MINUTES OF THE PROCEEDINGS OF THE PLANNING COMMISSION
OF THE CITY OF BROOKLYN CENTER IN THE COUNTY OF
HENNEPIN AND THE STATE OF MINNESOTA
STUDY SESSION
FEBRUARY 16, 2012
CALL TO ORDER
The Planning Commission meeting was called to order by Acting Chair Rahn at 7:05 p.m.
ADMINISTER OATH OF OFFICE
Mr. Benetti administered Oath of Office to Scott Burfeind.
ROLL CALL
Acting Chair Rahn, Scott Burfeind, Kara Kuykendall, Stan Leino, Carlos Morgan, Michael
Parks, and Stephen Schonning were present. Also present were Councilmember Carol Kleven,
Secretary to the Planning Commission Tim Benetti, Director of Business & Development Gary
Eitel, and Planning Commission Recording Secretary Rebecca Crass.
APPROVAL OF MINUTES —January 26, 2012
There was a motion by Commissioner Schonning, seconded by Commissioner Kuykendall,
to approve the minutes of the January 26, 2012 meeting as submitted. The motion passed, with
Chair Rahn, Commissioner Leino and Commissioner Burfeind abstaining.
ELECTION OF 2013 CHAIR AND CHAIR PRO TEM
Acting Chair Rahn opened the floor for nominations for Chair of the 2013 Planning
Commission. Commissioner Kuykendall nominated Commissioner Rahn as Chair of the 2013
Planning Commission. Acting Chair Rahn called for further nominations three times. There
being none, there was a voice-vote and Commissioner Rahn was elected Chair of the 2013
Planning Commission. Commissioner Burfeind requested to abstain.
Chair Rahn opened the floor for nominations for Chair Pro Tern of the 2013 Planning
Commission. Commissioner Morgan stated that he would like to delay the nominations until the
next meeting when Commissioner Burfeind would be more familiar with the Commission.
Commissioner Kuykendall and Commissioner Schonning stated that they felt a vote should be
taken tonight since the Commission was in full attendance.
It was the general consensus of the Commission to elect the Chair Pro Tern this evening.
Commissioner Morgan nominated Commissioner Parks and Commissioner Schonning
nominated Commissioner Kuykendall as Chair Pro Tern of the 2013 Planning Commission.
With two nominations on the floor, a paper ballot was provided for voting. The vote tally
indicated Commissioner Kuykendall as Chair Pro Tern of the 2013 Planning Commission.
Commissioner Burfeind abstained from the vote.

CHAIR'S EXPLANATION
Chair Rahn explained the Planning Commission's role as an advisory body. One of the
Commission's functions is to hold public hearings. In the matters concerned in these hearings,
the Commission makes recommendations to the City Council. The City Council makes all final
decisions in these matters.
DISCUSSION ITEMS
Review and Discussion of the 2012 Community Development Projects Map and Planning
Activities List
Mr. Benetti stated that they will be highlighting projects that are being targeted for some possible
studies regarding future development.
1. Former Lifetime Fitness Site—(4001 Lakebreeze Avenue N)
Mr. Benetti stated that the City Council authorized approval of the land use amendment
and Mr. Paul Hyde is tweaking his development plans and will be back before the
Commission in March with a possible rezoning, preliminary plat and site and building
plan approval. The Comp Plan amendment has been sent to the Met Council for review.
Commissioner Leino asked for an explanation on the excess MnDOT right of way. Mr.
Benetti responded that it was 2.8 acre parcel (former Denny's). It will be deeded to the
City and conveyed back to Mr. Paul Hyde to create a larger development parcel.
2. Howe Fertilizer Site—(49th and Brooklyn Boulevard)
Mr. Benetti stated that currently there is a PUD approved for this site for a 51,000 sq. ft.
office/warehouse facility also being developed by Mr. Paul Hyde. There was discussion
regarding the clean up on the site and the current status of the site for future development.
3. 57th Avenue and Logan Avenue Site
Mr. Benetti stated that the site is owned by the City of Brooklyn Center EDA and is being
marketed by the City. The site has been cleaned up and it is ready for redevelopment.
4. Mississippi Park Regional Trailways
Mr. Benetti explained that they are looking at a reconnection of the trail at points through
the Lifetime Fitness site and also over or under Brooklyn Boulevard and through the
Shingle Creek Crossing development.
5. Shingle Creek Crossing PUD
Mr. Benetti explained that Walmart is on its ways to completion and the developer is still
working to secure tenants for the rest of the site. He added that there is no updated
information on Sears at this time; however, the developer is actively working with the
City for further development on the site.
6. Northport Elementary Phase 11 of V
Mr. Benetti stated that staff met with school representatives and they are making major
modifications to the interior of the school as well as parking improvements. With the

