RESOLUTION NO. 2012 -34
RESOLUTION APPROVING A TYPE IV RENTAL LICENSE FOR 5715
EMERSON AVE N
WHEREAS, City Ordinance Sections 12 -900 to 12 -916 set forth requirements
for licensed rental properties; and
WHEREAS, the property located at 5715 EMERSON AVE N, was issued a
Type IV Rental License on May 9, 2011; and
WHEREAS, eleven property code violations were found during the initial rental
license inspection resulting in a Type IV Rental License Category according to Rental License
Category Criteria Policy adopted by the City Council on March 8, 2010;
WHEREAS, City Ordinance Section 12- 901.2 requires a property owner who
receives a Type IV Rental License complete Phase 1, Il and III of the Crime Free Housing
Program; and
WHEREAS, City Ordinance Section 12 -914 establishes the requirement for an
owner of a Type IV rental property to complete Phase I, 11, and III of the Crime Free Housing
Program, including attendance at a minimum of 50 percent of Owners /Managers Association
Meetings, completion of Crime Prevention Through Environmental Design Requirements and
submission of monthly updates; and
WHEREAS, the property owner of 5715 Emerson Ave N, Brooklyn Center failed to
attend 50% of the scheduled Owners/Managers Association Meetings, did not complete security
improvements, did not submit monthly updates, and did not submit the Crime Free Multi-
Housing Certificate.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota, that a TYPE IV Rental License is hereby approved for the property
at 5715 Emerson Ave N, Brooklyn Center, MN.

The motion for the adoption of the foregoing resolution was duly seconded by member
Kay Lasman
and upon vote being taken thereon, the following voted in favor thereof:
Tim Willson, Caro? Kleven, Kay Lasman, Lin Myszkowski, and Dan Ryan
and the following voted against the same: none;
whereupon said resolution was declared duly passed and adopted.
