The 1977 City Council will convene for the purpose of completing its
1977 business and will then adjourn.

-Roll Call 1978 Council
The oath of office will be administered to Mayor -elect Dean Nyquist and
Councilmember -elect Cecilia Scott and - the 1978 Council convened.

• Item 9 Select Mayor Pro Tem
The City Charter provides that "the Council shall choose from its
members a president pro tem who shall hold office at -the pleasure
of the Council and shall serve as president in the Mayor's absence
and as Mayor in case of the Mayor's disability or absence from - the
city ". Although -the Charter does not so specifically require, it is
traditional that - the Council selects a mayor pro tem annually at its
organizational meeting.

Item 10a Planning Commission
The City Ordinances provide that the Mayor has the responsibility for
appointments to the Planning Commission, subject to majority consent
of the City Council. Appointments to the Planning Commission are for
two year terms on an at -large basis. The terms of Gilbert Engdahl and
Patrick Horan, and -the seat formerly held by James Kohrt, expired
December 31, 1977. In addition 'the seat formerly held by Cecilia Scott
which expires December 31, 1978 is vacant.

• Item 10b Conservation Commission
Resolution No. 69 -318 provides that the Mayor has the responsibility
to appoint members of - the Conservation Commission subject - to -the
majority consent of the City Council. Appointments to the Conserva-
tion Commission are for three year terms on an at -large basis. The
terms of .Chairman Mary Ellen Vetter and Henry Dorff expired
December 31, 1977

Item 10c Human Rights Commission
Resolution No. _68 -44, amended by Resolution Nos. 69 -35, 71 -211 and
74 -68 provides - that the Mayor has - the responsibility Ito appoint members
to the Human Rights Commission subject - to the majority consent of - the
City Council Appointments 'to 'the Human Rights Commission are for
three year terms on an at -large basis. The terms of Jerome Campion,
Michael Miller and Forrest Castle expired December 31, 1977. The
seats formerly held by James Lacina, which expires December 31, 1978,
and Mary Stire, which expires December 31, 1979, are vacant, leaving
• two vacancies to be filled on this Commission.

Item' 10d Park and Recreation Commission
Resolution No. 73-25, amended by Resolution No. 77 -52, provides that
the Mayor has - the responsibility for appointments 'to the Park and
Recreation Commission subject - to majority consent of the City Council.
The resolution provides for representatives from each of five park service
- areas with two at -large representatives. Commission terms are for three
years. The terms of Donald Bogle, at- large, and Marie Nyquist, represent-
ing Park Service Area V, expired December 31, 1977.

Item l0e Housing Commission
Resolution No. 77 -22 provides' that the Mayor has the responsibility
to appoint members of - the Housing Commission subject , to majority
consent of - the City Council. Appointments - to the Housing ,Commission
are for three year - terms and are made on an at -large basis after giving
consideration to representation from the six community neighborhoods.
The Commission Chairman is responsible for assigning Commissioners
as liaison to - the neighborhood advisory committees. The - terms of Dale
Magnuson, LEO Beikler, and Phyllis Plummer expired December 31, 1977.
In addition, the seat formerly held by Chairman Lou Howard is vacant
with a term running -through December 31, 1979

Item -10f Northwest Hennepin Human Services Advisory Commission
Resolution No. 77 -23 provides - that - the Mayor has - the responsibility -to
appoint two members of the Northwest Hennepin Human Services Advisory
Commission subject to majority consent of - the City Council. Appoint-
ments to this Commission are for -two year terms The term of Dorothy
Buckingham expired December 31, 1977.

Item 12 Final Plat Approval (2)
The following Registered Land .Surveys are recommended for final
approval:
1. The Holiday Inn property located on the south side of Freeway
Boulevard from Humboldt to James Avenues North. The Council
gave preliminary plat approval on November 28, 1977 •through
Planning Commission Application No. 77065 submitted by John
Sheehan of Innco, Inc.
2. The Brookdale Shopping Center area. The Council gave preliminary
plat approval on November 14, 1977 - through Planning Commission
Application No. 77060 submitted by Dayton - Hudson Corporation.

