its adoption:
RESOLUTION NO. 2011 -125
RESOLUTION VACATING CERTAIN EASEMENTS WITHIN LOT 10, BLOCK
2, SUNRISE MANOR; LOT 1, BLOCK 3, SUNRISE MANOR; TRACT B,
REGISTERED LAND SURVEY NUMBER 370; TRACT A, REGISTERED LAND
SURVEY NUMBER 1456; LOT 2, BLOCK 1, CHRYSLER REALTY ADDITION
(LUTHER SITE), HENNEPIN COUNTY, MINNESOTA
WHEREAS, certain existing easements on existing properties are either no longer
needed, or are being replaced by new easements pertaining to the properties contained within the
proposed plat for BRI MAR SECOND ADDITION; and
WHEREAS, the easements proposed to be vacated are identified as follows and are
hereafter referred to as "the Easements ":
" All publicly dedicated sanitary sewer easements as shown on Lot 10, Block 2,
Sunrise Manor, Hennepin County, Minnesota, and shown as crosshatched in the
attached Exhibit; and
All publicly dedicated sanitary sewer easements as shown on Lot 1, Block 3, Sunrise
Manor, Hennepin County, Minnesota, and shown as crosshatched in the attached
Exhibit; and
All publicly dedicated easements as shown on Tract B, Registered Land Survey
Number 370, Hennepin County, Minnesota, and shown as crosshatched in the
attached Exhibit; and
WHEREAS, after due notice and public hearing, the City Council has determined that
the Easements will be no longer needed, once the plat of BRI MAR SECOND ADDITION is
recorded, and it is in the public interest to vacate the Easements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota, that:
1. The City Council hereby approves the vacation of the Easements described above
and depicted in the attached Exhibit.
2. The City Clerk is directed to prepare a Notice of Completion of Vacation
Proceedings and to record it with the Hennepin County Recorder or Hennepin
County Registrar of Titles, as appropriate; provided, that this resolution will only
take effect upon the release and filing of the final plat of BRI MAR SECOND
ADDITION, execution and filing of associated and separate rededicated

easements, and upon execution and filing the subdivision agreement for said
associated development.

The motion for the adoption of the foregoing resolution was duly seconded by member
Kay Lasman
and upon vote being taken thereon, the following voted in favor thereof:
Tim Willson, Carol Kleven, Kay Lasman, and Dan Ryan;
and the following voted against the same: none;
whereupon said resolution was declared duly passed and adopted.
