Item 5, Authorize Participation in Anti -Trust Law Suit
Pursuant to informal authority Erooklyn Center has filed as a
Plaintiff in anti -trust action against certain Minnesota liquor
wholesalers and their trade association the Wine and Spirits
Institute. The law suit•seeks to recover treble damages and
a prohibition against further violation of anti -trust laws. I
will be prepared to further discuss the matter Monday evening
and recommend confirmingjauthority to ent a co aint. "

Item 6. Authorize Selling Price for Library Land
The City Council earlier authorized the conduct of negotiations
possibly leading to the 'sale of land underlying the former City,
library. The , Hennepin County Library 'Administration and I have
each secured an independent appraisal and have negotiated 4
tentative sale price on the basis of such appraisals. Twill be
prepared Monday ev g 'to recommend a course of action

All subdivision obligations pertaining to Edling Third Addition
have been completed. It is t ore mmended that the sub-
division bond in the amount f $ 770.0 posted by Lundstrom Construction

The attached resolution is intended to confirm special assessments
for those projects for which hearings are approved.

The attached resolution is intended to certify to the tax rolls
those 1971 sewer accounts'whfch are delinquent.
Item 9c. Resolution Approving Non- Conservation Classification
List for Thx Forfeited Land
The attached resolution is intended to concur with the legal
classification of certain tax forfeited properties as being non-
conservation property. Such Classification will then permit
the land to be disposed of, either through public sale or
acquisition by the City.
Item. 9d. Resolution Designating Certain Tax Forfeited band for
Public Acquisition
A resolution will be presented Monday evening recommending the
acquisition of certain tax forfeited lands in the City of Brooklyn
Center to be acquired for City; pv�p es.
Item 9e. Resolution Rejecting Paving Bids
The attached resolution is recommended to reject bids for bituminous'
paving contract 1972-C. Other arrangements are being made to
complete the work
Item 9f. Resolution Authorizing Execution of Utility Service
Agreement with Robbinsdale
The attached resolution is recommended to approve an a greement
between the cities of Robblusda a and Brooklyn Center wherebly
Brooklyn Center will provide utility service to certain Robbinsdale
residents along France Avenue approximately 200 ft. south of the
Brooklyn Center city limits,

The attached resolution i r ecommended for the purpose of acce
landscaping work at the Civic Center.

Item 9he Resolution Accepting Quotations for Bituminous Paling
The attached resolution is recommended for the purpose of
approving quotations for the bituminous paving of Eryint
and Colfax Avenues from 68th to 69th Avenue North, The grading
and base work on these projects will be accomplished by
City forces with all labor, materials and equipment costs
charged against the projects,

The attached ordinance was first read on August 28, 1972 and
published on September 14, 1972 and is offered this evenfrg for
second rending and adoption.

The attached ordinance is recommended for 'the purpose of
implementing the recently successful referendum authorizing
issuance of Sunday liquor licenses.

1. The City Clerk has, with the assistance of the Engineer
heretofore selected by this Council for such purpose, calculated
the rroper amounts to be specially assessed for the improvements

assessable lot piece or parcel of land in accordance with the pro-
visions of law, and has prepared and filed with the City Clerk

of each and every lot, piece or parcel of lanai to he specially

2. Notice has been duly published as required by law that

WHEREAS the City Council of the City of Brooklyn Center,
Hennepin ,County, Minnesota has received from the Assistant Finance
Director - County Auditor of Hennepin County, Minnesota, a list of
lanes in said City which became the property of the State of Minn-
esota under the provisions of lawn declaring the forfeiture of lands
to the State for hon-payment of taxes, which said list has been
designated as Classification List "646 -C'", and
HEREAS, each parcel of land described in said list has
heretofore been calssified by the Board of County Commissioners
of Hennepin County, Minnesota, as non-conservation land and the
sale thereof has heretofore been authorized by said Board of County
Commissioners.

RESOLUTION DESIGNATING CERTAIN TAX FORFEITED LAND
I1 THE CITY OF BROOKLYN CENTER TO BE USED FOR
PUBLIC PURPOSES

WHEREAS, there is situated within the boundaries of the
City of Brooklyn Center and the County of Hennepin certain tax
forfeited land; and
WHEREAS, the City of Brooklyn Center desires to obtain
the said land for public purposes:
TiOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Brooklyn Center that the City Manager be instructed
to make application for conveyance of. tax forfeited lands as
herein described and further, that the Mayor and City Manager
be authorized to sign such application for conveyance. The land
is described as follows:'

Commencing at point of intersection of north line of
Government Lot 2 and the southeasterly line of Lake'
Drive extended southerly, thence west along said
north line 827.98 feet to actual point of beginning,
thence south at right angles 50 feet, thence west 100