Item 13a Designating Representative and Alternate Representative 'to Association
of Metropolitan Municipalities
Councilman Tony Kuefler served as Brooklyn Center representative
to the Association of Metropolitan Municipalities during 1977 and
former City Manager Donald Poss served as ` alternate representative.

Item 13b Designating Director and Alternate Director to Suburban Rate Authority
Councilman' Gene Lhotka served as Commissioner and former City Manager
Donald Poss served as alternate Commissioner to the` Suburban Rate
Authority during 1977.

• Item 13d Designating Director and Alternate Director to the Board of Directors of
the Suburban Health Nursing Service.
The City Council on December 12, 1977 agreed-to participate in "a
joint powers arrangement known as the Suburban Health Nursing Service
and temporarily named City Manager Gerald Splinter as director. It
was the Council's desire at - that time - to hold off designating a permanent
director and alternate director until the bylaws of that organization had
been formed. The bylaws have been formulated and it is recommended
that the Council' designate a director and alternate director at Monday
evening's meeting

Item 13e Designating City Depositories
During 1977 ten institutions were designated as official depositories for
the City. The attached resolutions provide for the redesignation of - those
institutions as official depositories

Item 13f Authorizing Execution of Engineering Assistance Agreement with MN/DOT
The attached resolution is recommended for - the- purpose of authorizing a
routine annual agreement with - the Minnesota Department of Transportation
to provide - technical service on a fee basis.

Item 13g Pertaining - to Agency Agreement with the State of Minnesota Department
of Transportation
The attached resolution is recommended for - the purpose of appointing the
State Commissioner of Trans portation 'to act as the City's agent in accepting
federal aid on the City's behalf for road and bridge construction and in con-
tracting for the construction financed either in all or part with federal monies.
It is a standard agreement and is necessary for proceeding with construction
of -the pedestrian- bicycle bridge across T.H. 100 from Summit - to 59th Ave.
North.

Item 13h Authorizing Execution of Cooperative Construction Agreement with MN /DOT
The attached resolution is recommended for - the purpose of authorizing the
Mayor and City Manager to execute a cooperative construction agreement
with MN /DOT for the reconstruction of old Lyndale Avenue from 59th
Avenue North to 61 st Avenue North.
Disposition
Item 13i Conveying Application for Metropolitan Land Planning Assistance Grants
The attached resolution is recommended for -the purpose of seeking the
City's $7,895 entitlement for assistance in - the planning process for the
development of - the City's Comprehensive Plan as mandated by State law.
In addition to the entitlement, the resolution conveys the City's intention
to apply for special planning problems discretionary funds

Item 13j Regarding Mayor Nyquist's 1978 Salary

The attached resolution is recommended for the purpose of acknowledging
Mayor Nyquist's request -that he not be compensated for serving as Mayor
of Brooklyn Center.

The attached ordinance was first read on November 14, 1977, published
on November 23, 1977 and was given an amended first reading on
December 12, 1977, to clarify - that - the ordinance pertains to licenses
and fees that expire after December 31, 1977. The amended first reading
was published on December 29, 1977 and -the ordinance is offered this-
evening for second reading and adoption

