CITY MANAGER'S COMMENTS
Item 5 Approve Animal Control Agreement
It is recommended that the Council approve the renewal of a contract
for calendar 1977 with Metropolitan Animal Patrol Service, Inc.
Disposition
Item 6 Approve Payment of Bond Sale Costs
It is recommended that the City Council approve payment to the City
Bond Consultant, Springsted Incorporated, and to the bonding attorney
for services rendered relative to the issuance of $980,000 of General
Obligation Improvement Bonds.

Item 7a Authorizing Purchase of Reversible Plow
The attached resolution is recommended for the purpose of awarding
a bid for a budgeted reversible snow plow. The net amount budgeted
in the 1977 budget is $3,600.

The attached resolution is recommended for the purpose of awarding
a bid for a rigid snow plow. The net amount of $2,300 was budgeted

WHEREAS, the Director of Public Works and the City Clerk have reported
that on November 23, 1976 at 11:00 a.m. they opened and tabulated bids received
for furnishing and delivery of one hydraulic reversing snow plow and that said
bids were as follows:

Member introduced the following resolution and moved its

RESOLUTION NO.
RESOLUTION AUTHORIZING THE PURCHASE OF TWO DOOR SEDAN
WHEREAS, Chapter 471.345 of the Minnesota Statutes provides for the
purchase of merchandise, materials or equipment, or any kind of construction
work by informal quotations when the amount of such contract is less than five
thousand dollars ($5 , 000); and
WHEREAS, the City Manager has obtained quotations on the purchase of
a two door sedan and has determined that the quotation of Brookdale Ford in the
amount of $4,345 for a 1977 Mustang two door sedan is the best quotation
submitted.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center that the City Manager be authorized to contract for the purchase
of a two door sedan in the amount of $4,345 from Brookdale Ford.

RESOLUTION AUTHORIZING THE PURCHASE OF FIVE (5) POLICE
PATROL SEDANS
WHEREAS, the City of Brooklyn Center is authorized to participate in the
Hennepin County Purchasing Agreemext; and
WHEREAS, on Tuesday, October 19, 1976 at 2:00 p.m. bids were
received for the furnishing of five (5) police patrol sedans
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center that the bid of Suburban Chevrolet for four (4) compact Chevrolet
Nova police patrol sedans in the amount of $18,392.88 ($4,598.22 each) and
that the bid of Central Chrysler Plymouth for one (1) 1977 intermediate Plymouth
Fury police patrol sedan in the amount of $4,533.25 in accordance with the
specifications are deemed to be the best bids submitted by a responsible bidder
and said bids are hereby accepted.

RESOLUTION AUTHORIZING PAYMENT OF CERTAIN .HOSPITAL
MEDICAL INSURANCE COSTS
WHEREAS, the City Council on December 22, 1975 adopted Resolution
No. 75 -246 authorizing payment of an amount not to exceed $40 per month
toward the cost of coverage under - the Brooklyn Center Group Hospital- Medical
Insurance Plan for permanent full -time employees (and eligible dependents) who
are not members of recognized bargaining units; and
WHEREAS, - the City Council is committed by labor contract effective
`January 1, 1975 -to continue paying an amount not Ito exceed $27 per month toward
the cost of coverage under - the Brooklyn Center Group Hospital - Medical Insurance
Plan for permanent full -time employees (and eligible dependents) who are members
of Local No 49, International Union of Operating Engineers; and
WHEREAS, -the City Council is. committed by labor contract effective
January 1, 1976 through December 31, 1976-to pay a maximum of $60 per month
per employee toward health, life and long term disability insurance and effective
January 1 1977 - to December 31, 1977 -to pay a maximum of $65 per month per
employee toward health, life and long term disability insurance for permanent full-
time employees in the police bargaining unit represented by Teamsters Local
No. 320; and
WHEREAS, the City Manager recommends increasing effective January 1, 1977
the City contribution - toward -the cost of health insurance premiums for permanent full-
time employees (and eligible dependents) who are not members of recognized bargain-
ing units
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn
Center 'to authorize effective January 1, 1977 payment of an amount not -to exceed
$50 per month toward - the cost of coverage under - the Brooklyn Center Group Hospital -
Medical Insurance Plans as fringe benefit compensation for permanent full -time
employees (and eligible dependents) who are not members of recognized bargaining
units.

ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 25 OF THE CITY ORDINANCES
REGARDING STREET NAME CHANGES
THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS
FOLLOWS-
Section 1. Chapter 25 of the City Ordinances is hereby
amended by the addition of the following:'
Section _25 -418. T.H. 169, known as Lyndale Avenue,(part)-
West River Road. That portion of T.H. 169, known as Lyndale Avenue,
from F.I. 94 to the North Corporate Limits (73rd Avenue North) is
hereby renamed, and shall be known as West River Road effective
January 2, 19770
Section 2. This ordinance shall become effective
January 2, 1977.

