MEMORANDUM
TO: Donald G. Pos s
PROM: Blair Tremere
DATE: December 12, 1975
SUBJECT: Review and Comments as to Development and Deficiency
in Section 35 -330 (3) (f)
We have reviewed the development of the ordinance amendment to Section 35 - 330
(3) (f) which comprehends certain commercial activities in the I - district as special
uses This was stimulated by the discovery that the actual published and adopted
language differs from the language intended by the Planning Commission, staff, and
5..
Council, apparently due to an inadvertent clerical error.
Our comments and copies of the adopted ordinance and the intended draft a ppear.
following the chronological account of the approval history. .
1. March 19, 1973. Report to Planning Commission as to Ad Hoc
OF Committee Research and Recommendations. Included items
„a.
1 (d) - 1 (J) which are the service /office and other non-retail
`y " uses in the C -2 district.
2. April 5, 1973. Planning Commission accepts and endors
report. Noted that it would serve as input to Council. Incl uded
items 1 (d) - ] (j).
3. October 11, 1973. joint meeting of Planning Commission and
IN
Council. Concept of Special Use in I -1 vs . formal Freeway
a.
District. Special Use concept endorsed. Noted main question
3x ,
was determining which uses would be included.
y
4. November 20, 1973. City Council, considers draft ordinance'
and approves FIRST READING. Includes items 1 (d) - 1 (j }.
Cohen, Pritts, Fignar stated some retail uses should be
included.
Leary and Kuefler endorsed the draft as proposed with no additional
retail or C -2
e Kuefler and Leary moved FIRST READING as submitted; including .
items 1 (d) -- i W.
Fignar and Britts moved an amendment to A two items: item
1 (c) (3) and 1 (c) (4). Amendment approved with Kuefler and
Leary opposed`,
Action on amended draft, including items 1 (d) - 1 {) plus the
;:, two added items was. to approve, with Kuefler opposed.
5
Memo -2- December 12, 1975
5. Minutes of November 20, 1973 meeting included attachedcopy
of the Ordinance given first reading. That version , does nnat
include items) through 1 { }, but does include the added
items.
6. November 29, 1973 Ordinance amendment was published.
in Brooklyn Center Post Does not include items 1 (d) - 1 ( }:
but does include the added items.
f
7. December 17, 1973. Council considers ordinance amendment
as published. The agenda draft is the same published with
the November 20, 1973 minutes. DOES NOT INCLUDE items
fr 1 (d) - 1 (i). Kuefler states opposition to inclusion of the two
added. items.
Action for Second Reading and adoption, with Kuefler opposed.
8. December 29, 1973. Ordinance Amendment effective as it
appears in ordinance book, Section 35 -330 (3) (f) DOE ' NOT
INCLUDE items 1` (d) -'l (f) . DOES INCLUDE items l (c) (3)
and l (c) (4)
fi 9. January 28, 1974. B.C.I.P. submits application No. 74004
requesting Special Use Permit and Site and Building Plan
Approval for commercial office building in I -1 district, per
provisions of Section 35- 330 (3) (f)
10. February 7, 1974. Planning Commission recommends approval
" - x of Special Use and Site and Building Plans as comprehended '
by Application No. 74004, Noted that this represents first
special commercial use in I -1 'under new ordinance section
assumed to include item l (d) .- service/off ice uses.
11. February 25, 1974. Council approves Special Use and Plans'
for the commercial (C -1) office building as contained in
Application No. 74004. Noted that this is first approval under
newly adopted Section 35 -330 (3) (f), assumed to include C-1
uses`.
_ COMMENTS
` It appears there was a clerical- typdgraphical error after the November, 20, 1973 first
reading, when two items were added to but when no items were deleted from the..
draft-ordinance recommended by the Planning Commission and staff.
The revised draft was not only sent to the newspaper for..legal publication, but also
x.:,.. was reproduced for inclusion with the November 20 minutes and the 17,
1973 agenda.
r
Memo -3- Dew i 12 1975
After adoption and effective date, that revised copy was used to type thereviaed
page for the Ordinance Boos.
` It is clear from the record and our recollection that the intent was to include items
1 (d) l (j). The only di s p u te a rose over the only revision: adding -two retail
activities (1) (c) (3) and (1) (c) (4) . No deletions were recommended or a?pproved.
Attached are: EXHIBIT A , which is the language adopted under Ordinance No,.'7 --2 ,
< and EXHIBIT B , which is the ordinance amendment as it should 'read with the two
added items.
