Item 5 Resolution Transferrin g Monies to Transit Fund
The attached resolution is intended to provide the necessary funds to close
out the Brooklyn Center Bus related Transit Fund.

Item 6. Resolution Transferring Surplus from Special .Assessment Funds
to Capital Project Fund
The attached resolution is recommended for the purpose of executing the
Capital Projects financing plan adopted in 19680 To date, $87,000 of
surplus accruals in special assessment fund have been transferred to the
Capital Projects Fund and it is recommended that additional surplus accruals
of $57,000 be transferred to the Capital Projects 'Fund to meet the obligations
of the financing piano

Bids will be opened Monday morning for Contract 1972 -D consisting of certain
sidewalk improvements. I will be prepared Monday evening to recommend a
resolution accepting bids and awarding a contract.

The attached ordinance was first read on August 14, 1972, published on

Item 11. Ordinance Amending Chapter 35 Providing Planned
Residential Development
The attached ordinance has been recommended by the Planning Commission
following considerable study. It is the intent of the ordinance to provide
for a mixture of residential living modes and certain commercial uses with-
in a planned development subject to certain standards. The special usd permit
vehicle is recommended for the purpose of providing_ maximum flexibility and
reasonable control and is analogous to the planned unit development concept
which is typically expressed in a voluminous format.

Item 14. Public Hearing on 1973 Eudget
The City Charter provides that the annual budget shall be subject of a
public hearing at the first meeting in September and shall be adjourned from
time to time until the budget is adopted. Public notice of the hearing has
been published on August 31, 1972 as required by the Charter. I will be
prepared Monday evening to review the format of the budget and present `a
general insight into the proposals

TRANSIT T AL LOSING OF THE TRANSIT FUND
WHEREAS, on May 24, 1971, the City Council authorized the
establishment of an internal bus circulator as an experimental'
program; and
WHEREAS, on June 28, 1971, the Council created a Transit Fund
to account for funds provided for the operation of said internal
bus .ci.rculastor. and
WHEREAS, since the inception of the circulator system, the
operational losses of the system have been jointly subsidized by
the City of Brooklyn Center and the Metropolitan Transit Ccxnmission;

WHEREAS, the Transit Commission and the City have transferred
funds to the Transit Fund from time to time as losses have been
incurred; and
•
WHEREA on July 10, 1972, the City Council directed that the
circulator system ope rations cease on July 20, 1972; and
WHE REAS, the Metropolitan Transit Commission has paid in full
their share of the operating lass of the system; and
WHE REAS, there remains an operational loss of $2,423.21 to be
subsidized by the City of Brooklyn Center; and
WHEREAS the retraining su bsidization is the limits
authorized by the Ci Counci'; and
RFAS, all activities of the Transit fund have ceased and
all tl'anaactions have been cmpleteda
NOW VWPEFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center that the amount of $2,423.21 by transferred f rom
the General. Fund's Mayor and Council's Contingency Appropriation to
the Tra nsit Fund to provide the balance of the City's subsidy of tle ,
circulator , system; and

RESOLUTION TO TRANSFER SURPLUS FUNDS FRUA VARXOUS
SPECIAL AS N!E F'Ul� S THE CAPI L PROJECTS FU ND
WHEREAS, on October 14, 1955, the City` Council of the City
of Brooklyn Center did establish a Capital Projects Fund to provide
funds and to account for the expenditure of such funds fo major
capital outlaw (which include, but is not limited to, construction
or acquisition of major permanent facilities having a relatively
long life) and /or to reduce debt incurred for capital outlay; and
WHEREAS, the Council dial resolve that the s o urces of revenue
for the fund would consist of ad valorem taxation, transfers by
the Council of surpluses of other City funds, issuance of bonds,
interest earnings of the fund, and from other sources of revenue
which from time to time the City Council seems to be available
for ,transfer to the fund, and
WHEREAS, in the develop4ent of a Capital Projects Finance
Plan by the City Council. in 1956, the Council dad determine that
sunr funds accrued in certain Special Assessment Funds which
primarily were a result of interest earnings on the investments
of the fund, be transferred on an annual basis to the Capital Project
Fund; and
WHEREAS, the above mentioned Capital Projects Finance Plan
did anticipate the transfer of $60,000 in 1969, $31,.000 in 1470,
and $75,000 in 1971 to the Capital Pro jects Fund; and
AREAS, to date, the Council has transferred the amount of
$87,100 from the Special. Assessments Funds to the Capital Projects
Fund in accordance with the financial plan; and