AN ORDINANCE AMENDING CHAPTER 17 OF THE CITY ORDINANCES
RELATIVE TO VACATION LEAVE
THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS:
Section 1. Section 17-111, No. l is hereby amended to read as follows
1 Amount Permanent employees shall earn vacation leave at the rate
of five - sixths of one working day for each calendar month of full-
time service or major fraction thereof. Permanent employees with
five consecutive years of service through ten consecutive years of
service shall earn vacation leave at the rate of fifteen working days
per year (1 -1/4 days per month.) [one and one -fourth working days
for each calendar month of full-time service or major fraction thereof.
Employees with fifteen consecutive years of service shall earn vacation
leave at the rate of one and two - thirds working days for each calendar
month of full -time service or major fraction thereof.] Permanent
employees with more than ten consecutive years of service shall
earn vacation leave according - to the following schedule:
During l lth year of service 16 working days per year (1- 1/3 days/Mo.)
During 12th year of service 17 working days per year (1-5/12 days/mo.
• During 13th year of service 18 working days per year (1 -1/2 days /mo.)
During 14th year of service 19 working days per year (1 -7/12 days /mo.
During 15th year of service 20 working days per year (1 -2/3 days /mo.
Employees using earned vacation leave or sick leave shall be considered
to be working for the purpose of accumulating additional vacation leave.
Section 2. The terms of this ordinance shall become effective January 1, 1977.
Section 3. This ordinance shall become effective after adoption and upon
thirty (30) days following its legal publication.

AN ORDINANCE AMENDING CHAPTER 17 OF THE CITY ORDINANCES
RELATIVE TO SICK LEAVE
THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS:
Section 1 Section 17 -112, No. 3 of the City Ordinances is hereby
amended to read as follows:
3. Accrual. Sick leave shall accrue at the rate of one day per month
until 120 [100]; days have been accumulated and at the rate of one-
- half day per month after 120 [100] days have been accumulated.
Employees using earned vacation leave or sick leave shall be
considered to be working for the purpose of accumulating additional
sick leave. Workmen's Compensation benefits shall be credited
against the compensation due employees during sick leave.
Section 2. Sick leave accruals shall be calculated according to Section 1
for all employees employed on the effective date of this ordinance and thereafter.
Section 3. This ordinance shall become effective after adoption and upon
• thirty (30) days following its legal publication.

Member introduced the following resolution and
moved its adoption:
RESOLUTION NO.
RESOLUTION APPROVING COLLECTIVE BARGAINING AGREEMENT
BETWEEN TEAMSTERS PUBLIC AND LAW ENFORCEMENT EMPLOYEES
UNION LOCAL NO 320 AND THE CITY OF BROOKLYN CENTER
WHEREAS, the Public Employment Labor Relations Act of 1971 as amended
thereafter requires a written contract between the employer and the exclusive
representative of a recognized bargaining unit; and
WHEREAS, Minnesota Teamsters Public and Law Enforcement Employees
Union, Local No. 320 has been designated as - the exclusive representative for
the Brooklyn Center police bargaining unit; and
WHEREAS, tentative agreement on 1976 -77 contract terms has been reached
through collective bargaining between Minnesota Teamsters Public and Law Enforce-
ment:Employees Union, Local No. 320 and - the Brooklyn Center City Manager
representing the employer; and
WHEREAS, advice has been received from the League of Minnesota Cities
labor relations consultant that Section 9.5 of - the tentative agreement is vague in
its applicability 'to Brooklyn Center's long established career development /job
enrichment /productivity program of assigning certain plain clothes duties on a
rotating personnel basis:
NOW, THEREFORE, BE IT RESOLVED by the Brooklyn Center City Council to
approve and adopt by reference as though incorporated fully herein - the document
entitled:
LABOR AGREEMENT BETWEEN THE CITY OF BROOKLYN CENTER
AND
MINNESOTA TEAMSTERS PUBLIC AND LAW ENFORCEMENT EMPLOYEES UNION,
LOCAL NO. 320
dated December 6, 1976, three copies of which shall be on file and available for
inspection in the office of - the City Clerk.
BE IT FURTHER RESOLVED - that said approval and adoption is premised upon
the understanding that Section 9.5 of the agreement is not to be construed to
effectively prohibit the personnel rotation concept of the Assignee Program, which
is operated pursuant to Minnesota Statutes Section 179.66, Subdivision 1 and
Section 5.1 of the labor agreement.