WHEREAS, the State of Minnesota, acting through its Commissioner
of Transportation, is authorized to provide technical and engineering
assistance to other road authorities by M.S. '161.39, and is willing
to do so,
NOW, THEREFORE, BE IT.RESOLVED by the City Council of the
City of Brooklyn Center as follows:
1. The City of Brooklyn Center enter into a Technical and
Engineering Assistance Agreement with the State of
Minnesota, Department of Transportation.
2. The Mayor and City Manager be and they are hereby
authorized to execute such an agreement and thereby
assume for and on behalf of the City of Brooklyn
Center all of the contractual obligations therein.
. 3. The City Engineer for and on behalf of the City of
Brooklyn Center is hereby authorized to request and

through 6, Minnesota Statutes, the Commissioner of Transportation be
appointed as agent of the City of Brooklyn Center to let as its
agent, contracts for the construction of portions -of Municipal Streets,
for the year 1978, and the Mayor and the City Manager are hereby

execute and enter into. a contract with the Commissioner of .Transportation

Highway No. 169 (Lyndale Avenue) from 59th Avenue North to 62nd
Avenue North within the corporate City limits in accordance with
State approved city plans, specifications and special provisions
therefor designated as Grading, Base and Surfacing Project No. 1977 -19
and Curb & Gutter Project No. 1977 -20.

LAND PLANNING ASSISTANCE GRANT
WHEREAS, the Metropolitan Council has adopted guidelines for the
application, award, and disbursement of funds; to local government to assist
In the comprehensive planning activities mandated by the 1976 Metropolitan
Land Planning Act; and
WHEREAS, pursuant - to those guidelines, -the City has prepared a
proposed work program, estimated costs and information in support of - the
application for its grant entitlement and for special planning problems funds;
NOW, THEREFORE, BE IT RESOLVED "by the City Council of the City
of Brooklyn Center to convey herewith to the Metropolitan Council the
Community Grant Application for the City's planning assistance entitlement
of $7,895 and for available special planning problems funds in the amount
of $3,000.

gesture and wishes to acknowledge his request and formally direct.that
no salary be given him in 1978 for serving as Mayor of Brooklyn Center.

City of Brooklyn Center to direct that Mayor Dean Nyquist, at his own

AN ORDINANCE AMENDING THE CITY ORDINANCES OF BROOKLYN CENTER`
REGARDING VARIOUS' LICENSE FEES
THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS:
Section 1 The following sections of the City Ordinances are amended as
follows
Section 8 -103. LICENSE FEES.
8- 103.01, License Fees Fees for licenses issued hereunder shall be as
follows
A. Bakery food vehicle: $[15.001 25.00 per annum for each vehicle.
B. - Catering food vehicle: $[50.001 100.00 per annum, plus $10.00 per
annum for each additional vehicle
C Food establishment: $[25.001 100.0 per annum, plus $[5.001 10.00 per
annum for each additional facility on the
same premises.
D. Itinerant food establishment: $[10.00] 25.00 for the first day's
• operation, plus $[1.001 10.00 for each
additional day of operation in a continuous
period.
E. Readily- perishable food vehicle: $[5.00] 30.00 per annum..
F. Readily perishable food vehicle, fleet license $[25.001 150.00 per annum.
G. Vending Machine - Vendor
1. Bulk Vendor - [ Ten] Twenty -five dollars per annum for operators of
machines which vend gumballs, nuts, panned candies, etc. in
unpackaged form
2. Nonperishable Vendor _- [Five] Eight dollars per annum for operators
of machines which vend nonperishable products in a sealed container
wrapped package, or open cup.
3. Perishable or Readily Perishable Vendors [Fifteen] Twenty dollars
per annum for operators of machines which vend perishable or readily
perishable products
4. Combination Nonperishable- Perishable Vendor - [ Twenty] - Twenty -eight
dollars per annum for operators of perishable and nonperishable product
machines.
5. Machine Location Permits - In addition to the vendor license fees
required herein, each licensed vending machine operator shall obtain
a permit for each vending machine location at which he operates
vending machines within the City. The fee for such permits shall be
in accord with the following schedule:

