tem 5 Approval of Final Plat
I't is recommended that the City Council approve the final Registered
Land Survey for the property at 6810 Brooklyn Boulevard. The prelim-
inary plat was approved on July 25, 1977. As a, part of - the preliminary
plat approval, the City staff was directed to prepare <a resolution
acknowledging that the property remains as a single parcel under
common ownership even though two separate buildings are developed
on the site. A draft resolution for that purpose is contained under
item 6d of this agenda.

Item 6a Authorizing Issuance of Temporary Improvement Notes
The attached resolution is recommended for the purpose of authorizing
the issuance of temporary improvement notes as interim financing for
public improvement projects which will subsequently be financed
through long `term bonding.

Item 6b Authorizing Purchase of Four Mobile Radio Units
The attached resolution is recommended for the purpose of authorizing
the purchase of four mobile radio units . Two of 'the units are for the
Street Department as comprehended in the 1977 budget and two of •the
units are for the Public Utilities Division:

Item 6c Authorizing Purchase of Shades & Slat Blinds for 7100 Brooklyn Blvd.
The attached resolution is recommended for the purpose of authorizing
the purchase of shades and slat blinds for 7100 Brooklyn Boulevard
pursuant to the provisions of the joint powers agreement between
Brooklyn Center and Brooklyn Park relating to the LEAP headquarters

The attached draft resolution is in response to Council request
relative to the platting of the property at 6810 Brooklyn Boulevard
The resolution acknowledges that the property will remain a single
parcel under common ownership even though `two different developments
are proposed for the same site.

Item 6e Accepting Work
The attached resolution is recommended for the purpose of formally
accepting work associated with Tennis Court Improvement Project
No. 1977 -9 which consisted of constructing a tennis court at
Evergreen Park.

The attached resolution is recommended for -the purpose of establishing
and providing for a public hearing for Alley Paving Improvement Project
No. 1977 -13 located between James and Knox Avenues North from 53rd
Avenue to 54th Avenue.

The attached resolution is recommended for the purpose of accepting the
Metropolitan System Statement dated June 23 relative to - the 1976 Metro-
r politan Land Planning Act. The Director of Planning and Inspection is
prepared to review the System Statement with you on Monday evening.

Application No. 77028 comprehends a preliminary plat for replatting
of the'Riverbrooke Townhouse Addition at 66th Avenue and 'Camden
Drive The application was reviewed by the Planning Commission
on July 20, 1977.

Item 8a Amending Chapter 19 Regarding Noisy Parties
The attached ordinance was first read on June 6, 1977, published on
June 16, 1977, first reading amended by the City Council on July 11, 1977
and republished on July 21, 1977. The ordinance is offered this evening
for second reading and adoption.

Item 8b Amending Chapter 3 Regarding Building Permit Fees
• The attached ordinance amending Chapter 3 of the City Ordinances is
recommended for the purpose of updating code references and increasing
' permit fees to be more in line with other communities and recommended
rates by the Uniform Building Code.

Item 9a Annual Financial Report
When the Annual Financial Report was distributed to the City Council,
the Council expressed an interest in receiving an overview of the report.
The Director of Finance will be prepared to give a summary of the report
' to the Council on Monday evening.

Item 9b Remodeling Entry to Police Department
Councilman Fignar has requested that the subject of remodeling the entry
• to the Police Department be discussed by the Council. The remodeling
would consist of providing an entrance to -the Police Department from the
outside lower level to provide a more convenient entrance from the City
Hall parking lot.

RESOLUTION AUTHORIZING THE ISSUANCE OF TEMPORARY
IMPROVEMENT NOTES
WHEREAS, there is a need for interim financing prior to'•the selling of
bonds to finance certain improvement project costs which are - to be assessed
against benefited properties;
NOW, THEREFORE, BE IT RESOLVED by the City Council of - the City of
Brooklyn Center, Minnesota, 'to authorize the issuance and 'sale of Special
Assessment Construction Fund No. 58, Temporary Improvement Notes in the
amount of $35,000. These notes shall be dated July 25, 1977, and shall be
payable out of proceeds of the final bond. issue for - the projects. These notes
shall bear an interest rate of 6% per annum in accordance with Resolution
No. 74 -32, dated February 25, 1974, which established an interest rate on
loans from the Investment Trust Fund to other City Funds.
• BE IT FURTHER RESOLVED that the City of Brooklyn Center Investment
Trust Fund be authorized to purchase these notes.
BE IT FURTHER RESOLVED that the Mayor and City Manager be authorized
to execute - the aforementioned notes.

