Adjournment o, CITY MANAGER'S COMMENTS Item 5a Authorizing Execution of Agreement with Local No. 49 The attached resolution is recommended for the purpose of ratifying the union ratified terms for a 1976 collective bargaining agreement with Local No. 49 of the International Union of Operating Engineers. Disposition Item 5b Authorizing Application for Housing Assistance Funds The attached resolution comprehends applying for Section 8 Housing Assistance Funds through the Metropolitan HRA. The proposal has been reviewed by the Brooklyn Center Housing Commission which adopted a resolution advising the City Council. Disposition Item 5c Authorizing Amendment to Fire Training Center Agreement The attached resolution is recommended for the purpose of authorizing an amendment to the Fire Training Center Agreement with the Suburban Hennepin County Area Vocational - Technical School District No._ 287. The purpose of the amendment is to authorize rental of the Fire Training Center facilities to municipalities and school districts who were not I° originally parties to the agreement. Disposition 2 Item 5d Approving Plans for Pedestrian Bridge and Signal System The attached resolution is recommended for the purpose of approving plans for pedestrian facilities across Trunk Highway 100 at Trunk Highway 152 and a signal system at the north interchange ramps of the intersection. Preliminary plans for this project were approved .9 - February 24, 1975. # Disposition ,rf 3 . k CITY MANAGER'S COMMENTS Page 2 Item 5e Authorizing Cooperative Agreement with Minnesota Highway Department ,_ The attached resolution is recommended for the purpose of authorizing execution of a construction agreement with the Minnesota Highway N Department for cost sharing relating to the proposed pedestrian bridges and traffic signals at Trunk Highway 100 and Trunk Highway 152. " Disposition Item 5f Authorizing Signal Maintenance Agreement The attached resolution is recommended for the purpose of authorizing execution of a traffic signal maintenance agreement with the Minnesota Highway Department. Disposition Item 7a Amending Chapter 35 In the event Planning Commission Application No. 76004 is approved by the City Council,the attached ordinance is recommended for the purpose of amending Chapter 35 of the City Ordinances by changing the zoning designation of properties comprehended by Application No. 76004. n Disposition _X2 ` Item 8a Hennepin County Transportation System Report Public Works Director James Merila will be prepared Monday evening to summarize those features of the Hennepin County Transportation System Report which bear directly on Brooklyn Center. Disposition r� h { N Member introduced the following resolution and moved its adoption: 1 >t RESOLUTION NO. RESOLUTION RATIFYING 1976 CONTRACT TERMS AND AUTHORIZING ` EXECUTION OF COLLECTIVE BARGAINING AGREEMENT WITH LOCAL NO. 49, INTERNATIONAL UNION OF OPERATING ENGINEERS WHEREAS, the City Manager reports that tentative agreement has been ` reached between the negotiating committees representing the Metropolitan Area Management Association on behalf of participating employer municipalities and Local No. 49, International Union •of Operating Engineers; and WHEREAS, the terms of said tentative agreement on 1976 contract provisions have been ratified by the membership of Local No. 49 on February 9, 1976; and WHEREAS, the City Council accepts the City Manager's recommendation 'k that the terms of the tentative contract agreement be ratified. NOW, THEREFORE, BE .IT RESOLVED by the City Council of the City of Brooklyn Center to agree to the incorporation of the following terms and conditions of employment in the 1976 collective bargaining agreement with Local No. 49, International Union of Operating Engineers: I . Length of Contract. The agreement shall be for a period of one j year with all terms and conditions retroactive to January 1, 1976 and an expiration date of December 31, 1976. ki 2. Wages. Effective January 1, 1976 $1,000 per year across the board shall be applied to 1975 salaries for all job classifications in the bargaining unit. • 3. Vacations. Effective January 1, 1976 vacations shall accrue at the rate of four