Item 5a Commending Petition Carriers In response to the City Council's direction, the attached resolution is recommended for the purpose of commending the people for their efforts in carrying a petition requesting the City of Brooklyn Center and any other governmental agencies such as the Minnesota Department of Transportation to install traffic signals with pedestrian crossing signals on T.H. 169 at 66th Avenue North, 69th Avenue North, and 73rd Avenue North. Disposition Item 5b Authorizing Issuance of Temporary Improvement Notes The attached resolution is recommended for the purpose of authorizing the issuance of temporary improvement notes as interim financing for public improvement projects which will subsequently be financed through long term bonding. Disposition • Item 5c Establishing Improvement Project Nos. 1977 -15, 16, 17, & 18 The attached resolution is recommended for the purpose of establishing Trunk Water Main Improvement Project No. 1977 -15, Sanitary Sewer Improvement Project No. 1977 -16, Street Surfacing Improvement Project No. 1977 -17, and Curb and Gutter Improvement Project No. 1977 -18. The above projects provide the necessary utility and street improvements for Phase II of The Ponds subdivision along Unity Avenue North, north of 69th Avenue North. Disposition Item 5d Establishing Improvement Project Nos. 1977 -19 & 20 The attached resolution is recommended for the purpose of establishing Street Surfacing Improvement Project No. 1977 -19 and Curb and Gutter Improvement Project No. 1977 -19 located along Lyndale Avenue North from 59th Avenue to 62nd Avenue North. Disposition r r CITY MANAGER'S COMMENTS Page 2 Item 5e Establishing Improvement Project No. 1977 -21 The attached resolution is recommended for the purpose of establishing Sanitary Sewer Improvement Project No. 1977 -21- located along Lake- side Avenue North from Twin Lake Avenue easterly approximately 170 feet. Disposition Item 5f Authorizing Bids for Sidewalk Improvement Project No 1977 -12 The attached resolution is recommended for - the purpose of approving Sidewalk Improvement Project No. 1977 -12 plans and specifications an authorizing bids to be taken Disposition Item 5g Requesting Hennepin County Participation in Sidewalk Improvement • Project No. 1977 -12 for Pedestrian Ramps Recently Hennepin County has established a policy whereby they participate in 25% of the cost of sidewalks along County roads if funds are available. It is recommended that the City request participation from Hennepin County for the installation of pedestrian sidewalk ramps along County Road 10 as part of Sidewalk Improvement Project No. 1977 -12. Disposition Item 5h Supporting Hennepin LAWCON Grant Application Representatives of the Hennepin County Park Board Reserve have requested support from Brooklyn Center and other north suburban communities in their efforts in procuring a LAWCON grant application for acquisition of property for the implementation of a Hennepin County trailway system through the north suburban area We will be prepared to make further comments on the application at Monday night's Council meeting • Disposition CITY MANAGER'S COMMENTS Page 3 Item 51 Confirming Special Assessments To the extent - that special assessment. hearings are successful the attached resolution is recommended for the purpose of confirming the proposed assessments. 6 Disposition 1 Item 6 Revenue Sharing Hearing (8:00 p.m.) The 1976 amendments to the Federal Revenue Sharing Act requires . local municipality to hold a public hearing on - the proposed use of Revenue Sharing Funds. It is recommended that the City Council convene the proposed use public hearing and then table - the matter until after Item 8 on the agenda so that it can be considered concurrently with •the 1978 budget hearing deliberation. Disposition • Item 7 Special Assessment Hearings The City Council has scheduled hearings on ,proposed special assess- ments for 8 :00 p.m. this evening. The Director of Public Works will be prepared to proceed through each improvement project. Disposition Item 8a Application No. 77047 submitted by Mark Laberda The above application was considered by the Planning Commission on September 14, 1977. The application is a variance request for expand- ing a house with noncomplying setbacks at 5446 Humboldt Avenue North. Disposition • CITY MANAGER'S COMMENTS Pa ge 4 Item 8b Application No. 77026 submitted by Real Estate 10 The above application was considered by the Planning Commission on September 14, 1977. The application is for rezoning from R -1 to C -1 the property at 7240 Brooklyn Boulevard. i Disposition Item 8c Application No. 77022 submitted by L. W. Joel Company This application was discussed at the August 22 City Council meeting and tabled until September 12, 1977 for further review by the staff. On September 12, 1977 the applicant requested 'that the application be tabled until September 19, 1977. The application consists of an appeal per Section 35 -251 from administrative denial of a building permit for construction on a substandard outlot at 5325 - 63rd Avenue North. Disposition • Item 9 1978 Budget Deliberation (9:15 p.m.) It is recommended that the City Council reconvene the 1978 budget deliberations and continue the review of the operating accounts. Disposition Item 1 l Liquor License Fees At the November 22, 1976 City Council meeting a proposal - to reduce the liquor license fee was submitted by three current liquor license holders, namely Holiday Inn, Nino's and Jimmy's Lemon Tree. The item was discussed by the Council