Adjournment CITY MANAGER'S COMMENTS Items 5a & b -Park and Recreation Commission -Park Service Area IV Mayor Cohen will be prepared Monday evening to make appointments for Council confirmation. Disposition Item 6 Declare Surplus Equipment The Park and Recreation Director has recommended discontinuance of the cross country ski program at the Kylawn Nature Preserve. There has been very little activity in - the program, other cross country skiing facilities are more competitively attractive, and our equipment is old and somewhat obsolete and in need of repair. It is recommended that the City Council declare as surplus equip - ment to be disposed at City auction 32 pairs of skis, 39 pairs of ski poles and 40 assorted size binders: Disposition • Item 7a Amending 1977 General Fund Budget vw � Brooklyn Center was a minor beneficiary n of. the Federal Anti- recessionary Fiscal Assistance Program which is tied by formula into the Federal Revenue 'Sharing Program. The Anti- recessionary Program has its own set of rules and regulations, among them the requirement that the money must be spent within six months after receiving it and the money must be 'spent for an ongoing municipal service. The attached resolution is recommended , r for the purpose of amending the 1977 General Fund Budget to satisfy the Federal requirements contained in the Antirecessionary„Assistance Program Disposition Item 7b Acknowledging Gift The attached resolution is recommended for the purpose of acknow- ledging a $25 gift from the Brooklyn Center Women's Club. Disposition i CITY MANAGER'S COMMENTS Page 2 Item 7c Reaffirming Equal Opportunity Policy The attached resolution is recommended for the purpose of reaffirming the equal opportunity employment concept practiced in Brooklyn Center. The subject was discussed by the Human Rights Commission earlier this year and the resolution recommended by the Commission on April 20, 1977. Disposition Item 7d Awarding Contract No. 1977 -D A resolution will be presented Monday evening for the purpose of awarding Contract No. 1977 -D consisting of a pump and motor at deep well No. 8. Disposition • Item 7e Authorizing Participation in Group Health Plan The attached resolution is recommended for the purpose of authorizing Brooklyn Center's participation in' the group health Health Maintenance Organization (HMO) . State law mandates that employers of 25 or more persons which offer employer participation in group health insurance programs must by January, 1979, provide employees the alternative i opportunity to participate in an HMO. There is no additional cost to the municipality. Disposition Item 7f Authorizing Participation in Employee Assistance Program The attached resolution is recommended for the purpose of authorizing Brooklyn Center's participation in an employee assistance program designed to deal with employee personal problems such as alcoholism, drug dependency, emotional problems and a whole range of human relations problems. I will be prepared Monday evening to elaborate on the features of the program which is partially funded by the State of Minnesota through Hennepin County. • Disposition CITY MANAGER'S COMMENTS I Page 3 • Item 7g Conveying Critical Area Work Program The attached resolution is recommended for the purpose of formally conveying Brooklyn Center's Critical Area Work Program to the State Planning Agency. As may be noted, we are requesting a $20,600 grant from the State Planning Agency to perform the work which has been mandated by ,State law. Disposition Item 7h Approving Preliminary Plans for FI -94 The attached resolution is recommended for the purpose of approving preliminary plans for the north /south leg of FI -94 from 53rd Avenue North to 62nd Avenue North Abutting property owners have been notified of the meeting and the Director of Public Works is prepared to present a report on the current status of the planning. Disposition I • Item 7,i Amending Comprehensive Plan The attached resolution is recommended for the purpose of amending 'the Comprehensive Plan in the event that Planning Commission Application No. 77011 is approved this evening. i Disposition Item 8 Application No. 77011 submitted by Kennth Bergstrom Application No. 77011 comprehends the rezoning from C -2 to R -1 that property located south of 69th Avenue North and east of - the Humboldt Square Shopping Center. The application was reviewed by the Planning Commission on March 10, April 14, and May 12, 1977. Disposition Item 9a 'Amending Chapter 35 Regarding Notice Radius for Special Use Permits • The attached ordinance amending Chapter 35 regarding an increase in 'the notice radius for special use permits was initiated by the Planning Commission, , Disposition CITY MANAGER'S COMMENTS • Page 4 Item 9b Amending Chapter 35 Regarding Rezoning from C-2 to R -1 The attached'ordinance amending Chapter 35 is intended to accomplish - the rezoning from C--2 - to R -1 of that property located south of 69th Avenue North and east of 'the Humboldt Square Shopping Center. The ordinance is recommended on the condition that Planning Commission Application No. 77011 is approved. Disposition Item. 9c Amending Chapter 19 Regarding Noisy Parties The attached ordinance amending Chapter 19 regarding noisy parties is recommended for the purpose of providing a necessary tool to the police department in addressing the