RESOLUTION AUTHORIZING THE PURCHASE OF FOUR (4)
MOBILE RADIO TRANSMITTER RECEIVERS
WHEREAS, Chapter 471.345 of the Minnesota Statutes provides for the
purchase of merchandise, materials or equipment, or any kind of construction
work by informal quotations when the amount of such contract is less than ten
thousand dollars ($10,000); and
WHEREAS, the City Manager has obtained quotations on the purchase
of 'four 'mobile radio transmitter receivers and has determined that the quotation
of Air Comm, 76 Moreland Avenue East, West St. Paul, in the amount of $2,476
is the best quotation submitted.
NOW', THEREFORE, BE IT RESOLVED by the City Council of 'the City of
Brooklyn Center - that the City Manager be authorized to contract for :the purchase
of four mobile radio `transmitter receivers in the amount of $2,476 from Air Comm.

RESOLUTION AUTHORIZING THE PURCHASE OF SLAT BLINDS
AND SHADES
WHEREAS, Chapter 471.345 of the Minnesota Statutes provides for the
purchase of merchandise, materials or equipment, or any kind of construction
work by informal quotations when the amount of such contract is less than -ten
thousand dollars ($10,000); and
WHEREAS, the City Manager has obtained quotations on the purchase
of slat blinds and shades and has determined that the quotation of Metropolitan
Office 'Equipment Company, St. Paul, Minnesota in - the amount of $1,876 for
slat blinds and shades is the best quotation submitted
NOW, THEREFORE, BE IT RESOLVED by the City Council of 'the City of
Brooklyn Center that 'the City Manager be authorized -to contract for - the purchase
of slat blinds and shades in the amount of $1,876 from Metropolitan Office
Equipment Company.

RESOLUTION REGARDING DEVELOPMENT AND PLATTING OF PROPERTY
AT 6810 BROOKLYN BOULEVARD
WHEREAS, Planning Commission Application No. 76067 submitted on behalf of
Car -X Service Systems, Inc. was approved by - the City Council on December 20, 1976,
comprehending a commercial development on property described as Tract A, Registered
Land Survey No. 456 and Tract A, Registered Land Survey- No. 457, also known as 6810
Brooklyn Boulevard; and
WHEREAS, Planning Commission Application No. 77020 submitted on behalf of
Car -X Service Systems, Inc. (owner) and of Winchell's Donut House (tenant) was
approved by the City Council on J une 6, 1977, comprehending a second commercial
development on the above property; and
WHEREAS, consistent with Section 35 -540 of - the City Ordinances and conditions
of each of the above approvals, Planning Commission Application No. 77025 submitted
on behalf of Car -X Service Systems Inc. was approved by the City Council on July 25,
1977 comprehending the `combination of -the above Tracts into a single Tract by means
of a new Registered Land Survey; and
• WHEREAS, Car -X Service Systems, Inc. submitted a letter dated July 1, 1977
to the City as follows:
Pursuant 'to previous discussion on the subject property, this letter
is to confirm - that Car -X Service Systems, Inc. , owner of the property
known as 6810 Brooklyn Boulevard hereby acknowledges - the City Zoning
Ordinance requirement that the property be combined through platting
or registered land survey into a single parcel under common ownership
for purposes of serving - the commercial development approved by - the
City Council under -the Planning Commission Application No. 76067 and
No. 77020. This is to further acknowledge that Car -X Service Systems,
Inc., its heirs, successors, and assigns does covenant and agree 'that
the property is to remain a single parcel under a common ownership
as long as the property serves the commercial development approved
and constructed under the above applications
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brooklyn
Center that the subject property known as 6810 Brooklyn Boulevard is to remain a single
parcel as approved under Application No. 77025, under a common ownership as long as
the property serves a commercial development such as that approved under Applications
No. 76067 and No 77020; and
RESOLUTION NO.
BE IT FURTHER RESOLVED, that a certified copy of this resolution shall be
filed with the •title to - the subject property.

