Woman, and Community
Service; and
WHEREAS, the Brooklyn Center Mrs. Jaycees provide individual
development to tomorrow's leaders; and
WHEREAS, their Creed states, "May we leave the world a better•
place because we lived and served within it;"

NO. 78007 INCLUDING JOINT PARKING AGREEMENT BETWEEN
BROOKDALE WEST OFFICE BUILDING AND CROSS OF GLORY
LUTHERAN CHURCH
WHEREAS, Planning Commission Application No. 78007 comprehends
a. joint parking agreement between the ownership of the °Brookdale West Office
Building, 5901 Brooklyn Boulevard, and the Cross of Glory Lutheran Church,
5940 Ewing Avenue North submitted in accordance with the provisions of
Section 35 -720 of the City Ordinances; and
WHEREAS, said Agreement is necessary to create additional parking
for said office building in order to accommodate proposed medical uses beyond
those allowed through an earlier agreement approved under Council Resolution
No. 74 -46; and
WHEREAS, the site plan indicating the proposed joint parking and
related site improvements was endorsed by the Planning Advisory Commission
on February 9, 1978;

Section 1 Chapter 19 of - the City Ordinances of - the City of Brooklyn Center

Any person found guilty by lawful a uthority of violating any provisions of this

• Section 19 -1706. Liability for the Crimes of Another
Every person who commits or attempts to commit, conspires 'to commit or
aids and abets in the commission of any act constituting a violation of this ordinance
or any act which constitutes an omission and, therefore, a violation of this "ordinance
whether individually or in connectio with one or more persons or as principal, agent
or accessory, shall be quilty of such offense and every person who falsely, fraudulently
forciblv or willfully induces, causes, coerces, `requires, permits or directs another to
violate anv of 'the provisions of this chapter _is "`li�ewise guilty of such offense.
Section 2. - ' This ordinance shall become effective after adoption and upon thirty
_ (30) days following its legal publication.

AN ORDINANCE REGULATING THE OPERATION AND MAINTENANCE OF
BUSINESSES OR COMMERICAL ESTABLISHMENTS OFFERING-SAUNAS OR
SAUNA BATHS, REQUIRING A LICENSE TO OPERATE SUCH FACILITIES
AND ESTABLISHING STANDARDS FOR THE CONSTRUCTION, OPERATION
AND MAINTENANCE OF THESE FACILITIES
THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS:
Section 1. Chapter 23 of the City Ordinances of the City of Brooklyn Center
is hereby 'amended by the addition of the following:
Section 23 -1600, STATEMENT OF POLICY
The City Council of the City of Brooklyn Center deems it necessary to provide
for the special and express regulation of businesses or commercial enterprises which
offer saunas or sauna baths to the general public in order to protect the public health,
safety and welfare and to guard against the inception and transmission of disease.
The City Council further finds that commerical enter rises offering "saunas or sau

either exclusively or in connection with any other business enterprise without being
first licensed as provided in this Ordinance.
Section 23 -1603. CONTENTS OF APPLICATION FOR LICENSE
Application for a license 'shall be made only on the .forms provided by the
City Manager. Four complete co of the application must be submitted to the
City Manager's office containing the address and legal description of the property
to be used, the name, address and telephone number of the owner, lessee, if any,
and the operator or manager, the name, address and telephone number of two persons,
who shall be residents o f Hennepin County who may be called upon to attest to the
applicants', m or o'perator's character; whether th manager or '
operator has ever been convicted of a crime or offense other than a traffic offense
and, if so, complete and accurate information as to the time, place and nature of
such crime or offense including the disposition thereof; the names and addresses
of all creditors of the applicant, owner, lessee, or manager insofar as and regardi
credit which has been extended for the purposes; of constructing, equi p ping, main-
taininq, operating or furnishing or acquiring the premises, personal effects, equip -
ment or anything incident to the establishment, maintenance and operation of a'sauna

Section 23 -1604. LICENSE FEE LICENSE INVESTIGATION AND LICENSE YEAR
The annual license fee shall be as set forth in Section -23 -010 of the City
Ordinances and an investigation fee for the purposes of issuing a license is $1, 500
The license fee and fee for the investigation of the license shall be paid when the
application is filed In the event that the application is denied or in the event that
the license once issued, is revoked, canceled <or surrendered, no part of the annual
license fee or fee for the investigation for the issuance of a license shall be returned
to the applicant unless by express action of the City Council A separate license
shall be obtained each year for each place of business. The licensee shall display
the license -on a prominent place in the licensed premises at all times A license,
unless revoked, is for the calendar year or a part thereof for which it has been issued
The fee for the investigation for issuance of a license must be tendered with each
new' application for a license and must also be paid at any time when there is a
proposed change of ownership or reapplication for a license wherein additio or
different parties other than the original licensee and parties are proposing to be
licensed. All licenses grant herein are nontransferable.
Section 23- -1605. GRANTING OR DENIAL OF LICENSES