enclosure, space, or area where one or more vending machines are installed and
operated
H. Special food handling license: $[5.00] 30.00 per annum.
Section 11 -104. LICENSE FEES
• Subdivision 3. The annual fee for an "on- sale" license [shall be two hundred
fifty dollars ($250) . The annual fee for] , an "off - sale" license [shall be thirty-
five dollars ($35).] and the daily fee for a "temporary on- sale" license shall be
[ten dollars ($10).] as set forth in Section 23 -010 of the City Ordinances.
Section 23- 201.01. LICENSE REQUIRED. No person shall own or keep any pool,
billiard or bumper pool table that is used by the public or for which a charge is made
for the use thereof within the limits of the City of Brooklyn Center, Minnesota,
without first obtaining from the City Council of said City a license therefor. [There
shall be an annual license fee of five ($5.00) dollars per table payable on or before
the beginning of each calendar year.] The annual license fee for a pool, billiard or
bumper pool table shall be as set forth in Section 23 -010 of the City Ordinances.
Section 23- 209`.04. LICENSE FEE. The annual fee [for such license shall be
five dollars ($5.00)] for each bowling alley or lane located in the property described
in the application shall be as set forth in Section 23 -010 of the City Ordinances.
Section 23 -301. LICENSE REQUIRED. No person shall conduct or permit public
dancing in any public establishment within which intoxicating liquor or nonintoxica-
ting malt liquor is licensed to be sold or consumed unless a public dance license
shall have been issued by the City Council Licenses shall be issued for one(1)
year periods expiring December 31. The annual fee for a public dance` license shall
be [$25.00] as set forth in Section 23 -010 of the City Ordinances.
ORDINANCE NO.
Section 23 -404. LICENSE FEE. The annual fee for each filling station license
• shall be as set forth in Section 23 -010 of the City Ordinances [five dollars ($5) for
one pump plus three dollars ($3) for each additional pump] and shall be paid to the
clerk with the application for the license. The annual fee for the storage of such
liquids as described in Section 23 -401 including the selling and dispensing the
same by any other method than by pumps, `shall also be [five, dollars ($5).1 as set
forth in Section 23 -010 of the City Ordinances.
Section 23 -901.
(d) If the application be granted, an additional license fee [of seven dollars
($7)] as set forth in Se 23 -010 of the City Ordinances shall be paid to the City
of Brooklyn Center for each bench, at the time the license is issued.
Section 23 -1302. APPLICATION. The application for license for selling
Christmas trees shall be made to the City Clerk and shall be accompanied by a
seasonal fee (.of $151 as set forth in Section 23 -010 of the City Ordinances The
license will expire.on January "5 - of the year following its issuance. A separate
license shall be required for each place of sale.
Section 23 -1500. MECHANICAL CONTRACTORS LICENSE REQUIRED. No person
shall install, alter, reconstruct', or repair any .portion of a building mechanical system
Consisting of heating, ventilating, comfort cooling, or refrigeration equipment, in-
cluding any gas piping incidental thereto, without first having procured a license
• therefor from the City of Brooklyn Center. Licenses shall be issued only to
individuals or contractors who demonstrate an understanding of the laws and
regulations and techniques relating to the installation and maintenance of building
mechanical systems. The annual license fee [is hereby established at $251 shall
be as set forth in Section 23 -010 of the City Ordinances. Licenses shall expire on
the last day of April each year.
Section 23 -1501 HOUSE MOVING CONTRACTORS LICENSE REQUIRED.. No
person shall move, remove, or raze any building within Brooklyn Center without
first having procured a license therefor from the City of Brooklyn Center. Licenses
shall be issued only to individuals or contractors who demonstrate qualifications
and knowledge regarding such work and who can furnish" proof of insurance relating
to such work. The annual license fee [is hereby established 'at $251 shall be as
set forth in Section 23 -010 of the City Ordinances Licenses shall expire on the
last day of April each year.
Section 34 -160 SIGN HANGER'S LICENSE
2. The [applicant] fee for a sign hanger's license shall [pay a $35 license fee]
be as set forth in Section 23 -010 of the City Ordinances and the license
shall run from May 1- to April 30 of the following year.