and deferred to a later date. I have received letters from Nino's and Holiday Inn again requesting consideration for lowering the liquor license fees prior to adoption of the J.978 budget. We will be prepared to discuss this item with you on Monday evening. Disposition Member introduced the following resolution and moved its adoption: RESOLUTION NO. RESOLUTION EXPRESSING RECOGNITION OF AND APPRECIATION FOR THE DEDICATED PUBLIC EFFORTS OF THE T.H. 169 PETITIONERS WHEREAS, the City Council on September 12, 1977 received a petition signed by approximately 1 ,190 persons regarding the need for various traffic_ semaphores along T.H. 169; and WHEREAS, the petition specifically requests the City Council of the City of Brooklyn Center to act on behalf of the petitioners and to cooperate with any other governmental body to bring about the installation of three traffic semaphores at pedestrian crossings on T.H. 169 at 66th, 69th, and 73rd Avenues North; and WHEREAS, the petition carriers and petition signers have, by ,their actions, demonstrated their support and concern for the resolution of a long- standing and disturbing traffic problem; and WHEREAS, this civic effort for the betterment of the community merits the gratitude of the citizens of Brooklyn Center. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that the efforts and expressions of the T.H. 169 petition carriers and petition signers are recognized and appreciated by the City of Brooklyn Center. RESOLUTION AUTHORIZING THE ISSUANCE OF 'TEMPORARY IMPROVEMENT NOTES WHEREAS, there is a need for interim financing prior to the selling of bonds to finance certain improvement project costs which are - to be assessed against benefited properties; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, to authorize the issuance and sale by Special Assessment Construction Fund No. 58, Temporary Improvement Notes in 'the amount of $30,000. These notes shall be dated September 12, 1977, and shall be payable out of proceeds of the final bond issue for - the projects These notes shall bear an interest rate of 6% per annum in accordance with Resolution No. 74 -32, dated February 25, 1974 which established an interest rate on loans from the Investment Trust Fund to other City funds. BE IT FURTHER RESOLVED that the City of Brooklyn Center Investment Trust Fund be authorized to purchase these notes. • BE IT FURTHER RESOLVED that the Mayor and City Manager be authorized to execute the aforementioned notes. WHEREAS, a petition, has been presented to the City Council requesting Trunk Water Main Improvement Project No 1977 -15, Sanitary Sewer Improvement Project No. 1977 -16, Street Surfacing Improvement Project No. 1977 -17, and Curb and Gutter Improvement Project No. 1977 -18; and WHEREAS, the City Council deems it necessary to initiate the above mentioned improvement projects: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn' Center to direct the City Engineer to prepare plans and specifications for said improvement projects described as follows: 1977 -15 Trunk Water Main • In proposed Unity Avenue North from 460 feet north of the centerline of 69th Avenue North northerly approximately 480 feet 1977 -16 - Sanitary Sewer In proposed Unity Avenue North from 420 feet north of the centerline of 69th Avenue North to 73rd Avenue North. 1977 -17' - Street Surfacing On proposed Unity Avenue North from 443 feet north of the centerline of 69th Avenue North northerly approximately 460 feet -. 1977 -18 Curb and Gutter On proposed Unity Avenue North from 443 feet north of the centerline of 69th Avenue North northerly approximately 460 feet. WHEREAS, a petition has been presented to the City Council requesting Sanitary Sewer Improvement Project No. 1977 -21 ;and WHEREAS, the City Council deems it necessary to initiate the above mentioned improvement project: NOW, 'THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center to direct the City Engineer to prepare plans and specifications for said improvement project described as follows: 1977 -21 Sanitary Sewer In Lakeside Avenue North from the centerline of Twin Lake Avenue easterly approximately 170 feet. RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR SIDEWALK IMPROVEMENT PROJECT NO. 1977 -12 AND DIRECTING ADVERTISEMENT FOR BIDS (CONTRACT 1977 -G) BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, as follows; 1. The plans and specifications for Sidewalk Improvement Project No. 1977 -12 prepared by the City Engineer, are hereby approved and ordered filed with the Clerk. 2. The Clerk shall advertise for bids for such improvements by publication at least once in the official newspaper and in the Construction Bulletin, the date of first publication not less than ten (10) days prior to the date for receipt of bids. Said notice shall state that no bids will be considered unless sealed and filed and accompanied by a cash deposit, bid bond, cashier's check or certified check payable to the City Clerk in the amount of not less than five per cent (5/) of the bids. 3. Bid date is set for Monday, October 3, 1977, at 11:00 a.m., • central daylight time. 4. Member introduced the following resolution and moved its adoption: • RESOLUTION NO RESOLUTION REQUESTING HENNEPIN COUNTY PARTICIPATION IN SIDEWALK IMPROVEMENT PROJECT NO. 1977 -12 WHEREAS, the City Council of the City of Brooklyn Center deemed it necessary to construct Sidewalk Pedestrian - Bicycle Ramps and established Sidewalk Improvement Project No. 1977 -12; and WHEREAS, Hennepin County has adopted a policy of participating in the cost of