weeks per year after fifteen years of service have f been completed. RESOLUTION AUTHORIZING THE METROPOLITAN COUNCIL TO APPLY FOR HOUSING ASSISTANCE FUNDS FOR IMPLEMENTATION WITHIN THE CITY OF BROOKLYN CENTER WHEREAS, the Metropolitan Council has been duly organized pursuant to Minnesota Statutes 473.06, Subdivision 3 and Minnesota Laws 1975,; Chapter 13, Section 6, Subdivision 3; Section 21, Subdivision l; and Section 24, and has all of the powers and duties of a housing and redevelopment authority pursuant to Laws 1975, Chapter 13, Section 24 under the provisions of the Municipal Housing and Redevelopment Act, Minnesota Statutes Section 462.411 to 462.711, and acts amendatory thereof;; and WHEREAS, the City of Brooklyn Center and the Metropolitan Council desire to assist lower income families and elderly to obtain adequate housing in the City of Brooklyn Center at a price they can afford, and 'to accomplish this purpose desire to apply for federal funds to undertake ,a program of sub - sidizing rent payments to landlords who provide adequate housing to such individuals and families. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that the Metropolitan Council is hereby authorized to include the City of Brooklyn Center in its application for federal funds to implement a program of rental assistance to lower income families and elderly, and that upon federal approval of such application, the City of Brooklyn Center and the Metropolitan Council will enter into an agreement for operating the program within the City. Date Mayor ATTEST: Clerk The motion for the adoption of the foregoing resolution was duly seconded by member and upon vote being taken thereon, e t e n the w' p g eo t e following g voted in favor thereof: r and the following voted against the same: whereupon said resolution was declared duly passed and adopted, { Member introduced the following resolution and moved its adoption: RESOLUTION NO. 4 RESOLUTION AUTHORIZING AMENDMENT TO FIRE TRAINING In CENTER AGREEMENT WHEREAS, along with other municipalities, and joint Independent School District No. 287 Brooklyn Center is a party to the Fire Training Center Agreement which became effective August 9, 1973; and WHEREAS, it has been recommended by the Fire Training Center Board that the agreement be amended to permit nonparticipating municipalities and school districts the opportunity of access to the Fire Training Center and related facilities; and WHEREAS, amendment to the Fire Training Center Agreement requires approval of at least three - fourths of the municipalities which are parties thereto. °. NOW, THEREFORE, BE IT RESOLVED by the City Council cf the City of Brooklyn Center to agree to the proposed amendment and to authorize the Mayor and City Manager to execute an amendatory agreement. RESOLUTION APPROVING T.H. #152 PEDESTRIAN BRIDGES AND TRAFFIC SIGNAL SYSTEM PLANS AT JUNCTION OF T.H. #100 WHEREAS, the Commissioner of Highways for the State of Minnesota has caused to be prepared: plans, special provisions and specifications for the improvement of Trunk Highway No. 129, renumbered as Trunk Highway No. 152, within the corporate limits of the City of Brooklyn Center, at junction T.H. 100; and WHEREAS, said plans are on file in the Office of the Department of Highways, St. Paul, Minnesota; being marked, labeled and identified as: S.P. 2742 -27 (152 =129); and WHEREAS, said special provisions are on file in the Office of the Department of Highways, St. Paul, Minnesota; being marked, labeled and identified as: S.P. 2742 -27 (152 =129), and which, together with, the Minnesota Department of Highways Standard Specifications for Highway Construction, dated January 1, 1972, as amended by Minnesota Department of Highways Supplemental Specifications for Highway Construction, dated January 1, 1974, will govern, and which are on file in the office of the Commissioner of Highways, constitute the specifications for said improvement ;...