adoption:
RESOLUTION NO. 2011 -126
RESOLUTION VACATING CERTAIN DRAINAGE AND UTILITY
EASEMENTS WITHIN LOT 2, BLOCK 1, RAINBOWS GARDEN CITY
ADDITION (AUTOZONE SITE), HENNEPIN COUNTY, MINNESOTA
WHEREAS, certain existing easements pertaining to the properties contained within
the plat for RAINBOWS GARDEN CITY ADDITION are either no longer needed, or are being
replaced by new easements; and
WHEREAS, the easements proposed to be vacated are identified as follows and are
hereafter referred to as "the Easements ":
All publicly dedicated drainage and utility easements as shown on Lot 2, Block 1,
RAINBOWS GARDEN CITY ADDITION, Hennepin County, Minnesota, and
shown as crosshatched in the attached Exhibit; and
WHEREAS, after due notice and public hearing, the City Council has determined
that the Easements will be no longer needed, once the plat of RAINBOWS GARDEN CITY
SECOND ADDITION is recorded, and it is in the public interest to vacate the Easements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota, that:
1. The City Council hereby approves the vacation of the Easements described above
and depicted in the attached Exhibit.
2. The City Clerk is directed to prepare a Notice of Completion of Vacation
Proceedings and to record it with the Hennepin County Recorder or Hennepin
County Registrar of Titles, as appropriate; provided, that this resolution will only
take effect upon the release and filing of the final plat of RAINBOWS GARDEN
CITY SECOND ADDITION, and execution and filing of associated and separate
rededicated easements.

The motion for the adoption of the foregoing resolution was duly seconded by member
Dan Ryanr
and upon vote being taken thereon, the following voted in favor thereof:
Tim Willson, Carol Kleven, Kay lasman, and Dan Ryan
and the following voted against the same: none;
whereupon said resolution was declared duly passed and adopted.