WHEREAS, there now ;exists accumulated cash surpluses in
Special Assessment Fund No. S (1956 Fund), and Special. Assessment
Fund To. 9 (1957 AB Fund) in the amount of $57,000; and
WHEREAS, all obligations of the above mentioned funds have
been satisfi d and no ponds are outstanding in the funds, ° and that
the Occumulated cash su ° luses are primarily a result of the interest
earned on the investment of special assessment pre-paym and
annual assessment leviess-
.OW. ThTREFORE, BE IT RESOLVED by the City Council of the
City of Brooklyn Center to transfer to the Capital Projects Fund
the amount of $25,000 from Social Assessment Frond No. 1, the

The Mayor announced that the meeting was open for the con-
• sideration of proposed Street Grading, ease & Surfacing Improvement
Project No. 1972 - 34.
The Clerk produced an affidavit of publication of notice of
" hearing on the proposed improvement showing two weeks' publ ication
thereof in the official newspaper, the last publication being on
September 7, 1.972, which affidavit was examined and found satis-
factory and order placed on file.
The Mayor then called upon all property owners present to
present arguments either for or against the proposed" improvement.
After+'hearing and considering all objections, and the property
owners appearing in favor of said iamprovement, member
introduced the following resolution and moved its adoption:

Section 1: Chapter 35 of the City Ordinances is hereby amended as
follows

In all districts' Che than R1 and R2, all open gaff- street dfIvIng and
parking areas shall be Improved with a minimum of 2 inches of hot mixed paver
Iaxcl bituminous mat, or a' comparable concrete slab, placed over a well compactec.
subgrade and gravel bass. The base gravel shall conform to the Minnesota
Highway Department' specifications for Class 5' gravel.
In other than RI and R2 districts, drainage plans shall be submitted to
and approved by the City Eng ineer; drainage shall be d i scouraged across aide-
• walks or driveways. The perimeters of all driving and parking areas shall be
bounded by cast inplaced concrete curb and gutter which conforms with the
Minnesota Highway Department Type "B -612 ". Other shapas of concrete curb''
and gutter may be permitted providing the design provides an equal cross
'sectional area and is approved in writing by the City Engineer. the concrete
used for curbing shall confom to the currant City specifications.
Section 2 :. This ordimnce shall become effective after adoption and
thirty (30) days following its legal publications

WHEREAS, the City Clerk and the City Engineer have reported
that on September 11, 1972, at 11:15 o'clock A.M., central standard'
time, they opened and tabulated bids received for Contract 1972 -D,
including Sidewalk Improvement Projects No. 1972 -9, 1972 -10, 1972 -11,
1972 -12, 1972 -13 & 1972 -15, and that said bids were as follows

NOW, THEREFORE, BE IT RESOLVED by the City Council of the

Cement Contractors, Inc., in the amount of $71,050.42, as to furnish-
ing of all work, labor, and material in connection with the above-
mentioned improvement projects, according to the plans and specifi-
cations therefor now on file in the office of the City Clerk, is
deemed to be the lowest and best bid submitted for said work by a
` responsible bidder, and said bid is hereby accepted.
BE IT FURTHER RESOLVED to authorize the Mayor and City
Manager to execute a contract with Knudson & Trail Cement Contractors,
Inc., for said amount