�. - P P of Trunk Highway No. 129, renumbered as Trunk Highway No. 152; and WHEREAS, copies of said plans and special provisions, as'bo marked, labeled and identified are also on file in the Office of the City Clerk; and WHEREAS, the term, said plans and special provisions, as herein- after used in the body of this resolution will be deemed and intended to mean, refer to and incorporate the plans and special provisions in the foregoing recitals particularly identified and described; and WHEREAS, the Commissioner of Highways desires in the interest of public safety that any and all parking of vehicles, if such parking is permitted within the corporate limits of the City of Brooklyn Center, on said Trunk Highway No. 129, renumbered as Trunk Highway No. 152, will be parallel with the curb adjacent to the highway and will be at least 20 feet from any crosswalk. NOW, THEN BE IT RESOLVED that said plans and special provisions for the improvement of Trunk Highway No. 129, renumbered as Trunk Highway � No. 152, within the corporate limits of the City of Brooklyn Center, be and hereby are approved. RESOLUTION NO. BE IT FURTHER RESOLVED that the City of Brooklyn Center does hereby agree to require the parking of all vehicles, if such parking is permitted within the corporate limits of said City, on said Trunk Highway No. 129, renumbered Trunk Highway No. 152, will be parallel with the curb adjacent to the highway, and at least 20,feet'from any crosswalks on all public streets intersecting said trunk highway. BE IT FURTHER RESOLVED that the elevations and grades as shown in said plans and special provisions are hereby and consent is hereby given to any and all cl in grade occasioned by the constructior of Trunk Highway No. 129, renumbered Trunk Highway No. 152, in with said plans and special provisions. RESOLUTION PERTAINING TO MINNESOTA HIGHWAY DEPARTMENT i COOPERATIVE CONSTRUCTION AGREEMENT NO. 58162 REGARDING PEDESTRIAN BRIDGES ON T.H. 152 OVER T.H. 100 BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, as follows: I 1. That the City enter into an agreement with the State of Minnesota, Department of Highways for the following purposes, to -wit: j to provide for payment by the City of Brooklyn Center to the State of Minnesota, 50 percent of the costs not reimbursable under Federal -aid funding of all construction to be performed under a state contract for State Project No. 2742 -27 (T.H. 152 =129) except for the construction of a traffic signal system by Federal -aid and State funds in accordance with the terms and conditions set forth and contained in Agreement No. 58162, a copy of which was before the Council. Said city cost participation construction consists of two pedestrian bridges adjacent to and easterly and westerly of ink place Trunk Highway No. 152 Bridge No. 27038 over Trunk Highway No. 100, concrete walk approaches to said pedestrian bridges and other miscellaneous concrete walk, concrete steps and appurtenances; and other miscellaneous items upon, along and adjacent to the Trunk Highway No. 152 bridge approach areas. 2. That the Mayor and City Manager be and they hereby are authorized to execute Cooperative Construction Agreement No. 58162. 3. That $28,667.33 be appropriated from State Aid Construction Account No. 2613 for the City's share of said project construction costs in accordance with said agreement. RESOLUTION PERTAINING TO MINNESOTA HIGHWAY DEPARTMENT AGREEMENT NO. 58178M REGARDING MAINTENANCE OF TRAFFIC CONTROL SIGNALS AT THE INTERSECTION OF T.H. #152 AND THE T.H. #100 NORTH RAMPS BE IT RESOLVED that the City of Brooklyn Center enter into an agreement with the State of Minnesota, Department of Highways, for the following purposes, to -wit: To provide electric energy and certain maintenance to the traffic control signal with street lights at the intersection' ,of Trunk Highway No. 152 (Brooklyn Boulevard) and Trunk Highway No. 100 North Ramps in accordance with the terms and conditions set forth and contained in Agreement No. 58178M, a copy of which was before the Council. BE IT FURTHER RESOLVED that the Mayor and City Manager be and they are hereby authorized to execute such agreement, and thereby assume for and on behalf of the City of Brooklyn Center all of the contractual obligations contained therein. Section 35 -1120 is hereby amended in part by the deletion of the following: [ Lot 6, Block _ 1 and Block 2, Hi Crest Square Addition] Section 2.