improvements being made to the school, staff has looked at the surrounding properties
including the neighboring park for potential improvements there also. The City is
attempting to work with the school in a joint effort to make improvements to the
playground and other outdoor areas.
7. Shingle Creek Enhancements—Trail and Daylighting
Mr. Benetti stated that ongoing enhancements are wrapping up. Mr. Eitel added that
there will be some realignment to the trails to alleviate frequent flooding problems.
8. Development Strategies and Marketing of Opportunity Site (former Brookdale Ford,
Brookdale Square and Minnesota School of Business)
Mr. Benetti stated that these are the key areas that the City will focus on and hopefully
when activity at Shingle Creek Crossing picks up, it will trigger activity in the
Opportunity Site also.
9. Marketing of Phase II EDA Site—Link to EBHC, Pond and Fountain
Mr. Benetti explained that this site is located on the south side of the Embassy Suites and
the city is looking at marketing this site and doing some work to the pond and fountain
area. He added that the link to the EBHC is complete and provides a sealed corridor from
the Hotel to the EBHC.
10. EDA Marketing of Remaining Five Acres (former Olive Garden and Cracker Barrel site)
Mr. Eitel stated that with the FBI moving into their space, the City is planning to actively
market this site.
11. Humboldt Avenue Corridor Enhancement Opportunities
Mr. Eitel explained that the staff maintains this area as a focus and tries to enhance the
lighting along this main entry into the city.
Commissioner Morgan asked if the city has considered including the faith community in
the development planning. Mr. Eitel responded that that would be a policy issue for the
City Council.
12. Luther Auto Phase III—Honda and Toyota Dealerships
Mr. Benetti explained that both buildings are underway and with a mild winter they were
able to get footings and foundations in already.
13. Brooklyn Boulevard Market—6,700 sq. ft. Commercial Site
Mr. Benetti pointed that there has been no new activity on this site and the approved
building did not happen due to financing issues.
14. Northwest Family Service Center—new 63,000 sq. ft. office addition and parking ramp
Mr. Benetti stated that construction of the building and parking ramp are ongoing.

15. Brooklyn Boulevard Corridor Study/Reimaging
Mr. Benetti stated that staff is working with SRF on a study to identify access controls,
medians, and land use. This corridor has been studied several times in the past; however,
no changes have occurred along the Boulevard.
16. Maranatha Homes Phase I - 97 Units
Mr. Benetti explained that the owners and developer are on a very aggressive schedule
and they are looking at a nice addition that will remove the single story building with a
multi-story apartment senior community in its place.
17. Former Starbuck's Site (69th and Brooklyn Boulevard)
Mr. Benetti stated that there had been an interested tenant for this site but the site did not
work out for them. It has since been purchased and may be turned into more of an office
use.
18. Luther Auto—old Honda dealership
19. Palmer Lake Plaza(PUD Planning)
Mr. Benetti stated that this property is owned by Wirth Companies and last year a PUD
rezoning was approved that created a master special use permit. He added that currently
there is a K-8 charter school interested in the site.
20. Allied Building Site
21. Surly Brewing Site
Mr. Benetti stated that Surly Brewing is actively looking for a site to expand. The City
has had discussions with them regarding a location within the city. It is possible for
Surly to acquire the Allied building site to expand their business to include a brewery, tap
room and convention center.
22. Evergreen Villas plat
Mr. Benetti stated that the plat was approved last year and staff anticipates that the owner
will develop some single family homes.
23. Eastbrook Estates
Mr. Benetti explained that the preliminary plat was approved a few years back but no
development took place. There is, however, another group planning to take over and will
potentially create some new single family homes.
24. I-1 Industrial Park Study Area
25. Brookhaven/Granite Peaks Apartments Rehab
Mr. Benetti stated that the apartments were recently purchased by Jim Soderberg and they
are being renovated.

