Resolution Amending 972 Budget 4 4 The attached resolution constitutes a routine distribution of } wage adjustments as established by the City Council in December 1971. Disposition`_____ Item 6. Resolution Establishing Public improvement Hearing The attached resolution is intended to establish a public hearing for the curb and gutter improvement portion of the impending Brooklyn Boulevard project south of Trunk Highway 100. Disposition Item 8. Ordinance Amending Zoning Ordinance Section 35 -800 The attached ordinance is intended to extend the Administrative Permit period within which out -of -door sales of nursery and garden merchandise may be conducted. The ordinance was first read on February 14, 1972 published on March 2, 1972 and is offered this evening for second reading and adoption. Disposition Item Ordinance Amending Platting Chapter 15 The attached ordinance consists of a series of changes in the Platting Code for the purpose of recognizing plats relating to condominium townhouses. Disposition­_­ i i Member introduced the following resolution and moved its adoption: RESOLUTION NO. RESOLUTION AMENDING THE 1972 GENERAL FUND BUDGET WHEREAS, Section 7.08 of the City Charter of the City of Brooklyn Canter does provide that the City Council tray, by a majority vote.of its members, transfer unencumbered appropriation balances frofa one office, department or agency to another within the same Fund and WHEREAS, on October 6, 1971, when the City Council adopted the 1971 budget, labor negotiations had not been completed vrith City employees; and WHEREAS, the City Council did appropriate funds for departmental labor in the amount of $65,000 to Unallocated Departmental Labor to provide funds for final wage settlements; and WHEREAS, on December 30, 1971, labor negotiations having been completed, the Council did set wages for the year 1972; and WHEREAS, an agreement with the Brooklyn Center Police Assotaation d!d provide for an increase in the clothing allowance itm addition to salary increases: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Canter, Minnesota to transfer $65,000 from the Unallocated Departmental Labor Appropriation (Account No. 497 -10) to the following departmental approprla tlon�- in the amount shown: Administrative Oifi4e Labor (Account No. 4051610) $ 4,125.00 Office of the Assessor Labor /Account No. 4053 -10) 918.00 Finance Labor (Account No. 4054 -10) 2 Governmw BullldiM s tabor amount No. 409 -10) 2,404.00 Police Protection Labor (Account Rio. 421 -10) 10,058.00 General Supplies (Account No. 411 -39) 700.00 Protective Inspection Labor (Account na. 413 -10) 1,860.00 Recreation No. 3 Engineering Labor (Account. RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED CURB & GUTTER IME VEMM pROJECT NO. 1971 -.3 WHEREAS, it is proposed that there be constructed an improvement consisting of curb and gutter on Trunk Highway 152 from the T. 100 interchange to the south • corporate limits; and WHEREAS, the City Engineer has made a preliminary report advising that said proposed improvement is feasible and that it i can be constructed at an estimated cost of $5,300.00. NOW, THEREFORE, BE IT RESOLVED by the City Council of th City of Brooklyn Center, Minnesota, as follows= 1. The Council ro ses to P po proceed under authority granted by Chapter 429, Minnesota Statutes, s 2. A public hearing on the proposed improvement shall be held at the City Hall in the City on Monday, the 27th day of March, 1972, at 8s00 o'clock P.M., central standard time, and the Clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the city. 3. RESOLUTION NO. RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO EXECUTE COOPERATIVE CONSTRUCTION AGREEMENT NO. 57057 WITH THE STATE OF MINNESOTA, DEPARTMENT OF HIGHWAYS BE IT RESOLVED that the City of Brooklyn Center enter into an agreement with the State of Minnesota, Department of Highways, for the following purposes, to -wit: "To provide for payment by the City of Brooklyn;to' the State of a share of the costs of constructing cooperative mainline storm sewer facilities, cooperative catch basins and leads, concrete curb 'and gutter, concrete driveway pavement, and concrete walk to be performed by the State upon and along Trunk Highway No'.152- from approximately 200 feet southeasterly of the southeast inter- section of 47th Avenue North in the City of Minneapolis to approx- imately one quarter of a mile southeasterly of the junction of Trunk Highway No. 100 in accordance with plans, specifications and special provisions designated as State Projects No. 2741-11 and No. 2742 -15 (T.H.152= 129)."