increasing frequency of disturbing the peace complaints within the community. Disposition • Item 1 O Twin Lake Boating Report Councilman Lhotka will be prepared Monday evening to discuss the current status of the Twin Lake boating issue and specifically the results of a public meeting held on Monday, May 16, regarding the issue. Disposition Item 10b Dutch Elm Disease Legislation Report I will be prepared Monday evening to brief the City Council on the Dutch elm disease legislation recently adopted by the Legislature. Disposition Item 10c Open Forum 'Councilman Lhotka has requested that the subject of an open forum concept be discussed by the Council. Disposition Member introduced the following resolution and moved its adoption: RESOLUTION NO. RESOLUTION AMENDING THE 1977 GENERAL FUND BUDGET AND AUTHORIZING APPROPRIATIONS AND FUND TRANSFERS FROM THE ANTIRECESSION FISCAL ASSISTANCE FUND TO THE GENERAL 'FUND WHEREAS, Title II of the Public Employment Act of 1976 provides for the distribution of funds to States and units of local government, based on unemployment rates and revenue sharing allocations; and WHEREAS, the City has received an allotment of $3,805 from the Office of Revenue Sharing of said funds for the three quarters period from - J July ' 1 , 1976 to _ April 1 , 1977 and an allotment of $319.00 for the quarter period from April l 1977 to July 1, 1977; and WHEREAS, said funds total $4,124 and are available in the ANTIRECESSION FISCAL ASSISTANCE FUND for appropriation for permissible expenditures; and WHEREAS, the City must use its payments to maintain basic services which have been customarily provided to persons in the area under the jurisdiction of the �• City and must appropriate or obligate payments received under the Act before the end of the six month period after the receipt of a payment; and WHEREAS, Section '7.11 of the City Charter does provide the City Council with full authority to make permanent transfers between all funds which may be created, provided that such transfers are not_: inconsistent with the provisions of related covenants, the provisions of the City Charter, or State Statute: BE IT THEREFORE RESOLVED bV the City Council of the City of Brooklyn Center, Minnesota to amend the 1977 General Fund Budget to increase the appropriation for street lighting (Account No. 01- 4371- 000 -45) by the amount of $4,124; and BE IT FURTHER RESOLVED that the funds to finance the budget increase be appropriated from the ANTIRECESSION FISCAL ASSISTANCE FUND; and BE IT FURTHER RESOLVED to authorize the transfer of $4,124 from the ANTIRECESSION FISCAL ASSISTANCE FUND to the GENERAL FUND. Single family residential development represents a reasonable use of_the land: and is consistent with the Comprehensive Plan development goal for the Northeast Neighborhood. RESOLUTION ACKNOWLEDGING GIFT WHEREAS, the Brooklyn Center Women's Club has presented the City a gift of Twenty -five, Dollars ($25.00) and has designated that it be used for the Recreation Department's Program for the Handicapped; and WHEREAS, the City Council is appreciative of the gift and commends the Brooklyn Center Women's Club for its civic efforts: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center to acknowledge the gift with gratitude; and BE IT FURTHER RESOLVED that the gift of $25.00 be appropriated to the Recreation Department's General Programs (Acct. No. 01 -4130- 515 -65) to be used for the Program for the Handicapped. RESOLUTION EXPRESSING AND REAFFIRMING THE POLICY AND INTENT OF THE CITY OF BROOKLYN CENTER TO PROVIDE EQUAL OPPORTUNITY IN EMPLOYMENT TO ALL PERSONS WHEREAS, equal employment opportunity is the right of all persons to work and to advance on the basis of merit, ability and individual potential; and WHEREAS, ideally the concept of equal opportunity has deep roots in American and legal democratic tradition; and WHEREAS, the City Council of the City of Brooklyn Center endorses the principle of equal employment opportunity and desires to reaffirm its long standing commitment to equal employment opportunity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center to reaffirm that the policy and intent of the City of Brooklyn Center is to provide equality of opportunity in employment to all persons and to prohibit discriminatory employment policies, programs and practices contained in the State Human Rights Act. RESOLUTION APPROVING PRELIMINARY PLANS FOR THE IMPROVEMENT OF T. H. 94 FROM 53RD AVENUE NORTH TO CAMDEN COURT WHEREAS, the Commissioner of the Department of Transportation has prepared preliminary plans for the improvement of a part of Trunk Highway Number 392 renumbered as Trunk Highway No. 94 within the. corporate limits of the City of Brooklyn Center, from 53rd Avenue North to 'Camden Court and WHEREAS, said preliminary plans are on file in the Office of the Department of Transportation, Saint Paul, Minnesota, being marked, labeled, and identified as Layout No. 11B S.P. 2781 -09 from 40th Avenue North to 61st Avenue North, and WHEREAS, copies of said preliminary plans are so marked, labeled, and identified are also on file in the Office of the City • Clerk; and WHEREAS, the City of Brooklyn Center is working with represent- atives of the Minnesota Department of Transportation relative to upgrading the west frontage road of T.H. 94 from 59th Avenue North to 195 feet north of 61st