Authorise Release of Site Improvement Bond - The bonded site improvement work at the Maranatha Nursing Home has een completed. ` The site improvements are not strictly consistent with the approved site plan, but the reasons for the inconststeacy _r$ seem reasonable and acceptable. Resolution Authorizing Execution of Minnesota Highway Agroement The Minnesota 111ghway Department Intends to install traffic slgnsle at the FAI -94 Interchange ramps at Brooklyn Boulevard. The attached revolution is intended to authorize the Mayor and City MaA*er to execute a standard agreement with the Minnesota Highway Department regarding maintenance and operation of the traffic control signals. The Director of Public `k orks will be "prepared to describe the details of the agreement. Disposition Item 6d. Resolution Amending Resolution 719.132 regarding Communication Program In 1971, the City Council authorized Brooklyn Center's participation In a Metropolitan Area Communication upgrading program which was E to' be administered by the Minnesota Bureau of Grimin al ;.Apprehension.,"'. That State agency has since declined to act a s an agent for the Metropolitan Area communities and tine attached resolution is Intended to authorize the Metropolitan Council to act as as ch agent sunieet to the same' financial commitments as previously authorised.. Resolution Authorizing Purchase of Open Space The etteched resolution is intended to authorise the purchase of open space property between County Road 10 and the north shore of Twin Lake at ar price determined through eminent domain proceedings. Disposition w Item 8. Ordinance Requiring Fencing around Outdoor Pools The attached ordinance was first rued on May 22, 1972 and puolist+ed ' on June 1, 1972. The staff has received numerous telephone cells reinq the provisions of the ordinance from owners of existing swimmum pools. Basically, the expressed concerns coil down to two major points: The type and height of the required fencing and the proposed 4-- foot- 41sUnce sieetween the required fence and the pool' perimeter. *A modified ordIA040e - <= draft is submitted for Council reconsideration which features a change in the 47foot distance factor. RESOLUTION PERTAINING TO MINNESOTA HIGHWAY DEPsARTM1l T AGREEMM No 57153 --M REGARDING MAINTENANCE FOR TRAFFIC CONTRDL SIGH&W AT THE T.H. 94 IM'aRCW=Z R%NP3 AND TRH, 152 BE IT RESOLVED that the City of Brooklyn Center enter into, an agreement with the State.of Minnesota, Department of Highways,' for the following purposes, to -wit: "To maintain and ,provide electric energy for the traffic control signals with street lights at the Trunk Highway 94 Interchange ramps and Trunk Highway No 152 (Brooklyn Boulevard) in accordance with the terms and conditions eet forth and contained in Agreement No. 57153 -M, a copy of which was before the Council."