There was a motion by Commissioner Kuykendall, seconded by Commissioner Parks, to adjourn
the Planning Commission meeting. The motion passed unanimously. The meeting adjourned at
8:55 p.m.

Request: Final Plat of"Evans Nordby Addition"
INTRODUCTION
Mr. Thomas Weber is seeking approval of a final plat titled "Evans Nordby Addition". This new
addition will plat three existing legal parcels into one large platted lot for the Evans-Nordby
Funeral Home property. The business is located at 6000 Brooklyn Boulevard. This final plat is
being presented as a discussion item under this agenda and does not require a public hearing.
BACKGROUND
This final plat application is related to Planning Application No. 2011-019, which considered the
preliminary plat of this Evans Nordby Addition. The preliminary plat was reviewed and
approved by the Planning Commission at the November 17, 2011 regular meeting.
At that meeting, Staff noted that pursuant to City Code Section 35-540. COMBINATION OF
LAND PARCELS: "Multiple parcels of land which are contiguous and adjacent and which are
proposed to serve a single development use and which are under common ownership shall be
combined into a single parcel through platting or registered land survey." The three parcels to
be platted are contiguous; serve a single development (i.e. the funeral home); and are under
common ownership by Mr. Weber.
Also pursuant to City Code Section 15-105. FINAL PLAT, the procedure section states:
2. The city clerk shall refer one copy of the final plat to the planning commission, one
copy to the city engineer, and a copy each to the telephone, power and gas
companies. The abstract of title or registered property report shall be referred to the
city attorney for his examination and report. The city attorney's report and city
engineer's report shall be given to the council within 15 days. The planning
commission may at its discretion submit a report to the council.
Prior to this particular application, the Planning Commission normally reviewed just the
preliminary plat; whereby the subsequent final plat was typically reviewed and approved
(internally) by the City Engineer and City Attorney, with City Council providing authorization
and acceptance of said final plats under separate action. City staff has now determined and
agreed that all final plats should be given proper consideration and formal review by the

Planning Commission prior to City Council consideration, regardless of the statement that action
or a final plat report is discretionary in this above-referenced section.
At the previous presentation of the preliminary plat of Evans Nordby Addition in November
2011, the Planning Commission actually did receive and reviewed (albeit informally) the final
plat presented herein. The Commission however, only took action and adopted a resolution
recommending approval referencing the preliminary plat. Any recommendation or acceptance of
the proposed final plat was left silent.
On December 12, 2011, the City Council considered the preliminary plat of Evans Nordby
Addition, and adopted Resolution No. 2011-171 (attached hereto), which affirmed Planning
Commission Resolution No. 2011-14, along with two (2) additional conditions. These two
conditions requested additional sidewalk easement in the southwest corner of the platted
property, along with a requirement the driveway in this southwest corner area be closed. Mr.
Weber has complied with these two and all other items, and this final plat appears consistent
with the approved preliminary plat and meets all the requirements necessary for final approvals.
The final plat document, including the proposed dedicated drainage and utility easements and the
sidewalk easement, which will be dedicated under a separate document, have all been reviewed
by the City Engineer and determined to be acceptable.
RECOMMENDATION
Staff recommends the Planning Commission adopt the attached Resolution No. 2012-02, which
recommends approval of the proposed Final Plat of Evans Nordby Addition.

