Adjournment CITY MANAGER' S ' COMMENTS Item 5 Approve Animal Control Agreement It is recommended that the City Council approve the renewal of a contract for calendar year 1978 with Metropolitan Animal Control Services, Inc. Disposition Item 6 Authorize Execution of an Encroachment Agreement Action is requested to authorize the Mayor and the City Manager to enter into an encroachment agreement with Robert G. Wilbur, 6857 Dallas Road. This agreement acknowledges the encroachment of a garage by two feet onto a utility easement on the south side of the owner's property and holds the City harmless from any damage that might occur in the future because of the encroachment.. Disposition Item 7a Expressing Appreciation for Services The attached resolution is recommended for the purpose of expressing _appreciation for services rendered by Housing Commission Chairman Lou Howard. This resolution was requested by the City Council at the November 2.8, 1977 meeting. Disposition Item 7b Denying Planning, Commission Application Nos. ' 77037 and 77038 The attached resolution is recommended for the purpose of denying Planning Commission Application Nos. 77037 and 77038 submitted by Howe, Inc. as directed by the City Council at the November 28, 1977 meeting. Disposition CITY MANAGER'S COMMENTS Page 2 Item 7c Reducing Assessment for Diseased Shade Tree Removal The attached resolution is recommended for the purpose of reducing diseased shade tree removal assessments for property owners participating in the shade tree removal program. The City has recently been reimbursed by the State of Minnesota for 37 % of the cost of diseased shade tree removal and this resolution would pass on the reimbursement to affected property owners. Disposition - Item 7d Directing Disbursement of Cash Escrow The attached resolution is recommended for the purpose of directing disbursement of a $13,500 cash escrow for certain subdivision improvements in "The Ponds" Phase I. On June 9, 1977 the Meadow Corporation entered into a financial performance guarantee agreement with the City to guarantee the installation of survey monuments and the payment of street surfacing and curb and gutter in the Ponds sub- division, Phase I. The street improvement and curb and gutter improve - • ment projects have been completed and this resolution authorizes the City Treasurer to negotiate the existing cash escrow, amounting to $13,500, and to credit the construction accounts in the amount of $9,411.90. It is estimated that the remaining subdivision obligations amount to approximately $1,000, and it is recommended that the 'balance of $3,088.10 be released to the Meadow Corporation as cash escrow excess, Disposition I I Item 7e Requesting 'MN /DOT Commissioner to Expedite Project Development Report for T. H. 169 The attached resolution is a joint resolution by the Cities of Brooklyn Center and Brooklyn Park recommended for the purpose of requesting the Minnesota Department of Transportation to start taking the necessary steps towards the total upgrading of T.H. 169 from F.I. 94 northerly to the future North Crosstown Highway corridor. A total upgrading of T.H. 169 is necessary to improve vehicular and pedestrian traffic safety along T.H. 169 in both communities. Disposition CITY MANAGER'S COMMENTS Page 3 Item 7f Amending 1978 General Fund Budget The attached resolution is recommended for the purpose of amending the 1978 budget to provide $3,516 in Revenue Sharing Funds for the ` - Fire Department appropriation to provide uniforms in the upcoming year for firefighters. This resolution was requested by the City Council at the November 28, 1977 meeting Disposition Item 7g Authorizing Participation in Suburban Health Nursing Service The attached resolution is recommended for the purpose of authorizing participation in the Suburban Health Nursing Service. The Council at the November 28, 1977 meeting adopted a similar resolution which was contingent upon a modification to article VII of the joint powers agreement to provide voting on the Board of Directors based on a community's population. This contingency was not acceptable for participation in the joint powers arrangement and the resolution is offered should the Council wish to become involved without such a stipulation. • Disposition Item 7h Increasing City Participation in Employee Group Health Plan The attached resolution is recommended for the purpose of increasing the