Section 23- 1606. CONDITIONS GOVERNING ISSUANCE
1. ` No license shall be issued if the applicant or any of its owners,

bath shall be of a safe and :sanitary design as approved by the City
Sanitarian and the entire premise's wherein saunas or sauna baths
are given, administered or allowed and all personal property, clothing,
towels and the like used therein shall be sanitary which is defined
as a complete absence-of the vegatative cells of pathogenic micro-
organisms.
9. The licensee and all persons in its employ or connected therewith
shall maintain an occupancy or guest register by which each patron
of the sauna or sauna bath must register with his correct name
address and phone number and each licensee, or person in its employ
shall require each patron to furnish identification describing and
identifying his correct name, address and phone number and shall
further require each patron to correctly and truthfully furnish h is

Section 23 -1609. CONSTRUCTION AND MAINTENANCE REQUIREMENTS
1. Each establishment shall have a separate restroom and separate
loc ker room facilities for each sex,
2. All sauna rooms, loc rooms, restrooms and bathrooms used on the
premises shall be constructed of materials which are impervious to
moisture, bacteria, mold or fungus and must be kept in a sanitary
condition which is defined as free from the 'vegetative cells of patho

2 cfm per square foot of floor area, a hand washing sink equipped with
hot and cold running water under pressure, sanitary towels and a soap
dispenser.

rooms, massage rooms, restrooms, bathrooms, janitor's closet,
reception area shall be illuminated with not less than
30 foot candles of illuminatio

the storage of cleaning supplies. Such closet shall have mechanical
- ventilation with 2 cfm per square foot of floor-area. Such closet shall
include a mop sink.
6. Floors, walls and equipment in sauna rooms and in restrooms and in
bathrooms used in connection therewith must be kept in a state of good
repair and clean at all times. Linens and other materials shall be
stored at least '12 inches off the floor. Clean towels and w ash cloths
must be made available for each customer.

The license maybe revoked, suspended or not renewed by the City Council
upon recommendation of the City Manager by showing that the licensee, its owners,
managers, employees, agents or any of its interested parties have engaged in any
of the following conduct:

• This ordinance does not apply to the operation of a sauna which is operated
I n connection with or as a part of a chiropractic office wherein the practitioners
thereof are licensed by the State of Minnesota or as a part of a fully equipped, bona
fide health club, having a fully equipped_ exercise room, complete with types and
pieces of equipment in operating and working order of a'type required for all forms
of physical exercise, staffed and administered by persons trained as athletic
directors, trainers,` physical therapists or chiropractors, which offers complete
exercising, physical training and reducing services including recommendations as
to food, health, diet and the like, nor does this ordinance apply to any municipal
corporation nor does this ordinance apply to any sauna located in any commercial
office building or apartment building, which is offered solely and exclusively to
'bon -fide tenants and employees of said tenants of said building and not offered to
the public generally and -a as to which there is no public advertising or public offer
of these sauna via any news media.
Section 23 -1613. SEPARABILITY
Every section, provision or a part of this ordinance is declared separable
from every other section, Rrovision or part to the extent that if any section, provision
or a part of the ordinance shall be held invalid, such holdings shall not invalidate
any other section, provision or part thereof.

YEAR.

• Section 23 -1708 GRANTING OR DENIAL OF LICENSES AND CERTIFICATES,
License applications and certificate applications shall be reviewed by-the
Police Department Planning and Inspection Department,' ` Health Department and
such other departments as the City Manager shall deem necessary. The review
shall include an inspection of 'the premises covered by the application to determine
whether - the premises conforms to all applicable code requirements. Thereafter,
licenses and certificates shall be recommended for approval or denial by - the City
Manager 'to 'the City Council subject to 'the provisions of this ordinance . Any
appeals shall be before 'the City Council. A license_ permitting 'the conduct of a
massage parlor or massage establishment is nonrenewable and nontransferabl

Whoever does any act forbidden by this ordinance or omits or fails `to do
any act required by this ordinance shall be guilty of a misdemeanor and upon

either. Each day that a violation exists constitutes a separate and distinct offense.