PLANNING COMMISSION RESOLUTION NO. 2012-02
RESOLUTION REGARDING THE RECOMMENDED DISPOSITION OF A
REQUEST FOR FINAL PLAT APPROVAL OF EVANS NORDBY ADDITION
SUBMITTED BY THOMAS J. WEBER ON BEHALF OF T.J. WEBER
PROPERTIES, LLC
WHEREAS, Thomas J. Weber on behalf of T.J. Weber Properties, LLC
(Applicant), submitted Planning Commission Application No. 2011-019 to the City of Brooklyn
Center, Minnesota (City) requesting approval of a preliminary plat of a subdivision to be titled
Evans Nordby Addition, which is a replat of three contiguous parcels into one lot, for the benefit of
the existing Evans-Nordby Funeral Home business, located at 6000 Brooklyn Boulevard; and
WHEREAS, the Planning Commission held a duly called public hearing on
November 17, 2011 at which time a staff report and public testimony regarding the preliminary
plat of Evans Nordby Addition were received and the Planning Commission determined during its
review that said preliminary plat was in general conformance with City of Brooklyn Center's
City Code Chapter 15 —Platting; and
WHEREAS, the Planning Commission adopted Planning Commission Resolution
No. 2011-14, which recommended the City Council of Brooklyn Center approve the Preliminary
Plat of Evans Nordby Addition, subject to certain conditions; and
WHEREAS, the City Council considered Application No. 2011-019 at its
December 12, 2011 regular meetings, and in light of all testimony received and the Planning
Commission's recommendations, adopted City Resolution No. 2011-171, which approved the
Preliminary Plat of Evans Nordby Addition, subject to the following considerations:
1. The final plat shall be reviewed and approved by the City Engineer;
2. The final plat shall be subject to the provisions of Chapter 15 of the City
Ordinances;
3. The Owner/Applicant shall provide an updated certified abstract or title or
registered property report to the City Attorney and City Engineer for
review at time of final plat application;
4. The Owner/Applicant shall provide a 10-foot drainage and utility
easement on all exterior lot lines;

5. The Owner/Applicant shall provide an additional sidewalk easement as
illustrated on the revised plan set prepared by K.K. Design, dated
12/05/2011. Said easement shall be dedicated on the final plat or provided
for under separate recordable document;
6. The Owner/Applicant shall remove the bituminous driveway section as
illustrated on the K.K. Design plans (dated 12/05/2011), and install the
landscaping and sod as indicated. Until the City repairs the sidewalk and
removes the driveway apron in the right-of-way, the Owner/Applicant
shall install a temporary barricade post with chain and/or planters to
prevent vehicles from using the driveway access onto 60th Avenue North
near this location; and
WHEREAS, the City Engineer and City Attorney have also reviewed the final plat
and found it to be in conformance with the previously approved preliminary plat and its conditions
of approval; is in general conformance with City Code Chapter 15 — Platting; and determined to
be acceptable; and
WHEREAS, the Planning Commission considered the Final Plat of Evans Nordby
Addition at its March 1, 2012 regular meeting, at which time a staff report and supporting
documentation of said final plat was presented; and
WHEREAS, the Planning Commission determined during its review that said final
plat to be in general conformance with the approved preliminary plat, that all conditions have
been or will be met by the Applicant prior to release by the City of the final plat for recording
purposes; and the final plat is in general conformance with City Code Chapter 15 —Platting.

2011-019by adopting Planning Commission Resolution No. 2011-14 on November 17,2011;and
WHEREAS, the City Council considered same Application No. 2011-019 at its
November 28,2011 regular meeting;and in light of all testimony received the Planning Commission's
recommendations.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Brooklyn
Center,Minnesota,that Planning Application No.2011-019 submitted by Thomas J.Weber on behalf

Presbyterian-Maranatha Concept Plan
The westerly R6 parcel contains the 4-story 64 unit Maranatha Homes Senior Apartments (Independent
Living) facility, while the easterly RI parcel contains the 97 bed Maranatha Baptist Nursing Care Center
facility.
As illustrated on the concept plan, Presbyterian Homes is requesting to construct a new 96-bed skilled
nursing care facility to the south of the 64 - unit senior apartments, and upon completion will remove the
97-bed nursing care facility on the easterly parcel, and replace it with a new, 4-story 38 unit independent
living apartment building.
Some of the planning issues Staff has tentatively identified and discussed with Presbyterian Homes
include the following:
1) Zoning
a. Determining the appropriate zoning that accommodates this mixed-use residential site
will require careful analysis.
b. A new PUD is being considered,with an underlying R6 zoning for the entire site.
2) Density
a. The density allotments in the respective multiple family residential zoning varies. Up to
19.8 units/acre are permitted under the R6 Zone.
b. Nursing Care Homes are calculated at 50-beds per acre.
c. With the 96 bed nursing care, this requires 1.92 acres. The remaining 5.14 acres is left to
accommodate the independent living areas (existing and future)-which calculates to:
5.14 ac. x 19.8 units = 102 allowable units
3) Stormwater treatment(on-site)
a. Developer will need to provide on-site stormwater treatment areas
b. City and Developer are working on identifying potential areas for rain-garden sites
4) Fire lane access
a. Fire Dept. will more than likely request a full, ringed access road for firefighting and
emergency vehicles.
b. The site may need to have agreed-upon, temporary fire lane service during time of the 96
skilled unit building is complete, due to no available room along the far east edge of the
nursing care facility.
5) Vacation of drainage and utility easements
a. A platted drainage easement for the on-site pond will need to be vacated.
b. This vacation may be completed as part of a future re-plat of the two parcels, or by means
of separate document.