employer's contribution towards the cost of coverage under the City's` Group Health Plans for 1978. Disposition Item 71 Setting 1978 Compensation A proposed resolution is enclosed designed to set 1978 compensation for City employees. Also in your agenda materials is the -copy of the Loren L. Law and Associates Compensation Study for City Department Heads Disposition .,4 CITY MANAGER'S COMMENTS Page 4 Item 8a Amending City Ordinances Regarding Various License Fees It is recommended that this ordinance, which had a first reading on November 14, 1977 and was published on November 23, 1977, be given an amended first reading to clarify that the ordinance pertains to licenses -and fees that expire after December 31, 1977. This ordinance does not provide for licensing mechanical amusements and pinball machines, theaters, circuses, on -sale wine, carnivals, juke boxes and kiddie rides which were included in the license fee survey previously provided. Disposition ; Item 9a Open Forum On November 28, 1977 the Council adopted the recommendation contained in the Subcommittee minutes of August 17, 1977 relating to establishing, an open forum at Council meetings . The Council has not yet decided on a time to hold the open forum and has extended an opportunity to Mayor -elect Nyquist and Councilmember -elect Scott to provide further input on this subject. Disposition Item 9b Airport Zoning We will be prepared Monday evening to discuss the Airport Chapter of the Metropolitan. Development 'Guide and its effects on Brooklyn Center. Disposition Member introduced the following resolution and moved its adoption: RESOLUTION NO. RESOLUTION EXPRESSING RECOGNITION OF AND APPRECIATION FOR THE DEDICATED PUBLIC SERVICE OF MR. LOU HOWARD WHEREAS, Mr. Lou Howard served as a Charter member of the Housing Commission and as that body's Chairman from October, 1973 through',: November, 1977; and WHEREAS, his devotion, to the tasks and responsibilities of this Commission, and the leadership he provided, contributed substantially to the sound progress and development of the City; and WHEREAS, his public service and civic effort for the betterment of the community merit the gratitude of the citizens of Brooklyn Center: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that: The dedicated public service of Mr. Lou Howard as a member of the Housing Commission and citizen, is • recognized and appreciated by the City of Brooklyn Center. RESOLUTION REGARDING DISPOSITION OF PLANNING COMMISSION APPLICATION NO. 77037 AND APPLICATION NO. 77038 SUBMITTED BY HOWE INC WHEREAS, Planning Commission Application No. 77037 was submitted by Howe, Inc. on August 4, 1977 requesting rezoning from R -1 (Single Family Resi- dential) to I -2 (General Industry) of two parcels commonly described as 3129 and 3135 - 49th Avenue North; and WHEREAS, the Planning Advisory Commission considered the request at a duly called public hearing `onAugust 25, 1977 at which time testimony both for and against the petition was taken and WHEREAS, the item was tabled to permit the development of additional information and was referred to the Southwest Neighborhood Advisory Group for review and comment; and WHEREAS, the Neighborhood Advisory Group` considered the matter at a duly called public meeting on October 4, 1.977 and on October 11, 1977 following a `tour of the premises on October 1, 1977; and d WHEREAS, the Neighborhood Advisory Group submitted a report dated ... October 11, 1977 recommending that the rezoning request not be approved and that the Comprehensive Plan not be amended at this. time; and WHEREAS, the Comprehensive Plan at page 67 states that, while the existing fertilizer plan should be recognized, further expansion of the operation should be prohibited and if at all feasible the eventual relocation of the use to a more compatible site should be undertaken; and WHEREAS, the Planning Advisory Commission continued its consideration at a duly callers public meeting on November 10,E 1977 and recommended denial of the request on the grounds that the proposal is not consistent and compatible with the surrounding use classifications; that the zoning proposal is not consistent with the Comprehensive Plan; and that the expansion of the zoning district is not warranted by the Comprehensive Plan or by the best interests of the community; and WHEREAS, the item was considered by the Council at a duly called public hearing on November 14, 1977 when testimony both for and against the petition was taken, and when the item was tabled to permit development of additional information and to permit the opportunity for the applicant to review the matter with the neigh- boring property owners; and WHEREAS, the City Council continued its consideration at its November 28, 1977 meeting, when testimony both for and against the petition was received; when Information regarding pollution control was presented by representatives of the Minnesota Pollution Control Agency; and when analysis of the land usg issues were presented by the City Administration and the City Attorney, RESOLUTION NO. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that Application No. 77037 submitted by Howe, Inc. is hereby • denied in consideration of the following: 1. The Planning Advisory Commission recommended denial of the re -. quest, following public hearings, review by the Southwest Neigh - borhood Advisory Group, and discussion of the Comprehensive Plan. 2. The proposed zoning classification is not consistent with the Com- prehensive Plan guidelines for the area 3. The rezoning request represents an expansion of the fertilizer plant operation which the Comprehensive Plan recommends should be prohibited 4. The applicant's use constitutes a non- conforming use in the I -2 district, and as such, is prohibited from expansion and enlargement by the Zoning Ordinance Non - Conforming Use provisions 5. The use is found to remain incompatible with the surrounding resi- dential land uses, and amendment of the Comprehensive Plan and Zoning Ordinance is thus deemed unwarranted at this time. RESOLUTION REDUCING ASSESSMENTS FOR DISEASED SHADE TREE REMOVAL (LEVIES #6801 AND 6802) WHEREAS, the City of Brooklyn Center has caused the removal of diseased shade trees from certain properties under Section 19 -1504 of the City Ordinances; and WHEREAS, the property owners of these certain parcels of land have ,chosen to have the removal cost of said trees plus administrative fee and interest certified to Hennepin County for payment with their real estate, taxes; and WHEREAS, said costs were certified to Hennepin County for collection on October 3, 1977; and WHEREAS, the State of Minnesota has reimbursed the City of Brooklyn Center 37% of the removal costs and the City in turn agrees to reimburse the property owners 37% of the said property owner's share of said removal costs, excluding administrative fee and interest; i • NOW, THEREFORE, BE 'IT RESOLVED by the City Council of the City of Brooklyn Center to reduce the assessments for the following parcels. The motion for the adoption of the foregoing resolution was duly seconded by member , and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same; whereupon said resolution was declared duly passed and adopted. i 0 f s Member introduced the following resolution and moved its 'adoption: RESIOLUTION NO. • RESOLUTION DIRECTING DISBURSEMENT OF $13,500 CASH ESCROW FOR CERTAIN SUBDIVISION IMPROVEMENTS IN "THE PONDS" (PHASE I) WHEREAS, on June 9, the Meadow Corporation entered into a Financial Performance Guarantee Agreement with the City of Brooklyn Center to guarantee the installation of survey monuments and the payment of Street Surfacing Improvement Project No. 1977 -3 and Curb & Gutter Improvement Project No. 1977 -4 in The Ponds subdivision, Phase I, and; WHEREAS, the Meadow Corporation deposited checks in the amount of $7,500.00 and $6,000.00 with the City of Brooklyn Center to guarantee the above improvements; and WHEREAS, the said street surfacing and curb and gutter improve - ments have been completed and all costs have been tabulated; and WHEREAS, the amount of improvements remaining to be completed under said cash escrow is estimated to cost $1,000.00, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City • of Brooklyn Center to direct the City Treasurer to negotiate the existing cash escrow and credit the proper construction account as follows: Street Surfacing Improvement Project No. 1977 -3 = $5,266.63 Curb and Gutter Improvement Project No 1977 -4 = 4,145.27 -z— Total 9,411.90 BE IT FURTHER RESOLVED that the City Treasurer retain the balance of $1;000:00 until': completion of the remaining improvements' covered by the Financial Performance Guarantee Agreement and issue a check in the amount of $3,088.10 to the Meadow Corporation, which amount represents the difference to be returned to