sidewalk improvements along county roads; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center to request Hennepin County participation in the cost of the proposed improvement, adjacent to county roads, hereinafter described. Sidewalk Improvement Project No. 1977-12 (Pedestrian - Bicycle Ramps) At street intersections along County Road 10 from T. H. 152 to T.H. 100; County Road 57 from T.H. 100 to Logan Avenue • North; Shingle Creek Parkway from County Road 10 to Summit Drive North; and Freeway Boulevard from James Avenue to Shingle Creek Parkway. RESOLUTION SUPPORTING THE HENNEPIN COUNTY PARK RESERVE DISTRICT'S EFFORT -TO SECURE LAND AND WATER CONSERVATION FUND CONTINGENCY RESERVES FOR THE NORTH HENNEPIN TRAIL CORRIDOR WHEREAS, the Hennepin County Park Reserve District has proposed the establishment of a 40 -mile multi -use North Hennepin Trail Corridor; and WHEREAS, the Metropolitan Council in 1974 included the North Hennepin Trail Corridor in its Regional Recreation Open Space Plan; and WHEREAS, the City Council has reviewed the concept plan for the proposed North Hennepin Trail Corridor; and WHEREAS, the proposed trail corridor incorporates existing and /or proposed parkland owned and operated by the City of Brooklyn Center; specifically, Palmer Lake Park, Central Park and the Shingle Creek Trail- way; and • WHEREAS, the proposed trail corridor will be readily accessible to the residents of Brooklyn Center, providing outstanding opportunities for such activities as hiking, bicycling, cross- country skiing, he� and WHEREAS, the Hennepin County Park Reserve District intends to submit application for Land and Water Conservation Fund Contingency Reserves for the acquisition and development of the North Hennepin Trail Corridor. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that it supports the proposed North Hennepin Trail Corridor; BE IT FURTHER RESOLVED that the Brooklyn Center City Council supports the efforts of the Hennepin County Park Reserve District to secure Land and W ater Conservation Fund Contingency Reserves for the acquisition and development of the North Hennepin Trail Corridor. -Date Mayor ATTEST: Clerk RESOLUTION NO The motion for the adoption of the foregoing resolution was duly seconded by member and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: whereupon said resolution was declared duly passed and adopted. RESOLUTION CONFIRMING ASSESSMENTS FOR WATER MAIN IMPROVEMENT 1977 -1 AND 1977 -7; AND SANITARY SEWER IMPROVEMENT 1977 -2, 1977 -5 AND 1977-8; AND STREET SURFACING IMPROVEMENT 1977 -6; AND GRADING, BASE AND SURFACING IMPROVEMENT 1974 -32; AND CURB AND GUTTER IMPROVEMENT 1974 -33; AND PUBLIC UTILITIES WATER HOOKUPS AND SANITARY SEWER HOOKUPS BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, as follows: 1. The City Clerk has, with the assistance of the Engineer heretofore selected by this Council for such purpose, calculated the proper amounts to be specially assessed for the improvements known as the improvements listed above of said City against every assessable lot, piece or parcel of land in accordance with the provisions of law, and has prepared and filed with the City Clerk tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed and the amount calculated against the same. .2. Notice has been duly published as required by law that this Council would meet in regular session on Monday, September 19, 1977, to pass on the proposed assessments. 3. Said proposed assessments have at all times been open to inspection and copying by all persons interested, and opportunity has been given to all interested persons to present their objections, if any, to such proposed assessments, or to any item thereof. 4. This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessments was and is specially benefit by said improvement in the amount of said proposed assessment set opposite the description of each lot, piece or parcel of land, and that amount so set out is hereby levied against each of the respective lots, pieces or parcels of land therein described. 5. Such proposed assessments are adopted and confirmed, and the sums fixed and named in said proposed assessments are affirmed, adopted and confirmed as the proper special assessments for each of said lots, pieces or parcels of land respectively. RESOLUTION NO. 6. Said assessments as adopted and confirmed shall be certified to by the City Clerk and filed in his office, and shall thereon be and constitute the special assessments for the payment of the above listed improvements. 7.. The amounts assessed against each lot, piece or ;parcel of land - hall bear interest from the date hereof until the amounts have been paid at the rate of eight (8.0 %) per annum. 8. Such assessments shall be payable in equal installments beginning in the year 1977 payable on the 16th day of November in each succeeding year and and continuing until all of said installments shall have been paid, each installment to be collected with the taxes collectible during said year by the Director of Finance of Hennepin County. A. Water Main Improvement No. 1977 -1 and 1977 -7 in twenty (20) equal installments. B. Sanitary Sewer Improvement No. 1977 - 2,;_1977 --5 and 1977 -8 in twenty (20) equal installments C. Street Surfacing Improvement No. 1977 -6 in seven (7) equal • installments. D. Grading, Base and Surfacing Improvement No. 1974 -32 in fifteen (15) equal installments. E. Curb and Gutter Improvement No. 1974 -33 in fifteen (15) equal installments. F. Public Utilities Water Hookups in twenty (20) equal installments. G.