Avenue North centerline; and WHEREAS, said upgrading may allow a change in noise barrier design to minimize the impact of said barriers to abutting residents; and WHEREAS, a survey of residents abutting the wall type noise abatement barrier shows the majority of said residents prefer a'wall material of textured concrete block; and WHEREAS, the term "said preliminary plans" as hereinafter used in the body of this resolution shall be deemed and intended to mean, refer; to, and to incorporate the preliminary plans as in the foregoing recitals particularly identified and described; • RESOLUTION NO. t" NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that said preliminary plans for the improvement of f T.H. 392 renumbered T.H. 94, within the limits of the City of Brooklyn Center, be and hereby are approved with the following conditions: 1) That the noise barrier design between 58th Avenue North and bust 'Avenue North may be modified in coordination with the City's plans for upgrading the west frontage road of T.H. 94! 2) That the wall type noise abatement barriers be constructed of a textured concrete block material, Date Mayor` ATTEST: Clerk ! • The motion for the adoption of the foregoing resolution was duly ' seconded by member and upon vote being taken thereon,'the' following voted in favor thereof: and the following voted against the same: whereupon said resolution was declared duly passed and.adopted. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that the bid of Keys Well Drilling Company in the amount of $14,225.00, as to furnishing of all work, labor, - and material in connection with the above mentioned project, according to the plans and specifications therefor now on file in the office of the City Clerk, is deemed to be the lowest and best bid submitted for said work by ,a responsible' bidder, and said bid is hereby accepted. BE IT FURTHER RESOLVED to authorize the Mayor and City Manager to execute a contract with said bidder. RESOLUTION AUTHORIZING PARTICIPATION IN GROUP HEALTH PLAN, INC. WHEREAS, State laws require that employers of 25 or more people which offer group hospitalization insurance programs to those employees must by January 1, 1978 offer an alternative health maintenance organization plan, and WHEREAS, the Group Health Plan, Inc. has clinic facilities located in Brooklyn Center; and WHEREAS, certain City employees have indicated a desire -to participate in such a health maintenance organization plan: NOW; THEREFORE, BE IT RESOLVED by the City Council of - the City of Brooklyn Center to authorize Brooklyn Center's affiliation with Group Health Plan, Inc. -to provide health maintenance services for employees of the City of Brooklyn Center and their dependents effective June 1, 1977 . • BE IT FURTHER RESOLVED that the current schedule of City employer contribution benefits to group health insurance similarly applies on behalf of those employees electing to participate in - the health maintenance organization option Date Mayor ATTEST: Clerk The motion for the adoption of the foregoing resolution was duly seconded by member` , and upon vote being - taken thereon, the following voted in favor thereof; and the following voted against the same: whereupon said resolution was declared duly passed and adopted. Member introduced the following resolution and • moved its adoption: RESOLUTION NO. ` RESOLUTION AUTHORIZING PARTICIPATION IN EMPLOYEE' ASSISTANCE PROGRAM WHEREAS, 'the State of Minnesota through Hennepin County has provided financial subsidies to encourage employers to participate in an Employee Assistance Program; and WHEREAS, such a program is intended to assist individual employees with a broad range of human relations problems such as alcoholism, drug dependency, emotional problems, financial problems, and other similar personal problems; and WHEREAS, the program is based on - the premise 'that such problems can adversely affect an employee's ability to function effectively on the job; and WHEREAS, through the program an employee can obtain initial diagnostic services at no charge without concern that participation will jeopardize the employee's job security,_ promotional opportunities nor reputation: • NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brooklyn Center to authorize Brooklyn Center's participation in - the Employee Assistance Program through June 30, 1978 at a cost not to exceed $1,500 during that period. RESOLUTION TRANSMITTING APPLICATION FOR STATE CRITICAL AREAS PLANNING GRANT WHEREAS, State Executive Order No. 130, effective November 23, 1976 establishes and defines a Mississippi River Corridor within the metropolitan area, including Brooklyn Center, and designates said corridor as a Critical Area pursuant to Minnesota Statutes, Chapter 116 G; and WHEREAS, said Order requires preparation of certain plans and regulations consistent with State standards and guidelines and WHEREAS, funds have been established to provide grants 'to support local efforts in achieving said plans and regulations: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center to transmit to the State Planning Agency an Application for a Critical Areas Grant together with the required work program. ^• Date Mayor ATTEST: Clerk The motion for `the adoption of the foregoing resolution was duly seconded by member , and upon vote being taken thereon, - the following