W Item 5a Human Rights Commission
Mayor Cohen will be prepared Monday evening to request Council
confirmation of his appointment of a member to the Human Rights
Commission.

The City Manager will announce - the appointment of Dr. Duane Orn
as City Health Officer.

The attached resolution is recommended for the purpose of commend-
ing the services of Kathleen Miller as a member of the City Human
Rights Commission.

Item 6b Establishing Improvement Projects 1977 -5 & 6
The attached resolution is recommended for the purpose of establish-
ing Improvement Projects 1977 -5 & 6 described as sanitary sewer
and street surfacing respectively in 55th Avenue North between
Queen and Russell Avenues.

Item 6c Assigning Proceeds of Real Estate Sale
The attached resolution is recommended for - the purpose of assigning
- the proceeds of - the sale of property - to LaVerne Linder.

Item 7a Application No. 77009 submitted by Roger Lange
The City Council tabled Planning Commission Application No. 77009
on February 28 in order that more information would be forthcoming
pertaining - to the proposal of Roger Lange. We will be prepared
Monday evening to present the information which - the Council
requested.

Item 7b Application No. 77005 submitted by Howard Johnson Company
Planning Commission Application No. 77005 was first considered
by the Planning Commission at its meeting of January 27 and - tabled
to permit - the applicant the opportunity 'to make revisions and
corrections to the submitted plans. The item was again considered
by the Planning Commission at its meeting of March 10, 1977.

Item 7c Application No. 77006 submitted by Howard Johnson Company
Planning Commission Application No. 77006 was first considered
by the Planning Commission on January 27 and tabled pending
disposition of Application No. 77005. The matter was again
considered at the Planning Commission meeting of March 10, 1977

Item 7d Amendment 'to Application No. 76046 submitted by Dayton
Development Company
Planning Commission Application No. 76046 was considered by the
Planning Commission at its meeting of July 22, 1976 relating to - the
proposed Titus, Inc. commercial development. The application
was subsequently approved by the City Council but the development
proposal was abandoned. This proposed amendment - to Application
No. 76046 was initially considered by -the Planning Commission at
its meeting of January 27, 1977 and was tabled - to allow for certain
revisions. The amendment to Application No. 76046 was subsequently
considered by -the Planning Commission at its meeting of March 10.

Planning Commission Application No. 77012 was considered by - the
Planning Commission at its meeting of March 10, 1977.

Item 8 Liquor License
In conjunction with Planning Commission Applications No. 77005
and 77006 the Howard Johnson Company has requested an on sale
liquor license and a Sunday on sale ,liquor license for Ground
Round Restaurant - to be located on the County Road 10 periphery
of Brookdale Shopping Center. The police department has completed
its investigation of the principals involved in the application and
the various other requisites to issuance of a liquor license have
been met. One unresolved matter consists of the designation of a
manager of - the licensed premises On - the basis of the license
requisites being met, it is recommended 'that - the City Council
authorize the issuance of liquor licenses to the Howard Johnson
Company for the subject premises, subject - to an affirmative
recommendation to - the City Council following - the designation and
investigation of a restaurant manager.

Item 9a Dutch Elm Disease Legislation
Senators Humphrey and Luther have been invited to -the meeting
- this evening - to address - the matter of Dutch Elm disease control
legislation.

RESOLUTION EXPRESSING RECOGNITION OF AND
APPRECIATION FOR THE DEDICATION PUBLIC
SERVICE OF MS. KATHLEEN MILLER
WHEREAS', Ms. Kathleen Miller served as a member of the
Human Rights Commission from June, 1975 through January, 1977; and
WHEREAS, her devotion to the tasks and responsibilities of this
Commission contributed substantially to the sound progress and development
of the City; and
WHEREAS, her public service and civic effort for the betterment
of the community merit the gratitude of the citizens of Brooklyn Center.
STOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Brooklyn Center that:
The dedicated public service of Ms. Kathleen Miller as
a member of the Human Rights Commission and citizen, is
recognized and appreciated by the City of Brooklyn Center.

• RESOLUTION ESTABLISHING SANITARY SEWER IMPROVEMENT PROJECT
NO. 1977 -5 AND STREET SURFACING IMPROVEMENT PROJECT NO.
1977 -6, AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS
WHEREAS, a petition has been presented to the City Council
requesting Sanitary Sewer Improvement Project No. 1977 -5 and Street
Surfacing Improvement Project No. 1977 -6; and
WHEREAS, the City Council deems it necessary to initiate the
above mentioned improvement projects:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center to direct the City Engineer to prepare ,plans and
specifications for said improvement projects described as follows:
1977 -5 - Sanitary Sewer
In 55th Avenue North from the centerline of Queen Avenue
North westerly approximately-135 feet.
1977 -6 - Street Surfacing
• On 55th Avenue North from the centerline of Q ueen Avenue
North westerly approximately 150 feet.

RESOLUTION TO ASSIGN THE PROCEEDS OF THE SALE OF REAL
PROPERTY O BY THE CITY
WHEREAS, the City Council, by the adoption of Ordinance No, 76 -13,
authorized the conveyance of real estate from the City of Brooklyn Center to
Laverne E. Linder in consideration of the sum of $9,276.82; and
WHEREAS, Section 12.05 of the Brooklyn Center City Charter does direct
that the proceeds of any sale of City real property shall be used as far as possible
to retire any outstanding indebtedness incurred by the City'in the purchase,
construction, or improvement of this or other property used for the same public
purpose, or, if no such outstanding indebtedness exists, for some other public
use; and
WHEREAS, the City of Brooklyn Center did issue bonds in 1969 to finance
the acquisition of the Civic Center, municipal service buildings and the
acquisition and betterment of parks and playgrounds; and
WHEREAS, an indebtedness exists in the 1969 Building and Improvement
• Debt Retirement Fund for said acquisitions:
BE IT THEREFORE RESOLVED by the City Council of the City of Brooklyn
Center to direct the City Treasurer to assign the amount of $9,276.82 to the 1969
Building and Improvement Debt Retirement Fund to be used towards retiring the
debt.