RESOLUTION ACCEPTING WORK
(CONTRACTED BY CITY)
WHEREAS, pursuant to a written contract signed with the City
of Brooklyn Center, Minnesota, Bituminous Roadways, Inc., has sat -
isfactorily completed the following improvement in accordance with
said contract:
Tennis Court Improvement Project No. 1977 -9
Evergreen Park, south of 72nd Avenue North at Aldrich Court.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center:
1. The work completed under said contract is hereby accepted
and approved.
2. The value of work performed is less than the original
contract_ amount by $54.87 because of a general overestimation of plan
• quantities.
- 3. It is hereby directed that final payment be made on said
contract, taking the Contractor's receipt in full. ' The total amount
to be paid for said contract for said improvement project shall be
$10,771.59.

• RESOLUTION ESTABLISHING AND PROVIDING FOR A PUBLIC HEARING
FOR ALLEY PAVING IMPROVEMENT PROJECT NO. 1977 -13 AND ORDERING
PREPARATION OF PT.,ANS AND SPECIFICATIONS'
WHEREAS, a petition has been presented to the City Council
requesting Alley Paving Improvement Project No. 1977 -13; and
WHEREAS, the City Council deems it necessary to initiate the
above mentioned improvement project; and
WHEREAS, it is proposed that there be constructed an improvement
consisting of the following:

North from 53rd Avenue to 54th Avenue North.
WHEREAS, the City Engineer has made a preliminary report'
advising that said proposed improvement is feasible and that it can
be constructed at the estimated cost indicated above;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center, Minnesota,as follows:
1. The Council directs the City Engineer to prepare plans and
specifications for said improvement project, described as follows:
1977 -13 Alley Paving
Between James and Knox Avenues North from 53rd Avenue
to 54th Avenue
2. The Council proposes to proceed under authority granted
by Chapter 429, Minnesota Statutes.
3 A public hearing on the proposed improvement shall be held
at the City Hall in the City of Brooklyn Center on Monday, the 12th day
of September, 1977, at 8:00 o'clock P.M., central daylight time, and
the Clerk shall publish notice of the time and place of hearing by two
weeks publication in the official newspaper of the City.
4. The area proposed to be assessed for said improvement,
according to Council policy established in Resolution No. 75 -89 'adopted
• May 5, 1975, is as follows:

DATED JUNE 23, 1977, RELATIVE TO THE 1976 METROPOLITAN
LAND PLANNING ACT
WHEREAS, on June 29, 1977 the Chairman of the Metropolitan
Council submitted to the City the official System Statement for Brooklyn
Center as required by the 1976 Metropolitan Land Planning Act (M. S. A.
473.175) and
WHEREAS, the City has reviewed the System Statement dated
June 23, 1977 as the initial phase of the Comprehensive Planning process
specified by the Act;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Brooklyn Center to accept the June 23 1977 Metropolitan System
Statement for Brooklyn Center as submitted on June 29, 1977.

ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 19 OF THE CITY ORDINANCES
PROVIDING FOR THE ABATEMENT OF NOISY

THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS:
Section 1. Chapter 19 of the City Ordinances is hereby amended by the
addition of the following;
Section 19 -1201 PURPOSE. It is recognized that loud, unpleasant, raucous
or prolonged noise can and does have a harmful, debilitating and detri effect
upon human beings, adversely affecting their mental and physical health, safety
and well being. Such loud, unpleasant, raucous or prol noise and 'the resulting
detrimental debilitating and harmful effects upon human beings has become a majo
contemporary urban concern and is now considered to be a pollutant, not dissimilar
to the pol of the air and water by toxins or- particulates . In a e ndeavor to
provide for the mental and physical hea safety, well -being and peaceful repos
of its citizens and their neighborhoods, it is hereby declared to be in the public
interest that loud, unpleasant, raucous, unnecessary or prolonged noise be abated.

Section 19 -1202. No person shall congregate bec of,
participate in, or be in any party or gathering of people from which noise emanates
of a sufficient volume so as to disturb the peace, quiet or repose of toersons residing
• in any residential area No person shall visit or remain within any residential
dwelling unit wherein such party or gathering is taking place except persons who have
gone there for the sole purpose of abating said disturbance. A police officer may
order all persons present in any group or gathering from which such n oise emanates j
other than the owners or tenants of the dwelling unit, to immediately disperse in lieu
of being charged under this ordinance. Owners or tenants of the dwelli —uni sha
immediately abate the disturbance and, failing to do so, shall be in violating of this
ordinance.
Section 19 -1203. PENALTY. Any person violating the provisions of this
ordinance, shall upon conviction be punished by a fine of not more than three hundred
$300 dollar and by imprisonment not to exceed n inety (90) days, or both
Section 2. This ordinance shall become effective after adoption and.upon
thirty (30) days following its legal publication.