6) Parking Needs determination(s)
a. Residential units require at least 2-spaces/unit. Nursing Homes require 1 space/4-beds +
1 space/two employees+ 1 space for each staff doctor.
b. Presbyterian reps indicated to staff that up to 65 employees work the largest shift.
c. The concept plan illustrates 107 total spaces.
d. Additional parking may be needed to accommodate the on-site residents, visitors, and
employees.
The schedule of this expansion project is aggressive and time —sensitive. In order to meet State
mandated funding deadlines, the Developers will need to process the application for PUD and site and
building plan approvals based on the following tentative schedules:
• March 1, 2012: Informational/Concept Review
• March 29, 2012: presentation of the PUD zone application and public hearing
• April 9, 2012: first reading of the PUD zoning before the City Council
• April 26, 2012: Site Plan consideration before the Planning Commission
• March 14, 2012: Second reading of the PUD rezoning — AND - final Site Plan consideration
before the City Council;
• May 21, 2012: Third/Final Reading of the PUD zoning before the City Council, with effective
date to take place30-days thereafter(June 21, 2012).

Staff is presenting for review and discussion Mr. Hyde's redesigned site layout on the former Lifetime
Fitness site, located at 4001 Lakebreeze Ave. There is no official action to be taken on this item.
The initial plans called for an approximate 125,000 sf. office/manufacturing/warehouse facility, with the
building sitting along an east/west alignment; main parking along the front (north side ) and loading and
overflow parking to the rear (Attachment — A). Plans also called for the use of Azelia Avenue to the
west as the main access point for trucks to the rear loading area, and included a full-service cul-de-sac
on the southerly end of Azelia Ave.
Planning Staff has been meeting and working with Mr. Hyde to redesign the concept plans for this
redevelopment site, and in doing so we hoped to eliminate or minimize any potential (or perceived)
impacts upon the nearby residential properties, especially the use of heavy trucks on Azelia Avenue.
Our objective was to see if Mr. Hyde could eliminate the use of Azelia Ave. for future truck or visitor
traffic. The option of securing the rights to purchase these homes along Azelia Avenue by Mr. Hyde,
and the possible vacating of Azelia Avenue by the City to use as a private road/driveway for this site did
not seem practical or feasible (to Mr. Hyde) in the overall planning for this site.
During negotiations with the two potential tenants of this site, Mr. Hyde determined a smaller, 90,000 sf.
facility (Attachment—B) instead of the larger 125,000 sf. as originally planned, would work on this site.
The smaller building now affords the ability to site the building on a north/south alignment, with parking
on the east side and loading on the west side. Although this west side faces the residential homes along
Azelia Avenue, the 50-ft. and 100-ft. buffers remain in effect, and Staff will be working with Mr. Hyde
in providing a suitable and aesthetically functioning buffer to protect this residential neighborhood,
either by means of fencing, walls, landscaping, berms, or a combination of these features.

Paul Hyde Concept Plan Review
City staff is also determining an ideal location or alignment of the future trail (easement) along this
project site's westerly edge, which would make a suitable connection between Lakeside Avenue to the
south and up to the regional trail system on Lakebreeze Avenue and Azelia Avenue to the north.
This plan will be presented as a public hearing item before the Planning Commission at a future meeting
date. The intent is to present a new zoning under a Planned Unit Development—Mixed Use C2/I-1
(Commerce/Industrial Park). This new PUD will provide the appropriate zoning to allow for this
office/manufacturing/warehouse facility on this site. Site and building plan consideration will follow.