voted in favor thereof: and - the following voted against ,the same: whereupon said resolution was declared duly passed and adopted. RESOLUTION AMENDING COUNCIL RESOLUTION NO. 66 -295 (COMPREHENSIVE PLAN) RELATIVE TO COMMERCIAL ZONED LAND IN SOUTHEAST QUADRANT OF 69TH AND HUMBOLDT AVENUES NORT WHEREAS, Resolution No. 66 -295 was adopted on November 7, 1966 establishing the Brooklyn Center Comprehensive Plan, A Guide for Community Development; and WHEREAS, the Plan recommends that there be provided a centrally located neighborhood shopping center in each of - the six residential neighborhoods, unless the residents are adequately_ served by community or regional shopping centers located nearby; and WHEREAS, the Plan refers to and recommends the designation of land in the southeast quadrant of 69 and Humboldt Avenues North as the location of such a shopping center for - the Northeast Neighborhood, and WHEREAS, the Plan recommends that single family residences be the pre- dominant character of the Northeast Neighborhood; and r. WHEREAS, pursuant to Chapter 35 -202 of the City Ordinances, - the Planning Advisory Commission has reviewed the above Plan recommendations, and has considered amendments to the Plan, at a duly called public hearing, which would provide for designation of the subject area as an appropriate location for single family residences; and WHEREAS, the Commission has recommended, in Resolution No. 77 -2, that the Comprehensive Plan be so amended; NOW THEREFORE, BE IT RESOLVED by -the City Council of the City of Brooklyn Center that Resolution No. 66 -295 (Comprehensive Plan) is hereby amended to designate - the developable land in - the southeast quadrant of 69 and Humboldt Avenues North as an appropriate location for single family residential i development in consideration of the following; 1 The Northeast Neighborhood is adequately served by shopping facilities both within and near the neighborhood: 2. The Comprehensive Plan designation of `this area for future development as a neighborhood shopping center has been satisfied with the existin g retail center. 3. There is substantial vacant commercial land elsewhere in the Northeast Neighborhood. ROBERT JENSEN WHEREAS, Mr. Robert Jensen served as a member of the Brooklyn Center City Council from January 7, 1974 through January 3, 1977; and WHEREAS, he served as a member of the Brooklyn Center Planning Commission from January 25, 196:2 through January 3,` 1974, and as that Commission's Chairman from October 7, 1907 through January 3, 1974; and WHEREAS, his devotion to the tasks and responsibilities of City Council and the Planning Commission, particularly with regard to his efforts involving the development of the City's Comprehensive Plan, contributed substantially to the sound progress and development of the City; and WHEREAS, his public service and civic effort for the betterment of the community merit the gratitude of the citizens of Brooklyn Center: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of • Brooklyn Center that: The dedicated public service of Mr. Robert Jensen as a member of the City Council and Planning Commission and citizen is recognized and appreciated by the City of Brooklyn Center. CITY OF BROOKLYN CENTER ORDINANCE NO: AN ORDINANCE AMENDING CHAPTER 35 RELATIVE TO DISTANCE OF MAILED NOTICES FOR SPECIAL USE PERMIT HEARINGS THE- CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 1. Chapter 19 of the City Ordinances is hereby amended by the addition of the following: Section 19 -1201. PURPOSE. It is recognized that loud, unpleasant, raucous or prolonged noise can and does have a harmful, debilitating and detrimental effect upon human beings, adversely affecting their mental and physical health, safety and well being. Such loud, unpleasant, raucous or prolonged noise and the resulting detrim debilitating and harmful effects upon human beings has become a major contemporary urban concern and is now considered to be a pollutant, not dissimila to the- pol of the ai and water by toxins or particulates. In an endeavor to provide for the mental and physical heal safe , well -being and peaceful repose of its c itize n s and their < neighborhoods, it is hereby declared - to be in the public interest tha loud, unpleasant, raucous, unnecessary or prolonged noise be abated. No person shall, between the hours of • 10 :00 p.m. and 7 :00 a.m. congre because of, participate in, or be in any ap rty or gathering of people from which noise emanates of a 'sufficient volume so as to disturb the peace, quiet or repose of persons residing in any residential area No person s vis or remain within any res dwelling unit wherein suc party or gathering is taki ng_plac e except persons who have gone there for the sole purpose of abating said disturbance. A police officer may order all persons present in any group or gathering from which s uch noise e other than the owners or tenants of the dwelling u to immediately disperse in lieu of being charged under this ordinance. Owner or tenants of the dwelling unit shall immediately abate the disturbanc a nd, fai to do so, s hall be in violation of this ordinance Section 19- 1203. PENALTY. Any person violating the provisions of this ordinance shall upon conviction be punished by a fine of not more than three hundred ($300) dollars and by imprisonment not to exc ninety (90) days; or both.