them as cash Escrow excess. JOINT RESOLUTION BY THE CITIES OF BROOKLYN CENTER AND BROOKLYN PARK REQUESTING THE COMMISSIONER OF THE MINNESOTA DEPARTMENT OF TRANSPORTATION TO EXPEDITE THE PREPARATION OF A PROJECT DEVELOPMENT REPORT FOR T.H. 169 WHEREAS, the City Councils of the Cities of Brooklyn Center and Brooklyn Park have a common interest in the desire to improve the vehicular and pedestrian traffic along T.H. 169 in said Cities; and WHEREAS, the current and projected traffic demands greatly exceed the capacity of said roadway, causing vehicular and pedestrian traffic delays and safety problems; and WHEREAS, planning studies indicate a need for the realignment of, portions of said roadway as part of the future upgrading; and WHEREAS, the continued development along said roadway will make future realignment and upgrading more difficult and expensive; and WHEREAS, the State Legislature has passed statutes requiring that all cities undertake planning programs under the Metropolitan Land - Planning Act and that these planning programs consider, among other' elements, transportation planning for current and future development; and WHEREAS, said Cities are in the process of implementing such planning programming and the future right -of -way location and improvement schedule-of T.H. 169 are an integral segment of a number of said Cities planning programs to be addressed under said Land Planning Act and WHEREAS, together with the Metropolitan Council,the Counties of Anoka and Hennepin, the Cities of Blaine, Fridley, Coon Rapids, Maple Grove and Brooklyn Park, in cooperation with the Minnesota Department of Transportation - Highway Division, have jointly agreed upon the needs and procedures which established the North Crosstown Highway; and WHEREAS, said North Crosstown Highway is anticipated to be developed in stages, the first stage to be the construction` of a bridge across the Mississippi River, joining highways on the East side of said river to T.H. 169 on the West side of said river and RESOLUTION NO.. • WHEREAS, the development of the first segment of said North Crosstown Highway will introduce additional traffic demands on existing' T.H. 169 and further reduce it's ability to handle the traffic demands, thereby increasing the vehicular and pedestrian traffic delays and safety problems along said roadway; and WHEREAS, the Metropolitan Council has established that T.H. 169 in said Cities functions as an intermediate arterial highway, required to carry the traffic from said North Crosstown Highway 'South to I -94 in Brooklyn Center; and WHEREAS,, the construction of said I -94 from Minneapolis North to I -694 in Brooklyn Center is scheduled to be completed in 1981, ` and will introduce additional demands on said T.H. 169 North of I -94(1 -694) through said Cities; and WHEREAS, said T.H. 169 is under the jurisdiction of the Minnesota Department of Transportation Highway Division. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that the City Council hereby requests the Commissioner of the Minnesota Department of Transportation to expedite the preparation 6 • of a`Project Development Report for T.H. 169 from its intersection with I -94 (I -694) in Brooklyn Center, north to the proposed intersection with the North Crosstown Highway in Brooklyn Park. RESOLUTIO °N AMENDING THE 1978 GENERAL FUND BUDGET TO PROVIDE- FUNDS FOR VOLUNTEER FIRE DEPARTMENT UNIFORMS` WHEREAS, Section 7. 11 of the City charter does provide the City Council with full authority to make permanent transfers between all funds which may be created, provided that such transfers are not inconsistent with the provisions of relevant covenants, the provisions of the City charter, or State statute; and WHEREAS, funds are available in the FEDERAL REVENUE SHARING FUND in the amount of at least $3,516 to be transferred for GENERAL FUND use; and WHEREAS, the City Council did, on November 28; 1977, determine to provide, uniforms for the Brooklyn Center Volunteer Fire Department during the calendar year 1978: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, to amend the 1978 GENERAL FUND Budget by in- creasing the Fire Protection (Dept. #32) clothing and Personal Equipment Account ( #4224) appropriation by $3,516 to provide for the purchase of uniforms; and BE IT FURTHER RESOLVED that the increased appropriation shall be financed a • by federal revenue sharing funds and that funds in the FEDERAL REVENUE SHARING FUND shall be encumbered in the amount of $3,516 and BE IT FURTHER RESOLVED that the actual transfer of funds will be made from the FEDERAL REVENUE SHARING FUND to the GENERAL FUND on a reimburse- ment basis at such time, and by Council resolution when the GENERAL FUND has expended funds for the appropriation authorized. Date Mayor ATTEST: Clerk The motion for the adoption of the foregoing resolution was duly seconded by member and upon vote being taken thereon, the following voted in favor thereof: and the 'following voted against the same: whereupon said resolution was declared duly passed and adopted.; Member introduced the following resolution and moved its adoption: , RESOLUTION NO. • RESOLUTION AUTHORIZING PARTICIPATION IN THE SUBURBAN HEALTH NURSING SERVICE; DIRECTING THE EXECUTION AND DELIVERY OF A JOINT POWERS AGREEMENT; AND DESIGNATING A REPRESENTATIVE OF THE CITY AS ITS MEMBER ON THE BOARD OF THE SUBURBAN HEALTH NURSING SERVICE WHEREAS, the City of Brooklyn Center is authorized by Minnesota Statutes, -Section 471.59 to enter into joint and cooperative agreements with other governmental units; and WHEREAS, the City Council has duly established a board of health and assigned it duties as provided in Minnesota Statutes, Section 145.913; and WHEREAS, the City Council has determined that the City cooperate with other municipalities in providing community health nursing services and home health services: NOW, THEREFORE, BE IT RESOLVED by the City Council of Brooklyn Center, Minnesota as follows: 1. The Mayor and (Manager) are authorized and directed to • execute the attached Joint and Cooperative Agreement providing for membership of the City in the Suburban Health Nursing Service. 2. In accordance with the provisions of the Joint and Cooperative Agreement, the Council hereby designates Gerald G. Splinter as its first director on the Board of Directors of the Suburban Health Nursing Service 3. The City Clerk is directed to file a copy of the executed agreement together with a certified copy of this resolution with the City Manager of the City of Crystal. CITY OF BROOKLYN CENTER ORDINANCE NO. AN ORDINANCE AMENDING THE CITY ORDINANCES OF BROOKLYN CENTER REGARDING VARIOUS LICENSE FEES N THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES `ORDAIN AS FOLLOWS: Section 1. The following sections of the City Ordinances are amended as follows Section 8 -103. LICENSE FEES. 8- 103.01. L icense Fees Fees for licenses issued hereunder shall be as follows: a A. 'Bakery food vehicle: $[15.00] 25.00 per annum for each vehicle. B. Catering food vehicle: $[50.00] 100 per annum, plus $10.00 per annum for each additional vehicle. C. Food establishment: $[25.001 100.00 per annum, plus $[5.00] 10.00 per annum for each additional facility on the same premises. D. Itinerant food establishment: $[10.00] 25.00 for the first day's • operation, plus $[1. 00] 10.00 for each additional day of operation in a continuous Aeriod E. Readily- perishable -food vehicle: $[5.00] 30.00 per annum. F. Readily - perishable food vehicle, fleet license: , $[25.00] 150._00 per annum. G. Vending Machine - Vendor 1. Bulk Vendor - [Ten] Twenty -five dollars per annum for operators of machines which vend gumballs , nuts, panned candies, etc. in unpackaged form. 2. Nonperishable Vendor.-- [Five] E3� dollars per annum for operators of machines which vend nonperishable products in a sealed container wrapped package, or open cup. 3. Perishable or Readily Perishable Vendors - [Fifteen] Twenty dollars per annum for operators of machines which vend` perishable or readily perishable products 4. Combination Nonperishable- Perishable Vendor - [Twenty] Twenty -eight dollars per annum for operators of perishable and nonperishable product machines S. Machine Location Permits - In addition to the vendor license fees required herein, each licensed vending machine operator shall obtain a permit for each vending machine location at which he operates vending machines within the City. The fee for such permits shall be A in accord with the .following schedule: ORDINANCE NO. • For each machine location; a . $[ 1.00] 4.00 for each machine vending bottled or canned soft drinks, prepackaged confections and similar dry, nonperishable items, or for each machine which manufactures and or vends packaged or unpackaged ice [, up to a maximum of $5.001. b. $[1.50] 7.00 for each machine vending perishable or readily- perishable food [, up to a maximum of $12.0 -4; provided, however, that in no case shall the combined permit fees for categories (a) and (b) `_exceed $15.00 for any one location] . As employed herein, the term "vending machine location" shall mean the room, enclosure, space, or area where one or more vending machines are installed and operated H. Special food handling license: $[5.00] 30.00 per annum. Section 11 -104. LICENSE FEES. • Subdivision 3. The annual fee.for an "on- sale" license [shall be two hundred fifty dollars ($250) . The annual fee for], an "off- sale" license [shall be thirty- five dollars ($35) .] and the daily fee for a "temporary on- sale" license shall be [ten dollars ($10) .] as set forth - in Section 23 -010 of the City ordinances. I Section 23- 201.01. LICENSE REQUIRED. No person shall own or keep any pool, billiard or bumper pool table that is used by the public or for which a charge is made for the use thereof within the limits of the City of Brooklyn Center, Minnesota, without first obtaining from the City Council of said City a license therefor.: [There shall be an annual license fee of five ($5.00) dollars per table payable on or before the beginning of.each calendar year.] The annual license fee for pool, billiard -or bumper pool table 'shall be as set forth in Section `2 3 -`010 of the City Ordinances. Section 23- 209.04. LICENSE FEE. The annual fee [for such license shall be five dollars - ($ 5.00)] for each bowling alley or lane located in the property described in the application shall be as set forth in Section 23 -010 of the City Ordinances. Section 23 -301. LICENSE REQUIRED. No person shall conduct or permit public dancing in any public establishment within which intoxicating liquor or nonntoxica ting malt liquor is licensed to be sold or consumed unless a public dance license shall have been issued by the City Council. Licenses shall be issued' for one (1) year periods expiring December 31. The annual fee for a public dance license shall be [$25.00] as set forth in Section 23 -010 of the City Ordinances. • ORDINANCE NO. Section 23 -404. LICENSE FEE. The annual fee for each filling station license shall be as set forth in Section 23 -010 of the City Ordinances [five dollars ($5) for one _pump ' plus three dollars, ($3) for each additional pump] and shall be paid to the clerk with the application for the license. The annual fee for the storage of such liquids as described in Section 23 -401 including the selling and dispensing the same by any other method than by pumps, shall also be [five dollars ($5) .] as set forth in Section 23 -010 of the City Ordinances. Section 23 -901. (d) If the application be granted, an additional license fee [of seven dollars ($7)] as set forth in Section 23 -010, of the City Ordinances shall be paid to the City of Brooklyn Center for each bench at the time the license is issued. Section 23 -1302. APPLICATION. The application for license for selling Christmas trees shall be made to the City Clerk and shall be accompanied by a seasonal fee , {of $15] as set forth in Section 23 -010 of the City Ordinances. The license will expire on January 5 of the year following its issuance. A separate license shall be required for each place of sale. Section 23 -1500. MECHANICAL CONTRACTORS LICENSE REQUIRED. No person shall install, alter, reconstruct, or repair any portion of a building mechanical system consisting of heating, ventilating, comfort cooling, or refrigeration equipment, in- cluding any gas piping incidental thereto, without first having procured a license, therefor from the City of Brooklyn Center. Licenses shall be issued only to individuals or contractors who demonstrate an understanding of the laws and regulations and techniques relating to the installation and maintenance of building mechanical systems. The annual license fee [is hereby established at $251 shall be as set forth in Section 23 -010 of the City Ordinances. Licenses shall expire on the last day of April each year. Section 23 -1501 HOUSE MOVING CONTRACTORS LICENSE REQUIRED. - No Person shall move, remove, or raze any building within Brooklyn Center without first having procured a license therefor from the City of Brooklyn Center. Licenses shall be issued only to individuals or contractors who demonstrate qualifications and knowledge regarding such work and who can furnish proof of insurance relating to such work. SIGN HANGER'S LICENSE 2.
